SPeaking of the one-shot, I've decided to make it a two-shot, the next chapter showing Dak coming home (Mrs. Henderson-Mitchell bullied me into doing it...no i'm just kidding, I had so much fun writing it, so I was kind of hype when she asked me to do that lol)

In this Chapter...The Trial 2.0!
Chapter 36: Carlos' POV
I was nervously pacing around the living room. I had just gotten dressed and I was waiting for Kendall and James to be ready so we could all go together. Today was the day of the trial, and I honestly didn't know what to expect. On one hand, I was confident that Dak would go back to jail, but on another hand, I was way nervous that we would go to prison.
"Carlos, come sit down," Logan instructed.
"I can't," I continued pacing. "I'm thinking."
"You're overthinking," Logan corrected. "We've done this before."
"Yeah, except last time, we weren't the ones doing criminal activity!" I shot back.
Mama Knight wanted to be at the trial, but somebody had to watch the kids, therefore she volunteered. I made sure to tell all of them that I loved them before they left with her though. As I walked past him, Logan grabbed me into his lap and started tickling my sides, causing me to burst out laughing.
"Logie, stop!" I laughed as he continued to tickle me.
"Only if you sit down next to me," he said.
"Okay!" I yelled.
"Promise?" he was having too much fun with this.
"I promise!" I yelled.
He smiled and let go of me, and I plopped down next to him on the couch.
"Meanie," I gave him a look.
"But, you feel better now right?" he asked.
"…Yes, I do," I admitted.
"Good," Logan kissed me. "Everything will be alright."
Kendall and James walked in, looking suave.
"Ready?" Kendall asked.
"More than ready," Logan chuckled.
I'm glad that he's stayed calm about this whole thing. I don't know what I would've done if he hadn't of kept me grounded. Logan and I both stood up from the couch and I grabbed my keys to lock the door behind us.
The ride to the courthouse was mostly quiet. There wasn't much to say, and besides, all of us were more worried about the trial than sharing our nervous thoughts about the trial. We pulled up and my heart started racing.
We got out of the car and entered the building. When we walked in, Jim was right there.
"Hey guys," He smiled softly.
No occasion to smile about.
"How tense is it in there?" Logan asked.
"The crowd is pretty quiet," He said. "There are a lot of your friends in there, but there is also a lot of spectators and reporters. I just want you guys to stay calm and tell the truth. Let me handle the rest, I'm not going to let you fall."
"I think Carlos needs help in the 'staying calm' category," James said.
I punched his arm, causing him to yelp. Jim looked at me in concern.
"I'll be fine," I said.
Jim nodded.
"Okay, so in about 20 minutes they're going to call us in and then the case starts, so just be prepared," Jim said.
We all nodded and just stood around. After 20 minutes, I gulped as Kendall and James walked in to take their seats and Logan lined up with the door. The three of us walked in and everyone stared at us as we walked down the aisle, it was kind of uncomfortable and the air was thick.
We made our way to the front and at that point the judge came in.
"All rise! Court is now in session. Judge Nancy Buick presiding," the bailiff said.
Hey, it was the judge from last time! That makes sense though, but that should also means she's automatically on our side. We all stood up.
"The plaintiffs are Logan Mitchell and Carlos Mitchell, Jim Henderson as their representation. Our defendant is Dak Zevon, Bruce Oakwood as his representation. Bring in the defendant."
The door opened and I looked to the side to see two officers escorting Dak in his jump suit over to his side. He took a seat next to his lawyer and everyone was allowed to sit.
"This is case number 85C43-0405-CT-03948," Judge Buick started. "In the matter of Carlos and Logan Mitchell. Present in the court is the defendant and his attorney, lead prosecutor, the probation officer, and the arresting officer, which happens to be the plaintiff, Carlos Mitchell."
I got an introduction…that didn't actually help me.
"We will begin with opening statements. Mr. Henderson?" Judge Buick looked at him.
Jim stood up, and looked at the crowd. I was glad that he was confident, because I would be nervous.
"Everyone…" he started.
Good start Jim, good start buddy.
