Author's Note: Hello, hello, my readers! Welcome back to another chapter of Raise Me Up! First, I want to apologize for the delay in getting this chapter out to you guys! I wanted to finish the Kidnapping Arc in The Many Adventures of Iron Dad and Spider Son because I didn't want the wait between those to be too long. So, if you haven't read that yet, you can go check it out as that is the kidnapping incident I reference here in this story. Anyway, we are back with CHAPTER 26, and it is Peter's 16th birthday! It's his first birthday without May, so of course Tony and Pepper are going to make sure it's a special one! I hope you all enjoy it, but…before we get to that…REVIEW REPLIES!

Guest (Chapter 12): OMG, I'm sorry I made you tear up, but I'm glad you're enjoying it! Hope you continue to enjoy it!

Guest: (chapter 25): YES! GO SPIDER-MAN! And don't worry, he will eventually!

Kora (Chapter 14): Yesss! But keep in mind, Tony is Peter's legal guardian! Adoption is going to come up later.

Megan 844: Glad you love it!

Guest: Yup, Peter already learned what the Accords were, but I wanted him to get a full understanding as to why it's a good thing to have but that there is a reason why some of the Avengers were against it and why Tony wasn't completely on board.

SapphireRuby24:Yessss! I'm glad you liked that part! Peter is a smart kid, so he would understand the pros and cons of the Accords, especially since it could affect him later.

RosePetal7: Yup! Ross is an asshole, lol! But yes, he called his guardian for back-up! Our boy is learning! And yes, we have a long way to go so buckle up! Lol as for the storm…you'll have to wait and see!

Radiant Arabian Nights: Thank you so much, friend! I hope you continue to enjoy it!

Sillysammijo: Lol…well…you'll have to wait and see…

Chapter 26

It had been a couple weeks since Spider-Man and Iron Man's confrontation with Ross and since Ross informed Rhodey and Tony that he and the UN agreed to revisiting the Accords…only if Tony and Rhodey continue to follow the Accords as they were currently written. Not only that, but they also had to convince King T'Challa of Wakanda, Clint Barton, Scott Lange, and the Vision to agree and to support them and to sign the new ones and to do a press conference in December drawing out the other Rogues. After that, things had been quiet for Peter, Tony, and Pepper. Peter and Tony began working on the possible changes for the Accords with Rhodey. They agreed to lay out the changes first before they would go looking to smooth things over with the two Rogues, and they agreed to take a break on this particular day.

However, Peter almost wished that they were working on the Accords as he woke up that morning…on August 10, 2017…his 16th birthday. The Accords would've been the perfect distraction as this was his first birthday without May. He thought that after Ben's death, he would be used to all the firsts after a loved one died—first birthdays, first holidays without them—but it seemed to hurt even more with May being gone. He slowly opened his eyes as the tears formed while he remembered all the birthdays that he got to spend with May and Ben…how they always tried to get off from work to spend the day with him since it was over the summer. May would come into his room to wake him up singing "Happy Birthday." They would later cap off the night with cake and presents, and his heart ached knowing that those birthdays were now only memories. Yes, he was going to get to spend his birthday with his new guardian Tony, Pepper, Rhodey, Happy, and Vision, but it wasn't the same. He felt bad for thinking that, but he couldn't help it. He missed her with all his heart.

The teen sighed closing his eyes letting the tears fall. "I miss you so much, May," he said. "I wish you were here."

Of course, his prayer was met with silence, but that didn't last long as there was a knock on the door.

"Pete, it's me," he heard Tony say. "Can I come in?"

"Yeah, sure," Peter replied.

The door opened, and he heard Tony walk in.

"Hey, kiddo," the billionaire said as he perched himself on Peter's bed placing a hand on his back. Then he began to sing…

"Happy Birthday to you…"

"Happy Birthday to you…"

"Happy Birthday, dear Peter…"

"Happy Birthday to you…"

Peter couldn't help but smile with tears in his eyes. "T-Thanks, Tony," he said.

Tony couldn't help but smile in return, but then he noticed the tears in Peter's eyes. "What's the matter, bud?" he asked. "Was my singing really that bad?"

Peter laughed and shook his head. "No, no, your singing was fine," he said laughing with tears in his eyes. "It's just…I was just…well, before you came in…I was thinking about…about May."

