When Emily woke up and was still in pain the doctor covering Dr Green decided to keep her in over night and rescan with Ed in the morning. Gibbs stayed through to the afternoon to allow Tim to get some fresh air and go for a walk while he sat with Em. Luckily, Jethro was collected by the dog walker and dropped at the kennel.

Gibbs headed into the office and when he got there, he filled Tony and Ellie in on exactly what was going on with Emily. He got Tony to order a delivery from the diner to them for dinner so they didn't have to eat hospital food. Ellie said she'd make a couple of freezer meals for them tonight to get them through the next few nights.

"Yeah, Gibbs" he answered his cell, not his desk phone.

"Yeah, it's me." Tobias announced. "I'm at Dulles. What is she? What hospital and where?"

"Calm down, I left there an hour ago and she was resting. Everything is ok." Gibbs tried to reassure him. "I heard it straight from the doctor's mouth." He heard Tobias exhale of sigh of relief. "It's mostly round ligament pain. The bleeding is beginning to ease up."

"What can they do for that?"

"Other than Tylenol, I don't think you'll like the treatment." He laughed awkwardly.

"Whatever it is, if Emily gets relief it's worth it."

"Oh no, I'm not telling you what it is. You want to know, you can ask her doctor yourself." Gibbs said in self-preservation mode. "I want plausible deniability." He laughed. Gibbs told him exactly where she is in the hospital and what hospital she was in.


Tobias made his way through Georgetown Med to the Maternity wing, giving his name and showing his FBI credentials before a midwife immediately took him through to his daughter. As expected, she was sleeping. He wasn't expecting to see her asleep in Tim's arms. Tim was holding his daughter's hand, protectively across her abdomen and stroking her forehead with the back of his other hand.

"Hey kid," Tobias whispered. "How's she doing? I got here as soon as I could."

"Hey, the nausea and dizziness has eased." Tim said through a yawn. It had been a long day already for them. "The pain is still there, but in the last hour she's started a fever and sweats. Tylenol is taking care of it, which is good. They have taken more blood to check for sepsis and infection. Our doc is on his way back in." It warmed Tobias' heart to hear Tim refer to Emily's doctor as 'our' doctor. It reinforced his opinion that Tim was planning on being there for the long haul.

"Did you want to go get some air or go home and have a sleep? I'm happy to stay for a bit." He offered, honestly Tim looked drained. He probably needed to have a stretch too. He and Emily were cramped into the double bed. He knew Tim slept on a cali king bed and could clearly see he was curled up to fit his six foot two inch tall frame onto the smaller bed.

"As soon as the doc has been, I'll head out for some air. It'll give you a chance to fuss over Em for a bit too."

The doctor came by with positive news from all the test samples earlier - being found clear of STI's was good news and the bloods showed no sign of infection. Tobias got to stay while Ed did another scan to check the progress.

"What can Emily do for pain, besides the Tylenol?" Tobias asked Ed as he was followed him out into the hall, preparing to make a call to his SFA for a case update.

"Do you really want to know? As a father, if my daughter were Emily's position, I'd prefer not to know." Ed asked.

"Doc, my daughter is pregnant with her rapist's child. Anything to help her cope with the pain, can be helpful right now."

"As I explained to Gibbs and Tim, some women find massage helps. But most women swear an orgasm is better than any pain relief available, multiple orgasms apparently are preferable."

'Well, holy fuck!' Tobias thought, sputtering in shock. "Right, thanks Doc. I'm sorry I asked. Could have just said, as a dad, there's nothing that I can do."

"Sorry Mr Fornell, Tim and Emily have embraced my straight up attitude."

"Normally, I'd be all for it too. But it's my daughter… and I'm still not 100% sold on her dating Tim. I've known the man for over a decade too!" He ran his hand through his hair, sighing in frustration too, leaving the doctor to his other patients.


Deciding to break Gibbs' balls first, when he called Gibbs, he barely let Gibbs greet him before interrupting the man. "Thanks for the heads up on the treatment plan, you prick!" He laughed.

