In the last chapter, the suspects were forced to walk down the streets of Santiago, Chile in their bare minimums, much to the dismay of the females. Apollo continued to provoke at the drop of a hat, but Ema just wouldn't fall for it. Then at the elimination, Simon came out with a tempting offer. A generous bribe to leave the game then and there. Angel took the bribe, but the elimination continued. And it was Larry who got the boot. Disclaimer: I don't own Ace Attorney.

Chapter 4: The Breaking Point

Dick: This feels so wrong. Angel and Larry are both gone, two of my favorite people in this game. Larry in particular was maybe my best friend here.

Ema: Quite frankly I'm shocked to see Larry go. I had him pegged as the Phantom, and now I need to hunt for a new suspect.

Kay: Larry was the only person I felt like I could trust in this game, and now he's gone. I've never felt more alone in my life.

The group was moved from Santiago, Chile to Uspallata, Argentina, among the breathtaking Andes Mountains. (Kay: Driving through those mountains had to be one of the high-points of this journey so far. The sheer size of them makes you realize how insignificant you can be.) (Diego: The added element of the mountains... High altitude, low temperature. I can already tell our next mission involves some sort of physical activity.) Inside the vans, Apollo had taken a marker to a lemon and drew a frown face on it, labeling it the new Phantom mascot. "From now on, any time I feel I'm doing something wrong I'll just squirt this in my eye."

(Apollo: There's really only one face a lemon could have. A sour one. And in this game, that's pretty much how everyone tends to feel from time to time.) Simon met the group at the base of the mountains. Kay, Ema, Apollo, Klavier, Diego, and Dick were wearing blue pants, while Phoenix and Adrian wore black ones. "Welcome to Argentina, players. The Andes Mountains are the longest mountain range on the planet, and it's here at the base of the Penintentes resort that your next mission begins. I should tell you all that at this moment, we're at about 7,200 feet altitude." (Dick: At Los Angeles, where most of us live, the temperature rarely gets as cold as it was on those mountains, even in the winter.)

"Right now," Simon said, "The pot stands at $129,000. For this next mission, you'll need to split into two teams of four... The 'Selfish' and the 'Selfless'." Quickly the players had Ema, Kay, Adrian, and Diego on the Selfish team, and Phoenix, Dick, Apollo, and Klavier on the Selfless team. (Kay: To be honest, I'm not a selfish person by nature. But as an only child, I'm often characterized as being selfish, so I thought that team would be a good fit.) Simon nodded once he saw the teams had been divided up. "All right then, now for the mission, which is called 'Midas Rush'."

He pulled the cover off a table next to him, revealing several stacks of gold bars. "Before you ask, yes these are real gold bars. There's two-hundred of them in total, and each weighs in at about five pounds. Now centuries ago the Inca race ruled this entire region. That is, until the Spanish Conquistadors came in. They would force the Incas to carry gold through this very mountain pass out to sea, so it could be returned to Spain. Now you won't have to travel that far, but you will get a taste of just how tough that really was. You will have fifty minutes to carry as much gold as possible all the way to the top of this mountain. And you only get one trip."

Several of the players looked at the summit and didn't look happy. "It's 10,000 feet altitude up there," Simon said, "But it'll be worth it. Because for every gold brick brought up, I'll add $250 dollar to the pot. So in theory, assuming you could carry all two-hundred bricks to the mountaintop, this mission would be worth $50,000." (Diego: I honestly thought Simon was crazy. Asking us to carry gold bars up the Andes Mountains?) "A few things I should mention," Simon said, "You must reach the summit with your entire team, which means you'll only be as fast as your slowest player. Also, there's an exemption available for the first team who makes it up the mountain."

(Ema: So there's an exemption available for the entire team who makes it up the mountain first.) (Adrian: No one can be considered safe at the elimination, so having an exemption is a huge deal.) Simon stuck a feather in mouth. "Remember that we are at a high altitude, so be sure to pack plenty of water. And with that, the mission begins now." The two teams raced over to the gold and started grabbing. (Ema: I see Adrian pack eight gold bricks in her bag. That's a super woman right there.) The Selfish team was talking among themselves, suggesting not to take any more bricks than they could carry.

