Loona was arrested and charged with assasult and battery on Moxxie on April 3. Blitzo tried to represent her in court, but due to his unfamiliarity with real world court rules and procedures, Blitzo was charged with contempt of court and was thrown in jail for 45 days.
When Loona was asked if she could afford an attorney, she declined and instead chose to represent herself, believing that she knew the laws on earth better than Blitzo. Things didn't go so well for Loona. She was already charged with contempt of court for her behavior and was sentenced to 30 days in jail when she complained that she somehow had no access to law materials at a law liberty at the county jail.
Additionally, she was charged for escaping from prison and violating the no contact order by Judge Edwards. Now, on May 11, the omnibus hearing was conducted on Zoom.
On the Zoom hearing, Judge Edwards, a male anthro bulldog, could be seen at the upper left corner of the screen. Loona was seen on the upper right in her orange jumpsuit. Walker, the male anthro tiger prosecutor, was seen on the lower left corner of the screen. Loona crossed her arms while staring at the screen.
She did not like the state she was in. To her, the entire case against her was unfair and a huge waste of time. She didn't even realize how slow the legal system was until she was told that she would have to have hearings first before a trial began.
''Alright, we're back on the record,'' the judge said. ''Mr. Walker, when you're ready.''
''Yes, your Honor. We're on today for a couple of things. First of all, Judge Mustachecan did hear Ms, Loona's motions to dismiss and those were denied, but we ran out of time and my motions to join were not addressed. The other thing that we're on today is for omnibus,'' Walker explained.
Of course, as if my day could not have been more shitty enough. Loona thought.
''And of course, it's a little difficult procedurally, I think the court understands that I'm reticent to speak with Ms. Loona in a non-public forum to deal with these procedural issues. Because of Ms. Loona being pro se, I don't have an attorney to speak with, but I do have omnibus orders here, so, I'm going to ask the court, if the court is not ready to make a decision on my joined motion, maybe we put it on another date-'' The judge interrupted him unintentionally.
''I heard your argument today on that, I thought.''
''I can certainly give argument on that today, if you're ready to hear it?''
''I'm ready to hear it.'' The judge nodded. Loona rolled her eyes. Great... now she has to listen to his long rambling legal bullshit.
''So, the vast majority of the evidence in this case is all the same, two or three witnesses and most of that is proving the defendant's priors and the no contact order. In prior hearings Ms. Loona asserted she would be prejudiced. And I'm just going to point out to the court that previously, and this is something that for the omnibus, but previously she has not indicated that she's going to stipulate to her prior convictions or to this assault and battery no contact order.''
Loona looked around the room. She wished she had an iPhone with her right now.
''And the jury's going to be instructed in every one of these things that they're not to take into account her prior convictions or the other charges for anything except for the truth of the charges for the purposes of the no contact order violation and not to consider the other charges against one another. But objectively speaking...''
Loona sighed softly. God, is he still going on?
''... it seems like it's far more prejudicial for her to not stipulate to her prior convictions in the no contact order than to my allegation that she's violated the order three times. So, the witnesses are the same in almost every case. It's the protected party, it's the people that I need to call to prove the no contact order was served on her and it's the same victim. And the officers...''
Oh my god, shut up! Loona didn't say. The judge was the only person listening to his argument.
''...generally they would show up and Mr. Moxxie and one of the witnesses to the assault and violation of the no contact order would already be gone. I think I've got two or three witnesses that are not common to every charge here. So, that's my argument for it, Your Honor. It's strongly in the interests of judicial economy to join all these charges,'' Walker finished.
''Alright, thank you, Mr. Walker.''
About fucking time. I almost died from being bored.
''Ms. Loona, the state is moving to join and consolidate all of the charges against you into a single proceeding. Do you wish to respond to that motion?'' Loona closed her eyes and breathed deeply. Ok... she got this. All she had to do was to convince the judge not make it worse for her.
''Uh, yes, Your Honor. I believe if I'm doing this right, I would object to that because all of his witnesses that he's talking about are the Hogan Police Department and that would be the witnesses that he is talking about that are the common denominator in all these cases. These are all separate circumstances with separate victims. None of them are in the same circumstances. So for them to be joined together would 100% be prejudicial against my case and it would not allow me to have a proper fair chance at trial.'' Loona breathed deeply again. She believed she made her point perfectly clear to the judge.
''Alright, thank you, Ms. Loona.'' ''No problem, judge.''
''The court rules are rather clear on these kinds of motions that multiple offenses may be joined in at trial or for that matter in a single charging document if they are of the same or similar character, even if not part of a common scheme or a single scheme or plan. And that's clearly been
established by the state here.'' The judge argued. Loona was now shaking, hoping that the judge would finally accept her motion.
''There's no reason to have three trials on these three cases when they contain so much overlapping evidence in identical witnesses. So I'm going to grant the state's motion. All three of these cases will be joined for trial.'' Loona's eyes and mouth widened for a few moments and groaned silently.
Fuck! No...
