Chapter 05 The court

Quanktumspirit: "Please review.

Info: Nora, Miguel, Yolonda, Daisy (Linnie's sister) and Linnie belong to MilkyWayGalaxy4567. I did ask for permission and they said yes.

Miguel flew home and threw his head on the couch groaning. Why can't Linnie just keep his nose out of his business and ruin everything for the poor man?

"Blast you, Linnie, I could kill you for it." Miguel groaned rolling over.

"Miguel are you home? Can you help with the shopping please?" Yolonda called out, but then said, "Wait, sorry I know what you have just done, never mind."

Miguel sat up and saw Yolonda coming in with a few bags of food shopping, she summoned them into the kitchen and flew up to her husband, looking at him worried.

"So... how did it go? What do you have to do or do you have another appointment there?" Yolonda inquired.

Miguel sighed, "I did have an appointment, they checked the status of the fetus and it all seemed to be going well. I should've just taken a few pills and the ordeal would have been over."

"Wait," Yolonda said looking at her husband, "Should have? What do you mean should have? You went to the abortion clinic to have it aborted, no ifs or buts."

"Mr Linnie Cosma has appeared again. He somehow figured out I'd wanna have the baby aborted, they scanned on the child and after Linnie pretty much threw a fit over not wanting to have the child killed off they told me that he has fallen in love with the kid and therefore the abortion can't happen. Even if the loved one isn't the actual father, just one love is enough to not have it killed." Miguel snapped, "That Fairy's little tantrum at the clinic made them turn me away. And now he's gonna sue me for the parental and living rights of the fetus!"

Yolonda's mouth dropped down, "But... but what the hell has he got to do with the baby? It's not his decision but yours."

"I did have sex with his wife, despite the fact the two are going through a hard time, so I kinda understand he doesn't want his wife's, unwanted child, to be killed off," Miguel explained, rubbing his head. "Damn it, and now I'm worried about-"

The door suddenly received a knock. Miguel gritted his teeth together, if it was the no-good Linnie again he was going to break every bone in that damned Fairy's body and throw his corpse into his junk crusher.

"WHAT?" Miguel shouted as he opened the door.

A different Fairy dressed in a black suit stood in front of him, Miguel swallowed hard, hopefully, it had nothing to do with the baby, but no luck.

"Mr Fairywrinkle? You're being sued by Mr Cosma, here is the document as it currently stands and you're to appear in front of the court tomorrow. No if's, should you not appear the fairy police will be sent round and you'd be escorted to the high judge via the police." the Fairy said.

Miguel groaned again, gave his consent and the other fairy left again, Yolonda sighed, summoned her husband to the couch to have a nap and got her coat on.

"I'll go and talk to him, maybe I can knock some sense into that man." Yolonda sighed, shaking her head.

Miguel just groaned again and fell asleep. Yolonda flew out of the house and then summoned herself to Linnie's home.

Yolonda appeared in front of a yellow house with a black roof on, there was a blue post box with the name Cosma written on it in red and a doorbell. She rang the door and a short while later someone flew over to it to open it up.

She was presented with a green-haired Fairy, round reading glasses on and wearing a white shirt and black trousers.

"Oh good afternoon Mrs Fairywrinkle, to what do I owe the pleasure of your visit?" Linnie inquired her.

"Can I come in Linnie? I need to discuss with you the fetus, please." Yolonda snapped.

Linnie looked scared, "Is everything alright with the baby? Miguel didn't have the abortion, did he?"

"Can I come in?" Yolonda sneered, angrier now. "And you dam well know he hasn't aborted it you prick."

"Yes yes, sorry do come in." Linnie shivered.

Yolonda entered Linnie's home, she looked around and saw a small dining room, an attached kitchen, a living room, and a flight of stairs leading to the second floor, most likely two bedrooms and a bathroom.

Linnie guided Yolonda to the living room and then flew into his kitchen.