"Told ya, ya wouldn't like it?!" Gibbs retorted.

"No shit! Caio!" Disconnecting the call from Gibbs, making him immediately feel better about the situation.

"Go get some rest, kid. I'll fuss over Em for a while. I think it's time we exchanged our personal numbers, seeing as how you and Em are …"

"Yeah." Tim finished for him. Quickly they exchanged numbers and Tim reassured him he'd be back by twenty one hundred hours to relieve him for the night shift.

"Tim?" Tobias asked as he said goodbye to Emily and promised he'd be back soon. "I promise you, I will call if something happens. You won't miss anything. Go grab some rest. I'm all knowing like Gibbs, I'll know if you don't."


Tim struggled to rest, sleep a wink, he'd called Tobias four times for an update already and Tobias has threatened to turn his phone off. Finally, when the fifth call came in he rejected it and calls Gibbs, begging the man to go to Tim's apartment and knock him out, or he willingly.

Gibbs arrived at Tim's apartment, to find Tim pacing the floor. He was on hold with the hospital operator, waiting to be connected with the maternity ward. Gibbs took his cell phone from his hand and ended the call. "She's fine Tim." Gibbs said patting the man's back in comfort, before pulling him into a hug. "You need to trust Tobias to call you if something goes wrong." Gibbs tried to calm him down.

He poured a generous glass of the first liquor he found in the kitchen, issuing a silent order to drink. "What's bothering you the most, son? Talk to me. "

"Guess, I'm just worried, is all." Tim mumbled after a few sips. "She might need me and I won't be there."

"Perfectly understandable, but you're no good to her like this."

He could tell Tim was beyond exhausted and on his way to being drunk. Tim was a featherweight with hard liquor. He always got 'chatty' when he was this tired and if he got this tipsy this quick, then he definitely needed more than a few hours sleep. Tim's privacy walls always crumbled when he was like this. It was how Gibbs became privy to the bulk of the information he actually knew about his agent, Tim was a highly private person. But mostly, Gibbs knew that Tim was a drunk caller where he was also 'chatty'. Gibbs had received a few drunk calls from his agents. Both his boy's love to drunk dial.

"Sounds like you're falling for her." Gibbs decided to bring the subject into the open., in hope to help the young man sort his feelings out.

"Hard and fast." Tim answered his boss and father figure with a pleading look. "We've been good friends for so long. Scared to tell her. Know she loves me, boss."

"Didn't know that." Gibbs answered, surprised. "How long ya been friends?" He asked, as both he and Tobias didn't know they'd been friends and were curious as to why Emily sought Tim's support in the first place.

"Oh years, yeah." Tim slurred. "She … she … and I … we've had a thing before. Years ago. She … broke m' h..rt, b..ssss. She didn't w…want meeee."

"Ok Tim, time for bed. Come on, let's go. Up you hop." He jostled his agent up, hoisting him to his feet before leading him to his bed. Once he manoeuvred Tim's lanky frame onto bed, he took his shoes and pants off him, as Tim began to zone out.

"Remember me, Ziva and Tony headed to that club for Tony's birthday and Tony called you to the club coz he lost me?" Tim asked, suddenly upright again. Gibbs took advantage of the man upright and removed his button down shirt, leaving him in his boxers. Gibbs remembered the night in question clearly. It was almost five years ago now. He'd tracked down his agent three hours later, asleep in his bed, at his apartment in Silver Spring,with two women… with a naked redhead and an equally naked ebony skinned exotic, looking woman.

"Yeah, what about it?" Gibbs smirked, the smile not quite reaching his lips.

"Gotta call Tony and tell him the truth. Gotta say s..ry, m..ss..d da parrrty." he began slurring again and Gibbs lowered Tim back onto bed.

Gibbs never actually let on to any of them, even Tim, that he knew about the two women, but he had been in awe of his young agent, that night. "The truth? You sure?" Gibbs actually smiled that time.

"Had myself a threesome with two girls." Tim said proudly. "You ever had one? It's fun."

"A threesome?" Gibbs asked in disbelief that his agent and the man who was like a son to him, was actually asking that question. Silently he laughed to himself, at the absurdity of this conversation.