Tony made a sad, knowing smile. "Come here," he said pulling Peter up so that he sat up and into his arms embracing him. "My kid needs a hug."

Peter wasted no time in hugging Tony in return burying his face in his shoulder allowing the tears to fall freely. "I-I'm sorry," he said. "I-I don't mean to sound ungrateful or—"

"Shh…no apologies, kid," Tony said softly rubbing his back soothingly. "You have every right in the book to be sad. I know it's not the same without her, and it's okay to miss her on your special day. But I promise you, we're all here for you, and we're going to do everything we can to make this birthday special for you. She'll be here in spirit. We won't see her, but one way or another she'll be here with us."

Peter nodded as he kept his face in Tony's shoulder. "It's not the same," he said.

"I know," Tony said rubbing his back. "I know, buddy. I wish I could do more, bud. I wish I could bring her back."

"Believe me, Tony," Peter said hugging Tony just a little tighter, "you being here is enough. You, Pepper, Happy, Rhodey, and Vision all being here is enough. I don't mean to sound like I'm expecting more."

"It's not, bud," Tony said pulling away so that they were looking at each other. "It makes you sound human. I'm an adult, and there are days where I miss my mom and want her back. You wanting May back is perfectly normal, okay?"

Peter nodded. "Okay," he said with a small smile.

"Okay," Tony repeated. "Now, we're going to do exactly what May would've wanted and have a lot of fun today, and if you have a moment where you want to slow down and take a minute, we'll do that, okay?"

Peter nodded again.

"Good," Tony replied, "now, why don't you get dressed and come into the kitchen for breakfast? We have some birthday festivities today…including getting a certain birthday boy his learner's permit."

Peter smiled as he realized that Tony was right. It was his 16th birthday, which meant that he was legally ready to get a driving learner's permit. He had to take the written test, and of course he had been studying for the past few weeks or so. Tony and Rhodey had been trying to tell him not to worry too much about it and that it was an easy test, but Peter refused to be swayed and studied as hard as he could for the test. Now, today was the day he would take the test and hopefully pass it, so that Tony and Pepper could teach him how to drive. "Okay, I'll be out soon," he said.

Tony smiled in return before standing up and walking toward the door.

"Hey, Tony?" Peter said.

"Yeah, buddy?" Tony asked.

"Thanks," Peter replied with a smile.

"You're welcome, birthday boy," Tony said before walking out of the bedroom.

As soon as Tony left Peter alone, he practically jumped out of bed to shower and to get dressed. Once he was ready and freshened up, Peter walked out of the bedroom and was met with a birthday breakfast—made by Tony of course—consisting of pancakes, eggs, bacon, hash browns, and fruit…all for him. As soon as he sat down, his phone vibrated, and he took it out of his pocket and saw that it was a text message from Pepper.

"Hey, sweetheart! Happy Birthday! I'm sorry I had to work, but I promise I'll be back as soon as I'm done by the time you get back. Good luck on the permit test!"

Peter smiled as he typed back…

"Thanks, Pepper! Can't wait for later! Hopefully, I'll have good news later!"

"I'm sure you will! You'll knock it out of the park!"

"Is that Pepper?" Tony asked with a smile.

"Yeah, she wished me a happy birthday and good luck on the test," Peter replied as he sat down at the counter. "I'm still a little nervous though."

"Don't be," Tony said as he put the food on Peter's plate before doing the same to his own plate. "You're going to be just fine. You studied—even though Rhodey and I told you that it's going to be okay. You're a smart kid. Now, come on, I want all of this to be eaten. The birthday boy needs to feed his big brain."

"You're going to call me 'birthday boy' all day, aren't you?" Peter asked with a smirk and a raised eyebrow.

"You bet I am," Tony said with a smile of his own. "Now, come on, eat, birthday boy."

After a hearty breakfast, Tony and Peter grabbed the car and drove off to the DMV to get Peter to his appointment. Thankfully, they left early to give themselves enough time and arrived just in time for Peter to take the test. After checking in, Peter went into a small room while Tony promised to wait outside. So, Peter went into the room and saw the DMV agent setting at the front of the room and a few other kids sitting at small desks already taking the test. He took a deep breath and walked over to the agent.

