Happily Ever After Chapter 11

AN: Thank you for the reviews and new story followers. Once again I got wrapped up on my other story. Wish I could find the time to write both stories at the same time but I just can't seem to manage it.

Disclaimer: I do not own or claim to own the wonderful characters of NCIS. Also, I am not a lawyer and I have a plan for this story. If it does not follow New Mexico or the District of Columbia laws, I never claimed to be a lawyer but I want Tomas to be Samantha's and Gibbs' child so I will have write it as I would hope would work out.

Samantha woke up in the ambulance as it sped the several miles into town. She was searching madly for the baby. "Tomas, where's my baby?" Gibbs reached up and stroked her check then he turned her head gently so she could see the baby. She looked down at him and smiled. He was now sleeping peacefully with a full tummy for the first time in his life. She smiled as she saw his sweet features. She looked from the baby over toward Dr. Davis. "Is he ok? "

"He looks to be very healthy considering all he has been through and no prenatal care." Samantha relaxed and wrapped the baby in her arms as she fell back asleep. Gibbs looked worried. "Relax Mr. Gibbs. She is just exhausted. I would imagine she has not slept much over the last couple of days." He then reached over and started to take Gibbs' vital signs again. Gibbs pulled away.

"I'm fine" Gibbs mumbled.

"Agent Gibbs. If you plan on staying fine, let me do my work" Dr. Davis growled. Gibbs was a little taken back. No one ever talked to him that way. He glared back at the doctor. He received a glare in return. "I mean it. I will do my job Agent Gibbs" Gibbs sighed and leaned back against the side of the ambulance and allowed the doctor to do his work.

Tony, Ziva and the FBI agents rounded up all the inhabitants of the DeLoSantos' ranch. "You two need to get to the hospital." Fornell said. "Gibbs and Samantha need you there. Jim and I can handle things here."

Tony was torn between following his Boss' orders and being back at the hospital to support his family. He looked from Fornell and then to Ziva. Ziva knew what they needed to do. With so many of their family in the hospital they needed to be there to support them. "I know what Gibbs told us Tony but if Gibbs is out of commission Samantha is going to need us. Also, we need to find out about this baby. Why are they calling him their son?"

"That's what concerns me as well." Fornell added.

"Knowing Samantha, the mother was here when she was taken. She helped deliver the baby and then as the mother was dying she offered to take the baby." Tony summarized. "She has done that before."

"Kelly, yes. " Ziva replied. "That would make sense. Also, Samantha always wanted to have a baby." Ziva realized what she said. That was a secret.

"Let's go Ziiiiva." Tony said. "We need to be there for them. Tobias keep me posted on what you find here. The cartel may still be after Samantha until we find her father's file."

"File?" Agent Jim Wilson said as he came up. "They are looking for a file."

"Yes, they seem to think that her father had a file that contains information on the cartel." Ziva told him.

"He would have done that. His true friends on the force always wondered about that "accident". We always believed someone orchestrated it to be murder that looked like an accident. Nobody in the know ever believed that he was on the take." Jim told them. "Let me know how I can help prove the coach innocent."

Tony grabbed Ziva's hand and they started toward the car. "We'll keep you posted on the hospital front as well as the file. Samantha's grandfather has a safe that she believes it might be in. She is the only one who can open it." He looked at Ziva with a worried look on his face. "I hope."

Samantha, Gibbs and Tomas arrived the hospital. Dr. Davis tried to pry the baby from Samantha's arms in the emergency room. She woke up screaming for the baby. Dr. Wallard walked into the exam room. He came up to the gurney started talking to her. "Sammy, sweetheart. It's me, Dr. Wallard. The baby needs to go to the Nursery and get all the newborn tests done. He needs a bath and a warmer. You know that." She continued to thrash against his grasp. "Samantha!" He took her face into his hands. "Look at me. It's me. Would I ever hurt your baby?" She still continued to fight against him. Finally he got firmer. "Samantha Waverly Gibbs, I am taking this baby now. He needs medical attention. I promise I will bring him back to you."

She nodded and released her grasp. "Dr. Wallard, you know I just delivered him and that the mother wanted me to raise him."

"Of course. I will make sure he is safe. Jimmy Wilson called. He has a guard posted in the Nursery. He will be watched," the old doctor told her. "I know how important this is to you. Remember I've known you a long, long time."

She smiled at him. He held the baby down for her to kiss and then he took him away. Samantha wiped away a tear then she turned to Dr. Davis. "Where's my husband?"

"He is doing well in another exam room. Seems you got the anti-venom administered in time but we want him sedated for awhile just to make sure the venom does not cause him any problems. He is still weak from his other energies."

"Can I see him?" she asked.