"We were here once before just over two years ago," Jim continued. "But that was a matter of proof of the crime that Mr. Zevon did commit. This could be simple, because we already know that he is guilty. He was arrested for multiple counts of rape and he escaped, so he's already wanted. He just added more charges onto the list, including kidnapping of children, attempted murder, assault to a police officer, and not to mention that he forced the plaintiffs to do things against their wills. It even resulted in the assault and attempted murder of an officer and my client, Carlos Mitchell. I'm not asking that Dak be given the death sentence, or any type of torture or anything drastic like that; I'm only asking that my clients get the justice that they deserve."
"Good start, Jim," I whispered to myself.
"Thank you Mr. Henderson," Judge Buick said. "Mr. Oakwood, you have the floor."
Bruce stood up and I almost tackled him. He's helping Dak, so I automatically don't like him.
"It is true that my client was arrested for multiple counts of rape only two years ago, but he has changed, and I believe that it should truly be evaluated before we proceed further. As for his other charges, I believe that we can work through them and find the truth in the situation. My client, Dak is being falsely accused and there is no reason that he should spend any more time behind bars. The real suspects here are the plaintiffs, who forced Mr. Zevon to hide out from the police, when he wanted to turn himself in, and if he did commit the acts of the charges, we should take the circumstances into account and realize that he was provoked," Bruce said.
That is the biggest bullshit I've ever heard in my life.
"I just want to make a motion that the charges be dropped and my clients former sentence also be revoked," Bruce finished.
"Mr. Zevon escaped from a state penitentiary, and he will serve time for not only that, but also not fully carrying out his sentence," Judge Buick said.
That's right Nancy!
"As for the other charges, they will be explored, now Mr. Mitchell," she turned to look at Logan. "Can we please have your story?"
Logan looked at me and I gave him a small smile before he stood up.
"Well, I don't really know where to begin," Logan chuckled nervously. "When Dak was first arrested, I thought I was safe and when I visited him a few months later, I had believed that he had changed. When he broke out, he wasted no time in finding me and forcing me to help him stay hidden from the cops, which included my husband. And I am sorry for that because I never meant to hurt my husband, or the force in anyway, I really just didn't want him to hurt my family and I know Dak, he had the capabilities to do so, so I really felt like I had no other choice."
I'm surprised he said that much.
"Then he kidnapped my children," Logan continued.
"How old are the children?" Judge Buick asked.
"My oldest, Ethan is 2 ½, and my daughters, Emma and Jade just turned 2," Logan explained.
"They were kidnapped along with their babysitter, Lucy Stone."
Everyone turned to look at Lucy, who just gave a small wave.
"I just know that losing them for those three days, were the scariest of my life because I didn't know where they were and they were with Dak, and I was really concerned with getting them back," Logan hung his head.
It was pretty quiet by then.
"Officer Mitchell, as the arresting officer, can you give me the details from that day?" Judge Buick asked.
I stood up nervously.
"I remember getting to San Diego and receiving a note from a random man giving us a clue as to where Dak was, so after had searched the woods for hours, we came along another man's house who wasn't very skilled and we found the cabin where he was holding Lucy and my children hostage, and it had come to be that he had abused my oldest son, Ethan, leaving a scar on his back that stretches most of the length of his back, and at the time I was pregnant with my son, Evan, and we argued, and he provoked me to the point where I pulled out my gun on him, but he fired first, and shot me in the stomach, catching my baby in the foot, and the shock sent me into labor and apparently I was in a coma for a few days. I just remember waking up and finding out that the baby was born and when I got back to L.A. , I marched right down to the station, where Dak tried to reason with me, but I just wasn't having it," I said.
She looked at me like she was thinking.
"And where is the evidence to back up all of the claims between you and your husband?" She raised her eyebrow.
"It is all right here, your honor," Jim handed her a folder.
In that folder, I knew that there were all of the notes that Dak sent to us, even the one about Ethan getting hurt, there were pictures of Ethan's scar, and there were the pictures of the scene where I was shot (which I couldn't look at because I just couldn't handle it), and a picture that I took last week of my gunshot wound. The judge scanned over all of it, she really didn't look happy.
