Title: You Want Me to Do What?

Summary: Unexpectedly, after divorcing Jake, Ellie discovers she is pregnant with his child. Struggling against her demons she confides in Tony. And she has a request for Tony to help her stop Jake taking her child from her.

Also – I may have made Jake Malloy out to be a bad guy. I never really liked him anyway.


You're pregnant. The Doctor's words rolled around in her head, echoing off the sides and it was starting to give her a head ache. Eleanor Bishop hated that she hadn't known about this before now. She should have known. She sighed heavily and put her head in her hands at her desk.

"Ellie? Are you ok?" Tim asked, he was usually in only just before Tony so she expected Tony to follow closely behind Tim.

"Huh? Yeah, Tim. I'm good. Where's Tony?" Ellie asked.

"I saw him as I came in. I think he's grabbing coffee before coming up." Tim said.

"Oh…"

"Why?" He asked.

"I just need to talk to him about something. It's the kind of thing I think he could help me with." Ellie said.

"Well, he's here now. Why don't you ask him?" Tim smiled.

"Ask who what?" Tony said as he placed a coffee down in front of Ellie, then on Gibbs' desk, on Tim's and finally lifted his own hazelnut coffee.

"Tony…Ellie needs to talk to you." Tim said.

"Ellie?" Tony turned to the woman.

"In private?" She asked, biting her lip. He nodded a little confused.

"Come on." He led her to a conference room and shut the door behind them.

"So, you wanted to talk?" Tony asked, sitting down. He didn't mind talking privately with any of the members of the team. If they needed to talk to their big brother then it would be OK.

"I found out yesterday morning that I'm pregnant." Ellie said, softly. She hadn't wanted to tell anyone until she couldn't hide it anymore. But she knew that Tony would notice.

"Oh. Congratulations." Tony said, still confused about why this had to be said in private.

"No. It's Jake's." Ellie was shaking her head and the familiar burn of tears made her shut her eyes. Suddenly she felt a presence in front of her. Large, warm hands on her knees.

"Ellie? Ellie…look at me." He urged. He didn't want her to be upset and he needed to know that she understood that he was there for her.

"No…" She shook her head again.

"Yes, Ellie. Look at me." He coaxed, again she shook her head. He didn't have a lot of experience with girls when they were upset or conflicted as Ellie seemed but he could be a big brother and that is what he was going to be.

"I can't…" she sobbed.

"Yes, you can." He said, big brother love coloring his tone.

"No. I can't." She whispered.

"Why not?" He asked.

"I can't handle…your expression…" She sighed. He frowned; did she think he didn't love her like a sister? Had he given her any reason not to think that?

"Of concern?" she lifted her eyes to his, "Ellie, you're like a little sister to me. I would never dream of showing you anything else other than concern. Now…what can I do to help you?"


"Say again?" Tony started to frown as he let Ellie's explanation roll around in her head. She was pregnant with Jake's baby and was afraid that Jake would try to take the baby from her. And the only reason would be because he had always wanted a child. But – he would only take the child if it was a boy. Ellie had made the decision not to tell her ex-husband about the pregnancy. She had also chosen her eldest 'brother' to tell and confide in. But there was a catch.

"You want me to do…what?" he was sure he'd heard her wrong.

"Only if Jake finds out I'm pregnant. I'm hoping that if he does and wants to take the baby if it's a boy – I need to convince him that it's not his baby. Look, you're single and I'm recently divorced from my husband. Jake would accept that I could be 'distraught' and seem comfort in anyone I can. So, it seems logical that I would naturally sleep with you if I needed that comfort and if you were drunk enough." Ellie said.

"You want me to pretend that your child is mine?" Tony asked.

"Why not? Only you, me and the team have to know. That way if Jake asks, they all say the same thing." Ellie said.

"Ellie…I already told you you're like my sister. It's going to be really weird. But…the team should know – otherwise it's going to make they really confused. Particularly Jimmy." Tony said, "and do you honestly think that Jake is that dense?"

"That's why I'm going to be asking you to sleep over whenever he's around. You can sleep on my couch for all I care. But knowing Jake he'll be over early any morning so having you there – coming out of the shower, making coffee or breakfast would certainly make him think that you are sleeping with me." Ellie said.

"If that's what you want. As long as your couch is comfy and not like Gibbs' lumpy couch." Tony warned.

"It's soft Italian leather." She said, she'd gotten a new couch after she divorced Jake, so it was still brand new.

"I'm there!" Ellie laughed; she knew that anything Italian usually had Tony's name written on it.


Three months Later

Just as Ellie had predicted. When Jake found out Ellie was pregnant, he came looking for Ellie, firm in his belief that the baby was his. But for the past month and a half, Tony had been sleeping on her couch. So, when Jake had knocked on the door loudly and woken him, Tony was able to get up put away the blanket and pillow and wake Ellie. She ushered him into her shower and then made her way to the door opening it to Jake.

"Jake! What are you doing here?" Ellie cried, acting surprised even if Tony had suspected it, was Jake. Tony was singing in the shower; he'd started the song half-way through so it didn't sound like he'd just jumped in.

"Ellie! I came to help you take care of yourself and the baby!" Jake said as he stepped in past her even though she hadn't invited him in.

"What?! Why would you want to help me take care of Tony's child?" Ellie exclaimed, immediately starting their lie. Ellie heard Tony stop singing and the shower stop.

"Tony?!" Jake balked.

"You ok, Ell?" Tony asked as he walked out, jeans pulled on but shirtless.

"Tony?" Jake said, disbelief coloring his tone. Ellie welcomed the embrace Tony offered, letting herself lean back into his still damp chest as if they were truly lovers.

"Oh hey, Jake." Tony said with a fake smile.

"What are you doing here?" Jake asked, as if had no idea even though Ellie had already explained it to him. Ellie stepped away towards the kitchen to make coffee.

"Could ask you the same thing." Tony replied.

"I came to help my wife take care of our child." Jake stated, matter-of-factly, to be answered by a scoff from Ellie.

"Uh, I believe that's ex-wife and it's my child." Tony said, taking a threatening step towards Jake who took another back.

"Jake…you lose. Sorry, but this is Tony's child." Ellie said from the kitchen.

"But why Tony, Ellie?" Jake asked as Tony backed him to the door.

"Why not Tony, Jake?" Ellie replied.

"You lost her, Jake. Game over." Tony said before shutting the door in the stunned man's face.


Seven Years Later

Wide brown eyes looked up at him from a heart-shaped face as he finished up the story, he had been begged to tell for the fourth or maybe the fifth time by the 7-year-old in his lap.

"Really? That's what happened?" He whispered, awed by his story-telling.

"Yeah. That's exactly how it happened." Tony swore.

"So that's story of you and Mom?" The little boy asked.

"Sure is, little man. Like I said, I may have acted like your dad for a while, but that was to keep you and your mother safe. I'd do anything for you two." Tony promised.

"Thanks, Dad- I mean Uncle Tony." The boy grinned sheepishly.

"Yeah – you're welcome, Oscar." Tony said, ruffling the boy's hair with a grin.