"You need to get checked out too. He will be asleep for hours. "

Just then Abby burst into the exam room. "Sam, Sam are you ok? Timmy and I were so worried. Where is Gibbs? What happened?" Abby pushed past the doctor to give Samantha a huge hug almost disconnecting her IV. Abby then turned to the doctor. "Please tell me doctor she is going to be ok." He nodded. "Great, where is Gibbs?"

"He is asleep in another room Abby. He is going to be fine." Samantha assured her. "Thanks for the anti-venom."

Abby gasped. "He was bit by a snake. What kind?"

"Rattlesnake." Samantha told her.

"Samantha, you look so tired. Did they hurt you? Did they beat you?" Abby was off on another tangent.

"I'm fine Abby really. The food was horrible and I have not had much sleep but I am fine."

"The team Gibbs mantra." Abby laughed. "I'm sure you feel like hell and would never say anything else."

Samantha smiled. "Have you talked to Kelly and Jack?"

"Gibbs felt that it was a good idea to get them in protective custody. Ned went to Stillwater to bring them back to the house. He is staying with them until we know something. We did not call them when you were kidnapped. Gibbs wanted to wait." Abby told her.

"How's Tim? I need to talk to him."

Dr. Davies cleared his throat. "Let's get your blood work done, start another IV, and get you some food," he replied. "Maybe after you get into a room your friend here could help you get a shower." Abby nodded. The doctor left the room and the nurse came in to get the blood work and change the IV.

"Dr. Wallard has you a room ready upstairs and they are bringing your husband into the same room as we speak," the nurse told her. Samantha visually relaxed and smiled at Abby. "Now I'll get someone to move you upstairs with your husband."

"Thank you," Samantha yawned. "Abby, will you check on Tomas for me? It seems like hours since they took him."

"Who's Tomas?" Abby questioned. Then she remembered the phone call she had received from Ziva earlier. "He must be the baby."

"My baby, Abby." Samantha corrected her.

"Samantha, please explain how you think he is your baby." Abby was unsure about this question but she really needed to know the story. She was afraid that Samantha was having trouble with reality.

Samantha smiled. She knew that she had to tell the story and Abby was the one who would make her feel better about the whole delivery. Sam then began the whole story. From the minute she was kidnapped to the minute Gibbs showed up at the shed. Then she told her all about the rattlesnake and how Gibbs got bit trying to protect them. Abby sat back and listened. The tears for the young mother dying and never getting to love her baby began falling down Abby's face. "So you and Gibbs plan on raising the baby."

"Of course Abby. We named him Tomas Jackson Gibbs. Tomas was what Marissa wanted him named." Samantha told her as the orderly came in with the wheel chair. The young man and Abby helped Samantha into the chair. "Now Abby will you check on Tomas for me? I really feel responsible for him since it was my fault that he is forced to grow up without his mother." Abby frowned.

"Samantha, how is it your fault? You aren't a doctor. You did the best you could."

"That's what Jethro said but I just feel I could have done more." Abby really was worried about her friend. She looked at the orderly and nodded. .

"Could you direct me to the Nursery?" Abby asked. He pointed toward the elevator.

"The nursery is on the fourth floor," he told her. "I'm taking Mrs. Gibbs to the third floor in the room next to Agent McGee."

"Thank you." Abby smiled as Samantha. "I'll be right back."

Abby bounced over to the elevator and pushed the button for the fourth floor. The orderly turned to Samantha. "Now let's get you settled Mrs. Gibbs."

NCIS

Gibbs had just been wheeled into Exam Room One. He was still fighting treatment repeating that he was fine and that they needed to check on his wife and son. Dr. Davis was determined to take care of the entire family and this tough Marine was not going to spoil his record. "Now Agent Gibbs your wife is fine. She just needs to rest, eat and take in some fluids. You on the other hand were bitten by a rattlesnake while still recovering from surgery less than a week ago." Gibbs relaxed back against the bed. "You don't have to be the hero here. Your wife is in the other room being treated. The baby I am sure is heading toward the NICU unit for observation. Now let me treat you." Gibbs nodded.

"Can I make a phone call first?" The doctor nodded. He handed Gibbs a cell phone. Gibbs quickly dialed his father's phone. "Hey Dad."

"Hello son. How are you?"

"Been better Dad."

"What's wrong son? Is Samantha alright? I know you are not having a quiet honeymoon. Ned has tried not to say anything but I know."

"I'm fine Dad, Samantha's fine. We have had some issues with our old friend the Reynosas. Just wanted you and Kelly safe. How is she by the way? Is she listening?"

"No Son. She and Ned are in the kitchen making cookies."