"Let's move on to the testimonies," she said eventually.
"Your honor, Mr. Zevon hasn't told his side of the story yet," Bruce spoke up.
"He should be lucky that I haven't closed this case yet and sent him into solitary confinement," she said pointedly.
That sounds like a great plan.
"How can they even prove that my client did all of those things?" Bruce asked.
"Most of them are signed with his name," she gave him a look.
"What about the scars and the gunshot?" Bruce asked.
"Oh, I've included fingerprint reports, which match Dak's fingers to the gun," Jim added.
"Shut up!" Bruce hissed.
"Order!" Judge Buick used her gavel. "I'm moving to the testimonies, and Mr. Oakwood, you better have some good ones because it isn't looking too good for your client."
He nodded and quickly called Dak to the stands. Dak was escorted up to the chair and he looked at his lawyer.
"Dak, I understand that you are being misunderstood correct?" Bruce asked.
"Right," Dak nodded.
"So, explain to me how you are feeling."
"I just want this to be over," Dak said. "I want to go home and I want to go back to a normal life. None of us deserve this."
At that point, Dak looked like he was about to cry.
"So many lives have been wronged, including mines and I just want it to end!" Dak cried.
Seriously? If the judge falls for that, I'm going to jump off of a bridge.
"Is there anything that you did do?"
"I gave Logan a daughter 2 years ago and I don't regret it, but the rest of these claims are just ridiculous," Dak said.
"They weren't ridiculous when I was in a coma fighting for my life!" I stood up and yelled. "MY BABY COULD HAVE DIED BECAUSE OF YOU!"
"Officer Mitchell!" Judge Buick warned.
"I never got any chance from Carlos to even talk! He just acted and then he made me take the fall for his crimes," Dak said sadly.
"Alright Dak, that is all," Bruce nodded. "I would like to call Officer Mitchell to the stand."
I walked up to the stand, glaring at Dak as I passed him. Can you believe that the dick actually winked at me and smirked before taking his seat? Phony ass bitch! I sat in the stand and waited for Bruce to talk.
"How are you today, Carlos?" Bruce smiled.
"It's officer Mitchell to you," I said tightly.
"We all know each other here," Bruce said.
"Some of us were forced together," I shrugged.
"How is your baby boy doing?" Bruce asked.
I glared at him, my breathing picking up. He was honestly pissing me off.
"He's great," I said even tighter. "Especially after being SHOT."
"Don't act like the victim here," Bruce said. "We all know that you were in on Dak."
I stopped and I just blushed. It didn't go unnoticed by the judge or anyone really.
"Did you ever help Dak?"
If I had a reason, I would kill him. But I can't act unless provoked, and I haven't been provoked yet, not enough anyway.
"Dak actually came by my house," I said. "It was there that he forced me to promise to help him or else he would hurt my family. I wouldn't purposely do anything like that especially as a police officer, but I didn't know anyway to let anyone know what I knew without Dak knowing and losing the people that I love."
"But it is against the law to assist an escaped inmate and hiding information from the cops," Bruce said.
"I am the cops," I shot back confidently. "I'm the police chief and I waited for the right time for it to be done and me getting shot was that last straw, so if you didn't notice, I did my job, just in a strategic way."
"Doesn't seem like the best way to me," Bruce said.
"No one asked what you thought the best way was," I said.
"Just saying," Bruce shrugged.
"Well, I'm not impulsive like your client, I actually think about the consequences of my actions," I replied.
"Did you ever think about the fact that those actions had the consequence of prison?" Bruce smirked, like he had me beat.
"Of course," I said. "I'd rather go to prison for helping the sicko than let my family suffer because I love them too much."
He obviously didn't expect me to have a rebuttal.
"I call Logan Mitchell to the stand," he glared at me.
Logan quickly replaced my spot and the questioning began.
"So, what did you do for Dak?" Bruce asked.
"I brought him groceries so he wouldn't die," Logan said.
"And you're admitting to helping him," Bruce said.
