"Come in please, Agent Henshaw, have a seat," Benner said.
"I received your call, sir. Is this about the Morgan trial?" Henshaw asked.
"Yes it is. I'm afraid we… underestimated the man."
"How so? You said the evidence was…"
"It's not that simple, Agent Henshaw. He has a very strong defense, one of the best in the country actually because he's got hundreds of thousands of fans all over the world pumping money into his legal fund."
"Wait, what about the witnesses?"
"Damaged credibility. I think there's a very small chance the jury will still take their testimony seriously."
"His fake documents, disappearances, the airport mayhem…"
"Plead temporary insanity with expert witness to back it up."
"Jesus Christ, what about his online habits?"
"The judge threw the records out of court about a month ago. Jury was instructed to disregard them. That was the strongest piece of evidence we had on him and now it's gone."
"The deaths of his co-workers up in Oregon?"
"There's virtually no physical evidence to tie Dexter Morgan to any of those murders. You should know that."
"How about the first wave of Miami murders?"
"To us it looks clear. To the jury all the evidence points to Sergeant James Doakes as the Bay Harbor Butcher and none of it points to Dexter Morgan."
"The second wave?"
"There is some reasonable suspicion, but the way things have been going, it is not beyond reasonable doubt. Overall, and I say this with 30 years of experience as a federal prosecutor, I doubt there's even a 20% chance to obtain a guilty a verdict on any of the charges at this point. Though it is likely he will be compelled by the court to go into therapy for that incident at the airport. In a maximum of two years time he could be out on the streets again."
"So what are we going to do now?"
"We either need a full confession at this point, which is not going to happen, a new body this time with rock solid physical evidence linking it to Dexter Morgan or you need another witness. Someone from his past. Has anyone located Lumen Pierce yet? If we can get her on the stand, she could bury him alive. We'll offer immunity if necessary."
"I'm afraid she's completely fallen off the grid for good. Interpol suspects she most likely has taken on a different identity at this point. All traces of 'Lumen Pierce' end at an airport in the Malaysian capital of Kuala Lumpur. A body was never found. As they were romantically involved I doubt she would testify anyway."
"How about Hannah McKay? Has Interpol located her?"
"Now that you mention it, sir, they are closing in on her although extradition may be a bit tricky if not impossible. We know she's in Argentina with Dexter Morgan's son. But I very much doubt she would testify against him, plus I don't think we should be making a deal with her. She is just pure evil."
"This case has massive implications. We screw it up and our careers are over. Do we want to go down in history as the men who let a mass murderer get away, or worse, accused an innocent man of the law of committing a hundred murders?"
"Sir, I just…"
"Well, cheer up, Henshaw. At least if Morgan's innocent maybe there's still a chance all the reports he's made, all the evidence he's bagged and tagged, will not be rendered invalid. How benign. We'll still lose our jobs though!" he said raising his tone.
"Hang on sir, I think you just gave me an idea. But I need to confirm a few details first."
"Sure, go ahead, what do we have to lose? What do you have in mind Agent Henshaw?"
"We're going to get a full confession from Dexter Morgan very soon with a cherry on top. No need for any extra witnesses, no need to make morally questionable deals with devils"
"You're kidding right? How will you do that?"
"You will see, sir."
