About 3 months had passed and it was now October. Cody and Emery were now on duty for her grandfather's precinct. They enjoyed their job and were actually quite good at being uniformed officers. Erialynn was 5 months old and was learning new things every day. She could sit up on her own already and she was happy all the time.
"Hey momma's beautiful baby good morning!" Emery says, picking the baby up out of her crib.
They go downstairs and walk into the kitchen. Emery mixes Erialynn's bottle, and then walks towards her parents room.
"Everyone better be decent. It's your daughter and granddaughter." Emery says knocking.
"Come in." her mother says.
Erin was on the bed zipping her boots up. Jay was in the bathroom off of their room.
"Mom, does grandpa need help with paperwork today."
"I'm not sure but I'm sure he would love it if you guys came and helped out. Since today is your day off."
"Hey I got an idea why don't you stay home and do something other than work for once. By the time baby girl here is 3 she's going to know cases like the back of her hand." Jay says, grabbing Erialynn and throwing her in the air.
"Dad you're lucky I haven't fed her yet. She would have puked all over you." She said with a giggle.
"Ok here she wants her mommy." He says as she starts to cry.
Emery cradles her daughter in her arms and feeds her the bottle. That was their morning routine: bottle at 7, baby food at 8, and nap at 9. Even when Emery worked the little girl was on the same schedule. This was because Emery didn't have to have Erialynn at the sitter until 8:45 and then to work by 9. So she always takes her nap first thing at the sitters. Erin and jay leave around 8:15 every morning but that morning they had left a little early. "Bye we love you girls."
"Love you guys too."
Emery fed the baby her bananas and oatmeal at 8 and she rubbed it all over her face and in her hair so a bath was needed. She filled up the kitchen sink, grabbed the travel baby soap out of the diaper bag, and a baby towel out of the laundry basket.
"Come on princess, let's get cleaned up and then take a nap. Then we can go see Papa." She says unstrapping the baby from her high chair.
She bathed her and then wrapped her in the towel and then held her close to keep her warm. Emery was heading for the stairs when she heard a knock at the door.
"Let's see who it is, love bug." She says opening the door.
"Emery..." Tessa says and then stops when she sees the baby.
"You need to leave." Emery says slamming the door in her face then locking it.
Emery headed up the stairs and got her daughter dressed then rocked her to sleep and laid her in the crib. She headed back down stairs and Tessa was still on the porch. Emery gets her mom on the phone as she thinks of a plan.
"Mom, I need you to stay on the phone and listen ok. I'll explain later."
"Ok." Erin asks, puzzled.
Emery walks out on the front porch with her phone and the baby monitor in hand.
"Tessa, what are you doing here?"
"I came to see my daughter. I figured..."
"For one she isn't your daughter she's mine. She has my last name. I'm the one who named her. You never even saw her once at the hospital. So you need to leave now."
"Emery please, you know how hard it all was for me."
"Don't even talk about hard. You walked away, you took the easy way out, you signed your rights over to me. I'm legally adopting her. Why come back now Tessa? She's five months old. You don't even know her name."
Erin was listening to this whole conversation on her phone. She looked at Jay in shock.
"Jay we got to go. Tessa's at the house."
"Go, let me know what happens. Bring her back with you." Voight says.
Erin and Jay quickly head for the car and go home. She is listening to her very upset daughter and could tell she was barely holding it together.
"Hang in there baby, we will be there soon." Erin whispered.
"I wanted to come tell you in person that I want my rights back but since I can obviously tell you aren't going to give her back willingly. I've already talked with a lawyer."
"How dare you? She is mine and she isn't going anywhere. The little peak of her in her towel will be the most you will ever see of my daughter. You know nothing about her. Do you even remember what day she was born?"
"April 30th"
"Wow... Nice try but no. She wasn't born the day after the trial. She was born May 8th, 2016 at 4:45 pm. She weighed 5lbs 3oz. She was in the NICU for almost a whole week after she was born because she was 5 weeks early and was having problems breathing. I held her on my bare chest day in and day out. Hoping that the progress she was making wasn't going to stop. They sent me home with a monitor that would go off if she stopped breathing. Thank god she never had any issues. Would you like to know her name?"
