Hi. Um you don't know me, well some of you may, I've reviewed some fics, but I've never written an NCIS fic before, that I've posted anyways. This is just a one shot that came to me in the shower. It takes place during Silver War before Gibbs comes and sees Ziva sitting at Kate's desk. I think the writers left out this scene...I hope you like it, please review.

Special Agent Anthony DiNozzo stepped off the elevator and spotted a dark head sitting behind Kate's desk. For a second a feeling of hope went through his veins. You saw her die. You had her blood on you, he reminded himself. He turned the corner and saw her sitting there.

"What are you doing?" he practically shouted. "That's Kate's desk!"

Officer Ziva David looked up at him, eyes wide and more than a little startled. "I don't know if you know this, Tony, but she's not coming back."

"That doesn't matter! Get up!" Now he really was shouting. "Only Kate can sit there."

"Her name wasn't on the desk, Tony," she said gently.

"Really? Well I'll just put it there then." He grabbed a marker off his desk and walked over to Kate's chair. Caitlin Todd, he scribbled on the do not remove tag. He stomped back to his desk and threw the marker down on it. "There. Are you happy? IT'S KATE'S," he screamed. Tony didn't know it, but he had small tears running down his cheeks and jumping off his chin.

"Tony," Ziva whispered. "I'm sorry." She stood and walked towards Tony picking up a tissue on her way. "Here."

He grabbed it out of her hand and roughly rubbed it over his cheeks.

"Do you think Kate would want this desk to be empty?" she asked him.

"Yes."

She shook her head. "I didn't know her but I can tell you she wouldn't want it that way. She'd want someone sitting there, someone to follow her legacy. She'd want you to be able to look across the room and see someone else behind it, not just her. She wouldn't want you to forget her, but she'd want you to move on. To be a good agent and not be distracted by her," she half smiled, but her eyes were so sad that it didn't even seem real and went back to Kate's chair.

"That chair will always be Kate's chair, Ziva."

She nodded. "I know. I hope you don't mind that I use it."

Tony walked over to Ziva and gave her a gentle kiss on the head. "Thank you. Kate would have liked you. Of course if she was still alive you would never have met her so..." he trailed off.

"From what I hear, I would have liked her too," Ziva smiled, more obvious this time. She turned off the light, making it dark by Kate's desk and the path to the elevator.

He pulled away. "Actually, she probably would have hated you for being so nice to me just now." Tony walked off back towards the elevator, thinking about Kate and all the teasing he put her through. "I'll never forget you, Kate," he whispered, tears once again cascading down from his eyes.

Tony never knew it, but as he walked towards the elevator, he passed Special Agent Leroy Jethro Gibbs. Gibbs smiled as much as he could muster. "You hear that Kate? You made Tony cry. I'd say your job here was done."

Gibbs had been standing there the whole time as Tony had screamed at Ziva. Neither of them would know it, for Gibbs would soon pretend to be angry at Ziva in his own way.

He turned the corner and as his eyes came upon Ziva sitting at Kate's desk, he shook his head and realized he wouldn't have to pretend at all. To everyone who knew her, it will always remain Kate's desk. Nothing and no one will ever be able to replace her, not even Ziva David.
