She sees Rachel at the sidewalk outside the massive building before the cab stops. She rushes out the car and follows her friend until she reaches her.
"Rachel! What are you doing here? Is he still inside?"
"I don't know what to do."
"Okay, I'll tell you what you need to do. You need to go back inside and you need to be there for him."
"I'm not gonna go back inside."
"Why not?"
"Because he told me that he wasn't goig to do this. He told me that it was on the table, and I begged him not to take it and he promised me that he wouldn't." Donna knows exactly what Rachel is going through. She barely can imagine, how she would react, if Harvey has done the same.
"Rachel, last night Harvey came to me wanting to do the same thing and I begged him to have faith in that jury."
"And Harvey kept his word."
"But he might not have and I told myself that if he changed his mind, I would have to forgive him."
"Then Donna, you're a better woman than I am, because Mike is my heart and right now I feel like someone is ripping my heart out of my chest, and that someone… is him." Her eyes fill with tears and she sobs so much that her whole body is shaking. Donna takes her in her arms and rubs her back.
"Rachel, I'm here. I'm right here for you. What do you say: I'll bring you home and I'll stay with you 'till Mike is back. You won't be alone." Rachel nods but when they reach the cab, Donna had just left, she hesitates.
"I don't wanna go home. I can't sit there where everything reminds me of…"
"Okay. I'll take you to my apartment."
So they spend the next hours at Donna's couch. The Redhead notes with concern that Rachel doesn't even think about going home, although Mike should have been back long ago. Instead, she sits there, crying and pining over Donna's red wine supply.
"I'm sorry, I know this wine is far to good to get tanked up by."
"Actually I'm glad. That way the expensive bottle does its job. You know I can't drink for months."
"So I'm doing something useful, after all" she retorts with a disparaging laugh while she takes another sip. "I guess you could spend your day much better, than to take care of your drunk friend."
"You know that's not true. Being here, with you, is the most useful thing for me to do right know. But I'm not sure if that's the place you should be…"
"I should spend every second with him, I guess…" Donna nods.
"Just give me a few more lighthearted moments with my best friend before I return to reality?"
"Of course!" Donna gives her a hug "So, wanna see who you're going to spoil the next 18 years?"
"Yes!" She exclaims with sparkling eyes when Donna takes out the sonogram she got earlier.
"I wanna thank you for your support. I don't know what the two of us would do without Auntie Rachel. And the physician you recommended is amazing. I really like her."
"That's good. I read only the best about Dr. Montgomery. So, that's my niece?"
"Or nephew. In any case: it's your godchild.""
"Wow!"
"Exactly…" She sights, still amazed by the feeling, the thought of her unborn child, gives her.
"Will you show him?"
"I have to, don't I?"
"I think it's time. For us both to face our men…"
She sees Harvey sitting in his office when she enters the firm. She takes a deep breath and squares her shoulders. It's time.
But again, things turn out different then she had expected. Harvey is not in a good mood. To be exact, he's totally off the track. He sits at his table but he keeps jumping up and runs agitated in his office. Donna is taking a look at the situation from the door frame. Of course he didn't miss her presence but he tries to ignore her, he doesn't know what to say anyway. But of course it doesn't work – he has never been able to ignore her. Whenever she enters a room his attention belongs to her. As soon as he sees red hair in the corner of his eye, his breath gets faster and his heart skips a beat. It has always been this way.
"What are you doing here?"
"Can I help you?"
"How do you wanna help me? The only thing that can help now is a legal move but you're not even a lawyer." Donna knows he's only saying this to push her away. He would never seriously reduce her to her job.
"Okay calm down Harvey, I'm not the enemy here."
"You talked me out of doing the right thing! I listened to you! So, yeah, right now you're presence isn't helping at all."
"Wow, so you would rather spend your evening in prison?" She can't stand that he still blames himself for everything. Why can't he see that he deserves freedom as much as Mike does?
"Stop it, Donna! I think I made my point clear: I don't want you here."
"I was trying to support you. But right now I'm doing this by giving you some space."
And she's chicken out again. Why is she such a coward when it comes to the truth? Of course, Harvey's not in good shape right now, but she can't wait forever for the right moment. Harvey's been off track for weeks, and it's not gonna change that fast. Some day she'll have to do it! But not today…
"What are you doing here?" Harvey asks surprised when he finds Mike in sitting in his kitchen, pouring in some Whiskey.
"Harvey I wanna talk to you."
"Good, 'cause I wanna talk to you too."
"I want you to be my best man."
"What?"
"Rachel and I wanna get married."
"Less than a day from prison and you're thinking about dresses and flowers?"
"Harvey…"
"You know what? I'll be your best man on one condition: …"
"That ship is sailed."
"The hell it has! We can still call Gibbs."
"I am not calling Gibbs."