(Diego: From a realistic standpoint, I could carry about twelve of those bricks. But I only shoved in five for ease of movement. With an exemption in play, while I didn't want our team to finish with empty bags, we didn't need to be carrying ten or so apiece. We just needed to finish.) The Selfless team was trying their best to stuff as many bricks as possible inside their bags. (Phoenix: I knew we had the weaker team, what with Dick struggling even then. So it made more sense to us to simply grab as many bricks as we could carry and add to the pot.)

In total, the Selfish team carried 23 bricks, hoping to bring up a minimal amount and trying for the exemption. The Selfless team was carrying 38 bricks, hoping to increase the pot. (Apollo: I swear I took one look at that mountain and felt like I was about to go three rounds with a heavyweight champion. This was gonna be a struggle.)(Ema: I've only ever hiked to shopping centers. And certainly not with 35 pounds strapped to my back.) Barely a few feet up the mountain, and Ema was already feeling winded. "Come on Ema," Kay said, "You can do this, we've only just gotten started."

(Kay: We haven't even started this mission and Ema already needs to take a break. That feels a little suspicious to me.)(Ema: My goal is to throw as much suspicion on me as possible, because the more suspicion there is on me, the less there is on the actual Phantom.) "I did not sign up for this," Ema said. Kay put her arm around Ema's shoulder. "Just focus on breathing, not talking." Meanwhile the Selfless team finally had all the bricks they could carry. Klavier and Phoenix were even carrying bricks under their arms. "Alright," Phoenix said, "Let's get moving. Dick, you get into a slow pace and we'll stay with you." (Dick: Larry would be struggling even more than me if he was here. Now I'm missing him even more because I'm officially the weakest player.)

(Apollo: In the Andes Mountains the high altitude means a thinner atmosphere. Even at the slow pace we were taking I could almost feel my breath leaving me. It was strenuous.) Almost half the time gone, and soon the Selfish team ran into Simon along the path. (Ema: When we saw Simon I thought to myself, "Looks like we get that exemption." But it turns out I was wrong.) "We have little problem," Simon said, "I missed a detail. The Spaniards would also force the Incas to carry scales to weigh the gold." He pointed to two scales. One was slim, the other looked bulky. "You will also need to take one of these with you. One weighs ten pounds, while the other weighs twenty. As the first team here you get first pick, but you must make a decision without picking up either scale."

Diego and Adrian started looking at the smaller scale. "Should we grab this one?," Adrian asked. Diego shrugged. "I'm not sure. It looks smaller but it could be heavier." Adrian nervously looked at the path they had come from. "Let's grab it and go." (Diego: I guess Adrian was more concerned that the other team would catch up while we were debating more than anything else.) Diego picked up the small scale and could tell immediately they had made the right choice. "Congratulations," Simon said, "You've picked up the ten pound scale." The Selfish team quickly hurried up the path. Soon enough, the Selfless team came trailing in behind them.

Simon grinned. "You've made it up the halfway point. But I have a bit of bad news. You also have to carry this scale up the mountain with you." He pointed to the bulkier scale. "Unfortunately the other team left you with a heavier scale, about twenty pounds worth." (Apollo: Selfish team gets here before us and leaves us with this big, clunky scale... How can it get any worse?) Phoenix looked at his load, then muttered, "Screw it..." He dropped the four gold bricks he had under his arms and picked up the scale. "Whoa, Phoenix," Simon said, "You're dropping gold there." "I don't care," Phoenix said, "Let's just get going." Now down to thirty-four bricks, the Selfless team kept moving.

(Dick: The fact that Phoenix so readily left gold behind just adds to the number of suspicious acts he's performed.) "I'm gonna have to thank Adrian for leaving this beast behind," Phoenix said. Apollo looked over and saw some cows on the mountainside. "Did any of you hear something about cowpies giving you energy? Right now I'd eat it." "'Come to Argentina,' they said," Dick muttered, "'Have a good time,' they said." Phoenix chuckled. (Klavier: It really seems like both teams are acting like their names. Our team is sticking together, even through the complaints.)

