This takes place six months after A New Day Raises. Ethan, Gwen and Rebecca are released. Just how will be in the story. This is about the fight between Gwen and Ethan and Theresa for the children. What will happen? There are changes coming to Harmony. Will the town remain standing?

Rebecca sat in her cell. She had just got done talking to the governor. What she had on him could do more than ruin him. Now all she has to do is wait to be released. Then they could get the children back from Theresa and ruin her for good.

Governor Mitchell was trying to find a way to so what Rebecca wanted and still look like he wasn't doing anything illegal. Then it hit him, clemency. They wouldn't be pardoned but could be released and his secrets would stay hidden. He signed the orders giving clemency to Ethan Winthrop, Gwen Winthrop and Rebecca Crane. They would be released by the next day.

Twenty-four hours have past since the governor granted Ethan, Gwen, and Rebecca clemency. Ethan is called by a guard to go to release. He signs for his property and heads out the gate. There he is greeted by an already released Rebecca and Gwen. They are waiting in a Crane limo.

The first thing out of Gwen's mouth is, "When can we get our daughter back?" Rebecca nods her head at Gwen's question. Sighing Ethan replies, "I don't know. We will have to file for custody, it might take a while." "Well, I will help. If you file right away, I make sure that Judge Reilly will hear the case and you will get Jane. Gwennie can even change her name to Ashley, as is should have been in the first place," states a confident Rebecca. They lapse into silence as they continue to the Crane mansion.

While they were driving, Alistair gets word that Ethan, Gwen, and Rebecca were released on clemency. This infuriates Alistair. He just knows that this is Rebecca's doing. He calls Julian to his study and tells him that Rebecca, Ethan and Gwen will not be welcome in his home. When they arrive they will be turned away and Rebecca is cut off from anything Crane. Julian asks if he can divorce Rebecca. Alistair tells him yes and he will get his new consul started on the papers immediately. Julian bids his father goodbye and leaves.

Alistair then calls Theresa to warn her. Theresa isn't shocked. She knew that Rebecca would pull something like this. She tells him that when they arrive at the mansion, Ethan would be served with papers to sever his rights to the children. Theresa had found out that Ethan Martin is Ethan's after he went to prison.

After what seemed like forever, the limo arrives at the Crane mansion. Just as Ethan gets out of the limo, he is approached by a process server. Hand an large envelope. Ethan opens it with caution. Inside was papers for severance of his parental rights to both Ethan Martin and Jane. IT explains that Ethan Martin was sick and needed blood. Julian and Theresa apparently have the same blood type, B+, but Ethan Martin was AB-. This meant Julian was not the father. It was proven that Ethan Winthrop was the father.

A stunned expression shone on his face prompted Gwen to ask what's wrong. Ethan tells them and Gwen and Rebecca go ballistic. Calming down the trio try to enter the mansion. They are stopped by security. "You can't come in," the two security officers stand at the entrance to the mansion. "Do you know who I am," states Rebecca, who is preparing to fire the two officers. "Yes we do, and Mr. Alistair Crane has forbidden you three from the property. You all must leave and all Crane properties at once," the security states.

Just as Rebecca was working up steam, Alistair appeared behind them with Julian. "Rebecca, I want you, your daughter and Ethan off my property at once," states Alistair. "Oh, and Becks, you will be getting divorce papers by tonight, have a nice day," states a smiling Julian. I'll finally be rid of that wench.

Turning to the limo drive, Rebecca requests he drive them to a hotel. The limo driver looks at Alistair. Alistair just shakes his head no and then the driver tells Rebecca that he can't. This infuriates Rebecca. "I demand you take us to a hotel," demands Rebecca. The limo driver shakes his head and says, "Only if Mr. Crane says to." Trying to head off the problem, Ethan asks to use the phone to call his mother to come and get them. Just as Ethan asks this up pulls Ivy. Ethan sees that Alistair at least had the decency to do that much.

Getting out of her car, Ivy runs up to Ethan and Gwen. Hugging both, Ivy says, "I'm so glad you guys are out of that horrid place. Come on, Sam said you three can stay at the B&B til you get back on your feet." With that she ushers them all into her car and drives away.

