A/N: And suddenly in the middle of a chapter for one of the AU stories, I find myself being poked back into actual s5 canon by my muse, who started thinking about ITWSH, and wished for a little something like this, so there you have it. And CI's not mine.
He doesn't think he's ever seen her this way before. They're sitting in a courtroom, though, so he can't exactly get up and move. Can't get up and walk over to the stand, to make her feel better, and make those awful tears go away. But that's only one of the things he wants to do. The other thing is to make this defense attorney's life a living hell for bringing up something that so obviously bothers her. It bothers him, too, but that's beside the point.

Beside him, he can see the startled, incensed look on Barek's face, and beside her, the more than slightly annoyed look on Logan's. He can't really feel anything one way or the other, and he's got the feeling that this time, it's actually a good thing. Eames is already upset enough as it is; the last thing he wants is to make it worse.

But it's the note he hears in her voice that makes him shift uncomfortably in his position. He looks towards her, trying to catch her eye, but for once, she refuses to look at him. And he has the feeling that he knows why. They've been together as partners for the past five years, and he's only just finding out about this now. In her way of thinking, it's more than just hiding something…it's the ultimate betrayal. Especially after she once told him that she wasn't going anywhere.

Even so, that isn't the heart of what bothers him, and he knows it. He looks down at his hands, at the ever-present portfolio sitting in his lap, and suddenly feels guilty without knowing why. He's never done anything to upset Eames like this before, but with this case, and this trial…suddenly it feels as if everything they've worked for will be torn out from underneath them, and try as they might, they won't be able to get back to the way they were. It is this thought that scares him, but it is what he sees when he looks over at Eames again that scares him even more.

He has always seen her as someone that others can lean on, someone that others know they can trust. Someone strong, who can see herself through the worst that the world has to throw at her, and still come out unscathed, affected, but for the most part, unshaken by what she has seen. But this…this is different.

His partner, his strong, beautiful, stubborn, independent partner is broken…and as he sits there looking at her, he can't help but think that in a way, he has made it happen.
