Happily Ever After Chapter 12
AN: Sorry for the custody cliffhanger. As I said in the last author's note, I'm not a lawyer but I have seen several television shows where a person in police custody caused trouble for prospective parents. His guilt has not been proven in a court of law so he still has rights. Yes he raped Marissa but that has not been confirmed. Things are still new. Samantha and Gibbs are the best parents for this little boy.

NCIS
Location: Chaves County, New Mexico.
It had been almost ten hours since Roger DeLoSantos had been brought in by the New Mexico State police. Carrie Ann Brant was sitting in her office looking over the files. This man, who was once an award winning police office and then became the arson investigator for the fire department was now being charged with rape of a fourteen year old, kidnapping, and an assault on a federal officer. He was screaming for his right to see his newborn son. Carrie had not worked with him on the police force but she had been in his office for a teenage indiscretion. She remembered him as being creepy then. Now she knew why he liked young girls.
"How can I make a deal with this scum?" she whispered to herself. "But he's screaming about his parental rights. I don't want him to ever have contact with that baby. "She looked down at the file in front of her. The file contained the information she had been given on the couple who wanted to adopt the baby. Leroy Jethro Gibbs retired marine turned NCIS agent. He was the winner seven times of the civilian service medal. Samantha Waverly Gibbs retired Marine turned first grade school teacher. She had heard of Samantha's father but he had been killed before she moved to town in 1980. Mrs. Gibbs grandfather was one of the most well known men in town history with an impeccable reputation.
She had a meeting with Roger's lawyer in twenty minutes and she knew what she had to do. No matter what deal she made it had to include him signing over his parental rights to the baby. Just then her phone rang. "Brant," she answered. "Felix, that's great to hear so all I have to do, is make him an offer he can't refuse as long as he signs those papers." She shook her head. This was going against everything she stood for. Either way he was not getting out of prison. Not if she had anything to do with it.
NCIS
Samantha had been asleep almost ten hours when the call of her stomach woke her up. As she began to stir she could feel Gibbs' arms encircle her pulling her closer as he buried his nose in her hair. She looked up at him and noticed he was still asleep or at least appeared to be. She snuggled in close trying to go back to sleep. Then the nurse came in carrying two trays. If she was shocked the two were snuggled into one hospital bed she did not show it. "Good Morning Agent and Mrs. Gibbs. I've brought your breakfast. I suggest you both stop paying possum and eat. You both need it."
Gibbs could not help but chuckle because he knew that she was telling the truth. "Morning Wife."
"Morning Husband." Samantha smiled. She looked at the tray of food the nurse had sat on the moveable table in front of them. "Really, you call this food."
The nurse smirked and turned to walk out of the room. "Well it's all we have and you have to eat." She walked out the door chuckling to herself.
Samantha sat up more in bed and looked over at Gibbs. "Well how are you feeling this -"She looked at her watch. "Morning. Looks like we have both been sleeping for a while."
"Or at least you have." Gibbs smirked. "I never can sleep much in the hospital as well once you came into to join me well I had other ideas."
"Really after all we've been through." Gibbs nodded smiling at her. He then took her chin in his hand and then softly began kissing her. The kisses became more heated with hands roaming over their bodies. A knock on the door brought them back to the reality that they were not in their honeymoon bed but in another hospital bed. "Come in" Samantha replied quickly pulling down her t-shirt.
Abby carefully stuck her head in. "Ah I see you're awake," she smiled walking in the door. In her arms she was carrying two Styrofoam trays. She walked in and put quickly removed the hospital food and sat them down on the table.
"That smells much better Abby. Wish you had brought some _"
"Coffee," Tony replied coming in the door. Tony was smiling and holding a large cup of coffee and a can of diet coke. "Your wish in my command, Boss."
"You're a life saver, DiNozzo." Gibbs wiggled and managed to sit up taking the coffee from cup.
Samantha opened the tray to reveal a real homemade breakfast. "This is great. If I did not know better I would swear it was from _"
"Miss Millie's truck stop." Jimmy Wilson chimed in as he walked into the room. "She insisted you come by for a hamburger before you leave."
Samantha laughed taking a bite of the stack of pancakes covered in syrup. "Abby," she asked her mouth still full. "Tomas?"
"Just checked on him. He is sleeping peacefully having just had a bottle." Abby answered. Abby then reached into her bag and pulled out the picture frame. "Thought this would help you relax until they can bring him to you."