Ethan asks about his children. Ivy reluctantly tells him that Theresa won't let her see them. Theresa says that she, Ivy, isn't an influence that Theresa wants around her children. Changing the subject, Ivy asks what their plans are. Ethan tells her he is going to try and get his law license back. Gwen tells her she will look for a job and that they will find a place to live so they can get the children from that sleazy tramp. They lapse into silence as Ivy continues to drive.

-Passions-

It had been a week since Ethan, Gwen and Rebecca got out of prison. Ethan has heard back from the bar that they won't reinstate his license to practice. No company will hire either him or Gwen due to their records. Gwen is reduced to waiting tables at the diner in town. Luckily Ethan found work at an auto shop. They are trying to save up enough to get an apartment. Gwen couldn't get her trust fund because her father was appalled at the scandal six months before. HE has withdrawn all funds and told Gwen she would have to fend for herself. There was also the divorce between Rebecca and Julian. Julian is determined to leave Rebecca with nothing. In the six months since Rebecca went to jail, Eve and Julian have gotten closer. They also found out that Chad was Alistair's and Liz's, and Liz wasn't even related to Eve. Chad and Whitney got back together and were married. They live happily at the mansion. Julian fully intends to ask Eve to marry him as soon as the divorce is final.

Ethan has contacted a friend to represent him in the custody proceedings. Gwen still firmly believes that she and Ethan will walk out of that courtroom with the children. Ethan and his attorney doubt it. The hearing was the next day.

Theresa and Fox had begun dating not to long after Ethan went to jail. Ethan Martin wants nothing to do with his father, he wishes Fox and his mother will marry and he and his sister are adopted by Fox. Theresa has no doubt about the outcome of the hearing.

The morning of the hearing was here. Ethan and Gwen get up and Gwen gets ready and goes to her mother's to check on her. Gwen knows that the past week has been hectic for the woman. Ethan finishes getting ready and collects his wife and mother-in-law. They are meeting his mother at the courthouse.

Meanwhile at Theresa's, she gets ready and tells her mother that she is leaving. Ethan Martin tells her goodbye and good luck. Jane just waves her tiny hand. Pilar tells her daughter that she has it well in hand and is confident that the judge will rule fairly.

Theresa arrives at the courthouse to see Fox, Julian and Alistair already there. She also spies Ivy. Ignoring the woman, Theresa walks up to the three men. As the talk quietly, they hear the loud shrieks of Rebecca. She loudly states that her daughter will be getting her children and Theresa will never see them again. Rebecca also yells out that Theresa is just a gold-digger and will be left out of the cold. Ethan was walking beside Rebecca quickly walks up to his mother. He is concerned about the fact Alistair was there. Ethan also asks his mother about why Fox was there. She tells him that he and Theresa were dating. Ivy has a look on her face like she just sucked a lemon.

The bailiff calls everyone into the room. He tells them to stand for the honorable Judge Michael Roberts. The judge enters and tells everyone to be seated.

"Hello everyone, I'm an judge Roberts. I will not tolerate outburst in my courtroom. If I sustain an objection then please move on," the judge says. "Now I will allow Mr. Winthrop's side go first," the judge proceeds to says.

Standing up Ethan's lawyer starts to present his case. "Your honor, my client would like to be in his children's lives. He has made a mistake and has paid the price. So, we ask that you at least consider joint custody in this matter," the attorney states. He knows it's iffy if the judge will grant this request. Also knowing that Ethan's wife wants the children to be put in their custody. But, he doubts it. They may only get visitation, supervised at that.

Theresa's attorney, Jared Casey, stands after Ethan's sits. "Your honor, my client would like you to sever Mr. Winthrop's parental rights to the minor children. Both he and his wife are a danger to them. Mrs. Winthrop has been convicted of trying to kill my client and kidnapping both of her children. Mr. Winthrop was also convicted of kidnapping her eldest and for trying to blackmail my client into dropping the charges against his wife or he would take their daughter from her. Your honor, Mr. Winthrop only served six months of a 60-year sentence. His wife has done the same on a 110-year sentence. To allow Mr. Winthrop any rights to the children is tantamount to placing the children in extreme danger. Thank you," Casey states.

"I will hear from the social worker about both living situations," the judge states. Called to the stand the social worker answers the judge's question and the respective attorneys as well. She told of how Gwen was violative and often called Jane by the name Ashley. That Ethan often works long hours as does Gwen. She also tells of the actions of Gwen's mother, Rebecca. Then she tells of how both children are well looked after at their mother's. Of how Theresa works often times from home and provides single handily for the children. Ethan has not even tried to see either of the children since his release from prison. After answering all questions, the social worker is excused from the stand.