"Sure," Tim slurred his voice again and Gibbs' thumb began rubbing his eyebrow trying to put the young man to sleep. "Wait!" He bolted, upright again. "Have to tell Tony!" He snuffled through his sleepy, alcohol induced haze.

"Call Tony tomorrow, son." Gibbs said as Tim lowered himself back to bed and finally drifted off to sleep.

It had been three weeks ago, he'd noticed that Tim had needed some downtime. That he was almost running on empty. He'd been working full days and nights, coming in on weekends and on calls, taking cases home and taking care of Emily, plus the emotional burden of doing that solo, not to mention the traumatic memories that Emily's rape stirred up in him. "Just sleep Tim." Snatching Tim's phone and the charger up, he took them with him as he left the room, setting them up on the island bench.

Gibbs made himself at home in the apartment, grabbing a blanket and pillow from the closet. He poured himself a glass of bourbon that Tim kept there for him and settled in for the night on the sofa. Wasn't the first time he'd had to step in for one of his 'boys' like this.


Calling Tobias, was the easy part of the night. Keeping Tim asleep, the whole night always proved difficult. So he needed to call his friend before he forgot. "Yeah, you got Emily the whole night!" Gibbs said as soon as Fornell answered softly.

"Yeah, how'd you swing that? Reason with him." His friend asked.

"Tim is innately stubborn." Gibbs chuckled. "You can't reason with him."

"If I didn't know better, I'd say he gets that from you." The FBI agent stated.

"Ya think, Tobias? That stubborn streak gets wider every year." Gibbs' frustration growing at Tim's stubbornness.

"Gonna have to teach me how to work that streak, Gibbs. Looks like the kid's serious about being with Em for the long haul."

"Yeah, he is." Gibbs confirmed. "By the way, he is like me. You can't work that streak!"

"Damn it, Gibbs" Fornell sighed, frustrated, as Gibbs chuckled again.

"Zero, eight hours tomorrow."

"Bring coffee!"


True to previous times he'd stepped in, Tim had come out looking for his phone without opening his eyes. "Back to bed, Tim. Come on." Gibbs coaxed gently.

The second time was for a bad dream and Gibbs wordlessly held him as he cried and grieved for whatever or whom ever he'd dreamed about.

The third time was to find his cellphone again. He kept telling Gibbs to call Tobias, that Emily was missing.

That was the final straw for him, Gibbs grabbed his blanket, pillow and made himself at home on top of the covers on Emily's side of Tim's bed.

Tim finally slept the rest of the night through. Peacefully. So did Gibbs.


The morning found Tim awake, wondering why Gibbs was on his bed, next to him.

"Umm, good morning." Tim greeted and Gibbs smiled at him.

"You remember anything 'bout last night?" Gibbs asked teasingly.

"Oh no, I was supposed to go back to the hospital." Tim worried. "Fornell's gonna kill me."

"Nope, you needed the rest. Tobias is there with her." Gibbs reasoned.

"Had to give ya some bourbon and ya went out like a light, until you kept getting up drunk."

"Did I call anyone?" Tim asked, looking mortified. He knew he was a drunk caller.

"Nope, but if ya remember what ya want ya wanted to call Tony about, can I be there when you tell him?" Tim was horrified. He couldn't remember anything, but he knew what secret he'd been keeping from the senior agent.

"Nope! Not happening!" Tim said defiantly, closing his eyes in humiliation.

"So you remember, then?" Gibbs laughed out loud at him.

"Nope, but I know my own secrets." Tim reasoned, hoping Gibbs was bluffing and didn't really know anything.

"Your secret's are safe with me." The older man promised.

"Oh God, you know?" Tim groaned and pulled the duvet over his head, embarrassed.

"I've known the whole time. Tony had me looking for you that night." Gibbs admitted. "Tony was worried about ya. He sent me looking for ya. Saw ya all."

"Oh so, you know who they are then? Just great!" Tim asked sheepishly. He was preparing for a Gibbs slap at most, lecture at worst case.