"Would you like something to drink Mrs Fairywrinkle?" Linnie inquired, getting himself some tea.

"Do you have a black beer, Linnie?" She asked.

Linnie sighed, "Unfortunately yes for Nora."

He came back with his green tea and gave Yolonda a black beer, she thanked him, they sat in the living room and Linnie summoned a placemat for Yolonda's beer, she placed it down and shook her head.

"Linnie, the problem I wanna discuss is the forced pregnancy on my husband. I don't find it right that you're trying to mess with his health by forcing him to carry this baby. So I wanna ask you to withdraw your parental feelings from the fetus before it hurts my husband even more." Yolonda said.

"Yolonda, I know you don't have a good feeling about Miguel carrying a stranger's baby, aka my ex-wife's child. But I find it an incredibly selfish act to just destroy a living, breathing fetus just because the parents didn't watch out and put a cover over their 'privacies'." Linnie fired back calmly, "Which is why I am going through the courts to be legally allowed to adopt the baby and Miguel will carry it to terms, give birth to the child and then give it to me. It's a much better idea than destruction."

"But are you aware of what this child will demand of you, Linnie?" Yolonda asked, "Sleepless nights, constantly having to buy baby formulas to keep it fed, feed it every two hours, change its diapers every thirty minutes, give it twice a day a bath and god knows what else a stressful child would bring. And then all the costs of food, home, nursery, school, college, university and so on. You will be paying for this child until it reaches a thousand years Linnie, can you afford it for so long?"

"Thank you for being concerned about my financial well being Mrs Fairywrinkle," Linnie sighed, "Yes it will be tight for me, but I'd rather be eating soup and crisped bread for the next twenty years than knowing the baby has died. And don't worry about the child's nursery and stuff, I got plenty of old clothes from my previous three children I raised. I got clothes for the baby, beds, changing table and plenty of toys to play with. So the baby will not be missing out on anything. And once it's old enough it can be enrolled into Spellementary school and it will have a good education. And later on college, university or wherever life will carry it."

Yolonda rolled her eyes, she saw in Linnie's eyes he was completely honest with her and his love for the child will be a hundred times stronger than any feelings Miguel, she or Nora could develop for the baby.

Linnie then looked down, "I'm ever so sorry that Mr Fairywrinkle is going to be forced to suffer a lot of pain through the pregnancy, having to re-build his trust and love to you and give birth to the baby, but believe me the child deserves love and not death."

"I can see you truly mean it well with the baby don't you, Mr Cosma?" Yolonda sighed, "Thank you for your time and honesty. You've given me a lot to think about."

Linnie smiled a bit, they finished their drinks and Linnie leads Yolonda back to the door and waved. Yolonda thanked him and flew back home.

A few days went by and the court case was being discussed. Linnie got up early that morning, got washed and dressed in his best suit.

He had written out the documents of his discussion to preserve the existence of Miguel and Nora's baby. Hopefully, he hasn't missed anything from it and he'd be able to answer all the questions the court will have for him as to why he should be given the parental rights of Miguel's baby.

Linnie left his home and meet up with his twin sister, Daisy Cosma, just before the courts.

Daisy looked at her brother worried, "Linnie, are you really sure about it all? Please, it's Mr Fairywrinkle's decision over what happens to the baby and not yours."

"Don't you now start as well Daisy," Linnie sighed, "I've already had an ear full from his wife yesterday. I will not back off this child. I had asked you to come to be my support, but if you're just going to fire against me then you can just as well leave."

"Linnie I'm not against you, just this child will demand a lot off you, can you really raise another baby? And why keep taking care of everyone and anyone's children, take care of yourself for a change too." Daisy sighed. "Should we actually also mention-"

Linnie's eyes flared up, he summoned a door on Daisy's mouth and locked it off.

"Not one damn word about THAT Daisy, you know the punishment if THAT's mentioned!" Linnie said as darkly as he could.