"Hi…umm…I'm…I'm Peter Parker," he said. "I'm—"

"Your test is on the desk," the DMV agent said in a deadpanned tone not even bothering to look at him. "Sit anywhere and begin the test. When you're done, bring it back here, and I will tell you if you passed or failed."

"Okay, okay, right," Peter said as he took a deep breath and sat down at a desk in the front row. He wasted no time and began the test. He was pleasantly surprised at how easy it was, and he couldn't help but feel relieved at how Tony and Rhodey were right. Then again…maybe he was grateful that he studied. Nevertheless, he continued to answer the questions.

Tony twiddled his thumbs as he waited for the next 30 minutes. He wasn't nervous at all for his kid. He just couldn't help but think about how Peter was that morning…how sad he was that May was not with him for his 16th birthday. He didn't blame him at all. Tony remembered feeling the same when his parents died before his birthday and holidays. He wanted to make sure that Peter knew it was okay to miss May but to also make new memories on his birthday. Both he and Pepper agreed to do everything in their power to make this birthday special for their kid, and in doing so, they came up with a plan that was about a month in the making. He jolted out of his thoughts when he felt his phone vibrate, so he took it out and saw that it was a text message from Pepper.

"How's it going? Did he come out yet?"

Tony smiled as he texted back. "So far so good. He was a little melancholy about May this morning. Waiting for him to come out."

"Okay, we knew that would happen. The party will cheer him up. Ned and MJ just got here with Happy."

"Perfect! I don't think he suspects anything. You packed our bags for the night, right?"

"I did, don't worry. What are you telling him?"

"I'm going to say that Rhodey needs us to go to the Compound to give him a gift and to talk about the Accords."

"Perfect! Can't wait to see you both. Text me when you're on your way."

"Your wish is my command, dearest. Can't wait! Let's make our birthday boy happy!"

"Absolutely!"

"Tony!"

Tony looked up at the voice calling out to him and saw Peter walking over to him with a paper in his hands. He couldn't help but smile when he saw that Peter was trying to fight off a smile of his own. He stood up from where he sat as the teen walked over. "Well?" he asked.

"I passed!" Peter said excitedly. "I did it! I passed!"

"Hey, congratulations, kid!" Tony replied pulling Peter into a hug.

Peter returned the hug with just as much excitement. "Thanks, Tony," he said. "Oh man, this is so great! I'm finally going to be able to learn how to drive!" His face fell when he realized that…there was a certain someone missing.

Tony felt him deflate in his arms and pulled away so that he was looking at him, but it didn't take long to figure out what it was. "She would be very proud of you, buddy," Tony said smiling.

"I just wish she was here too," Peter said sadly. "I mean…when the three of us talked about today…she…she said that the three of us would come here."

Tony nodded knowing exactly what Peter was talking about. A few months ago…before May died, the three of them—May, Peter, and Tony—went out to dinner one night after the kidnapping incident, and they somehow got onto the subject about Peter needing a learner's permit and how he could take the test on his 16th birthday. Both May and Peter proposed the idea that all three of them could go to the DMV on his birthday together so that both May and Tony could support him. Of course, Tony was more than happy to accept the invitation, but now that May was gone…the trio was now down to two. "I know, bud," Tony said pulling Peter in for another hug. "I wish she was here, too, but I promise you…she's with us. And I have no doubt she's so happy for you."

Peter hugged Tony just a little tighter. "I'm really glad you're here, Tony," he said.

"Hey, what are guardians for?" he said smiling. He couldn't get over how much he loved Peter…how proud he was of him…how much he wanted to protect him, and he wanted to tell Peter. However, he knew a DMV wasn't the best place to admit that. It would have to wait especially while Peter was feeling the loss of his aunt. "I'll always be there for you, Pete…no matter what." He and Peter hugged just a little longer just before he pulled away. "Not that I don't love our hugs, buddy, but…we really should get going. We have birthday business to attend to."

Peter chuckled. "Okay, let's go then," he said before Tony led him out of the DMV. "I want to tell Pepper the good news anyway."

"Well, we'll have to call her," Tony said as they walked out. "I got a call from Rhodey while you were taking the test. He wants to see you for your birthday and take care of something with the Accords, so we'll have to go to the Compound for a bit. Is that okay?"

"Oh yeah, it's totally okay," Peter said with a smile. "You know I would love to see Rhodey and Vision and to work on the Accords."

