I'm back with chapter eight (: The plot is very much based on episode 5. 15 and I also took the dialogue from it. It just fits my arc of suspense very well. I know you're probably waiting for the next twist but it's coming soon, I promise! I know it sucks that I'm always asking for reviews but I just need some feedback from you guys, after all I'm not just writing for myself so please, keep going!


Harvey has acted confident when Donna asked him why he didn't help Mike with his speech. He said it would be his story to tell and pretended he wouldn't have doubts about that at all. That wasn't true but he knew all eyes were on him. Like Louis just said: if Harvey thinks they are going to lose then they will lose. He knew his partner was right about this. So he stood there in his office, head up, pretending. He never thought it would be possible for him to lie to her without her noticing but she seemed to buy it. It was strange how much had changed between them in the last months. From being his first person of trust who could always see right through him, she turned to a stranger. When she stood there in his office, right next to him, he wished so much to take her in his arms. He knew it would relieve him, it would take away a lot of his inner tension, if he could only touch her, if he could only feel she was there. But she wasn't, not really. She never felt further away although they were only an arm's length apart. So he could lie and no one was caring.

In the courtroom it took a load off his mind when he heard Mike's pleading. The closing was amazing. It was empathetic, touching, heart whelming and, most important, honest. Still, Harvey isn't sure if that would be enough, but he never would admit that to Mike.

He's proud of his protégé but the fear of losing him remains. So it's more of a panic reaction than a well thought-out plan when he asks Donna to find grounds for a mistrial. So it's no surprise that this conversation ends in an argument like so many others did before. He knows it couldn't go on like this for much longer, but that's how it is between them. He regrets immediately he has asked Donna to dig in the grey but he can't quite understand what she was so upset about. It is nothing, that they never did before. What has changed? Then he realises: she has lost faith in him. That's it.


How can he dare to ask her on with side she's on? Hasn't she proven that to them for all this years? Wasn't that one of the first things she promised to him when she just had begun to work for him, that she would do everything to him. Why can't he see that that's not what this is about. It's about dragging innocent people through the mud and she can't do it. She would do everything for him, every time, but she can't put anybody else at risk she cares about. How can he be so reckless? But actually, that's not surprised at all. Harvey's always been like this. But now she can't get over it. Not anymore, because soon there will be one more innocent little human being in this world whom she must protest with all her power. She never thought about what it means to be a role model before, but now she questions every decision she makes. Everything she does has an impact on her child, and that goes for Harvey too. He can't be that reckless anymore! Even if he doesn't know about it yet, he too will soon bear great responsibility. But how can she explain this to him when every conversation between them sooner or later ends in a quarrel?

When she confronts Jessica that she realizes how serious the situation really is. She may know Harvey and Mike better as persons but Jessica thinks in legal terms. When Harvey searched for a ground for mistrial she blamed his temperament - he was just scared because he cares deeply for Mike. But when the naming partner is willing to go for a mistrial although an acquittal would be the better alternative, then this means something. She thinks that they may lose. So Harvey's concern is justified.

But only when she gets Susanne's call that denies every chance of a possible way out, she freaks out. Now they have to rely on the jury's decision. But Harvey's look, when she tells him about it, shows her that he thinks this is the end. Could he be right? Was this really Mike's last chance?


"Harvey, it's the middle of the night. What are you doing here?" Then she sees his desperate expression.

"I had to see you. I know you said I couldn't do this anymore, but I need to talk to you."

"Talk about what?"

"About what I have to do." The firm conviction in his voice scares her.

"You're gonna turn yourself in, aren't you?" Deep breaths. Donnas face expresses bare shock. Without any more words he enters her apartment. She purses him some of her best whiskey. If there's any occasion for this exquisite drink, then it's tonight. Within an inch she had taken on sip herself but then she remembers and takes a glass of water instead. They set down at her dining table in silence. After some seconds he tells her what had happened with Gibbs' assistant. He drinks up, she purses him another one. She cleans her throat before she dares to speak.

"So you wanna turn yourself in because some cheater called you a bully?"

"No, Donna, I want to turn myself in because he was right. I'm not unbeatable."

"No, Harvey, I think he made you feel guilty and now you're not seeing clearly

"Donna…"

"Harvey, if it were anybody other than Mike on trial and you saw his closing, do you think that the jury would convict him?"

"I don't know, Donna but I can't afford to be wrong about this."

"Then let me ask you a question. Why aren't you talking to Dr. Agard about this?" She knows, she's pushing him with that but he needs to listen.

"How do you know about her?"

"Because I do. And I also know that the last time you had a huge decision to make, you went to her and not me." She doesn't hide that this still hurts. She still can't quite believe he has really come to her doorstep but she's happy about that. She thought everything was broken between them but apparently it isn't. Something is still there, something brought him back to her. Both can't name it but suddenly they realise it's there.

"That was about business and this is personal."

"No, Harvey, you didn't go to her because you know she won't try to talk you out of this, but I will."

"Donna..."

"Don't do it. Don't fall on your sword again."

"I have to."

"No, you don't."

"We might not win."

"You don't always have to be the hero." Harvey jumps to his feet. At the moment of greatest uncertainty he came to her. Why? He doesn't know. The two haven't had a reasonable conversation in weeks but now he can't hide from her unerring words. The tension is tangible.

"I'm not doing it to be the hero."

"Then why the hell are you doing it?"

"Because it's my goddamn fault." His voice breaks and his eyes fill with tears. He hates that but he can't stop. He has hidden his emotions and fears for so long that they are now bursting out of him. The accusations ate him up.

"No, Harvey it's not. It's Mike's fault just as much as it is yours."

"Then why should I be the one to throw him under the bus?"

"Don't you get it? I am not asking you to throw him under the bus. I am asking you to believe that the two of you are worthy of being found innocent" Her eyes also filled with tears. It hurts so much to see him like that. Harvey Spectre doesn't cry. She only saw that once when his dad had passed away. It was such a harrowing moment, breaking her heart. She wants him to see what she sees in him so badly.

"And what if I can't do that?"

"Then you can march yourself down to Gibbs's office in the morning and turn yourself in." She swallows "But I don't what you to do it."

"Why not?" He lowers his gaze and looks to the ground.

"Because I think you're worthy." He looks up and watches her, studying her face for any reaction. She can't stand his brown eyes any longer.

"And I don't wanna lose you" Now her voice breaks. She knows it's not the whole truth. They don't wanna lose him. The best reason for him to back out off his plan she carries underneath her heart. But she can't tell him. She puts her hand on her belly, touching the one thing that will change everything for them. It would be the perfect time to tell him. He won't lose another thought at going to jail for Mike if he would know he's about to becoming a dad, won't he? But it's like it's tightening her throat. She can't bring herself to say the words. There is still this fear that she just can't get rid of. What if Harvey can never forgive her for leaving him? What if he's not ready to accept the child? What if all this isn't enough to convince him after all? He's been acting so irrational lately. He hasn't been himself for a long time. He's a loose cannon. She just can't see through him anymore. She couldn't handle his rejection right now - so she remains silent although she knows it's selfish.

He swallows again. He senses that there is something else going on with her but he can't see what it is. She doesn't wanna lose him? That's hard to believe after all that had happened. He doesn't know how to respond to that so he just turns, grabs his jacket and leaves. She follows and reaches him right when he was already opening the front door.

"Harvey, go to the courthouse in the morning, sit with Mike until that verdict comes in, and show him that you have faith in him. Like I have faith in you" she whispers. He nods one last time and leaves for the night.
