Blue Bloods - 12-19 - Donny and Maria
With the holiday festivities over Eddie realizes that her due date is approaching…. Her Obstetrician Dr Stephanie has been closely monitoring the triplets growth and has scheduled an office visit for Eddie.
Eddie: Jamie ….. can you come with me today to Dr Stephanie… I don't know how much longer I can hold out….. I'm starting to look and feel like a bowling ball
Jamie: I planned on being with you….. I've taken the day off… When do we have to be there
Eddie: The appointment is at ten and Dr Stephanie will tell us what's happening next
Jamie helps Eddie into their new Genesis GV80 SUV.
Eddie: I'm glad we got this …. The seats are so comfortable and the three car seats fit nicely.
Jamie: you always know what you want
At the doctors office the nurse tells them that Dr Stephanie is running a little late , She delivered twins this morning.
Eddie: I hope she won't be late for our boys
Jamie: don't go there…. We are not the only one's having babies
Eddie: Ever since we decide their names I can't wait to see them and hold them….. soon Justin, Jeremy and Jonathan Reagan will make their presence known
Jamie: Long as they are healthy… that's all that matters
Nurse: Eddie ….. Jamie … Dr Stephanie is ready to see you
Dr Stephanie: Jamie…. Has our Eddie been doing things she shouldn't be doing
Jamie: she's been good….. she pushed it a little attending our nephews wedding
Dr Stephanie: Eddie…. I told you these last few weeks are the most crucial….. no undue stress … come let's lay you down so I can take a look
Eddie: I didn't do anything to hurt them did I ….. were the twins you delivered healthy ….. no complications
Dr Stephanie: let your mind relax….. the twins this morning were fine ….. the mother wanted a natural birth but because the way the twins were positioned… it was better for them that we did a Cesarian. Everything went well the babies are well.
Eddie: I've been thinking… can I do natural birth for my boys
Dr Stephanie: you could if all the conditions were right… but I don't recommend it… I don't suggest putting that much stress on yourself let alone the babies, especially the second and third one. From what I'm seeing we should schedule you for next week for delivery. These boys are ready to meet their mommy and daddy
Eddie's eye's light up: Jamie ….. it's finally happening
Jamie gives Eddie a gentle kiss as he too has a grin from ear to ear
Dr: Stephanie: we will schedule the delivery room for next Thursday …. We will get into touch with you with the exact time so everything will go smoothly
Eddie: You will be there right….. I trust you
Dr Stephanie: I promise you I will be there… now you will promise this next week …. You will just rest ….. stay off your feet and just be pampered by Jamie or who ever else you will have helping you. This will be a very hard week on you physically … you need to rest… your only concern is your three sons.
Jamie: I will make sure of it
Eddie : I promise…. I'll behave
Dr Stephanie: if you sense anything out of the ordinary or any severe pain that is unusual call me and go to emergency immediately ….. I will see you next week as long as everything goes according to plan.