Then are called the children's grandparents and Fox. All but Ivy, question how the children will be taken care of in Ethan and Gwen's care. Pilar is especially since Gwen is as bad as she was when she was convicted. The judge tells both sides that he will retire to consider both sides.

The two groups mingle in the courtroom. Gwen walks over to Theresa and loudly pronounces that the children will be with her and Ethan. That Theresa will never see them again. Theresa completely ignores Gwen, and this infuriates her. She stomps over to where her mother stands with Ivy. Ivy tells her that she shouldn't worry. The judge knows that they are the better parents. Soon the bailiff announces the judge has decided. Coming back into the courtroom, Roberts calmly looks out at both sides.

"I considered both sides. While I have no doubt that Mrs. Winthrop loves these children, she hasn't dealt with her own actions that cause her to try and murder Ms. Lopez-Fitzgerald and steal her children. The children are not possessions. Mr. Winthrop would like the court to believe that the children will be safe with them. The social worker has stated that the children should remain with their mother. That being said, I find in favor of Ms. Lopez-Fitzgerald and will sever the rights of Mr. Winthrop to the minor children. I also suggest that Ms. Lopez-Fitzgerald at least file a restraining order against Mrs. Gwen Winthrop, Mrs. Rebecca Crane and Ivy Winthrop. Everyone is free to go," says the judge as he bangs his gavel.

Ethan stands in total shock. The screaming that his wife, mother and mother-in-law are doing snaps Ethan out of his shock. Rushing to Theresa, who was leaving the courtroom, Ethan grabs her arm to stop her from leaving. "You can't do this. They're my children too," snaps an angry Ethan. Pulling free from his grasp, Theresa replies, "You could care less for my children. You would put them in the hands of a violent kidnapper." With that Theresa leaves with her supporters.

Gwen walks up to husband as Theresa finally left the courtroom. She asks, "She can't get away with this, Ethan. The children aren't safe with her, she is the danger." Ethan turns to his wife and says they have no chance of reversing this. Theresa has a legal court order to keep them from the children. Hanging his head, Ethan escorts the ladies out of the courtroom back to the B&B.

In the six months since the trials, Theresa and Fox are going strong. Alistair seems to have had a change of heart. He sees what he has become and doesn't like it. He thanks Theresa for showing him the person he wants to be. Alistair has found Martin. Surprisingly, his wife wasn't dead after all. Martin helped Katherine fake her death and ran off with her. Alistair found them outside of Porta Arena. They lived next to Pilar's sister and her husband. Paloma learns that it was because her father ran off that she was sent to Mexico. Pilar couldn't afford to raise all the children since Martin took off with Katherine. Sheridan is appalled at her mother. To take a man from his family. How could she.

As for the Lopez-Fitzgeralds, Pilar was furious about Martin and Katherine. Her children want nothing to do with Martin. Even Paloma, who grew up with Martin in Mexico. Theresa was working and taking care of Ethan Martin and Jane. She and Fox were dating again. Luis and Sheridan were raising Marty but were not together. Sheridan has told Luis that she must stay faithful to her husband, Chris. They are raising James together. Marty likes having a brother. Miguel has come back to Harmony with Charity. He found her and they were married. Kay was furious. A week after Miguel got back, Maria got sick and needed blood. Kay wasn't a match and they tested Miguel. HE wasn't a match either. So Miguel asks for a DNA test. It turns out Maria isn't Miguel's child. He was furious at Kay. Kay still maintains that Miguel if the father and Charity had changed the test somehow.

Sam and Ivy were no longer together. He had found out what she did to Grace and him. Sadly, Grace died before getting back to Harmony to be with her husband. Eve was back with Julian, she and T.C. split up. But Chad was found to be Alistair's with Liz. Liz wasn't even related to Eve, so Chad and Whitney got back together. They were planning to marry in two months' time. Simone was doing okay. But she was harboring a secret. She was in a relationship with a newly returned Patricia "Pretty" Crane. They both were keeping it secret from their families. Only Paloma knew. Jessica has turned around after hearing about what Ivy did. Though she lost her mother, she wanted Grace to be proud of her.