"Didn't see their faces, they were sleeping on their stomach's." Gibbs said and he watched Tim sagged in relief, as now Gibbs' curiosity rose.

"Thank god." Tim sighed in relief. "Well it seems I owe you breakfast and coffee. If I keep you caffeinated and fed, you can't tell anyone." Tim offered, getting up out of bed.

"I'd be more worried about me telling Tony what you asked me last night." Gibbs teased and got up himself to start their day.

'Oh no' Tim banged his head against the wall. 'I'm never going to survive this.' He thought.


"Hey, how you feeling Swe- Emily?" Tim asked as he and Gibbs entered her hospital room, almost calling her sweetheart automatically. He was contemplating buying some flowers, but settled on that fancy herbal tea she loves that looks like a flower in a cup.

"I'm feeling ok, but twingy but the midwife said that's ok." She grabbed Tim by the front of the shirt and pulled him into her, kissing him sensually. Both older men cleared their throats, reminding them that they weren't alone. "To be continued." She promised, kissing him hello again and taking the offered coffee.

"Don't think it's McGee you need to worry about taking advantage of Emily, there." Gibbs teased Tobias, handing him the breakfast bagel Tim had bought for him. "Maybe I should worry about Emily taking advantage of Tim."

"She's already pregnant, what's the worst that could happen?" Tobias retorted in jest. Both men looked up at the young couple kissing, and cleared their throats.

"You two aren't alone. I'll be able to accept it a whole lot easier if I don't have to see so much of it." Tobias reminded them both, as he took his leave to check in with his team. Emily smiled at her Dad and poked her tongue out at him. Tim looked sheepish, his ears were tinged red and Gibbs took pity on him.

"Ok, ease up. Poor Tim's having a rough morning." Gibbs sent him a playful wink and Tim groaned in embarrassment further.

"Do I want to know?" Emily asked, curiously.

"You know" Tim replied with a wink to Emily, which sent Gibbs' eyebrow almost flying off his face.

"Oh!" Emily said following. "First or second time? And how the hell does Gibbs know?"

"How the hell do you know?" Gibbs retorted, surprised she knew what they were referring to. Emily just stared at him in response, continuing to stare. A whole ninety seconds passed before Gibbs put two and two together. "Oh no! No! No! No!" Gibbs started denying. "Oh no!" Gibbs' response made Tim laugh out loud. The look on Gibbs face was priceless. "No!"

"Yes," Emily admitted. "Kasie and I were out celebrating life and we bumped into your crew and I introduced Tim to Kasie. Before we knew it —"

"No more" Gibbs held up his hand. "I don't need nor want details." Then Gibbs brain rewound what Emily had said, twice as in more than once. "Twice!" Gibbs exclaimed!

"Nah first time was with Abby and Kate!"

"Emily!" Tim exclaimed, half frustrated and annoyed she was spilling his secrets and half embarrassed that of all the people she could have told, why was it Gibbs.

"If you weren't such a horny, chatty drunk." Emily teased. "For an Irishman, you can't hold your liquor very well."

"He drunk calls people too."

"Boss!" Tim exclaimed. Officially, his day was now shit! Tim took a seat and cradled his head in his hands. He was at the end of his rope, nearly in a state of panic and Gibbs could see it, letting his zinger die right there.

"Hey, look at me." Gibbs said, crouching to catch his eyes. "Look at me, breathe." Gibbs took his hands, to get her his attention and to balance himself so he didn't topple backwards. "It's ok, I promise. Breathe. You're a private person. Sometimes, too private. Breathe. That's ok. Breathe. Some of the best conversations we've ever had have been your drunk calls. You seem to want to let me in when your drunk and I'm going to take it. Breathe. Been trying to get me to let you in since we met." Tim looked at him imploringly. "Breathe. It's ok, we can work on those talks when your sober. Maybe we can go sharp shooting one weekend soon. Breathe. Just the two of us, you can let me in and I'll let you in." Gibbs promised. "Breathe. That's it. Keep breathing."

Panic attack, averted.