"It won't be too long on the Accords," Tony said as they walked to the car. "If anything, it's just to see you and give you a gift."

"Oh, no…he…he doesn't have to give me anything," Peter said quickly. "No one has to give me anything really."

"Kid, relax," Tony said as they got into the car, "it's your birthday. You have every right to get gifts on your birthday…especially from the people who love you…your friends…your family."

Peter couldn't help but smile hearing Tony refer to himself, Pepper, Ned, MJ, Vision, and Rhodey as people who loved him. He cared about them. He loved them too, but he never really found the appropriate time or place especially after May's death. He hoped that he could find the time eventually. "Thanks, Tony," he said.

"You're welcome, kiddo," Tony replied with a warm smile as he pulled out onto the street.

The ride to the Compound took about two hours for Peter and Tony to arrive, and thankfully, Tony sent a quick text to Pepper that they were leaving the DMV. To keep the charade going, Pepper called her fiancée and their ward to ask about the test, and once Peter told her the news, she was elated and promised that she will give him the biggest hug when they got home, which Peter looked forward to. As much as he was excited to see Rhodey, he couldn't wait to see Pepper either. He really wanted to show how much he appreciated what she and Tony had done for him for the past two months since May died…how much he loved them…not just for the past two months, but for everything they had done and been through together ever since he and Tony met. They had truly become a family, and he loved every minute of it and them of course. It wasn't necessarily telling Tony that he saw him as a father figure…just that he saw them all as a family…his family.

Soon enough, the Avengers' Compound appeared on the horizon, and Peter couldn't help but think about how the last time he, Tony, and Pepper came was on the 4th of July. It was only one month ago, but it felt much longer than that. Now, they were in the month of August meaning that the end of summer vacation was fast approaching. That was always the downside of having a birthday in August. It always meant that the first day of school was right around the corner, but he shook his head to rid himself of that thought. The teen refused to focus on that for now. It was his birthday, and he was going to enjoy himself just as May would've wanted.

With that thought, Tony finally pulled up to the front of the Compound and parked, and Peter and Tony wasted no time in jumping out of the car and making their way inside.

"Did Rhodey say where to meet him?" Peter asked as he and Tony walked inside.

"I'm just about to text him," Tony said as he took his phone out of his pocket and texted Pepper.

"Just got here! Are you ready? Where are you?"

Thankfully, Pepper responded. "Come right outside! We're all waiting there!"

"Okay, bud," Tony began, "he just texted me. He's right outside. Want to go out?"

"Sure!" Peter replied as he followed Tony through the first floor of the Compound. "But why aren't we meeting in the conference room?"

"Because then it would ruin the surprise," Tony said with a smirk as he opened the backdoor allowing Peter to walk through first.

Peter furrowed his eyebrows together as he walked out the door looking at Tony with great confusion, but before he could do anything else, he looked in front of him only to see…

"SURPRISE!"

He widened his eyes and smiled at what was in front of him. He saw Pepper, Rhodey, Happy, Vision, Ned, and MJ clapping and cheering. "Happy Birthday," and they were all standing under a large white tent. There were presents on a table nearby and a table of food clearly set up by caterers.

"W-What…what…?" Peter tried to ask with a huge smile on his face. "What is this?"

"What do you mean?" Tony asked as he wrapped an arm around Peter. "It's your birthday party."

"This is all for me?" Peter asked with widened eyes.

"It sure is," Pepper said as she walked up to Tony and Peter and hugged Peter tightly. "Happy Birthday, sweetie!"

"Thank you, Pep," Peter said as he hugged her in return.

"You're welcome," she said as they pulled away.

"Hey, don't forget us, loser," another voice said from behind Pepper.

Peter looked only to see MJ and Ned walking up to him and wasted no time in pulling his best friend and newest friend into a group hug. "I could never forget you guys," he said. He quickly pulled away as he realized that MJ and Ned were with him at the Compound. "Wait, h-how did you guys get here? When did you guys get here?"

"Stark called our parents a few weeks ago and set the whole thing up for your birthday," MJ replied with a smile at Tony.

"Yeah, and Happy drove us up here this morning," Ned added. "We wouldn't miss this for the world, dude. Plus…we're at the Avengers' Compound…with Iron Man, Pepper Potts, War Machine, and the Vision! I mean…dude!"

