Mentions of rape

It was a cold November day, and Elliot got called in on a case. There was a party, and a teenager the same age a Kathleen was raped. Cases that involved children were the harder cases. They get to the crime scene and Olivia interviews the victim. " Can you tell me what your name is?" she said in a soft gentle voice. Elliot was standing near the door thinking about his daughter and this could have been her. He snapped out his thoughts and started to listen to the young girl talk. She said that her name was Molly.

Olivia then proceeded to ask "can you tell me what happened?" Molly started from the beginning " I was invited to a party by some older guys and we were drinking" Molly started to cry. "One of the guys forced me into a room that was dark and he raped me." She gripped Olivia tight and was shaking crying "you didn't deserve that no one does and this isn't your fault" Elliot tells molly. Once they got into the car Olivia looked over at Elliot and asked "hey you have been a little distanced what's wrong?" "Kathy filed for divorce and she wants full custody of the kids" he replied. "I'm so sorry El" she replied "yeah me too although we haven't been together for 9 months"

Liv looked at him shocked, not expecting that. He was distanced but why wouldn't he tell her that they were separated. Not that it was any of her business but she thought they told each other everything. Though to admit the sexual tension between the two was at a high and both were trying to deny that they had feelings for each other. Elliot drove back to the precinct, The car ride was quiet, both of them lost in their thoughts. "What do you got?" Fin asked; Taking them both out deep thoughts, Liv told him the details of the case. They asked Casey Novak for a warrant to search the house the party was held in.

They got their warrant and found semen on the blanket and they asked people that were still in the house. What happened during the party everyone was clueless and hung over from the party. Molly was able to identify the person who raped her as a sophmore at Huttson university named Jake Rivers. They got a warrant for his arrest and they took him to integration."Tell me your side of the story" Elliot asked " We were knocking them back and she was all up. So we went back into one of my buddies' rooms and she started to undress me. Whatever she says isn't true" Liv standing next to him "She says that she was fighting you and that you pinned her down."

Jake started going on about how none of that happened and then an Olivier Gates walked in "Stop talking" his parents retained him as their lawyer. Liv and Elliot walked out integration and Liv turned to Elliot. "We need to check the security camera and interview some more of the kids at that party." Elliot nodded and they walked in sync to the squad car. They went and got chinese on their way back to the precinct after they had gotten their security tapes. They looked over the evidence and saw that Molly was all over him at the party but it looked as if he was forcing her up the stairs.

Cragen told them to go home and get some sleep and start fresh tomorrow. "You want to come over and talk, and have a beer" Liv said and Elliot nodded. After a quiet ride back to her apartment he started to talk. "Kathy thinks that I'm cheating on her with you" Liv is grabbing beers "Do you want me to talk to her?" "No, that would do no good. She's been thinking this for years but she said she is finally done with this, and I'm never home because of the job."Liv looked at Elliot who she has known for 9 years. She could tell that he was hurt by this and his family meant everything to him. She handed him the beer and sat on the other end of the couch.

"I'm not mad that she wants a divorce it 's probably for the best all we can do is argue. The part that pisses me off is that she wants full custody of the kids. I'm a good father. I provide for them. I'm present for them whenever I can be or when they need me." " I know El," liv said. "I may not have been the best husband but I'm a good father" He started to get emotional and liv scooted over and he rested his head on her shoulder. This put them in an awkward position of course liv isn't going to move at least right now.

Not when her best friend needs her; But god why does he have to look so handsome. "You are an amazing father and no one can take that from you and Kathy knows that. But she's hurt and when people are hurt they ultimately try to hurt other" Liv stated "But you should fight her for custody your kids need their father." El looked over at her and all he could think was that he wanted to kiss her but he didn't want to mess up their friendship. "I'm not even divorced yet and I want to kiss my partner of nine year and best friend" he thought to himself."With our jobs, what judge would give me custody of four kids?

We work all hours and get called in at random hours. There's no stability in that." Elliot said "But a judge may give you partial custody of them and hire a babysitter and get a bigger place to show that you can" He looked at her and nodded slightly and sighed. They both were tired and had to get up early in the morning. Liv offered to let him sleep on her couch so he didn't have to drive all the way back to his apartment in Tribeca. He woke up first shocked that she actually had food in the refrigerator. He picked up some eggs, bacon and bread. Liv walked out of her room shocked that he was cooking breakfast.

"Good morning" he said "morning" She replied he handed her a cup of coffee she thought " I could get used to this"She shook her head "He's still married and he most likely going back to his wife once this blows over" He looked over at her "I'm not going back to her" She hadn't realized that she said that out loud and her face went red. She stumbled trying to find her words. He walked closer to her about to wrap his strong arms around her waist when his phone started to ring.