Tobias and Ed both entered the room, Ed with the portable ultrasound machine in tow. "I'm assuming this is the whole team." Ed joked swing the two Dad's there and the young couple cuddling on the bed. "If everything's still good Em, how do you feel about going home?" He asked.

"Great!" Emily said, wanting to jump up and pack her belongings up.

"That's good, going home is always better in my opinion." Ed Green agreed. "Let's see what we've got and get you home, hopefully."

Dr Ed Green completed the scan, commenting "looks good Emily, bleeding has almost subsided. You may continue bleeding for a little while yet, that's perfectly normal."

"I can go home?" Emily asked, hoping. All she wanted to do was curl up in Tim's arms on their bed and snuggle. She missed him last night.

"I'll go get started on the paperwork."


Emily was discharged into Tim's care and he took her back to his apartment and the older men dutifully followed them. They hovered around under foot before reminding them both that it was Friday and they both needed to head to their respective offices and prepare for the weekend. At Gibbs' glare Tim reminded him that Vance had authorised him to take the rest of the week and start fresh on Monday.

Both men finally left, but not before Tobias reminded Tim to call him if something was happening. "Tobias," Gibbs growled at his friend. "I'm going to tell you what I told Tim. Trust him to call you." The older men kissed Emily goodbye, Gibbs hugged Tim tightly and ruffled his hair playfully. Fornell just pat his shoulder, friendly.

"Thank god, they left." Emily snickered. "I thought they were going to take up residence on the sofa." Tim settled her in his arms as they sprawled themselves out on the sofa. "Tim, do you think I can stay here, in your arms forever?"

"Actually, I have something to show you. Come on," he pulled her to her feet and made their way to the bedroom.

"This is what I got up to before Gibbs plied me with bourbon." Tim opened the normally empty tall boy to show Emily her clothes all neatly folded in drawers. Closing the drawer, he opened the door for the huge walk-in closet and there she saw her dresses hanging up and her shoes on the shoe racks, her jewellery case on the shelf in front of the mirror. "This isn't just my room now, it's our room. Stay with me?" Tim asked and Emily answered with a kiss.

The kiss started tentatively at first, before long Tim opened up and Emily happily obliged. Suddenly, Tim was worried. How far did Emily want to go? Would she have flashbacks? Would this trigger her further? Then, he mentally slapped himself. Sometimes his brain was his own worst enemy. Then his brain kicked into a higher gear. He was hoping to build a life with Emily. What if having sex too soon ruined everything? He had been trying to date her before Emily and the hospital trip happened?


It was very late Friday night, Gibbs was at his desk working away, catching up on his missed work from earlier in the week. The entire floor was empty and Vance was long gone too. Next time he looked up, his agent was standing in front of him. He looked terribly wrought. "Tim?" He asked. Tim perked himself up and went to his own desk. "Tim, everything ok?" He tried again, putting his pen down. Tim had been crying, he could tell. His eyes were red and watery. Gibbs left his desk and sat on the side of Tim's desk. "Talk to me, son!" Gibbs requested.

"D…do you th…think I'm…I'm a s..ss…sexual p..predator?" Tim hiccuped and stammered through his tears.

"No, I don't!" Gibbs snapped, angry at whoever had done this to Tim. "I think your young, you know what you want. You're respectful of your partner, I've seen that with own two eyes." Tim sobbed softly and Gibbs hoisted Tim into his arms for a comforting, paternal hug.

"They said I was a liar, controlling and manipulative to her. They took her away."

"Who took who away?" Gibbs asked, the more he heard the angrier he became.

"Emily, they took her. She's gone! Agent Eric Rowan and Steven Brown held their guns to my head, while Sacks and Fornell packed her bags and took her. She didn't want to go, she tried to fight them off. " Tim sobbed. " Fornell, Sacks, Eric Rowan and Steven Brown! He's a fucking psychologist for the FBI now. How the fuck did that happen?!"

"Who is he?" Gibbs seethed. He rarely saw Tim like this and the way Tim spat his name out, twisted Gibbs' gut.

"He's the monster that raped Sarah!"