This was the happenings in Harmony after the convictions of Ethan, Gwen, and Rebecca.

It had been two weeks since the court hearing that severed Ethan parental rights. Theresa has been getting harassing phone calls from someone using a voice distorter. They keep threatening to kill her or to take the kids. The voice also said that she will not be with the kids much longer. Fox is having the calls tracked. Alistair is helping him. He has guards around Theresa and the children.

Ethan has repeatedly tried to see the children, only seeing them in passing. Ethan Martin even turned away from him. He hopes that Theresa will relent and let him see the children. Gwen and her mother having been racking their brains to find a way to get the children from Theresa and with Gwen and Ethan. Rebecca believes that Gwen and Ethan are better suited to be parents. She and Gwen have come up with the idea to sue Theresa. They will file and tell Theresa that the only way to not have to lose is to give Ethan and Gwen the children.

Ethan is told of this plan and has his doubts. He agrees to it for a chance to be with his kids. Ethan feels that the worst isn't over.

Just as Ethan was calling their attorney, there was a knock at the door. Opening it, Gwen is stunned to see two police officers. "Are you Gwen Winthrop," one asks. "Yes," says a nervous Gwen. "We have a warrant for your arrest," the same one says as they both take out their handcuffs. Gwen screams, and Ethan come running. Seeing the officers attempting to handcuff his wife Ethan asks, "What's going on? Why are you handcuffing my wife?"

"There is a warrant for her arrest on charges of harassment and terroristic threats against Theresa Lopez-Fitzgerald," one officer says while the other handcuffs Gwen. That officer leads Gwen from the B&B, the other asks, "Where can I find Rebecca Crane?" "Next door, but you can't be serious about arresting my wife or mother-in-law. They've done nothing," Ethan fires back. Ignoring Ethan, the officer knocks on the door next to Ethan and Gwen's room.

Rebecca opens the door and smiles flirtatiously at the officer standing there. "What can I do for you officer," she says seductively, or as best she could. "Are you Rebecca Crane," the officer asks. "Yes" replies Rebecca. "You're under arrest," the officer says as he handcuffs Rebecca leading her out to the waiting squad car. Both Gwen and Rebecca are read their rights and placed in the squad car. Ethan coming out as the women beg him to do something. "I will call my father and have your badges for this," says a furious Ethan. The officers just roll their eyes and proceed off with their prisoners.

Ethan takes out his cell phone and calls Sam. Seeing it's his son, Sam answers, knowing it won't end well. "Ethan can I help you," says Sam. "Why were Gwen and Rebecca arrested just now," snaps Ethan. Heaving a huge sigh, Sam responds, "They have been harassing and making threats against Theresa. The DA has proof." "Theresa, I should've guessed. This is just her way of being petty," Ethan grinds out. "Gwen and Rebecca need their attorney here and soon," Sam snaps back and hangs up the phone.

Ethan, shocked that his father hung up on him, calls Eckert and tells him the situation. He agrees to meet Ethan at the police station. Hanging up Ethan heads to the police station.

Theresa and the DA have arrived at the station at the same time as Ethan and Eckert. Eckert goes up to the DA and asks to speak to him privately. The DA excuses himself and he and Eckert go over to a far corner in the station. Ethan sees Theresa and walks up to her. "Why are you doing this? Haven't you taken enough from us? Must you be so petty," Ethan practically yells at her. Calmly, Theresa responds, "I didn't do this. Your wife and her mother are responsible for their own actions." Glaring at her he goes to say something but is interrupted by Sam. "Ethan calm down. You know that Theresa isn't that petty to accuse someone without cause," Sam says as he tries to calm Ethan down. "You won't get away with this," hisses Ethan as he goes to another corner of the squad room. Sam tells Theresa that he's sorry about that. Theresa tells him that it's alright, he can't be responsible for other people's action.

Eckert comes out from talking with the DA and heads to the corner where Ethan is. He tells Ethan, "The DA is standing firm. He doesn't want to deal. Plus, there is concrete proof of the allegations against your wife and her mother." "Can't we get them out of here quickly," asks Ethan. "The DA has agreed to have them arraigned immediately. They will be before the judge in thirty minutes," Eckert says. He has his doubts that Gwen and Rebecca will get bail. It seems the DA is determined to see both ladies back behind bars. Gwen and Rebecca are brought out of the back and taken to the courthouse. The others follow.