"I'm not a man who lies, Bruce," Logan shrugged. "Now Dak on the other hand…"
"But we're talking about you," Bruce said.
"I mean, the note was read, the proof is everywhere and it is known by everyone that Carlos and I were forced to help, so whatever motive you have to try and make us responsible for Dak's crime and break us down isn't going to work," Logan said.
Bruce studied him for a second.
"Then, I guess we're done here," Bruce said.
"I guess we are," Logan smirked.
Logan went back to his seat. Bruce looked super stressed because they were losing big time.
"Mr. Oakwood, would you like to call anyone else?" Judge Buick asked.
"No, your honor," Bruce shook his head, to which Dak gave an 'are you crazy?' look.
"Mr. Henderson, you have the floor then," the judge said.
"I'd like to call Lucy Stone to the stand," Jim said.
Lucy made her way forward, not looking nervous at all, a very Lucy like quality.
"Ms. Stone," Jim started.
"Jim, just call me Lucy," Lucy said bluntly. "We know each other…"
"Right Lucy," Jim laughed. "Can you explain to me what happened the day of the kidnapping?"
Lucy kind of tensed.
"Well, on Carlos' birthday he had to leave and so did Logan and the others, so they asked me if I could watch the kids, and of course I said yes. Less than 10 minutes after they had left there was a knock on the door and there was a guy standing there with a gun to my face, demanding that I get the children together and follow him and no one would get hurt, and I really didn't know what else to do. He put a bag over my head and I had to try and comfort the kids, who just wanted their parents. When we finally reached the cabin, he locked us in the back room with minimal amounts of supplies and he came in and he hit Ethan multiple times with a switch," Lucy put her head down. "I've never heard worse screams in my life, and I just wanted it to end, but I couldn't and I feel like the worst sitter ever."
This is really painful to hear.
"I can assure you that my clients don't think that of you and are really grateful for what you did," Jim said.
"Yeah," I stood up. "You still stick with us and you always have. We've never blamed you."
That got a small smile out of Lucy.
"Thank you Lucy, you've given us enough," Jim smiled.
She nodded and left the stand.
"I call Jett Stetson," Jim said next.
Jett got up on the stand.
"Jett, I want you to tell me if you noticed anything weird on Carlos' birthday," Jim said.
"Well, I hadn't until Carlos called me, asking if the kids were with me," Jett said. "That's when I knew something had happened because they aren't the type to just lose children."
"Okay, and where do you stand with Mr. Zevon?" Jim asked.
"I haven't talked to him in a long time," Jett said. "I just know that he is a monster and I've seen the proof for myself what he did to my godson. I've tried really hard since the last trial to put Dak behind me, and yet he finds a way to pop up. I have managed to avoid him in this particular dispute, but I want him incarcerated for a long time."
"And I just want to know, if you have any other information that can help this case?" Jim asked.
"I really wish I did, but all of the evidence has been brought forth and that's all I know personally," Jett said.
Jim nodded and thanked him before calling a few others up to the stand. Just friends that may have noticed anything or have some word against Dak to help. Jim knows that Dak is going back to prison, he just wants him to be imprisoned for as long as possible now.
"The last person I want to call is Dak Zevon," Jim said.
Dak went back up to the chair and sat down.
"Why did you do it Dak?" Jim asked.
"I didn't do anything else," Dak lied.
"Okay, so we can cut the crap because everyone here knows that you've done at least two other things. It's obvious that you broke out of prison, it's obvious that you're going back, and it's obvious that you learned nothing the last time," Jim said. "Now, I got a confession out of you last time, and either you can give another one or we can fight here all day until justice has been served."
"Then I guess we're going to fight all day," Dak said.
"Do you even know why you escaped prison?" Jim asked.
"Because it isn't a place to spend life," Dak answered right away. "Everyone here judges me, but they haven't taken a second to think about what I've gone through in the past two years."
That's because no one cares, Dak.
"Well, like they say…if you can't do the time, don't do the crime," Jim said.
"It's vile in there," Dak said. "The things that you see mess with your mind, and the people are designed to destroy you from the inside out."
"So, you leave and commit more crimes?" Jim asked.
