Thanks for the reviews and I'm glad to be back writing this story even if it's only for a few more chapters.
Santana's up at the crack of dawn. She's been waiting for this day for three long years. Today is the day that the trial of her father's murder begins. She's glad that she's already on maternity leave as she knows her work would have suffered this last week as this date approaches. The only thing that has kept her sane is her boys, her sons and husband. Brett especially has been her rock the last two weeks.
She looks over at Brett who is sound asleep his arms behind his head. This makes her shake her head as she has no idea how this man can sleep in just about any position without waking up with neck pain. If she were to sleep in half the positions that he does her neck would be killing her. Needing to get up she slides out of bed watching her husband to make sure she doesn't wake him up. Rubbing her baby bump as she walks out of her room she stops at Tyler and Johnny's rooms smiling when she sees them fast asleep sleeping exactly like their dad.
"It's going to be okay." Brett whispers from behind her.
A little startled she turns around and buries her head in his shoulder.
"God Brett you gave me a fright." Santana breathe in his scent. "I'm sorry I woke you up." she softly says.
"It's okay I can never sleep well when you leave the bed anyway." Brett softly says wrapping his arms around her.
"Today-"
"Baby don't worry about anything. He'll go to jail and never be able to get out." Brett softly says.
"But what if they don't convict him." Santana says voicing her biggest fear for the first time.
"That won't happen baby. He did it and no jury is going to let him go." Brett reassures her.
"But-"
"No buts my sister and dad won't let him get away with it okay. You're family baby." Brett softly says kissing her lightly on the cheek.
"Thanks babe, I don't know what I'd do without you." Santana says leaning into him.
"You'll have to deal with that I'm always going to be here for you." Brett softly says before two little feet come running down the stairs.

"How is she?" Steve asks his son.
"She's doing as well as can be expected." Brett whispers watching as his mom hugs his wife.
"I can't believe that it's taken them three years to finally bring this case to court. I thought I was pretty cut and dry." Steve growls pissed that this is happening.
"Dad, don't do anything stupid. It was all tactics by his lawyer to try and get him off or a sweet deal and then the lead prosecutor became a judge so they had to delay the trial." Brett tries to explain.
Neither his parents or Santana had understood why it was taking so long. To him it was good lawyering by his lawyer even though he thinks that the bastard should be rotting in jail already he respects the system.
"Well I'm just glad that we're finally going to be able to put that bastard away." Steve says as they make their way to Santana and Susan.
"Brett honey come hold your wife." Susan orders her son.
"I'm here for you." Brett whispers wrapping his arms around Santana as she buries herself into his body.
"We're all here for you Santana." Susan says motioning for Peter, Aly and Karma to come join them.
"Thanks for coming." Brett says as Santana nuzzles her face into his shoulder.
"Anything for my favorite sister." Karma says smiling at Santana.
"Hey," Aly says frowning at Karma.
"Well she is," Karma says.
"Hush girls, we don't need any arguments now of all times." Susan says sitting on the other side of Santana.
Santana's just glad that they're all here for her, that they all took time out of their busy days to come and support her while she watches the trial of the man who killed her father. She rubs her swollen belly as she buries herself more into Brett's side.
"So are we sure the crazy grandparents can watch the little ones?" Peter asks sitting down next to his sisters.
"Of course they can, they've dealt with young kids before." Karma says rolling her eyes at her brother.
"Peter stop being annoying to your sisters." Steve says knowing that his son is going to try and get under the skin of his sisters.
"Steve," Susan says in a warning voice.
"What I didn't do anything wrong? I just told him off before he starts anything." Steve says raising his hands in the air.
"Let's all just shut up so we don't get in trouble for talking when the judge comes in." Susan says rolling her eyes at her family who somehow always manages to embarrass her. "I apologize for them Ann." she says sitting down next to Ann.
Since reconnecting with Santana, Ann has made it a point to keep in contact with her niece and visit a couple times a year. So when she heard that the trial was finally taking place she made sure that she could be their every day.
"Don't worry about, I'm just glad that we're all able to be here to make sure this son of a bitch gets put in jail." Ann says.
"Yep," Karma says before whispering under her breath. "And if not we'll end his life the old fashion way."
Brett sees the judge start to come in and with Santana still in his arms manages to stand them both up. He's glad that his whole family is here for Santana and that her aunt could make it as well. He knows that this is going to be hard on his wife to have to relive everything that happened that day. She didn't know much of it as he had taken care of everything at the time so she could focus on her dad and since then she's never asked about it.
"Just remember that you have to remain calm for the babies' sake." Brett whispers as they sit back down.
"I'll try," Santana whispers back.
The trial starts with opening arguments from the prosecutor and defense attorney. Santana thinks that prosecutor did very well and looking at the jury she can't help, but think that they agree with her. When the defense attorney said that there was absolutely no proof that he shoot her dad Santana wanted to stand up and shout yes he did. She feels Brett tighten his grip around her waist and she knows that it will only get worse from here. She wishes that he would just admit that he did it and go to jail for the rest of his life.