Linnie wasn't even joking. What he and his sister knew together about him is a sworn brother-sister pact of a secret, but Daisy still thinks the court should know about it.

"Linnie you gotta stop blaming yourself for that. You had no fault in any of it. It was-" Daisy wanted to continue arguing after poofing the lock off her mouth.

Linnie summoned the lock back onto his sister's mouth to shut her up.

"I don't care anymore who's fault THAT was Daisy," Linnie sighed looking down, "The fact is it has happened to me and I'd never wish it on anyone, not even my worst enemy. That's why I'm doing all I can to help the innocent baby, please."

Daisy sighed, Linnie, summoned the lock back off his sister's mouth and poofed instead a styrofoam cup with hot chocolate in it for his sister to drink before she gets called up.

Daisy thanked him, sat down and shook her head. The painful past her brother went through has really changed him several times.

A few minutes later Nora, Miguel and Yolonda all appeared as well, Linnie glared at Miguel and Nora cold as ice as the four were led into the courtroom to decide the faith of the baby of Miguel.

Linnie headed to the plaintiff's side of the court with his case file in front of him. Miguel flew to the defendant's table and glared over at the green-haired Fairies side. That Linnie had the power now in his hand to persuade the judge he is not allowed to control his own body was over the top.

The baby should be killed, no ifs. Miguel also looked worried as he saw Linnie had done quite a bit of research and had a file with him with papers clearly inside of it. Whiles all Miguel had to defend himself with is that the baby was in his body and so should be his decision.

"Linnie please," Miguel said before the judge came in, "Please withdraw this court's decision over the fetus and leave it."

"Will you swear not to abort it and let me adopt it?" Linnie said calmly, "I just want the well-being of the baby. That's all Miguel. Please."

"It's my body so my decision, I'm going to have it aborted, no ifs." Miguel sneered, "Once I can figure out how to withdraw your love from the fetus."

"Then not," Linnie said.

Just then the judge's door opened.

And the court writer stood up, "All rise for Lord Scales, please."

All the Fairies, including Linnie and Miguel, stood up and a Fairy with black hair and wearing a black judge's cape flew in. He looked around and nodded his head.

"Please be seated, we're discussing today the parental rights and abortion rights between Mr Linnie Cosma and Mr Miguel Big Daddy Fairywrinkle over the baby of Mr Miguel Big Daddy Fairywrinkle as the biological father and Mrs Nora Cosma as the biological mother. Is this right?" The Judge inquired.

"Yes your lordship," Linnie confirmed and sat down.

"Ok, we start with the defendant's side. Mr Linnie Cosma, please come up to the witness stand to give your testimony off." Lord Scales ordered.

Linnie got up and walked to the witness stand, he stood up and a police Fairy flew next to him, holding the Fairy rules book as a book of worship to them. A bit like the bible for us humans.

"Do you, Linnie Cosma, swear upon Da Rules to tell the court today the truth, the whole truth, not let anything out apart from the truth as true as you stand here today?" Lord Scales asked him.

Linnie lifted his left hand and placed his right hand on top of the rule book looking at the judge, "I swear it."

"Please be seated." Lord Scales asked.

Linnie sat down along with the other people, Miguel really wished he could shut Linnie up for good to not have that green-haired Fairy stop him, but maybe he'd have enough power to win the court to his side and not Linnies.

"So you've handed to the court the argument that Mr Miguel Big Daddy Fairywrinkle is not to have his fetus aborted. The fetus he's created via an affair with your wife Nora Cosma. Is this true?" Lord Scales inquired.

Linnie nodded his head, "Yes your honour, Mr Fairywrinkle and my ex-wife Mrs Cosma are the biological parents of the fetus growing inside Mr Fairywrinkle. I'm only the ex-husband of Mrs Cosma."

Lord Scales nodded his head, "Why do you think you've got any right to decide how a Fairy has to live with its body and the contents inside the body and not the Fairy in itself?"

