Sup, yall? So I know it's been a while and I apologize but I actually now have the story planned out so expect updates a LOT faster. Read, Review, and enjoy. But mostly enjoy.
David stared into that window for a long while, vaguely aware that his cousin, the person he had grown up idealizing, who had taken him to his first party, who introduced him to his first girlfriend, who had been right backing him up when David got into his first, and only, bar fight on the lawyers twenty-first birthday, on the phone.
There was a small commotion behind David who barely registered the sound of Amaro, Cragen, and Tucker now standing behind him demanding to know what the hell McNulty was saying to him. David shook his head, his hand and usually unfaltering voice holding a shake. "What… I'm sorry, Ian, wha-… I- wait what?"
"Come on, David, I'm not joking around right now!" McNulty yelled into the phone. "Alright, I made a HUGE mistake last night and I need your help."
David pulled the phone away from his ear for a second and turned towards the three gentlemen standing behind him. He quickly regained whatever professionalism he had left as he put his finger to his mouth before he put the phone on speaker. "What kind of mistake, Ian?"
McNulty sighed as though he was distressed and, they four were forced to grudgingly admit, pulled off the face to match his false emotions. "I… I didn't wanna tell you this, I mean I swear to God I didn't even know until this morning…"
"Just tell me what's going on, Ian," David prompted, struggling to keep his emotions in check. "What happened?"
Ian paused a long moment. So much so that for several seconds they thought the call had dropped. "I… I pulled over your girlfriend last night. She was buzzed, she got obnoxious so I arrested her. She was crying and I didn't wanna embarrass her so I pulled off in some alley just to talk to her.
We started talking, she told me about your relationship issues, but I swear to God she didn't name names! But we… we kissed and one thing led to another and we had sex in my squad car."
David clenched his phone as tight as he could, almost feeling it crack in his hand. If Olivia had fingered the right guy then what had happened between them wasn't sex. At all, and he had NO right to call it that…
The lawyer shook his head, struggling with every fiber of his being not to lash out at his cousin. "Okay… Okay then- then what happened?"
"Then I told her I just wanted to be friends first, see where that led us and she freaked out! She started talking about how much she cared for me, how I was the only one to understand her… I had no choice but to throw her out of my car! Next day I'm at the diner and I'm getting arrested for rape by her captain and nearly attacked by her partner when they bring me in for questioning! You gotta help me, man, I didn't do this!"
David opened his mouth and shut it several times, trying to come up with some response that would resemble something a lawyer might say to a future client. Instead all he got out was a quick muttered 'I'll call you back' before he hung up the phone. He took several deep breaths as he leaned against the glass wall. He closed his eyes, a million thoughts racing at full speed throughout his mind, none of them willing to believe what was so glaringly obvious. There wasn't a single doubt in his mind that Olivia was raped. None at all and David would fight anyone who said otherwise. But this was David's own flesh and blood, a decorated officer who used to spend nights at his house all the time because of his own family drama.
But to say that Ian was telling the truth would mean Olivia was lying in some aspect and had cheated on the man she claimed to love. And if that was the truth then who had rape her and why did she finger his cousin?
"You didn't agree to be his lawyer yet, there's no confidentiality in place," Cragen reminded him, breaking David out of his thoughts.
David shrugged as he out his phone back in his pocket. He's sticking with his story. He picked her up, they talked, had sex, she freaked out and claimed he raped her just for payback."
"Which is bull shit," Amaro told the group. 'Okay, Liv wouldn't A; have sex in the back of a car with a guy she just met, B; freak out when they left, or C; claim rape when it didn't happen. Alright, first off she loves you," the Detective added nodding towards David. "She wouldn't cheat on you so that right there proves he's lying."
David felt his heart fill with a sort of pride at Amaro's words. He and Olivia had said they loved one another but to hear someone else affirm it filled his heart with joy he didn't even knew existed. But he quickly shook away the momentary happiness and turned his attention back towards what Olivia's partner was saying.
"Have you ever seen Liv with a false report?" asked Amaro, looking between Tucker and David. "It's happened once since I transferred and when it was finally slapping her in the face, because she refused to believe otherwise, she treated that girl like she was the worst scum on this planet and arrested her for making a false report. Why would she do that herself when she loathes people that do?"
"You saying 'she hates people that lie about being rape' won't make a jury convict this guy," David reminded him. "He said/she said cases are never easy, you know this. And this one will be extra hard because the patron saint of women and children is accusing the NYPD poster boy."
Amaro turned and glared at him, "this one will be easy because she's telling the truth. And why am I getting the feeling you believe this guy?
David casted a slight glare at the Detective standing before him. "I know she was raped," David told them without a hint of a lie. "But… he's my cousin. Okay, we were best friends for the first 22 years of my life, no one, not even Olivia, knows more about me then he does. I'm just… maybe there was another Officer McNulty who assaulted her and he's trying to go with the best defense he knows how to?"
"Another McNulty in his patrol section pulled over another Detective Benson with the exact same story as our Benson?" Tucker raised his eyebrow at David, letting him know just what he thought of his theory without even saying a word. "And you think Benson cheating is farfetched?"
"Look, all I'm saying is let's do a little more investigating before we bring him in front of a jury and put an innocent man away or, let a guilty man go if the jury returns a not guilty verdict," David offered. "I'm not saying she wasn't raped, okay I want whatever… monster that did this to her locked up after letting every single Guard know exactly what he did for the rest of his life, but I want the right man locked up."
"Okay, David, hang on a second, if that was Officer Joe Snuffy in there who you had never met in your life before, would you be saying that?" argued Cragen as he shoved his hands into his pockets. "Or would you be falling over yourself to rush the trial and pull every single low down sleazy trick in the book to get him to go away?"
"I'd be telling you to get your ducks in a row whoever it was," said David, trying, and failing miserably, to convince himself he was telling the truth.
"That's a load of crap," Amaro practically growled.
"Believe what you want but this will not be an easy case. For anybody."
David turned and looked back through the glass at McNulty, another issue weighing heavily on his mind that Cragen was all too happy to announce, "so are you gonna be his lawyer or not?"'
David opened his mouth to speak but shut it almost as quickly, shaking his head, unable to turn away from the man sitting behind the glass. After several long moments David finally answered with a sigh, "I… I don't-… I don't know."
"He raped your girlfriend!" Amaro shouted and taking a heated step towards David before Cragen quickly stood in between the two. "How the hell can you even consider being his lawyer?!"
"I'm not I just need some time to think!" David yelled back. "Alright no matter what it won't be a fair trial, I know too many private details about both of them. I may just have to recuse myself entirely!"
"Okay well while you think over the fact you'd rather defend your rapist cousin instead of be there for Liv, I'm booking him," Amaro snapped. "If you and McNulty wanna bond over being pathetic assholes, you can do it in the tombs." Without another word to anyone he pushed by Cragen and stormed into the interrogation room. David glared after Amaro for a moment before he turned and stormed back out into the bullpen and out the door, ignoring both Tucker and Cragen calling out for him…