Theresa is observing the arraignment. Eckert argues for ROR and that the charges are false. Gwen and Rebecca have plead not guilty. The DA argues that both are still a flight risk and have prior history with the victim. They were previously been convicted on kidnapping charges and try to murder this same victim. The judge considers both sides and orders five million dollars bail cash only. Both Gwen and Rebecca pale at this. They couldn't afford that high of bail. Rebecca has been cut off and even had divorce papers from Julian. Gwen just can't go back to jail. It will just kill her. Both women are escorted back to jail to await their trial.

Ethan is stunned. This wasn't fair. He had to talk to Theresa. Get her to drop this vendetta against Gwen and Rebecca. He turns to see Theresa walk out of the courtroom. He tries to follow Theresa but loses her in the crowd. Sam tells Ethan that he needs to truly see the woman his wife has become. Ethan angrily tells his dad that this is just payback for staying with Gwen. Theresa is out to punish him for choosing Gwen. Sam sighs and walks away, not liking the man Ethan's become.

What Ethan's fears is that his wife will never be free of Theresa and her hatred. He just hopes his wife stays strong. Ethan will find a way to free her.

Kay was sitting in her room; she and Maria had moved back in with her father. She still couldn't believe that the test said Miguel wasn't her daughter's father. That has to be wrong. Charity must've done something to change the test. She hears a car pull up in the driveway. Looking out her window and sees her father get out of the car. Coming downstairs after looking in on Maria, she was still napping, Kay greets her father in the living room. "Hi daddy, you okay," she asks after looking at the weary look on her father's face. "Just a tough day at the station," Sam replies back. "What happened," asks Kay. Deciding to tell her, "Gwen and Rebecca were arrested today." "Why, it's not like they done anything," Kay says. "They have made harassing and threatening calls to Theresa. The DA is looking for blood," Sam tells his eldest daughter.

"I'm sure that it is all a misunderstanding. It will blow over in no time," Kays says, 100% sure that Theresa took Gwen calling about the children the wrong way. Sam knows this is not the case but refrains from telling Kay this. He excuses himself to go to the kitchen. Kay stands there sure of the fact she is right. Theresa is just being petty. It, to her, seems to be a trait in the Lopez-Fitzgerald family.

There is a knock at the door. Kay answers it and sees Ivy standing on the front porch. "Where's your father," she asks without acknowledging Kay. "In the kitchen, be quick about whatever you are squawking about," Kay says snidely, as she points Ivy towards the kitchen. Kay hears Maria cry out from her crib and Kay goes to see what's wrong with her daughter.

In the kitchen, an angry Ivy says to Sam, "What possessed you to arrest Gwen and Rebecca?" "The DA filed the charges and warrants were issued. There was no choice in the matter," says Sam. He heard this from Ethan and it was getting tiresome. "You know that this is just a vendetta by Theresa. That woman just won't leave our son alone," screeches Ivy. Before she could get going, Sam cuts her off and tells her, "There is proof, and Gwen and Rebecca will have to stand trial. If found not guilty then good, if not then it's their own fault," states Sam firmly.

Ivy just huffs and glares at her love. How could Sam do this to their son? Not liking Ivy's expression, he ushers Ivy out and locks the door. What a day.

Theresa is at her home with her mother and the children. Before she could tell her mother, what happened, there was a knock at the door. Fox is standing there, and Theresa calls him in. She then proceeds to tell both of them what happened earlier that day. Pilar and Fox are angry with the two women. How could they do this to Theresa and her kids. Fox assures both Pilar and Theresa that Gwen, Rebecca, Ethan, or his mother will not get near the children. Theresa tells them that Gwen and Rebecca have been arrested for the threatening calls she has been getting. Fox and Pilar are both angry for and concerned for Theresa. When will Gwen and Rebecca ever learn. These children are not their concern. She tells them how Ethan was angry with her over the arrests. Fox vows to himself to see to it that all of them had no more contact with Theresa or the children.