"Are we there yet?," Apollo joked. "Don't make me turn this scale around," Phoenix joked right back. Of course, with the Selfless team struggling so much, the Selfish team pulled way ahead by several hundred yards. "What's your betting they'll make us give up the bricks for the exemption?," Diego asked. Kay shrugged. "Well, if we have to, we have to." Down the mountain, the Selfless team had stopped to allow Dick some time to recover. (Dick: There were times I felt like I was going to fall over face-first and not be able to get back up again.) (Apollo: Dick's face was red from the blood trying to rush through his system and feed him oxygen. I was genuinely scared that he wouldn't be able to make it.)


"All right you guys," Phoenix said, "We really need to move. If we go over fifty minutes this will all be for nothing." Meanwhile, the Selfish team had successfully made it up the mountain. "Well done guys," Simon said, "But we still have to wait for the Selfless team to reach here." (Adrian: Reaching the top of the mountain first, I just felt this rush of excitement.) (Kay: We got there with twenty-three bricks, which was a good amount. Our plan was to get to the top as fast as possible, and we did.) Down the mountain, the Selfless team could see that Dick was struggling. "Take you time man," Klavier said. (Dick: Going up that mountain was hard, but I was motivated. It was like I was battling myself as much as the mountain.)

(Apollo: We finally reach a flat part of the mountain, and at that moment our hopes skyrocketed. I gotta give Dick credit, he's got a big heart and a big drive.) The Selfless team continued waiting at the top, worried looks on there faces. (Ema: We were all standing there wondering what we'd have to give up for the exemption. If we had to give up all our money, we'd do it in a heartbeat.) Finally, with less than a minute to go, the Selfless team reached the top of the mountain. The others could all see how pale Dick was looking. "Nice work team," Simon said. Dick laughed weakly. "I do that every Wednesday..." "And we got here with...," Apollo said, and he started counting, "Thirty-four bricks."

Diego's jaw dropped. "What...?" (Diego: My team had gotten a smaller amount of bricks with exemption in mind. That might make the other team suspicious of us.) Diego shook his head. "That's a lot of bricks." Simon nodded his approval and looked at the players. From his left, there was Apollo, Dick, Klavier, Phoenix, Diego, Adrian, Ema, and Kay. "You guys brought in a total of fifty-seven bricks, worth a total of $14,250." (Apollo: I noticed Adrian had carried almost half of the Selfish teams bricks, which meant they had exemption in mind.) "As the first team here," Simon said, "The Selfish team gets the exemption." The team members looked at Simon expecting the catch. Simon nodded and said, "However, there is only one exemption. You must decide unanimously who gets it, or no money will be added to the pot and the exemption will be lost."

As the team started debating, Diego pointed out that he had not yet gotten an exemption. (Diego: At this point it is important that I secure my position for later down the line.) (Adrian: I felt like I done more than my fair share and earned the exemption. But Diego didn't feel like he was going to back down. I'm starting to think he might be the Phantom.) (Kay: I haven't gotten an exemption myself, but in this case I felt Diego deserved it more.) Finally, after Diego promised to give Adrian a chance at exemption further down the line, the team agreed. (Adrian: I feel like I got steamrolled by a prosecutor. Diego knew I led the team this whole mission, but I suppose it is what it is.)

(Ema: I thought Diego might have been a little selfish in this case, but then again that is the name of our team.) "All right then," Simon said, "Diego gets the exemption, and you've officially added the $14,250 to the pot. You now have a total of $143,250, congratulations." (Dick: My main goal was just to get up the mountain with has much as I could carry, which I did. But at the same time I was kinda hoping the tables would be turned and someone on our team would get the exemption instead.) As the players headed back down to the mountain, Dick finally started feeling signs of fatigue. (Apollo: Dick looked pretty messed up once we got back down the mountain. He said it felt like he was blacking out.)