At the Commissioner's office two emails were delivered. Abigail opens the one addressed to her from Amy
Amy: Abigail…. Joe told me that it was more than likely that you choose our honeymoon location….. I want to thank you from the bottom of my heart for selecting such a romantic getaway….. This place couldn't be more perfect for Joe and I start our married life….. PS Joe is reaping the benefits … Thank you again….. I've attached a few pictures of how good your choice was
Abigail smiles and goes into Frank's office
Abigail: have you looked at your email's yet
Frank: no…..should I
Abigail: It's from your newest granddaughter…. She sent me one thanking me for selecting the place…. From the pictures she sent they look like they are having a great time….. seeing your granddaughter in her choice of swimwear …. Your grandson is being very well pleased
Frank: What are you saying Baker….. My grandson found himself a hot wife
Abigail: What I'm saying is you Reagan men know how to pick Reagan women
Frank looks at the pictures: She is allowed to go out in public like that
Abigail: with a body like that … you may become a great grandfather for a second time…. By the way I need to take some personal time and I don't need prying ears … is that ok
Frank: Take whatever time you need
Abigail: I'll bring someone from the office pool to answer the phones and bring your coffee…. I'm thinking several days should do it….. but if you need me I will make my self available
Maria calls Eddie to see how he visit with Dr Stephanie went
Maria: I was getting worried when you didn't call … is everything all right… she didn't find any complications….. did she
Eddie: not only are you a sister to me ….. your more mother to me…even my mother doesn't worry about me like you do… Are you ready to be Aunt Maria
Maria: What did she tell you….. are the boys ok
Eddie: they are better than Ok ….. next Thursday she will deliver them… my three sons will finally be with us….. you should have seen Jamies face… I have to stay bed ridden till then
Maria: I'll be with you…. To make sure that you are… at least you know your due date…. I don't like this waiting
Eddie: with you Danni will come out naturally… Dr Stephanie said it would be better for the boys and me if she does a Cesarian
Maria: look at the upside you know when and how….. I have to wait until my water breaks and who knows when and where I'll be….. so count your blessings
Eddie: Jamie is calling my mother to let her know… if she decides to come over will you help me keep her under control…. She will drive me crazy with her recommendations as to what I should do
Maria: Lena isn't that bad is she
Eddie: you haven't been around her much…. She is so more opinionated than I am… you have to admit I can get under your skin
Maria: you're Eddie that's what we all love about you
Eddie: that's why I love you so much you know what to say and when to say it
Maria: I'll change my schedule to fit around you this week…. Tell Jamie he doesn't have to worry… I've got you covered.
Jamie's call to Lena Janko didn't go the way he expected
Jamie: Lena….. this is Jamie your son in law…. I have some news for you
Lena: What news … Eddie didn't make you breakup…. Did she
Jamie: No … nothing like that… remember when we told you we were pregnant… Well next week the babies will be delivered
Lena: babies…. How many babies….. I thought their was only one… I'm to young to be a grandmother
Jamie: No…. we are having triplets … you'll be a grandmother to three boys , come next Thursday
Lena: How can Eddie deliver three babies ….. she isn't that big
Jamie: Eddie is amazing and she is carrying three boys… she has to stay in bed this next week so if you want to see her… you'll have to go to our apartment
Lena: how are you going to raise three boys in an apartment
Jamie: for now we have that covered…. I have to get back to work ….. I'll let you know if anything changes
Lena calls Eddie
Lena: I had the strangest call from Jamie…. Your husband… he said that you will be delivering three boys… when did this all happen
Eddie: Mother….. You don't remember me telling that Jamie and I were pregnant with triplets… I thought you stayed away because you were afraid of being a grandmother….. not that I minded
Lena: so you are really pregnant with three boys….. no one in both of our families ever had twins let alone triplets…. Are you sure
Eddie: I'm very sure mother…. If you were to have taken an interest you would've seen how sure I am…. Mother …. I have to get off my feet… I promised the doctor that I would stay calm and relaxed… Jamie will let you know if there are any changes.
Lena: Eddie do you need my help…. I come by and help you….. I love you sweetheart
Eddie: I love you too mom….. bye
Abigail calls Brian
Abigail: Brian… can you meet me for lunch so we can talk….. this is a conversation we both need to have
Brian: Is it about what I think it's about
Abigail: I can fix some lunch at the house … say 12:00 noon
Brian enters their house and sees lunch waiting for him: This is a surprise
Abigail: It's a surprise to me too….. How to begin… How do you see us….. as a couple … as a family
Brian: I don't understand… How do I see us….. you mean like you Abigail Baker…. Top cop working directly under the commissioner and I'm just a beat cop handing out traffic tickets
Abigail: let's leave our jobs out of it… I'm talking about you and me … when did we become two people living in the same house taking care of children that we had when we were a loving couple…. Is that clear enough to understand…. Please don't take this as a blame game… I'm as much at fault as you are … I know that….. the question for this conversation is what are we going to do about it
Brian: I don't understand….. are you asking if we can get back to where we were or are we going to admit that we can't
Abigail: Let me put it another way… do you have any love for me or does your new girlfriend have all of it…. Again don't take it as though I'm blaming you….. I haven't been much of a loving wife to you… but to be fair you haven't been a loving husband either
Brian: When did you suspect… did you have the commissioner get details on me
Abigail: Brian I was and still am a very good detective … I don't need the commissioner to do what I can do myself…. The only reason for this conversation is for both of us to finally admit if we still belong together…. You haven't been happy in a very long time… I've become unhappy because I don't want to be in a situation like this… I want to be happy with myself. I don't want our sons to be on pins and needles and wondering when the dam is going to break… it's not fair to them and it's not fair to either of us
Brian: Are you saying that we should cut our losses and go our separate ways …. Like divorcing each other
Abigail: If that's the only way….. then yes… we should get a divorce….. but we need establish ground rules….. I don't want our sons to be destroyed by this…..we don't have to become enemies because we are choosing a different path for each other
Brian: How long have you been thinking about this…. Let's face it Abby ….. you give great thought into everything you do that's why I could never measure up to your expectations.
