Thor realizes Loki is not himself. Tony knows and has done work for Charles Xavier. He is also friends with Warren Worthington III. Steve keeps his promise to Erskine. These simple facts, among others, change *everything* when Loki comes to Earth and the Chitauri come calling, and what happens after.

When Loki fell from the Bifrost he was expecting the cool embrace of oblivion, not to become a spirit and then be ripped apart and forced into the mind of a six-year-old named Harry Potter. With no physical form, he must keep the boy alive if he seeks to keep existing, and everyone knows that the best way to ensure continued survival is to simply become greater than everyone else.

There are also hints of 'Muggles do it better', and more than a little crack, with the BDA being one of the most feared organizations on the planet, along with a bit of fun with Tom Riddle's 'You Know Who' pseudonym.