"I'm not judging what Mr Fairywrinkle does or doesn't do with his body. All I'm asking is that the fetus within himself doesn't get aborted or harmed and seeing as Mr Fairywrinkle has already spoken out a huge hatred towards the fetus as he was at the abortion clinic I only just could stop him from killing the baby. This is why I'd like to have the right to adopt the baby. Adopting and letting it live is a better idea than killing it and ending the circle of life for the little being." Linnie pointed out.

"So you're doing all this just for the simple love of a child? You feel to Mr Fairywrinkles fetus a loving and protective urge to save its life?" Lord Scales asked surprised, "I don't think I've ever heard this happen before."

Linnie sighed a bit, "It's a bit more complicated than that. The fetus itself spoke to me on the day Mr Fairywrinkle tried to have the abortion appointment. It screamed and pleaded with me to save its life. I raced over and spoke to Mr Fairywrinkles doctor, he checked the status of the baby and confirmed that the baby and I hold a close bond of 'parental love' to one another, thus it can't be aborted. And I refuse to have my love removed from my ex-wife's baby because I'd like to save its life if I can."

Lord Scales and several other judges whipped tears falling from their eyes, Linnie was completely honest and clearly loves children with all his heart. But Miguel Fairywrinkle smirked and figured out he could use this 'statement' against Linnie itself if he twists the words around.

"Ok, you may step down, Mr Fairywrinkle will be heard next." Lord Scales asked.

Linne nodded and flew down, Miguel glared at Linnie and planned in his head to completely rip him apart. Hopefully enough that he can have the child aborted.

Miguel stood up and he too was presented with the DaRules book, he swore on it too and then sat down, glaring over at Linnie and hoping his argument can win him the court's case.

"Before I'd have to answer any questions I'd like to go back to Mr Cosma's answer to one of the questions." Miguel started smirking, "You've just admitted yourself that you love the child within me already. Don't you know that child or even baby love is considered under the term paedophile? You're seriously expecting me to believe giving you the baby just so you can live out your sick fantasies on an innocent baby is a better alternative to having it aborted?"

Linnie gasped for air and his head burned up with fury, "Mr Fairywrinkle that is absolutely NOT what I meant with 'love' of the child thank you very much. I've raised three children all into adulthood and cherish and love all three of them with all my heart, even if things get hard and difficult at times with them. My feelings for the child are purely parental love NOT sexual or any sickening thing like that."

Miguel smirked as he saw how red Linnie was getting, he'd truly struck a painful nerve with the Fairy.

"I refuse you to think that the child should live because of that. I just want the child to have a right to exist. And not be abolished just because you and my ex-wife can't watch out." Linnie fired back.

Miguel rolled his eyes, "I see that. And yet-"

"Ask any of my previous three children if I'd EVER done anything like that to any of them." Linnie fired back at Miguel, "I'd reassure you Miguel it has nothing to do with that as to why I don't want the baby aborted!"

"Ok ok keep your hair on Linnie." Miguel sighed, "I believe you. And yet I still don't get it as to why?"

"Well, you haven't answered as to why the child should not exist." Linnie spat back again, "Why have an innocent being killed off?"

"Because I don't want a flying example of my mistake existing and hurting me even more inside of me than it already is. Plus I got too much work to do with the recycling business and rubbish sorting out to take care of a baby. And my wife is never home to even cook dinner once every blue moon, so we won't have time to look after another screaming and demanding baby." Miguel stated, "So having it aborted would be a kinder alternative than letting it exist."

Linnie rolled his eyes, "Which is why I had asked to adopt it from you. I know you two have other things more important to consider than the existence of a baby. Give me the parental rights, carry the baby to full term and give it to me and you won't have to hear from the child ever again. Once the baby reaches a mature age, so 210 years old and asks about its real parents it then can be informed of you being the father and my ex-wife the mother of the child. But not beforehand."