Soon enough, an ambulance was called in and put Dick under emergency medical treatment. He was soon diagnosed with hypothermia and altitude sickness. He was slipping in and out of consciousness for the next hour. Back in the vans, the other players showed signs of concern for him. "How did do he going up the mountain?,"Adrian asked. Apollo sighed. "He was a real trooper going up. Gotta hand it to him, he only stopped a couple times. The rest of us were really impressed with how he handled it." (Dick: I just remember getting colder and colder and finding it real hard to breath. My lungs just seemed to stop working and it made me panic.) (Klavier: We were all worried about him. He's such a good guy you don't want anything bad to happen to him.) "Does anyone know if Dick's okay?," Apollo asked.


As Dick was hauled off in an ambulance, the rest of the players returned to the cabin. (Ema: We saw the ambulance race off past us, making us real concerned. The mood in the van immediately turned somber.) (Apollo: We were all worried about him, I gotta admit.) Finally, Dick was able to recover and was released under the condition that he stayed warm and got plenty of rest. "You feeling okay?," Phoenix asked him. Dick nodded weakly. "I've been better, but I should recover." "We were all worried sick when we saw that ambulance," Apollo said, "We certainly didn't want to leave without you."

Dick chuckled. "Yeah. I just remember I was struggling to breath. I literally couldn't get any oxygen in my lungs. To make matters worse, I was shivering uncontrollably without warming up. I could even feel myself slip in and out of consciousness." (Dick: I hope no one suddenly thinks I'm trying to get them to think I'm the Phantom by almost dying.) Adrian and Kay were in their room talking. "I hope Gummy's okay," Kay said. Adrian nodded. "He's such a trooper. He nearly died just walking up that mountain." Kay chuckled. "If he turns out to be the Phantom, I'll be so mad. I don't think he's the Phantom, but if he was he's got a great MO."

The next morning the contestants, save for Dick who decided to stay warm inside the cabin, were talking amongst each other in separate groups. "If people are forming coalitions," Kay said, "That may be a good thing. A way to get into... I dunno, like the final five or something." Klavier nodded. "I hear you. I think it's pretty clear everyone here is doing that." (Klavier: I think it's possible that Kay is the Phantom. She's definitely more intelligent than I originally thought.)

Kay chuckled. "Seriously Klavier, if you turned out to be the Phantom, that would throw me for a loop." Phoenix, meanwhile, was still going through his notes. He had been taking plenty of notes on all the players ever since he first got his journal. (Phoenix: I know there are those who think I'm obsessive in regards to my journal. Really I'm hoping to use my journal to succeed. So of course if something odd catches my eye I'm going to write it down. My strategy right now is to match my previous quiz answers to the remaining contestants to try and get a clear suspect.)

That night, most of the contestants joined Simon for dinner. (Kay: Dick didn't join us for dinner since the doctors wanted to make sure he didn't relapse.) "Greeting players," Simon said as everyone sat down, "Before we dig in, I'd like to ask you something important. How valuable are those journals to you?" "For me," Phoenix replied, "It's like your memory when your memory leaves you." Apollo shook his head. "I've tried not to rely on my journal that much during this game since doing so could be my downfall." Simon nodded. "What about you Diego?"

"Well," Diego said, "I find them personally useful during the quiz." Adrian raised an eyebrow. "Your not planning on taking away our journals are you?" Simon chuckled. "I guess that kinda ruins the surprise. All right then, would you please pass your journals down to me?" Once he had all the journals, Simon stepped out, promising to return in a few minutes. In those few minutes, the contestants conversed over dinner in nearly panicky tones.


The contestants breathed a sigh of relief when Simon returned, journals in hand and apparently still intact. He handed them back to their owners before sitting down. (Apollo: For a while there some of us were thinking we'd have to run around or something in order to find our journals.) "Well now," Simon said, "I noticed you guys have been busy writing in these journals. And you've had plenty of time to get to know each other." He brought out a green card and said, "So I've written down some of my favorite comments for a little game called, 'Who Said That?'" The contestants had mixed reactions as they realized what this new mission would entail.

"Before we begin," Simon said, "I should remind you that the pot stands at $143,250. Let's round that up. As of now, I'll add $750 to that total, no questions asked and no strings attached. The brings us up to an even $144,000. Now then, I will read off the comments on this card one at a time. Each time you correctly answer who wrote the comment, you'll add $2,000 to the pot. Oh, and no signaling other players, or that answer will be void. First, who said that at dinner Kay drank a lot?" Kay was flabbergasted that anyone would even suggest that.