Tessa just stood in shock, she didn't know what to say.
"Her name is Erialynn Michelle Lindsay. My mom helped me name her. Cody who has no connection to you or my daughter but the fact he was seeing me. Is the world's best father to his little girl. I went and saw Adam in prison. He signed his rights over so good luck trying to take her from me. My parents are here so I'd leave if I were you." Emery said hostile.
Tessa got back to her car before Erin and Jay even got out of theirs. Emery went inside with her mom following closely behind her. As soon as she saw her mom she broke down in her arms.
"Mom, she can't take her. She's mine."
" Baby she will never get her away from this family. Come on go get little miss and let's go to the precinct."
Emery heads for her bedroom and leaves her parents to discuss.
"What is her reasoning for coming back now?"
"I don't know. When we get back I'm calling the lawyer and filing a restraining order."
"Erin calm down. There is no way she will show up again after the beating Em just put her threw."
Emery hardly said a word on the ride to the precinct and even when they got there she didn't let Erialynn out of her sight. She strapped her on her chest in her baby wrap and did her work like that. Erin had explained everything to Hank and he just sat back and waited a little while before he pulled her in his office.
"What do you want to do baby?"
Emery was silent and just looked down at the sleeping baby strapped to her chest.
"Sweetie she's fine no one is taking her from you."
"You can't promise me that."
"Honey..."
"I already called Olivia and she said I can work on the beat for SVU and she's fine with me staying with her and Noah until we get our own place. I can't stay in Chicago anymore grandpa."
"Does your mother know this?"
"No, I haven't told her yet. Olivia just called me back."
"What about Cody or Jay?"
"Cody will understand he knows I have to keep her safe. If they can't find me I can't be served papers. She's mine. I have all the documents saying so except the actual adoption certificate. It isn't illegal for me to take off with her, I checked."
"But is that the life you want constantly looking over you shoulder?"
Grandpa, I don't know what else to do."
She says quietly breaking down as he wraps his arms around her.
"Baby you don't run, you stay and you fight. It's in your blood, your mom has taught you that.'
Emery didn't say anything, she just cried and when she finally calmed down she went out into the squad room, finished her work and then sat rocking her daughter until it was time to head home.
Emery got home, took Erialynn upstairs, placed her in her activity saucer and then sat at her desk and began to write a note. She then started to pack her truck with the things she knew they would need for their life in New York. Then late that night she loaded her 5 month old up in the car for the 12 hour drive to New York. The next morning Erin woke and went upstairs to see if Erialynn was awake and found a note taped to the baby's crib.
"Mom and dad, I had to leave. Don't worry we are safe. We are going to be staying with Olivia and Noah in New York. I'll be working at SVU. I want you both to know I love you and just can't stay any longer. I have to protect my own daughter now. Don't come after me. I love you and I'm sorry. I'll call as soon as I can."
Erin breaks down into the rocking chair next to her granddaughters bed. When she finally gets the strength, to pull herself together and go downstairs to tell Jay she finds Cody coming in the front door.
"Emery just called me and told me she was taking Erialynn and moving to New York. That'd be ok and I was more than welcome to visit. What's going on here? I'm so confused." Cody says almost crying.
Erin wraps him in a big hug just as he starts to lose it. Jay came around the corner and saw them and was instantly concerned.
"What's going on?"
Erin hands him the note and he begins to read. Before anyone says a thing, Jay goes into his room and grabs his jacket.
"Jay what are you doing?"
"I'm going to get our daughter and granddaughter and bring them home."
"Jay she's scared she isn't going to listen to you or me or anyone." Erin says almost in tears.
"What do we do then erin?"
"We let her go. Pray she gets homesick and comes home. She's almost 20 years old, we can't go and drag her back by her hair. She knows as long as she's gone and has paperwork saying Erialynn is legally hers, Tessa can't touch her. It isn't illegal."
"So we just wait?" Cody asks.
"Yeah, that's all we can do at this point." She says.