''Mr. Walker, the trial in clause number 21-1-274 is set for jury trial to begin on June 22nd. I am now going to order that all three of these cases be joined and tried beginning on June 22nd at 8:30 AM.'' While the judge was speaking to Walker, Loona tried to think of another plan. Maybe if she could convince him that her access to law materials was denied, she could make a good argument for a mistrial. Maybe have him release her on habeas corpus. Yeah... that's it!
Loona raised her right hand after clearing her throat. ''Can I say one more thing, Your Honor?''
''No, I've already ruled, Ms. Loona.'' Loona gasped then started yelling at the judge, though it was difficult to tell what she was saying as the connection on her broke up for a few seconds. The judge glared at her.
''Ms. Loona, you're going to be found in contempt again, knock it off.'' Loona growled as the judge spoke to Walker. ''Mr. Walker, previously we had an evidentiary hearing regarding Ms. Loona's conduct toward Mr. Moxxie.'' Loona took some time to calm herself down while the judge continued. ''And as you know, I made a finding that her conduct constituted extreme dilatory conduct and she had forfeited her right to counsel. You prepared findings, conclusions and an order setting forth my ruling, but it was only in one case. I don't know if there was a mistake in the filing or if it's just not showing up in Odyssey, but that order finding that Ms. Loona forfeited her constitutional right to counsel only appears in one of those three cases. So we need to remedy that.''
Loona managed to regain her composure when he finished.
''Okay, Your Honor. I think what had happened is I prepared one and if it was going to be acceptable, I would file duplicates in the other two and I probably just forgot to do that. So I'll fix that.''
''It's okay. Yeah, let's fix that.'' The judge looked at Loona, who had her arms crossed again. ''Ms. Loona, the omnibus order requires you to disclose your witnesses. Have you done so yet?''
''Yes, I've already filed my motions and haven't got a single response. I don't know why you haven't responded or why you felt the need to waste my fucking time with this fucking tr-''
''Ms. Loona, I didn't ask you for a speech. I asked you if you've already provided the prosecutor with a list of witnesses.'' Loona sighed.
''Yes, Your Honor, and I don't know if they got to them.'' The judge shrugged.
''Well, I don't know either. It's your obligation to make sure that they do.'' Loona moaned and shook her head in response. ''I will tell you, Ms. Loona, I received an envelope of documents from you late last week, thanks to your weird magic powers. And I can tell you that sending documents to me is not the appropriate way for you to file motions with the court.''
''Are you kidding me? What about the-''
''What you sent to me does not constitute a motion to the court,'' the judge interrupted. ''You must file motions with the court clerk. You must provide adequate notice to the prosecutor, something you did not do with the documents last week.''
''Judge, those documents from last week were my grievances saying that I do not have access to a law library. Your court administrator said some bullsh-''
''Ms. Loona, once again, I'm not a law library. There is a law library at the county jail, if you're having trouble accessing it-''
''I KNOW where the hell it is, you dumbass!'' Loona snapped. ''I'm asking you to provide access to-'' The connection broke up on her again. ''-terials for me, asshole!''
''Ms. Loona, you are now in contempt of court!'' The judge yelled sternly. ''Judge, I'm not-''
''Be quiet!'' Loona growled and crossed her arms, trying to regain her composure again. ''Listen to what I'm telling you. If you need assistance, you're going to need to get it from someone other than me. It is not my job to assist you as you prepare for this trial. You may contact the Department of Public Defense and request assistance from them. Whether they will be able or willing to provide it to you is between you and them, not me.'' Loona glared while hyperventilating through her nose.
''So, if you feel that you don't have access to adequate materials, you need to contact someone other than me. I am not sending you a laptop and I am not sending you your cell phone as you've requested.'' Loona groaned loudly in response.
''You gotta be kidding me!''
''You are on your own. By reason of your own conduct, you are on your own.''
''This is fucking ridiculous...''
''Alright, that's all for today. I'm going to set a pretrial conference for May 23 at 2:00 PM. We'll see you back then.''
''Uh, judge, I didn't catch that date,'' Walker replied. ''May 23 at 2:00 PM.''
''Your Honor, how am I supposed to get a fair trial if I don't have any access to law material? And why do I have to provide my motions to the prosecutor if I'm trying to win? Explain that, judge!''
''Ms. Loona, you're the one that forfeited your right to counsel, not me.'' Loona widened her eyes then growled loudly. ''You've created this problem. Not me.''
''You guys are corrupt! All of you!''
''Ms. Loona, I suggest you calm down-''
''No, you know what? I had enough of this hearing, I'm gonna blow some fucking steam!'' Loona then started breaking stuff all over the room, prompting prison guards to subdue her. The screen blacked out during the struggle.
''Alright, Mr. Walker, please prepare another order on contempt. The sanction would be 30 days without credit toward any time she's serving.'' Walker nodded and began to write the order on his paper. After the trial, Loona was found guilty, and sentenced to 10 years in the federal penitentiary. Blitzo did miss Loona, but Moxxie was sure he would never get abused by her again.