"I had to do something to stay out as long as I could," Dak said eventually. "And getting Logan and Carlos to help was the perfect way because Carlos is on the police force, and could steer them away from me and Logan is a genius."
Whoop, there it is.
"And there is the confession I was looking for," Jim said.
"I didn't confess anything," Dak said. "I just said that Logan and Carlos helped."
"Yeah, well I'm done asking questions," Jim sat down.
"Okay then," Judge Buick said. "I guess we'll go to closing statements."
"Wait, I want to call one more person to the stand," Bruce stood up.
"You've already had your turn," the judge said.
"Please, I have one more person to address," Bruce said.
The judge just looked at him.
"Fine," she sighed. "Make it snappy."
Bruce smiled politely.
"I would like to call Kendall Diamond to the stand," he smirked.
What is he planning? Kendall walked up to the stand cautiously and sat down.
"Kendall, I have one question for you," Bruce said.
"Obviously you do," Kendall nodded.
"What is your explanation for assaulting my client?"
Dead silence. Kendall even seemed a loss for words. I get what he is doing now. He's using the fact that Kendalll did hit Dak and Kendall's temper to try and get some kind of punishment inflicted on our side. This is why I told them to not attack unless they felt it was absolutely necessary.
"Assault?" the judge seemed interested.
"Yes, your honor," Bruce said. "It turns out that Kendall here decided that it was best to fight his problems."
Bruce handed her a file with pictures of Dak's face after James and Kendall beat his ass. He deserved it honestly and really it wasn't that bad, so he needs to stop being a whiny baby.
"And what do you say about this Mr. Diamond," the judge looked at Kendall.
"I plead self-defense because he put a gun to my face," Kendall said. "The same gun that he shot my pregnant best friend with."
"But can you prove that the gun was to your face?" Bruce asked. "I mean, we all know that you can be a bit hot headed."
See what I mean? He's manipulating the courtroom. He's trying to say that Kendall assaulted Dak for no reason.
"I felt threatened after he put the gun to my face, so I acted on it for my own safety," Kendall said. "I wasn't planning on killing the man or anything, I just wanted to protect myself."
"Okay, I've heard enough here," Judge Buick said. "Mr. Diamond, take your seat and let's move on to the closing statements."
Kendall quickly took his seat and Jim stood again to give his closing speech.
"Well, I think it is pretty clear to everyone in this courtroom what has happened here," Jim started. "If we take the long series of events from the time that Dak escaped to now, you can see that Dak was trying to scar the family emotionally and turn them against each other and their roles in society to be on the flip flop of the spectrum, but we've seen the evidence and we all know that Dak is guilty, and he should be properly sentenced that way," Jim took a seat.
Then Bruce stood up again. Ugh, asshole.
"I know my client has made mistakes, but that is all in the past," Bruce started. "He's ready to turn over a new leaf and turn a new life of freedom, free of any problems, drama, or crime. The plaintiffs are the ones that need a deeper evaluation as they prove to be manipulative and some impulsive."
He said that looking right at me. I will cut him…
"No matter what happens to my client, I just want the plaintiffs to be examined and properly taken care of also."
With that Bruce sat down.
"Well, without a jury present I am here to look at my notes and come to a decision," Judge Buick said.
With that, she got up and left, leaving us to wait in the courtroom; In this tense courtroom; in this very awkward courtroom. She came back a few minutes later though and that was kind of a relief. I want this to be over.
"I want to start with the plaintiffs," Judge Buick started.
I gulped. Uh oh. She's not supposed to pay attention to us.
"Even though you are the victims, you did break the laws, and that can't just go without punishment. Logan Mitchell, I am fining you 2500 dollars," she said.
"Fair enough, your honor," Logan nodded.
"As for you, Officer Mitchell, the way you handled this situation was in the best interest of your family, and it was an odd way to handle it and I commend you for thinking outside of the box, but you are to have the best interest of everyone at heart and this man is a danger to the community. I don't want to have to do this, but as an officer of the law, more is expected of you, so I am afraid that I am going to have to revoke your badge as police chief, and officer," she said.