"I need you to make a call for me. I lost my phone so I don't have the number. I need you to call my friend of mine. He is the lawyer that handled Kelly's adoption. I sort of need his help again. His number should be in Samantha's"

"What did you two find another kid that needs to be loved?" Jackson Gibbs replied.

"Kind of. I need him to get on this immediately. He can call my phone soon. I'm sure Tony will have it."

"So this is the entire story I'm going to get."

"Yep, for now. I'll talk to you later Dad. Send Kelly our love and give her a kiss from both of us. I promise either Samantha or I will call soon." Jackson Gibbs shook his head. His son was a man of few words but this time he really would like to have known the story. Gibbs knew what his father was thinking. "I promise to tell you all soon Dad. Love yak. Bye."

Gibbs turned to the doctor. "Thanks Doc. I will try to be a semi cooperative patient from now own."

"Could not help over hearing. Calling a lawyer to adopt that young man of yours."

"Exactly. He is our son doctor. I knew that the minute I held him. This will kill my wife if we can't get this worked out."

"Don't think I would want to be around if someone tries to take him from her. She is a Mama Bear where he is concerned."

"Don't I know it. She is like that with our daughter."

NCIS

As they exited the elevator on the third floor Samantha looked up at the orderly. "Could we stop by Agent McGee's room? I need to see him."

"I guess, Mrs. Gibbs," the orderly stammered. "The doctor really wanted you to get some rest."

"I know but Agent McGee risked his life to save me so I really will not rest until I talk to him." The orderly knew he was beat so he stopped at the door next to the Gibbs' room.

Tim McGee looked up as the door opened. "Samantha," he cried. "Are you alright? Abby and I were watching the operation on satellite but it was hard to tell about you and the Boss."

She smiled at her friend .The orderly stopped the chair next to the bed. "I'll give you ten minutes, Mrs. Gibbs. Then I will have to get you to your room." Samantha nodded. Then she turned to Tim.

"How are you?" she asked Tim.

"I'm fine Samantha. The doctor said I should be able to get out in a couple of days." He then looked into her eyes. He saw an exhausted woman, who had been through a lot over the past few days. "Sam, did they hurt you? You know what I mean." Samantha shook her head. A few tears filled her eyes at the thought of her friend was that concerned that she had been raped.

"I'm just tired Tim," she told him. "It was such an ordeal. Getting kidnapped, seeing what happened to you, being thrown in that shed with a pregnant fifteen year old, delivering her baby and then having her die on me. Then Jethro showed up and got bit by a rattlesnake." She blurted out feeling comfortable telling him anything.

Tim took a breath and looked at her. She reached her hand over and placed it on his arm. He patted it and smiled. "You've been through a lot but you're tough. It will be ok Sam."

"Well the best thing to come out of it is Tomas."

"Tomas?" He then looked at her in surprise. "The baby. Let me guess. Roger is the father and you and Gibbs are planning to adopt him." Samantha nodded smiling at him. "Well Kelly will adore being a big sister."

Just then the orderly knocked on the door. "Mrs. Gibbs, we need to get you to your room. Dr. Wallard will have my hide if I don't get you in your room."

"Ok, I know he can be an old bear sometimes." She looked over at Tim and smiled. "Come next door Tim and borrow a cup of sugar when you get a chance."

Tim could not help but laugh as the orderly wheeled her out. " Maybe we can plan a movie night later." Samantha waved as she left the room.

NCIS

Abby found the nursery and noticed a tiny little boy lying under the warming lamp with an IV attached to his umbilical cord. She leaned her face up to the glass in order to get a closer view. Dr. Wallard came up behind her. "I assume you have been sent to check on him," he said smiling. He seemed a lot like Ducky Abby noticed. "That Sammy, she has always been a bit over protective where her family was concerned."

Abby smiled at him. "So doctor. What do I report?"

"He's doing fine. They're giving him fluids and all his vitals are good. He's a bit of a little piggy where eating is concerned but that is to be expected. Tell her his is thriving and we should have him to her after she rests."

"You know the situation about his birth?"

"Yes, Sammy delivered him. She has now taken him in as her own. Are they planning on adopting him?"

"Apparently "Their conversation was joined by a five foot tall Hispanic woman. "I just got a phone call from Jimmy Wilson and then a lawyer from DC. Seems they want this done as quickly as possible."

"Well hello Josie. I figured somebody would call you."

"Coach Waverly had a lot of sons who seem to take it on themselves to protect and help their sister." Josie replied. She turned to Abby and introduced herself. "I'm Josie Kelly. My four brothers all were on Coach Waverly's little league teams over the years. We were all like family in those days."

"Abby Scuito, Samantha has a way of turning friends into family. I work with her husband in DC."

