Emery got up the next morning, fed Erialynn, and then got her ready for school. Erin was already gone for the day when they got up. Cody had been undercover for a few weeks and Emery was missing him like crazy. Especially with everything she had learned the night before. Emery got to work and went upstairs. She sat as far away from her dad as she possibly could.

"Emery and I talked with a few witnesses yesterday. They all had different stories but they agreed they saw 2 boys running from the house."

"The only family he had was an Aunt in Arizona and she said that Samuel had a 15 year old brother, Luke Owens, who lived with him. Both of their parents passed years ago. No one has seen him since the day before the fire" Emery says.

"According to CFD the fire was started in this back porch area. Gas was used as an accelerant. It was poured from the back porch and it was poured so that none of the exits were accessible. This was a murder, who ever set it knew Samuel was upstairs." Ruzek states.

"Burgess and Atwater go see if you guys can find anything useful at the scene. Dawson and Upton, go speak with Captain Boden to see if he has any insight into exactly what happened. Emery, you and your dad need to go see if you can pin down Luke." Hank says as he walks back in the office with Emery following close behind.

"Please grandpa put me with anyone but him. I'll stay here if needed." Emery pleads.

"What's going on with you two?"

"I'm mad at him. He keeps trying to talk to me and I don't even know what he expects me to say."

"Emery he's your dad.Go." Emery sulks out of the room and down the stairs with her dad following close behind.

"You don't want to drive today."

"Frankly I don't even want to be in the same room as you, let alone the same car."

"Emery, what is the problem? I'm trying here."

"Trying, really? What, trying to distract everyone from what's really going on? Trying to sleep with mom again? Is that what you mean by trying dad?"

Jay goes completely silent and doesn't know what to say next. Emery at this point is fuming, she's trying to do her job and not let her feelings get in the way but it's extremely hard when you have to work with the person who hurt you to begin with.

"That's what I thought. Let's just do our job so I can get home to my daughter." Emery says getting out of the car and walking away.

The rest of the day just drug on for Emery. She was so mad she couldn't even stomach the thought of being anywhere near her father. Jay didn't have the words, he was still shocked Emery even knew what had happened. He knew he had to decide what he was going to do. If he chose Hailey would he lose his daughter? If he chose Erin would Emery ever forgive him for cheating on Hailey? Those 2 questions just kept rolling through his head. He knew he had to talk to Erin and he also knew neither one of them wanted to see one another yet. Jay snuck away as soon as they were at the precinct to make a call.

"Hey." He heard a familiar voice say hesitantly.

"We need to talk in person. Can you meet?" He says.

"Yeah, meet me at the diner in about an hour." Erin replies.

Jay sneaks around the squad and tries to not let on that he's going anywhere. He manages to slip out without being noticed and heads for the diner. When he gets there he finds Erin sitting in a booth sipping on coffee.

"Hey" Erin says.

"How did she find out about us." Jay asks puzzled.

"I was on the phone with Olivia. I was trying to make sense of it myself. I didn't even know she was home." She says.

"She won't even look at me Erin." He says hurt.

"You act like you're the only parent she's punishing and you aren't. She won't even speak to me and we live in the same house." Erin states almost in tears.

"What do we do?"

"The only thing our daughter wanted for Christmas was us to get back together. She didn't think I knew that but I did. I think this whole situation just brought up a lot for her and she knows you're with Hailey. She doesn't want anyone being hurt in the process of her getting what she wants." Erin explains.

"I understand what we did was wrong. I understand that it will hurt Hailey. I don't know Erin. I'm not this guy and you know that. I'm not sure I can get married to her." He says looking at her.

"Jay, what we had isn't possible anymore. You were happy with Hailey. I just made your life more complicated."

Jay reached over and grabbed Erin's hand tightly. He caught her gaze and looked deep into her eyes.

"You never made my life complicated. You gave me my family. I love you and I always will." Jay says.

"Jay I can't do this" Erin says getting up and leaving.

Erin left the diner and Jay quickly followed. He caught up to her and grabbed her arm.

"Wait."

"Jay we can't."

"Why? What if I want to be with you?"

Erin freezes and in that moment she realized it was everything she wanted him to say but it was a few years too late. Maybe if he wasn't in a relationship it would change things but that wasn't the case.

"It's a little late Jay. Go back to Hailey. I'll deal with our daughter." Erin says getting into her car and driving off.