"Get it through your head. This is on me."
"No, you get it through your head. I am not letting you go to prison for a crime that I committed."
"Well, I'm not letting you go when you were gonna be found innocent. "
"What did you say?"
"That's right. The verdict was not guilty."
"No, I don't believe you. Why would you lie to me?"
"The truth would have broken you."
"Except now you want to break me?"
"Because it's the only way you're gonna let me do this. You think putting a ring on Rachel's finger is gonna make everything go away?" Harvey spits out.
"You know what Harvey? You want to come to my wedding, you let me know." Mike just turns and tries to walk straight pass him. But Harvey can't deal with all then pent-up tension inside him so he throws his glass by a hair's breadth over Mikes head. Mike winces when the glass crashes at the cupboard and the Whiskey drips to the kitchen floor.
"You wanna go to prison? Rule number one: never turn your back on anyone."
"I know what you're doing and it's not gonna work."
"I'm not trying to take your place anymore. I'm trying to get you ready like Gloria Danner asked me to. Because you're weak." Harvey has lost control of his life. Nothing runs in an orderly fashion anymore. Right now his entire house of cards, everything he had built up over the years, is falling apart. So there's only one thing left for him to do: to let it all out. Now! He can't stand it any longer. And he knows exactly how to get Mike to help him with that,
"I am not weak"
"Yeah, well, hit me"
"No"
"Hit me!"
"Stop it!"
"Louis got you in a headlock.."
"I'm not gonna hit you because.."
"Tess's husband kicked your ass.."
"… you can't handle the fact that…"
"Logan Sanders hooked up with Rachel…"
"Stop!"
"What do you think he's gonna do with her the second you get…" And baaam! There it is. Harvey has hit the nerve he wanted and Mike reacts as expected: he slaps his boss in the face. That gives Harvey the chance to get rid of his temper and he slaps back.
"Is that what you want? That I hate you and that you made me do this? I'm gonna lose everything because of you!" Mike pushes him away and Harvey falls over the stool. But Mike drops to his knees too, sitting at the floor, sobbing.
"Mike please. Let's call Gibbs."
"I can't. I can't Harvey. I can't…" because you're needed her, he wants to yell. But he can't - he promised not to. Yet it takes all his strength to keep his word. He was never willing to let Harvey turn himself in but he sure as hell won't allow his child to grow up without a dad.
"I'm sorry Mike. I should have told you the truth about the verdict."
"I probably shouldn't have hit you all those times."
"It's okay. Makes me feel better to know you have it in you." Harvey wipes away the blood from his lips but gives him a soft smile.
"I got to go..." Mike stands up, "I got to ask Rachel to marry me."
"I thought you were already getting married."
"There's something I have to take care for first…"
She shrugs, when there's a sudden knock at her door. She isn't expecting someone and so she's really surprised when she opens the door.
"Mike? What the hell are you doing here? Rachel left hours ago…"
"I know. She's at home."
"So why are you here? I think there are better things for you to do now."
"Donna, stop it. Don't you think I much rather would want to spend every remaining minute with my fiancé if there wasn't something really urgent for me to do?"
"Okay Mike, calm down. What's happening? Is it Harvey?"
"You have to tell him or you'll lose him."
"What are you talking about?"
"You know exactly what I'm talking about." He says looking straight to her lower abdomen.
"But Mike, how do you..? I thought Rachel…"
"She hasn't exactly told me, I figured it out. That's not important right now. Right now you just have to go to talk to him."
"But you didn't say anything, didn't you?"
"Of course not! Instead I bet him up." He mumbles and rubs his jaw that was still hurting.
"WHAT?"
"Donna, I repeat: that's not important right now. Right now he has to know"
"I just.. I wanted to tell him. I was already there but I couldn't."
"Donna, you're the strongest person I know. You can do that. You have no reason to be scared. He may freak out a little at first but in the end he's Harvey. He'll do the right."
"That's the thing. I don't want his support because it's the right. I want it, because he's willing to give it"
"I get you. I really do. But he's so eager to give himself up for me. We can't allow it. He won't listen to me but he will listen to you. You're the one with the most convincing argument." She just nods. She knows he's right. After all, the thought had already occurred to her.
"I'll do it, okay? It's just the timing..."
"Donna, the timing couldn't be any better! You'll have to tell him now, if you don't want your kid to grow up without a dad. Harvey needs to know." Suddenly there is a clang. When Donna's gaze reaches the source of that noise she sees red wine pouring over the floor of the hallway between a pile of glass panes. Before she realises that the bottle must have fallen out of someone's hand, that person is already yelling.
"WHAT DID YOU JUST SAY?" Then she sees Harvey's pale face that's staring at Mike.
"What did you just say?" He repeats but this time it's no more than an exhalation. When his horrified gaze falls on her, it tightens her throat.
