A/N: My take on Surrender Benson. I just don't see Elliot not showing up. Not after everything they'd been through. Definitely a long one shot. I've got many more swirling around in my head.

"Maybe you should call him then," he gurgled. "You don't have the balls the kills me. If you did I'd all ready be dead," he spat. He was right. She couldn't do it. Olivia closed her eyes, took a deep breath and pistol whipped him until he passed out.

Olivia paced around the room, the glock still in her hand. She should. It's been two years but she knows he'd come. She knows that he's probably been breathing down Cragen's neck wanting information on her whereabouts. She'd be doing the same thing if the situation were reversed. She goes to the home phone and dials the familiar number she hopes is still in service. "Please," she pleads with him. "come," she says wiping tears from her eyes.

It's not even 20 minutes and he's there and she's in his arms and she feels safe again. "I almost didn't think you'd answer," she admitted, her voice muffled by his chest.

"Cragen almost threw me in the cage for interfering with a police investigation," he said quietly. He placed a kiss on the crown of her head. "Mo called me when she saw it on the news. I went out of my mind," he added, kissing her closed eyes then the tip of her nose then her cheeks. He didn't think he just kissed her lips softly and she clung to him. She clung to him like her life depended on it, because it did. She felt alive again for the first time since she got his medallion. "Where is he?" Elliot asked

"The bedroom," she said to him.

He took the glock from her and moved towards the bedroom. He saw the open cuffs and said a silent prayer. He kicked the door back hoping Lewis was stupid. He heard a groan as Lewis sank to the ground. He didn't think. He grabbed the iron rod and hit him in the face, more than once. He heard the bones crack. When Lewis fell onto his back Elliot flipped him over, pulled at his one of his arms and stepped on his shoulder, dislocating it then moving to the next one.

Elliot shattered Lewis's kneecaps then one of his femurs then used a special skill to compound a tib-fib fracture. Then he stomped on his chest with his full weight knowing full well Lewis's ribs were pulverized.

He kept picturing Liv, his Liv tied to a chair, burned and tortured and god knows what else. He kept hitting Lewis with the rod. The more he saw her battered and bruised, the harder he hit him. He stopped when he felt her hand curl around his bicep. He dropped the rod without question and turned to face her. I don't know what to say. Thank you doesn't seem appropriate here." She said sheepishly.

Elliot didn't respond. He pulled her into his arms and Olivia instantly relaxed. She inhaled his scent and she felt herself grounded. That therapist was right. She was dependent on him and at this point, she didn't give a damn. "I love you." He said softly and she looked up at him, he curled a finger under her chin looking for any sign she was going to try and bolt.

"I love you too." She responded, tears slowly falling. "I couldn't stop. I tried. I tried to hate you for leaving but I understood. It took me a while but I got it. I would've convinced you to come back, to stay with me and that wouldn't have been fair. It's why I didn't tell you about computer crimes or about Oregon. I should've. God I should've. But here we are. I wouldn't change a thing. I swear I wouldn't." She said and angled her head up, kissing him softly on the lips. "Not how I pictured this finally happening." She said with a slight giggle.

"Me either. Liv, we gotta call this in."

"No. I have to call this in. You have to go. You can't be here."

"I'm not leaving you." Elliot said harsher than he'd intended.

"This is a one way ticket to Rikers. No El, you're going."

"No I'm not." He said sternly. "You're not leaving my sight."

"Stubborn son of a bitch." She muttered. She'd said those same words 14 years ago when they were working a stalker case.

"You'll thank me later." He grumbled.

"We'll see." She said sullenly. "How are we going to explain this?" She hissed at him. "This is bad. Really bad." She said. "No matter what we say you look like a rogue idiot here El."

"I can handle whatever they throw at me. I ignored you before and I keep replaying the last two years in my mind. What if I hadn't left? What if we were still partners? Would Lewis have had a chance to grab you?"

"We don't know. We never will. What's important is that you came when I needed you." She said stroking his face.

"I begged Fin to let me go through your apartment see if I could find a lead. I found this clipped to your gun." He said producing the medallion.

"I had it on a chain but I felt better knowing that it was on my gun. I thought it was gone." She said, her hand trembling, running over the piece of metal that got her through some dark times.

"When he pistol whipped you it was with this wasn't it?"

"Yeah." She said, tears starting to fall. "It's going back around my neck." She said definitively.

"I meant it."

"Meant what?"

"Semper Fi."

"Me too." She said to him. She jumped when she heard a car door slam. "We have company." She said and Elliot drew his colt. He motioned for her to hide while he took position on the side of the door.

The door was kicked open then Rollins stepped in followed by Amaro. "Clear." She called out but as soon as she turned around she saw Elliot lowering his weapon. "Told you tracking his phone would work." She said holstering her gun. "Do I even want to know?" She asked as he stepped towards her.

"It would be better if you didn't. Plausible deniability." Elliot said. He was face to face with Nick Amaro. He was a good cop but he wasn't sure if he trusted him enough to have Olivia's back.

"Where's the rest of your team?" Elliot asked.