"Dude, will you chill?" Peter said chuckling. "It's not that big of a deal."

"To you, no," Ned replied. "To me, it is!"

Peter laughed and shook his head before looking to Rhodey. "So, I guess you didn't want me and Tony up here to go over the Accords?" he said smirking and raising an eyebrow.

"Yeah, right, like I would bore the birthday boy on his special day," Rhodey said as he pulled Peter into a hug. "This day is just for celebrating you."

"Wait, you're helping with the Accords?" MJ suddenly asked.

Peter widened his eyes slightly as he turned to MJ realizing that he never fully explained that he had been helping Tony and Rhodey with changing the Accords, which clearly must've sounded weird to her since she still didn't know that he was Spider-Man. "Uhh…y-yeah," he said, "I-I am. You know, just to help with some of it and…and…y-you know…learn about them, that's all."

MJ furrowed her eyebrows together as she eyed Peter suspiciously but didn't say anything, which made Peter even more nervous. However, he was quick on his feet and turned to Happy and Vision. "Uhh…Happy, Vision, you guys are here, too," he said with a smile.

"Of course, we are," Vision said as he and Peter shook hands. "Happy Birthday, Peter!"

"Thanks, Vision," he said before turning to Happy.

"I drove your two buddies up," Happy said with a smile. "I had no choice."

"Aw, come on, you know you love me," Peter said with a smile of his own before he hugged Happy.

"Eh, I guess you're okay," Happy replied as he returned the gesture. "Happy Birthday, kid."

"Thanks, Happy," Peter replied. He then turned to Tony and Pepper, who were standing there watching him and smiling. "I can't believe you guys did this all this for me."

"Hey, it's your 16th birthday," Tony said as his smile widened. "After everything you've been through, you deserve it, and I know May would agree with us on that one. I told you we would make this birthday memorable."

Peter felt tears form in his eyes as he pulled his guardian and his guardian's fiancée into a group hug. "Thank you…" he said. "Thank you so much, guys."

"You're welcome, Peter," Pepper said kissing him on the top of his head. "Happy Birthday."

"Happy Birthday, kid," Tony said. He looked over Peter's shoulder at their party guests noting how they were all smiling at him and his family. "Well," he pulled away, "I don't know about you guys, but I'm ready…to get the party started!"

"Oh, hell yeah!" Peter said happily. "Let's do it!"

The party officially started without a hitch! Tony and Rhodey of course manned the barbeque while Pepper, Happy, and Vision mingled with Peter, Ned, and MJ. Fortunately, Pepper knew how to keep three teenagers occupied with party games like Twister, water balloon fights, the elephant game, and knocking down cups stacked in a pyramid. The whole afternoon was filled with laughter and good, and Peter loved every minute of it. There were a few moments where he felt melancholy when he found himself looking for May only to remember that she wasn't there. However, there were times where he looked up at the sky or felt a soft breeze, and then he remembered what Tony said…how she was with them in spirit.

Finally, before the cake, Tony and Pepper decided that it was time for Peter to open his presents. So, Peter sat on the ground while everyone sat around them and watched him open his presents. Ned gave him a brand-new Star Wars Lego set for them to build together. MJ gave him a sketch of May in a frame, which brought him to tears as he hugged them tightly thanking them. Rhodey gave him more T-shirts with science puns, and Happy gave him some engineering and science textbooks. Vision gave him a chess set as well as an offer to play with him sometime.

"Aw, man, this is awesome," Peter said as he put the gifts aside. "Thanks for the gifts, everyone!" Although he couldn't help but notice that he didn't see any gifts from either Tony or Pepper, but he wasn't going to worry about it. They already gave him this amazing party and were taking care of him after May's death. He could never expect anything more. "Hey, Pepper, maybe we could—"

"Ah-ah, hold on one second, birthday boy," Tony suddenly said. "There's still one more gift…from Pepper and me." The billionaire then pulled an envelope out of his pocket and gave it to Peter.

"Aw, you guys didn't have to get me anything," Peter said with a smile. "You're already taking care of me, and you already gave me the party."

"Pete, it's fine," Tony said. "It's your birthday. You deserve to be spoiled."