"However, should you change your mind and still wanna see your baby in itself, I can allow you supervised parental visits with the baby." Linnie promised, "I only want the baby to have a chance to exist and not be robbed of the life living within you. Please. Just give your baby the chance to exist."

The entire court felt tears falling from their eyes, Linnie smirked a bit on the inside, he knew buttering everyone up would win him points in having the child saved from Miguel. And yet Miguel was not moved by his words one bit but angered.

"So even if I'd give birth to the baby and give it to you, are you saying that: I as the biological father should have my rights in seeing my own baby removed until it's old enough to wanna see me? Isn't that just as selfish?" Miguel snapped.

Linnie shook his head, "No not at all. I'm just saying, the time you've been pregnant with Nora's baby will have angered and hurt you a lot. You will be busy with your business, building your relationship with your own wife back up again that you'd not have time to even think about the baby. Whiles, I can take care of it around the clock and give it a home where it is loved."

Miguel groaned, how the heck can Linnie see through all the questions and still be as truthful as ever? It was not helping Miguel's case at all but helping Linnie more instead.

"Once you've calmed down again from the whole ordeal and still wanna see the baby you may visit her or him." Linnie continued, "I won't refuse a father's parental visits to the child. Just don't kill it, please. I truly love this child as if it were my own and I can't just turn off my love for it."

Miguel sighed, he sat down and felt his stomach again. The fetus inside of him was definitely moving around a little bit and the warmth from Linnie's words were only strengthening Linnie's bond to the unborn baby.

Miguel had to admit, that he was losing the battle against Linnie and he couldn't do anything about it. The child was loved by Linnie and Linnie back to the child, Linnie was willingly accepting all the responsibilities of the infant from him and Nora and giving it a good home where it can grow up and be loved.

"Thank you for your honest words Mr Cosma." Miguel sighed bowing his head down, "We don't even need a court judgement anymore. I'll willingly let you adopt the baby. And I promise to carry it to full terms."

Miguel poofed up a document and signed it, Linnie smiled, signed it as well and the court was dissolved.

Miguel left the courthouse, feeling sadder than ever. Linnie ran after him and Miguel almost jumped out of his skin as the smaller Fairy embraced the bigger Fairy.

"Thank you Mr Fairywrinkle. I promise to look after her/him with everything I have." Linnie beamed.

Miguel groaned, "You can't know how delighted this makes me Mr Cosma."

"May we discuss one more thing before you go, please? I got an idea for you." Linnie said.

Miguel and Linnie sat together on a bench and Linnie pulled a notepad and pen out, handing it to Miguel.

"I don't have to write the adoption form out Cosma. The court has already done that." Miguel pointed out.

Linnie shook his head, "No nothing with an adoption form. Just think of a name for the baby, please. I've been thinking about it a few times and know what I'd like to call it, but because you're the father of the child you should give it at least a middle name."

Miguel blinked and noticed Linnie had already a piece of paper with some name written on it. Suddenly he felt unsure of himself.

"may I at least know the first letter of the name of the child? Just so it won't have the same letter twice in the name." Miguel instructed.

Linnie nodded his head, "Sure, the first letter is going to be a H."

Miguel nodded, he leaned back and thought of the whole alphabet and the letters in it, which letter could suit the baby that wasn't a H.

Suddenly Miguel smiled, he looked over at Linnie and nodded his head, writing the name down and handing it to him.

Linnie's eyes shone wide as he smiled and nodded his head too.

"Thank you." Linnie smiled at him. "I promise you the baby will get this as its middle name."

"Just don't bugger me about it all the time Linnie." Miguel snapped. "I need some peace and quiet for now."

"Of course and thank you." Linnie smiled before leaving.

Miguel rolled his eyes, how can it be that Linnie was so over joy with having the baby be in his possessions? At least he felt that Linnie truly does love the baby. And the name he's chosen for her, made Miguel burn up in embarrassment.

Both names will be good for the baby.