Abigail: All marriages are filled with highs and lows… but this last time when you lost control of yourself … it was your cry for help and you were no longer happy with me or our marriage…. From that point on I did some self evaluation and realized I was going along to get along and that was being unfair to you and to myself. When I discovered you had a girlfriend I wasn't devastated ….. I was relieved. One of the ground rules….Under no circumstances will the boys know that you have a girlfriend until after the divorce… are we clear.
Brian: How can you be so calm about that
Abigail: This is part of the solution to our problem and I desperately want a solution… I want both of us to be happy it's as simple as that
Brian: maybe we should have tried an open marriage long ago and maybe we wouldn't be hear now
Abigail: You actually think a different dick inside me would make me happy… if you continue to think that….. the poor girl that's fucking you now will be in for a big surprise. You see how different we've become
Brian: so this is what you want
Abigail: no this is what we both need… we won't say anything about this to anyone….. when you need to see your girlfriend I'll make some excuse for the boys, but again if you show her to the boys I'll cut your balls off and become your worst nightmare. I'm going to contact a lawyer I know that will be very discrete and handle the piles of paperwork that the state of New York requires. This will be a no fault divorce and no one will be blamed. Brian: I had no idea what you had in mind when you asked for this luncheon…. But you are Abby and you've thought this out… My curiosity won't let me go without asking ….. does the commissioner know you are doing this
Abigail: Why do you bring up the commissioner….. he is my boss… What makes you believe that I'm his mistress….. I've seen all his mistresses and I'm not one of them… are we clear.
After Brian leaves Abigail calls Jack Boyle
Abigail: Jack….. this is Abigail Baker from the Commissioner's office… Can I schedule a meeting with you on a personal matter… I need it to be very discrete
Jack: Is this concerning the commissioner…. It's taken me a long time to get back in his good graces and I don't want to jeopardize that now
Abigail: Nothing to do with the commissioner or any of the Reagans… it's a personnel family matter….. I will explain everything when we meet
Jack: When would you like to come in
Abigail: I've taken a several personal days off… any chance you could squeeze me in
Jack: Can you tell me what's it about so I know how much time you will need
Abigail: again I want this to be very discrete… My husband and I have agreed to divorce…. It will be a no fault….. it's time this marriage ends
Jack: I'm not a divorce lawyer….. but I can get someone in our office that can put together all the paperwork that needs to be filed… I need to ask….. no chance of reconciliation
Abigail: no ….. we have both stayed past the expiration date….. sometimes things just can't be fixed….. this is one of them
Jack: if it won't be contested from what I understand and from personal experience it's just a matter of processing all the necessary forms. How about tomorrow morning before I have to be in Court say 8:00 AM …. Is that to early Abigail: Can it be 8:30… I have to get my boys to school
Jack : That will be fine ….. I will see you tomorrow morning
Abigail : Thank you
Maria is as excited as Eddie with the news as to when the triplets will be delivered…. She can't wait until Danny comes home to tell him
Maria: Danny….. I have to tell you you lost your bet with Jamie
Danny: What bet did I have with Jamie
Maria: you know….. the one as to whose baby will be born first….. because they are having triplets their due date shrunk to 33 weeks….. next week will be 33 weeks and the obstetrician says it's time. The Reagan triplets will be here… Poor Eddie needs to stay in bed until it's time… she is so big now… I don't know how she does it… Jamie helps her get dressed and undressed and she can bearly walk… I'm going to stay with her and help her out through out the day until Jamie comes home
Danny: I don't want you overdoing it… your carrying our daughter
Maria: Don't worry….. Eddie would do the same if the roles are reversed….. it's only a week ….and we get to start seeing new Reagan babies….. we won't know if they are identical until that day
Danny: one good thing our Danni will have three playmates she won't be so isolated since everyone else are adults.