Peter's smile widened as he took the envelope and saw his name written on the front in Tony's handwriting. He gave one last look at Tony and Pepper before opening it. When he opened it, he saw a folded piece of paper inside and took it out unfolding it, and his eyes widened at what he saw on the paper.

"Dude, what is it?" Ned asked excitedly.

"Uhh…it…it's a house…a really big house…in…" Peter read the information under the picture, "Malibu, California." He then looked at Tony and Pepper with widened eyes. "Are we going there?"

"We sure are," Pepper said with a huge smile on her face. "Tony bought it for us about a month ago. Think of it as our summer home."

"Seriously?!" Peter asked excitedly with a smile. "W-When are we going?!"

"Next Friday, August 18," Tony said with an even bigger smile. "We're only going for the weekend because of everything with the Accords and Ross, but I promise we'll be able to go for longer afterwards. For now, it's a weekend with just the three of us. Think of it as one last hurrah before school starts."

"Oh my god…" Peter breathed, "y-you didn't have to do that."

"Pete, it's okay," Tony replied. "We want to. We want to spend time with you…as a family, and that includes going on family vacations."

Peter felt tears form in his eyes as he wasted no time in getting up and running over to Tony and Pepper hugging them tightly. "Thank you, guys," he said. "Thank you so much."

"You're welcome, buddy," Tony said before kissing the top of Peter's head. "We love you, kid." He froze when Peter stiffened in their arms and when he saw everyone staring at them, and Tony felt his heart begin to pound worrying that he ruined the mood…or even overstepped boundaries.

However, Peter pulled away and looked up at Tony and Pepper with a smile. "I-I love you guys too," he said. It felt like a weight had been lifted off his shoulders as he finally told Tony and Pepper that he loved them and that he finally knew that they loved him too.

Pepper was about to say something else when Rhodey interjected.

"Okay, not that this love fest isn't heartwarming," he said, "but I think that there's a whole group of people here who want cake, especially the guest of honor."

"Settle down, honey bear," Tony said rolling his eyes. "We'll get to that because honestly, I am craving some cake, too."

"Me too," Peter said with a smile.

After singing "Happy Birthday" to Peter and enjoying a delicious cake Pepper ordered, the crowd began to break up. Thankfully, Ned and MJ's parents agreed to allowing their kids to stay overnight with Peter, so Pepper set up some rooms for them. Rhodey showed them the way with Vision and Happy following suit leaving Pepper, Tony, and Peter alone in the common room.

"Guess we should hit the hay, too, huh, kid?" Tony said. "We'll have to drive back to the city tomorrow."

"Yeah, I guess," Peter said as he stood up. "I just don't think I'll be able to sleep tonight. I mean…the test…the party…the trip to Malibu. I-I just don't want it to end."

"I know," Pepper said, "but we're going to have many more birthdays together, I promise."

Peter smiled before pulling Pepper and Tony into another hug. "I love you guys," he said before pulling away, "and not just for today, you know? I-I mean like—you know—family and—"

"It's okay, buddy," Tony replied smiling. "We know, and we love you too."

Peter smiled again. "Thanks again, guys," he said, "for everything. I can't wait for this trip."

"Good, because we can't either," Pepper said with a smile. "Now, why don't you go get some sleep? Tony and I will be right there in a minute."

Peter nodded before giving them one last hug and leaving them alone.

As soon as they were alone, Pepper and Tony looked at each other and smiled hugging each other.

"We did it," Pepper said.

"We sure did," Tony replied.

He was right by what he told Peter. Everything was falling into place…one day at a time. They gave Peter a great birthday party, and they told him how much they loved him. Not only that, but Peter told them that he loved them too. They were truly becoming a family, and Tony loved every minute of it.

Peter smiled as he settled into bed thinking about the day he had with his friends and family. His smile widened at the thought of his family. Tony and Pepper gave him an amazing party and an amazing gift. He was going to spend an entire weekend with them in Malibu. He would get to see where Tony lived before he came to New York. Not only that, but they—Tony specifically—told him that they loved him, and he told them as well. Slowly but surely, they were becoming a family, and Peter loved every minute of it.

"Thank you, May," Peter said to himself. "I wish you were with me today, but I know Tony was right. I felt you today, and I'm so glad you made Tony my guardian. But don't worry. I'll never forget you or Ben or Mom or Dad. I love you guys, too."

With that thought, he fell fast asleep.
