A Fanfiction Writer’s Code of Ethics

A fanfiction writer’s story begins with a desire to change a pre-existing reality and mold it into a different one. That reality can be taken from an anime, book, cartoon, tv show, etc., and can become an entirely different one still based on the original source material. Rather than rules for writing fanfiction, this Code of Ethics serves as a guideline to help guide aspiring or veteran writers to making appropriate and ethical choices, based on the ethical principle of respect for intellectual property, the original source material, the relationship with readers, and the message portrayed. As fanfiction writers, we have no original content, not truly, and are always borrowing from one or multiple sources.

This Code of Ethics draws from the code of ethics of many other societies, as it seeks to establish a structural guideline on similar concepts of morality. Within this specific framework, fanfiction writing has a few unique guidelines with respect to the intellectual property of the owner’s of the source material, concern for worldly issues brought up within the modified work, the potential issues for expanding on the canon universe, and accountability to both the source and critics.

This code is not expected to provide guidelines for all situations. The world of fanfiction is ever growing and expands beyond the scope of this code where personal judgment will be required.

Obligations to Intellectual Property

A fanfiction writer recognizes that most, if not all, of the material in use for the creation of a fanfiction piece is already the intellectual property of another, and already exists within its own universe.

1. Respect to Intellectual Property

   1. Disclaimer

      1. An author’s note rejecting any claim to the original content of the original owners should appear somewhere in the fanfiction, usually at the beginning of the first chapter.

         1. Disclaimers for other fanfiction author’s when using their content should also appear, vis-a-vis intellectual property rights of § 1, Subsection C.

   2. Transitive Intellectual Property

      1. Though original characters (OC) and alternate universes (AU) belong to their respective fanfiction writers, the original source material still belongs to original owners.

   3. Extended Intellectual Property

      1. Original Characters

         1. Original characters (OC) created by a fanfiction author remain the property of the said author.

      2. Alternate Universes

         1. The alternate universes (AU) created by the fanfiction author remain the property of the said author.

   4. Monetary Revenue

      1. Fanfiction is entirely volunteer work and the groundwork for generating revenue for the work hasn’t been established.

         1. Monetization from or donations remains a contested principle among fanfiction authors, yet the principle for accepting money is taken under the same premise monetization of artwork of original content is accepted.

         2. If original owners take issue with monetization, it should be stopped immediately as legal action may occur.

Obligations to Source Material

1. Respect to Source Material

   1. A writer must remain true to the original universe, utilizing the existing fundamental rules of reality and the universe to shape any modifications performed.

      1. Else, the fanfiction becomes fictionpress and can no longer be categorized as fanfiction.

   2. All modifications to the universe must remain plausible within the confines of the universe.

      1. What is plausible is defined within the set rules of the universe.

   3. Use of canon characters over original characters is encouraged when working with a universe for the sake of continuity and frame of reference.

   4. The best work possible must be achieved as respect to the original material ie. delivered derived work must retain semblance to the original work

      1. If the work incorporates ideas outside the original scope of the universe, a proper announcement should be made in the blurb.

Obligations to Society

1. Respect to Readers

   1. Though fanfiction is inherently rougher than most original content, delivered content must be written to be reader-friendly with proper paragraph spacing, spelling, and grammar.

   2. Fanfiction should be properly categorized and marked for easy indexing within a host site’s search parameters.

2. Respect to Host Site

   1. Host site rules should be followed above all. They freely allow fanfiction writers to post their content online with no monetary payments to further the spread of fanfiction.

      1. If host site rules are ignored, proper and relevant warnings must be put in the fanfiction blurb.

3. Respect to Critics

   1. Fanfiction writers must accept reviews of their work as a means to improve their writing.

   2. Writers should listen to reviews.

4. Respect to Writers

   1. Cite the work of others when necessary (§ 1, Subsection C)

   2. Provide fair criticism of their work.

      1. Give praise where and when necessary.

5. Accountability

   1. An identifier must be used to distinguish the fanfiction author from others.

   2. Admit when mistakes are made and quickly make corrections

6. Development

   1. Fanfiction must develop either a different timeline or expand on the content not mentioned within the original universe.

      1. Novelizations are permitted as it’s a writer’s take on the original content.

7. Addressing Issues

   1. Call attention to issues within the original universe and attempt to address them.

      1. Else, take an issue from the real world and address it within the confines of the universe.