Samantha stopped eating long enough to open the package revealing the picture frame. She immediately turned it on. On the screen came several beautiful pictures taken in the Nursery of Tomas Jackson Gibbs. The final shot was of him in his crib under which Abby had put his vital statistics and his name. "Oh Abby it's beautiful. He looks one hundred percent better. "She turned the frame to show Gibbs, who smiled the smiled of a proud father touching the picture of "his son".
"Thanks Abbs," he managed to say.
"When will we get to see him. " Samantha asked.
"That's a small problem." Tony interjected. "DeloSantos is contesting custody." Both Gibbs and Samantha eyed him in shock. "DA's meeting with him right now. She's planning on cutting a deal for the charges that includes signing over his rights."
Gibbs could feel Samantha's body posture stiffen with the stress of the moment. He wrapped his arm around her and whispered in her ear. "Don't worry sweetheart. He's using this to manipulate things. He doesn't want that baby. He just wants to be in control." She looked into his eyes and she saw nothing but love and confidence. The tightness in her body relaxed. Abby came over and patted her hand smiling.
"You need to eat," she told her. "You have to be strong so you can take care of him."
"She is right Samantha." All heads turned toward the door hearing the kindly accent of their friend Dr. Donald Mallard. Ducky walked up toward the bed shook Gibbs' hand and then kissed Samantha on the cheek. "How are you both feeling today?"
"Been better Duck." Gibbs told him. Samantha smiled knowing that was Gibbs' way of telling Ducky he was not one hundred percent but ok.
"And you my dear." Ducky replied taking Samantha's hand. "You went through a lot."
"I'll be fine as soon as they bring me Tomas." Samantha told him. "Also, have you seen Marissa's body?" The look on Samantha's face was pensive. She reached for Gibbs' hand. He gave it a squeeze for reassurance. "You did not make a mistake," he whispered.
"Yes, I got here last night. You and Jethro were still asleep so I went straight to work."
Samantha squeezed Jethro's hand. He looked at her with a look of assurance. He then nodded. "Tell us your findings Duck. Why did Marissa bleed out?" Samantha asked him.
Ducky sensed Samantha's concern. "First, let me assure you my dear Samantha you were not the cause in any way of the young mother's death." Ducky replied. "She was lucky to make it to term. Her placenta was covering the opening to the birth canal. When she went into labor the contractions began pushing the placenta ahead of the baby." He took her hands in his and then looked into the frame that was now sitting on the table. "If you had not been there and had some medical training this young man would have died along with his mother. The only way Miss Marissa could have lived was extensive prenatal care, which she did not have and a c-section." He reached out and touched the picture frame. "The medical training you did have kept this young man alive until help could arrive."
"So I did not kill her." Samantha cried as the tears began forming in her eyes. Gibbs pulled her into his arms again. "Told you," he whispered.
"No, you did not kill her. It was obvious that you did all you could do trying to protect her. Even an experience doctor would have lost her under those conditions." Ducky reached into the breast pocket of his jacket and handed her his handkerchief. "Now I understand your medical training did manage to protect our fearless leader here."
Samantha smiled. "Thanks to Abby's premonition. She sent the anti-venom." Abby smiled at them both knowing that she was glad to protect them both.
NCIS
Jackson Gibbs was extremely worried after his son hung up the phone. Why would his son want the phone number of lawyer? He hated lawyers. The lawyer he called was the lawyer that handled his granddaughter's adoption. But now he had not heard from his son for over twelve hours. He decided that he had waited long enough. He took his cell phone and walked downstairs to the basement leaving Kelly and Ned busy in the kitchen cooking lunch. He quickly dialed his son's number.
After three rings he heard the voice of his new daughter-in-law. "Hello Jack. How are you and Kelly doing?"
"I'm fine darling. Kelly is helping Ned make lunch. I am more concerned about you and my son. He called me yesterday looking for Bob's phone number. He said he would call back."
"He's been asleep Jack. So have I." Samantha then began the story of their honeymoon so far. Starting with the tornado in Lubbock, Gibbs surgery, her kidnapping, the birth of Tomas and of course the rattlesnake. "We are now waiting for the DA to call. She is in control of our getting custody of little Tomas."
"Well I'm sure it will work out for you dear if it was meant to be."
"Don't tell Kelly just yet Jack. I don't want to get her hopes up."
"You mean like yours and I am sure my son's are." Jack told her.
"Well I can't deny that my hopes are up." Samantha stammered. "Mine too, Dad" Gibbs said into the phone. "Just don't tell Kelly just yet."
"I won't son." Samantha handed Gibbs the phone. Then she looked around the room and noticed that the room had emptied out leaving the couple time to talk to their "dad". Gibbs and Jack talked for a few minutes and then he handed the phone back to Samantha.