(Kay: Great, now daddy's gonna think I'm an alcoholic.) "I only had that one dinner where I was slamming pisco sours," Kay protested, "Just the one time." Kay as she looked around the room. "I'll have to say... Phoenix." "Correct," Simon said. "For the record," Phoenix said, "I was just being observant." (Kay: I thought back to that night in question and it was just process of elimination.) Simon looked at the card. "Who said that Diego is a very quiet and cool guy? As a hint, they also said they 'like his vibe'." Diego tapped his visor. "I'd have to say... Adrian." Simon nodded. "Correct."

(Diego: I've studied each person here enough to know the subtle ticks to their language. It was a simple enough process.) "Okay," Simon said, "Who said about Apollo, 'hoping this time it will work out right'?" Apollo frowned. "I dunno? Ema?" Simon chuckled. "No, that it incorrect." "Yeah," Ema said, "I don't right that much." "For the record," Simon said, "I won't be saying what the right answer is. Now then, who wrote that mission one, 'Over the Falls', was the stupidest thing anyone ever did for money?" Ema gave a slight cough, then a few seconds later Adrian said, "I'm guessing Ema."

Simon nodded. "Correct. Next question, who said that Klavier is taking control?" Klavier couldn't but chuckle before answering, "Phoenix." "Nope," Simon said, "Next question. Who wrote that game is too easy? As an added hint, the person misspelled 'too', instead writing T-O instead of T-O-O." "That's gotta be Apollo," Phoenix said. "It is indeed," Simon said with a nod. "Crud," Apollo said, "I should've realized. These handwritten journals don't exactly come with spellcheck." "Lastly," Simon said, "Who wrote that Ema is here for fame?"

Ema shook her head like she had no clue. (Phoenix: Ema is acting like she doesn't want to play at all. Why does everything she do have to be so suspicious?) Finally, Ema said, "Would it be Apollo?" Simon shook his head. "No. However, since this is the last question, I'll make you guys a deal. If the person who did write this comment will fess up, I'll add the $2,000 for this to the pot regardless of an incorrect answer." Kay sheepishly raised her hand. "Ow," Ema said, "You were my second guess." "You got five out of seven question correct," Simon said, "But during one question, I believe Ema was trying to give off signals. As such that question is null."

(Adrian: I don't know why Ema was trying to signal herself during the mission. She's been doing this kind of showboating for a while now, and I think she may in fact be the Phantom.) (Apollo: This is just another mark against Ema. Seriously, how much money has she kept out of the pot so far? With players like her, we don't even need a Phantom.) "So," Simon said, "That's a total of four question, worth $8,000. The pot now stands at $152,000." Once dinner was finished, Simon drove the contestants out to a small dirt patch on the outskirts of the cabins. There was nothing of note in the area except for a small wooden table with a green cloth drapped over it.

(Kay: I didn't even want to take this trip, but it looks like we don't have a choice. Now I don't know what's gonna happen, it's dark out, it's freezing...) (Diego: Simon took us out in the middle of nowhere.) (Ema: I was wondering if maybe we were doing some late night river rafting.) "One of the biggest factors of this game," Simon said to the contestants, "It taking risks. Every moment of this game is a gamble, and the stakes are high. As a test of this, I'd like know, right here and now, who here is willing to give up their journal." The group started to chatter amongst themselves, with a couple thinking there might an exemption up fr grabs.

(Diego: Personally I was not willing to sacrifice my journal. It was too important.) (Phoenix: Several of the others thought whoever gave up their journal would get an exemption for the next elimination round. My journal wasn't worth it.) Finally, Klavier offered up his journal to Simon. Simon then took a lit torch and held it near the journal. "For every action there is consequence. Sometimes good, sometime bad. Klavier, would you gather up the rest of the journals and place them on the table over there?" Once Klavier had done so, Simon handed Klavier back his journal and placed the torch near a long fuse. The fuse started to burn and quickly reached the table, which instantly caught fire and burned at rapid rate.