"Leroy Jethro Gibbs retired Marine. They have been married less than two weeks?" Abby nodded in answer to Josie's question. "Yes I just got faxed some information on both of them. I always knew that Samantha would turn up great but Agent Gibbs a great man too."

"Oh he is the best. Gibbs is totally the best. And Samantha has made even better that he was without her." Abby bubbly told her. "So you see any problems of making this little guy part of our family."

"Well the good thing is they had all the interviews and observations done when they adopted their daughter Kelly. This should not talk long. I'm waiting for a phone call from the DA about a couple of issues and the police needs to get a hold of the mother's parents and see if they want to make a claim on the baby."

Abby looked concerned. "Could they try for custody?"

"They could. But I think it probably won't be a problem. My sources tell me that they won't want to raise their daughter's bastard child."

"That is so sad." Abby sighed "But a good thing for us. I know Samantha loves this baby already. Have not talked to Gibbs about it but I am sure he is totally on board with it or she wouldn't be so possessive. Gibbs loves kids. "

Just then Tony and Ziva entered the hall. "How's the kid?" Tony asked.

"Doing well." Dr. Wallard replied.

"Samantha and Gibbs?" Ziva added.

"Gibbs is sedated to rest and they are moving Samantha into Gibbs' room right now. In fact I have to go report to her about the baby." Abby started toward the elevator. "Oh and Gibbs' room is next to Timmy's." Then Abby got an idea. She turned and whispered in the doctor's ear.

"Good idea," he whispered. Abby smiled at the doctor and then winked at Tony. She followed the doctor into the nursery.

Ziva and Tony both nodded. Josie looked at the couple. "Hi. My name is Josie Kelly. I'm here working on getting that little guy the best parents possible."

Tony eyed her. "Well you've come to the right place. Nobody would be better parents for that little guy than Samantha and the Boss."

"So you really think they want to raise this baby."

"They already call him their son. They were both acted like a couple of new parents with him. Both of them put his needs ahead of his. "Josie smiled at the concern in Tony's voice.

"Well since I can't talk to the prospective parents I will head to the office."

Tony and Ziva looked at each other. "Please say that we will be adding a new member to our family."Ziva replied.

"I'll be getting back to you and them as soon as I can. Samantha is like my sister."

The orderly slowly pushed the wheelchair out of Tim's room and into the room next door. Gibbs was sleeping peacefully in the bed. Samantha smiled upon seeing him. She would not relax until she could put her curl up next to him on the bed. She could feel him breathing. She was helped out of the wheelchair and into the other bed in the room. Samantha was disappointed but knew hospital policies. She and Gibbs had been in enough hospitals over the past year they knew ways around the policies. Usually nurses look the other way anyway.

As soon as the orderly left Samantha carefully swung her legs over the side of the bed and gingerly stood up. Using the IV pole for support because she was still weak, she shuffled over to her husband's hospital bed. Smiling at Gibbs' sleeping form she sat down on the bed and then lay down next to him. She laid her head on his shoulder wrapping his outstretched arm around her. As if on instinct he scooted over and turned over wrapping his other arm around her. She smiled and relished in his scent and warmth. Gibbs mumbled something intelligible in his sleep. It amazed Samantha even after only a couple of weeks of marriage and part of that they had been apart how in sink they were. "I love you too." Samantha whispered. "Good night, Tomas." Samantha fell asleep almost immediately. She did not realize how tired she was.

NCIS

Downstairs Abby was at the gift shop working on her little surprise for the couple. She had taken a couple of pictures of Tomas in the Nursery and was now using a photo printer to put together a slide show to put in a digital frame to put in their hospital room. She quickly added graphics along with his name, weight and birthday. "Miss Scuito?"

Abby turned and say Josie Kelly standing behind her in the gift shop. Abby could see tears in her eyes. "What's wrong, Josie?" Abby gasped. "Has something happened to the baby?"

"No, he is perfectly fine. There is a problem with the adoption." Abby gasped. "The biological father is contesting the custody. He refuses to allow his son to be adopted."

"What? How can that be Josie? He's in jail for statutory rape and kidnapping? Are they really going to let him take that baby?"

"It's that whole guilty until proven guilty thing. Also he wants his family to raise the baby."

"Can we fight it? Gibbs and Samantha have been through so much. Samantha wants a baby so bad and I know she already loves this baby."

"Our biggest hope is the DA. He's hoping to make a deal with Roger for custody."

"Then our best course of action now is prayer." Abby replied holding the picture frame holding pictures baby Tomas. She pulled the frame into a huge Abby style bear hug. "Lord guide the DA into making this deal. This little boy belongs with his family." Josie smiled and nodded in agreement. She would do everything in her power to help out the lady she had always thought of as a big sister. But she was not quite sure how. It depended on the Chaves County District Attorney and a lot of luck.