"We'll call you as soon as we know something." Just then a knock could be heard at the door. "I've got to go Jack. Nurse coming in to disturb us again."
"Bye my dear. Don't worry about Kelly. I'll keep her protected, fed and safe. She seems to like Ned a lot."
"Tell him thank you Jack." Samantha hung up the phone and then turned to the door. "Come in."
Josie Kelly stuck her head in. "Hey Sammy. Can I come in?"
"Of course Josie. How are you doing? Have you heard anything about the baby? I know Abby told me you were handling things here for our lawyer in DC."
"We sort of. I just got a call from DA Brant. She was able to…" Just then the door opened and all their family that was in New Mexico came in carrying packages, balloons saying "It's a boy" and after all the confusion of the family entering was over Gibbs and Samantha noticed Abby pushing Tim in a wheelchair.
In his arms he had a bundle wrapped in a blue blanket. "Looks like it's a boy Boss." Tim said smiling from ear to ear. Samantha looked at the bundle seeing the dark curly hair and his tiny hands waving around.
Samantha looked at him cautiously. "Is he ours?" she asked.
"Yes," Josie replied. "Brant made a deal with our friend Roger. Instead of fifteen to twenty years for all his crimes, he'll have to do ten before he gets a chance a parole. With his age he that might be almost a life sentence."
Samantha looked at Gibbs and then at the baby. "Well," Gibbs told her. "Are you going to pick up our son or are you going to let Uncle Tim have all the fun?" Samantha slipped out of bed and took little Tomas from Tim. The baby looked up at her his brown eyes were bright and he was staring right at her. Samantha moved back onto the bed and Gibbs helped her hold the baby's head. Gibbs bent down and kissed his son on the forehead. "Hey, little man. You look much happier than the last time I saw you." The baby looked at the voice as much as a 48 hour old baby can do. Samantha held the baby closer and he snuggled into his mother's arms.
"Josie, do Marissa's parents know about the baby?" Samantha asked as she held the baby and continued to eat her breakfast.
"Yes, I sent an investigator out with the police officers when they were notified of Marissa's death. They want nothing to do with her or the baby. Her parents won't even talk about taking the body for burial." Samantha had a look of shock.
"They just pushed her aside like she was dirt." Samantha asked. "They are going to let her be buried in an unmarked grave." Gibbs leaned in and kissed her temple.
"How about we make arrangements for her?" Gibbs whispered in her ear. Samantha looked up and smiled signing thank you.
Josie nodded. "They called her a tramp and slammed the door. They signed the legal paperwork. They have no claim on your son."
"So they don't even want to know him." Tears were filling up her eyes; she could not imagine someone not wanting to see this baby. Not to be part of his life. Tomas was sleeping peacefully in her arms. "Well little man, I imagine that there are enough people who will love you in your new family."
"That's true." Tim replied and all the assembled company agreed.
Gibbs looked at his sleeping son. "You also have a sister and a loving grandfather waiting for you at him. Do we have some papers to sign?"
"You do." Josie replied reaching into her briefcase. Abby quickly removed their breakfast trays. Josie placed the legal papers on table. "Well, you need sign the temporary custody papers. Then in six months you will go into court to be awarded permanent custody. But of course you know the drill. You've done this before." Josie handed Gibbs a pen and showed him where to sign.
After he finished signing all the appropriate spaces, he took the baby who was beginning to stir in Samantha's arms. She took the pen and started signing as well. Gibbs noticed Tomas' brown eyes looking up into his eyes. He started making faces at the baby. Tony and the rest of the team could not help but smile at their boss. Here was their big old tough marine cooing and making faces at this tiny baby.
Samantha took the papers from Josie after she finished signing them. "They will be filed with the court and the hospital will receive copies as well. They will be putting Tomas Jackson Gibbs on the birth certificate."
"Josie I can't thank you enough for all you have done for us." Samantha said smiling.
"No problem. My brothers kind of insisted." Josie replied.
"Well, tell them thank you too."Samantha handed her the papers and took back her son almost possessively. She looked down in his dark brown eyes. "Well, young man looks like you have a new family." She held the baby up turning him to face his family. "Ladies and Gentlemen may I present to you Tomas Jackson Gibbs. The entire assembled group clapped smiling from ear to ear. Gibbs pulled Samantha close and kissed her.
"I believe we have a phone call to make," he whispered.
Samantha looked over at Abby and Tim. "I think we need to make it a Skype call." Samantha suggested.
"Absolutely," Abby replied. "I'll get that set up."