"Damn," Phoenix muttered. (Adrian: Once the table was set ablaze, it was clear those journals were gone. Now the playing field is level.) (Apollo: This hit Phoenix more than the rest of us. His greatest asset in this game was gone.) "The only thing we were allowed to write in," Phoenix said, "Now taken from us." (Diego: Phoenix was visibly upset by this. I honestly couldn't blame him.) (Kay: All the jokes we ever made about how obsessive Phoenix was over his journal now seem a whole lot harsher.) "Klavier will be keeping his journal since he took the risk," Simon explained, "But the rest of you... Well I hope you committed whatever you wrote to memory for the upcoming quiz." Phoenix walked off elsewhere to think to himself. (Kay: Phoenix said he needed some time alone to himself. A few of tried to console him, but it was almost a half-hour before he was ready to rejoin us.) (Apollo: At one point when I went to look for him since we were leaving, he had disappeared.)


(Adrian: Phoenix's whole strategy revolved around that journal. Now his one weapon was gone. I really felt bad for him.) Phoenix finally rejoined the others, but he was visibly upset as he climbed into the van. (Diego: If Phoenix were to unravel to the point were it would prove a detriment to me, I'd have to end our coalition then and there.) (Apollo: The ride back to the cabin was somber. Phoenix was just... Devastated. There's no other way to describe it.) Back at the cabin, Dick was brought up to speed on what had happened. "I gotta feel for him," Apollo said, "But really, if you gotta rely on that, your done in this game."

(Klavier: I didn't even need the journal, and the fact that everyone else had their journals removed means they're all on my level at this point.) "Phoenix was very reclusive since we got back," Ema said, "I hope he doesn't decide to leave." Kay shook her head. "I doubt it. He's strong. He'll stay in this. It's just too bad that it turns out there was no exemption. I haven't had one yet, and the field it thinning out." (Kay: I don't wanna go home yet, but if I do, I'll only have myself to blame.) That night at dinner, several of the players were apprehensive about the quiz. Dick was back with the group, not yet fully recovered but healthy enough to partake in the quiz.

"How are you feeling Dick?," Simon asked. "Doing good," Dick said, "But to tell the truth I had been worried about you guys for a while now. I was told you were just heading off to dinner, but everyone was taking way too long. At first I was afraid I wasn't contributing, until I heard about the aftermath." (Phoenix: Dick got to keep his journal since he wasn't present at the time. I suppose that's fair, but it still gives him and Klavier an advantage over the rest of us.) Simon looked over the group. "Tonight, all except Klavier and Dick will be going into the quiz without your notes on each other."

"Here's hoping our memory is good," Ema quipped. (Kay: I think there is a certain advantage to not having a journal. Certain players may have obsessed over it, not just Phoenix. And without it, it could cause them to be off their game. Hopefully it's enough to let me stay in this a little longer.) (Dick: I realize I have an advantage since my condition allowed me to keep my journal, but I thought it better to not use it out of respect for the dead.) Simon stood up and raised his glass. "With the quiz coming up, let's toast the player who will be going home tonight."

After players assembled for the elimination, Simon stepped in and began speaking. "This is the fourth elimination, which finds here up the Andes Mountains. The pot currently stands at $152,000, and tonight one of you will be dropped out of the running to collect that money. Diego has an exemption and cannot be eliminated. As for the other seven, your names will be called up one by one and your scores will be checked. If the screen is green, you are safe and can continue to play the game. If however the screen turns red, then you have been eliminated. Oh, and I should mention this... There is a tie for the lowest score. That means whoever had the slowest time finishing the quiz will be eliminated. For the record, the difference is only five seconds. Let's begin." He began accessing the quiz results.

Apollo... Safe

Klavier... Safe

Phoenix... Safe

Kay... Eliminated

Kay sighed. "I knew it somehow." She grabbed her bag and followed Simon to the car waiting to return her home. "Looks like I was heading in the wrong direction," Kay said, "I gotta give the Phantom credit."

Diego: I'm very surprised. Thank goodness for that exemption, it might have saved me.

Dick: Kay and I have been friends for years now. I'll miss having her here.