While Theresa was telling her mother and Fox, Sheridan got a call at the cottage. "Sheridan, you have to help me and mother. They've arrested us on false charges," Gwen practically screams. Pulling the phone away from her ear slightly, Sheridan asks, "What are you talking about? Are you're in jail?" "Theresa has accused me, and mother were harassing and threatening her. It's all lies, I only called to check on the children. Now me and mother are in jail on five million cash each. Please you have to get us out," begs Gwen trying to convince her friend. Sheridan wants to help but doesn't know what this would do to the rocky relationship between Luis and her. She knows on one hand she would be standing by a friend, but Luis will want Gwen and Rebecca to stay in jail. Finally, Sheridan tells Gwen that she will pay their bail and get the out within the next hour. "Thank you, thank you, thank you," says a relived Gwen. They say goodbye and Sheridan heads out to bail out her friend and her friend's mother.

Coming to the station to pay bail for Gwen and Rebecca, Sheridan runs into Luis. He asks why she was there and she reluctantly tells him. "I am here to bail out Gwen and Rebecca," states a worried Sheridan. "WHAT," screams Luis. "Why would you do this? Haven't they done enough to the people of Harmony. They deserve to be in jail they should still be in jail," Luis states. "Gwen couldn't have done it Luis, Theresa is just making a mountain out of a molehill," replies Sheridan. "Do what you want, I have a feeling that you would do so anyway. But mark my word all of Gwen's problems are brought on by herself. She doesn't deserve a benefit of a doubt," Luis says as he walks away from Sheridan. Sheridan starts to have second thoughts but puts them firmly out of her head. She was standing by a friend wasn't she.

Quickly, Sheridan pays Gwen and Rebecca's bail. Out of the back come Gwen and Rebecca. Sheridan hugs her friend and she tells them that she will take them to the B&B. They leave the station, but not before a shadow in the corner. The figure lifts his cigar up to his mouth and inhales deeply and says, "We see if you get to keep your freedom." The figures quickly disappear into the shadows.

Ethan is at the B&B trying to find a way to get Gwen and Rebecca out. The bail was keeping them in. Just as he was trying to find someone that would put up the bail, in walks Gwen, Rebecca, and Sheridan. "Gwen your out of jail, how," asks a shocked Ethan. "Sheridan bail us out," replies Gwen, "Thank you so much Sheridan." Going to the mini bar Rebecca just fixes her a drink and downs it.

Now does she not only have a divorce but new charges. Damn Theresa and Julian. She deserves to be living the high life, not having to face possible jail time again. Theresa has to have something on the DA to get him to keep trumping up charges against them. Looking at her daughter and son-in-law, Rebecca announces she is going to her room to sleep this terrible night away.

Sheridan too takes her leave. This leaves just Ethan and Gwen. "Ethan, Theresa can't possibly have any proof. I mean I just called to check on the children," Gwen states once they were alone. Just as Ethan went to respond there was a knock at the door. Going to open it Ethan finds a strange man standing there. "Can I help you," asks a puzzled Ethan. "Is Gwen Winthrop here," he replies. "Yes, just hold on a minute," Ethan asks him. Just as this exchange was happening, Gwen made her way to the door. Ethan looks over his shoulder and sees Gwen standing behind him. "I'm Gwen Winthrop," Gwen tells the man. "You've been served," the man says, handing her a large envelope. Gwen takes it with shaky hands. Seeing the man go to Rebecca's door a sense of dread comes over Gwen. Taking the papers out of the envelope, Gwen sees that they are papers for a restraining order. It prevents her from coming within 300 yards of Theresa, her children or place of business and home. She chokes back a scream, Gwen hears her mother scream. Gwen knows that her mother just got the same papers.

Shoving the papers at her husband, Gwen hisses out, "Look what she did, Ethan. She is trying to ruin me and my mother. She can't do this can she." Looking at the papers and then at his wife, Ethan tells her, "There is a hearing for a permanent one in a week. There is no proof to sustain the charges let alone a restraining order. I will call Eckert and tell him, and we will go over it tomorrow." As Ethan calls the attorney, Gwen suddenly feels as the worst is yet to come.

At the Lopez-Fitzgerald home, Luis is telling his family what Sheridan has done. Theresa is livid. There is concrete proof of Gwen's actions. Theresa vows to make sure that Gwen and Rebecca. She tells her family that she has filed for restraining order against both Gwen and Rebecca. They should have already been served. Fox tells Theresa not to worry. That there will be a surprise at the trial for the harassment and threats. Just wait.
