They are sitting at the side table in his office. They are eating lunch, papers spread out in front of David, Alicia taking notes. It's a "working lunch" technically. David is billing his time to Alicia but since this is a personal matter for her, she has to meet during her lunch hour so that it doesn't affect her billability for the week.
"Have you decided if you're going to keep Florrick?" David asks her.
"or go back to your maiden name?"
And that simple question unhinges her. It makes it all real. And she does what David Lee hates, she starts to cry. As a practitioner of Family Law, this is not the first time that a client has started to cry in front of him, but he's surprised because she seemed so . . . put together. And because he's come to respect Alicia as a lawyer, he does what he's never done before, he covers her hand with his and tries to give it a reassuring squeeze.
The walls to all the offices at Lockhart/Gardner are glass and glass is see through, so when a group of assistants pass by with their salads in hand, one of them can be overheard saying "wow – David Lee! I'd rather stay with Peter and his prostitutes, as least Peter is hot!"