Maria: I think they will be more like brothers and sisters instead of cousins…. Eddie and I have gotten very close …. Our children will be close
Danny: one thing for certain the Reagan Sunday Dinners will never be the same
Maria: after dinner… you want to rub my feet
Danny : I would love to rub something else but I know we are past that
Maria: you made my day…I promise you after Danni is born I'll let you rub whatever you want…. I want you as much as you want me…. Danny Reagan
The Next morning Abigail arrives at Jacks office
Jack : Are you still ready to proceed with this … if you are I have a stack of forms that will need to be filled out between you and Brian….. The biggest obstacle is the Equitable Distribution of Assets…. Let me explain….. New York is now equitable distribution state. When a spouse files for divorce, the court must divide marital property equitably or fairly. But equitable doesn't necessarily require an equal split of the couple's assets. Instead, the judge will strive for a fair outcome considering :
. Each spouses's income and property when they married and when they filed for divorce . The duration of the Marriage . Each spouse's age and health . The need of a parent with custody to live in the family home and use or own its effects . The pension, health insurance, and inheritance rights either spouse will loose as a result of the divorce, valued as the date of the divorce . Whether the court has awarded spousal maintenance ( Alimony)
. Whether either spouse has a equitable claim to marital property to which that spouse does not have title, based on that spouse's contribution of labor, money, or efforts as a spouse, parent, wage earner, or homemaker, including contributions to the other spouse's earning potential( by, for example working to put the other spouse through school . The liquid or non liquid character of all material property . If the material property includes a component or interest in a business, corporation, or a profession, the difficulty of valuing that interest to be retained intact, free from claims or interference by the other spouse . The tax consequences to each spouse . Whether either spouse has wastefully dissipated marital assets . Whether either spouse transferred or encumbered marital property in contemplation of divorce without fair consideration . Any other factor the court expressly finds to be a just and proper consideration ( NY Dom. 236 (B)(5).)
What Property is subject to equitable Distribution . Each spouses income earned during the marriage . The property purchased with either spouses income . The property the couple purchased while married . The retirement benefits each spouse earned during marriage . The appreciation of marital property while the couple was married ( N.Y. Dom. Real. 236 (B) )
What is considered Separate Property . Property either spouse acquired before marriage . Property either spouse received individually as an inheritance or gift, except from the other spouse . Compensation for personal injuries to either spouse . Any property characterized as separate property in valid prenuptial agreement or other written contract . Property acquired from the proceed or appreciation in value of separate property unless that appreciation is partly due to the efforts and contributions of the other spouse (N.Y. Dom. Real. 236 (B)(d).)
Abigail: I could see if we multi millionaires this could get very complicated but we are not Brian and I are two cops that got married had two kids and tried to make a life together…. We have some saving for the kids education … much of our problems stem from my advancements and he remaining as a beat cop.
Jack: are there other people involved… girl friends…. boyfriends
Abigail: He has a girlfriend but I don't want that mentioned …. I don't care about that…. I don't want my sons to know that.

Abigail: no…. But Brian believes that I'm in love with Frank
Jack: Are you
Abigail: Frank has always treated me as his daughter…. We have never had any relations sexual wise if that's were you are heading …. Do I care for him …. Yes
Jack: After you and Brian fill out all these forms we will meet again to make sure that both of you are on the same page and that no one throws a monkey wrench into the final settlement….. if you both are in agreement we can get on the docket so we can get in front of a judge…. And resolve this amicably.
Abigail: you understand why I want this to be discrete
Jack: I understand completely… call me when you have everything completed…. Divorce is not fun
