Chapter 1
My name is Felix,
I am the oldest brother of Heidi.
On May 13, Heidi Volturi, was murdered by the defendant. How do I know this? You, the Jury, returned a verdict of guilty. The facts of the case were proven beyond a reasonable doubt and your verdict was rendered guilty!
Words cannot express the pain and anguish our family and friends have endured since her murder. The defendant's decision to take the life of a human being with no regard for the effect's it may have on others is unimaginable.
The loss of my sister is beyond words. There will be no more birthday parties, backyard gatherings, holiday celebrations or other family activities to share. The laughter, hugs, guidance/advice, sense of security and those opportunities to say, "I love you" are forever gone. Our family is forever "broken".
Compassion is a word commonly used for and by defendants. However, I ask, how much compassion the defendant considered when the decision was made to murder Heidi?
It is the request of the Volturi family that the maximum penalty for the crime for which the defendant was convicted be imposed. On behalf of the family of Heidi, I wish to express my sincerest gratitude for allowing this opportunity of expression.
-*-Sentencing Hearing -*-
Bailiff: All rise, the Honorable Judge J. Jenks proceeding…..
Judge Jenks: Please be seated
We are here today to determine sentencing accordance with the seven counts of 1st degree murder the defendant was found guilty on. But first I would like to make a statement.
In my 25 years of being a judge, I never been more surprised than with this case. Here in this court, where we deal with individuals as individuals, and care for individuals as individuals, as human beings we reach out for justice, but throughout this case I have learned that our system has failed the people, whom the system is suppose to support. For that I'm sorry. What your able counsel and what I have grappled with, is why you did something so horrific. What was it that led you here to this courtroom today? I have listened respectfully to what you have to say. And I ask you to search your heart and ask yourself what sort of unfathomable hate led you to do what you are guilty and admit you are guilty of doing. Look around this courtroom. Mark it well. The world is not going to long remember what you or I say here. Day after tomorrow it will be forgotten. But this, however, will long endure. Here in this courtroom and courtrooms all across America, justice is in fact being done. For the actions you, the defendant took the punishment shall prevail.
Defendant please rise
This day November 17th, 2008, I Judge J. Jenks; will now impose upon you the courts sentence.
On counts 1, 3 and 4 the Court sentences you to life in prison in the custody of the United States Attorney General.
On counts 2, 5, 6 and 7, the Court sentences you to 20 years in prison on each count, the sentence on each count to run consecutive with the other. That's 80 years. The Court imposes upon you each of the seven counts a fine of $300,000 for the aggregate fine of $2.1 million.
The court imposes upon you that you carry out your full sentence without the possibility of parole at the Illinois Super Max Tamms Correction Center in Tamms, IL.
This is the sentence that is provided by our statutes. It is a reasonable and impartial sentence. It is a worthy sentence.
Bailiff please take the defendant into custody.
Noooooooooooooo Jake!