"It's going to be a long trial isn't it?" Santana whispers in Brett's ear.
"Possibly it depends on how many witness and experts both sides have." Brett tells his wife as they're waiting for the first witness for the prosecution to come in.
"Will the defense be-"
"San, the defense is going to try and blame everyone and anyone aside from him don't take it to heart." Brett whispers knowing what his wife was going to ask. "Just know that the prosecutor has a very solid case and it will be hard for the defense to break it no matter what they do."
"Promise you'll tell me if it looks back please." Santana says burying herself even deeper into Brett.
"I will,"
Santana nods her head satisfied that her lawyer husband will tell her if it doesn't look good. With that she looks over at the jury to see who will be putting him in jail. There are five older women who all look over the age of sixty. She thinks that they'll convict him without a second thought. The three middle aged men she's not sure about as she can see them going either way on this. The twenty something woman she thinks will most likely not want to convict him. The three twenty something guys are eyeing the woman on the panel along with the young aid to the prosecutor so she thinks it a fair chance that they'll convict him. Overall she thinks that the jury will do the right thing and throw his ass in jail after everything is all side and done.
They prosecutor gets through two cops and the medical examiner along with the doctor that treated her dad before they have to break for lunch.
"So that went pretty well right bro?" Peter asks as they all sit around a table at a coffee shop outside the courthouse.
"Yes, the prosecutor is laying out her case very well thus far." Brett says.
"So she's competent?" Aly asks as they're all considered about him getting off.
"I remember going to school with Ashely and trust me she's the best which is why she got this case." Brett says Santana sitting in his lap curled into him.
Santana doesn't plan on leaving Brett's strong arms the whole time that they are here. It's hard enough for her to listen to the prosecution witnesses talk about her dad so she knows that she needs her husband's arms around her to keep her from doing something stupid especially when the defense starts.

"Does it normally take this long for the prosecutor to lay out a case?" Karma asks aloud as they enter the courtroom from the first day of the defenses defense week two of the case.
"It all depends on the case and how many questions the defense has for the witnesses." Brett says shrugging.
"So how is Santana really?" Karma asks taking this opportunity to talk to her brother about his wife while she's with their mother.
"She's holding in there for now." Brett says sighing. "It's really hard on her having to hear all this stuff about her dad."
"Just be there for her as I know you are and let the boys sleep with you." Karma says giving her brother a hug.
"I just wish I could take away all her pain." Brett whispers.
"I know, but you're doing a good job." Karma says before Santana comes back in and plops herself on Brett's lap.
"I don't want to hear him talk." Santana whispers laying her head against Brett's strong shoulder.
"We can leave if you want I'll do whatever you want baby." Brett whispers knowing that this will be the hardest day of the whole trial for her.
Santana nods into his shoulder. There's no emotion to describe how she feels right now knowing for the first time that she's going to hear this guy speak. She's not ready for this. Even after having to wait for three years for this trial she's still not ready.
"All rise for the honorable Judge Kristen James." the bailiff says.
The trial proceeds with him being called up to the stand.
"So Mr. Samuel Evans you just so happened to be walking by the Lopez Inc. building when Mario Lopez was shot right?" Sam's attorney asks.
"Yes, I saw a man in all black pull out a gun and shoot Mr. Lopez before taking off." Sam calmly says.
"What happened after that?" the attorney asks.
"Well I yelled for help, but when the cops showed up they arrested me. Apparently someone said that I shot Mr. Lopez which I did not." Sam calmly says looking in the juries eyes.
"So they just arrested you like that?" the attorney asks.
"Yes, I didn't have a gun or anything. All I know is that the real killer is still out there." Sam says.
Sam's testimony goes on for two hours of what the whole Pierce clan thinks is lie after lie. Santana is in Brett's lap her head buried in his chest so she doesn't say anything. When it's the prosecution's turn to question Sam they make it short and sweet.
"Mr. Evans did you or did you not have a gun on you when you were arrested for shooting Mr. Lopez?" Ashely asks.
"Um….I don't remember." Sam lamely says.
"Really because it says in the police report that you had a gun in your hand standing over Mr. Lopez." Ashely informs him.
"I guess I did." Sam says.
"The bullets fired from that gun match the bullets pulled out of Mr. Lopez." Ashely informs him.
From there on out Sam's testimony went horribly wrong for him. It takes another two days before the jury goes in to deliberate.
"It's going to be okay." Brett softly says as they sit on their couch in the living room.
"Momma," Tyler says smiling at her as he places his little hands on her swollen belly.
"Hey little man where's your brother?" Santana asks kissing his little cheek.
"Sleepy," Tyler says crawling up into his dad's lap.
Johnny comes tottering over smiling which makes Santana smile. It's the first time she actually smiles in the last four days. The boys just being themselves are making her feel better.