I just stared at her.
"I'm not sure I understand," I said.
"Because of your actions, I am banning you from your job and you aren't to be involved with the LAPD for at least 15 years," she said. "You are to turn in your badge and turn from the force by Monday, understood?"
I'm pretty sure my heart just crushed. I can't be an officer anymore? I know I shouldn't have helped, but 15 years! I couldn't help but agree to it though.
"I understand," I nodded, trying not to cry.
I actually love my job and it makes me sad knowing that because of Dak, I won't be able to do it anymore.
"As for Kendall Diamond, I am ordering that you go to anger management classes," she said.
How come my punishment was way worse than Logan or Kendall's? I guess I can't complain though, I'm not in jail and that's what matters most. Anger management actually won't be bad for Kendall.
"Now for the defendant," she turned to Dak. "Dak Zevon, I'm sentencing you to 20 years in prison for escape from a federal prison, kidnapping, attempted murder, and abuse of a minor child, you're lucky I'm not taking away your parental rights."
"I can't be in jail for 20 years!" Dak yelled.
"Well, I could shorten it by 10 years if you give me the names of all of your accomplices," the judge said.
That got my attention. Please don't do that. Keep him locked up as long as possible. He wasted no time in listing off names that were being written down, but there was one that stuck out to me the most; Steve! He said Steve's name, Camille's husband.
Everyone turned around to look at Steve because he was in the court room. Even Camille was looking at him because I'm pretty sure she knew nothing about it.
"Excuse me?" Camille stood up.
"Dak!" Steve yelled. "How could you sell out your own best friend?"
"Because he has some common sense," the judge said.
"Camille, I can explain," Steve turned to her.
"I don't want to hear anything," she said. "How could you?"
"He's my best friend and he always has been, I couldn't turn my back on him," Steve said.
"So, you sneak around my back and break the law?" Camille asked. "We have a family."
"And I'm here for you and our daughter," Steve said.
"Not anymore," the judge said. "Step forward please."
Steve's eyes widened as he stepped forward.
"I'm being nice and only sentencing you to 5 years, only because you seem like a nice boy," the judge said. "Now as for you Mr. Zevon…I'm sentencing you to 16 years in prison."
"But you said you would shorten it by 10!" Dak stood up, at that point the guards grabbed his arm.
"I needed to get the names out of you," she said.
"But that isn't fair!" Dak said.
"This is my courtroom and I determine what's fair, now you can take the 16 or you can take the 20, or if you want to push me even further, we can shoot for life," she said.
"16 is good," Dak finally said.
"That's what I thought," the judge said. "Take them away; court ajourned."
They took Steve and Dak out and I kind of smiled at that. He was out of life once again. I hugged Logan and Jim.
"We did it," Logan smiled.
"Yeah," I nodded. "But I lost my job."
"It could be worse," James said. "You could be like Steve."
"Speaking of which," Kendall turned to Camille. "Are you okay?"
He pulled her into a hug, and the rest of us quickly joined in.
"I'll be fine," she put on a smile. "I just thought I knew him so well."
"Well, its best that he's getting what he deserves," Logan said. "He'll learn this way."
"Yeah, I'm more worried about you Car, you just lost your job," Camille said. "What are you going to do?"
"Move forward," I shrugged. "It's all I can do. I'm not going to get depressed about it, I'm going to focus on my kids and move forward."
"Yeah, and my job should cover us," Logan nodded. "We can do this, together."
That's true. Dak is back where he belongs, hopefully to stay for a while and maybe these things are opportunities for growth somewhere else. I don't really know, but I will find out soon enough, because I have my friends and my family by my side.
Yeah, kind of rushed the ending there, but this was really long! Let me know what you thought of the outcome. The story still has a few chapters left.
OMG, THE STORY IS GOING TO END SOON AND THEN IT'LL BE ON TO THE THIRD ONE AND THAT'LL END AND THE SERIES WILL BE OVER. I CANT HANDLE THIS! I JUST NEED TO BREATHE OR SOMETHING BECAUSE THIS IS CRAZY!