"Fin and Munch are distracting Cragen and Cassidy." Amaro said. "We both had a feeling and didn't want to say anything until we knew for sure."

Before Elliot could speak Olivia appeared in the room. Elliot could see it in their faces. They cared for her. "I'm okay." She said gently hugging them. She watched them wordlessly speak and they went into the room she'd just vacated. Olivia grabbed a hold of Elliot's hand, holding onto it for dear life. She waited for them to come back into the main room, giving them time to process the scene.

"He's alive but barely. I'm assuming this was you?" Amanda said pointedly to Elliot.

"It was me." Olivia answered. "I had the chance to kill Lewis and I couldn't. So I called Elliot. Lewis just kept on taunting me and I grabbed the rod and beat the shit out of him."

"That's what you're going with?" Amanda asked her.

"That's what happened." Liv said in a defensive tone. "Plausible deniability Amanda." She added.

"When we get home you're telling me the truth." She said sternly.

"There was a housekeeper and her daughter. They showed up and Lewis was going to rape one of them while I watched. That's when I got free. I told them to go because I didn't want them to be deported for being brought into this shitstorm." Olivia said.

"We saw them walking down the road and they said the cop from the news was in a house and gave us the address before we could get her information she took off. Sound about right Nick?" Amanda asked him.

"Sounds right. Elliot you followed us when we got the call about the cop that was killed. We split from the group and you followed us. 1PP knows you were unofficially helping with this case. They won't say anything."

"Thank you." Olivia said. Amanda stepped in the other room to use the phone presumably to call in their location.

"He's still breathing." Nick said. "Barely." Nick added.

"Okay, they'll be here in a few minutes. Elliot go ahead and take Liv to the hospital. She doesn't need to be here. As far as the brass is concerned Liv, Lewis got free and you subdued him Liv. With that head wound there's bound to be memory loss not to mention brain damage." Amanda said. "I told Cragen I ordered you to take her to the hospital and he agreed with my decision. Go, we got everything handled here." Amanda said to them.

The ride to the hospital was somber. Olivia clutched Elliot's free hand and practically crawled over the center console to be close to him. "I uh, don't want you to leave my side at all."

"Liv they have to do a rape kit. I know you said he didn't but from the smell of your breath he forced you to drink so if and when you were unconscious we have to know and I don't think you want me in the room for that."

"I can't do this alone. I didn't let you in after Sealview and I regret that. This is my second close call El. I can't run and I need you to make sure I don't because everything in me is telling you to take me far away from here." She said, tears falling.

"And go where to the beaches you were looking at three years ago?" He asked her and she smiled.

"Paris. I had my beach getaway. Didn't have as much fun as I thought."

"Why?"

"Because you weren't there." She said looking up at him. "I tried to make myself go the distance with Cassidy. We went and yeah it was fun but not the way it should've been. I wanted you there. I've wanted you to be the one since that stalker case 15 years ago El. I slept with Cassidy back then to take my mind off of you. Then when he got shot I just decided that maybe things could be different, that I could be different. But I'm not. I'm still the same and Cassidy was just a safety net. I've loved you for so long El. I shouldn't have ran after Gitano. I should've told you the truth but I kept my head shoved so far up my ass and I can't anymore. I want to run but doing this without you the last two years has been a nightmare that I can't wake up from. So even if you won't come out of retirement I need you in my life. I need someone who understands this who really understands it whether you're at work with me or who I come home to I need you El and that scares me because I've never needed anyone. I pushed you away after Sealview because you had a baby at home and I couldn't take you away from Eli." She said, the tears freely falling.

"My head has been shoved so far up my ass too." He said pulling into the hospital parking lot. "We have so much to talk about. Right now let's get you inside and looked at." He said and she nodded her head in agreement. Elliot ran to her side of the car to help her out. "Liv what about Cassidy?" He asked as they walked inside.

"I don't want him involved." She said sternly.

Pissed didn't adequately describe her mood right now. She had to stay overnight for observation, they had her on anxiety medication and pain medication so she was tired. She felt everyone hovering and she felt guilty for Elliot standing at the door like a guard dog. But she also knew she would be able to sleep because he was there and she was safe.

Elliot made sure the nurses knew no one was allowed in and he dragged the chair in the corner next to the bed. "Hold me El." Olivia murmured and he slipped in the bed next to her. She curled into his side inhaling his scent. It calmed her down more than she wanted to admit. "I never realized how traumatic it was."

"What?"

"The rape kits. What the women go through. I almost lost my nerve. I have so much respect for every victim I've helped through this." She said softly.

"Me too. You did great Liv." He said placing a kiss on the crown of her head. "What do you want to do when you're discharged? Cragen mentioned a hotel until your place is cleared."

"No. Uh I want to move somewhere with better security."

"Okay. Do you want to stay at my place until you find somewhere?"

"Are you sure?"

"I want you with me Liv. No questions."

"Okay." She relented and she looked up at him.

"Liv when they run that rod they're going to find my prints." He said trying not to act like he'd just dropped a bomb.

"I know. You know there's only one way you can't be used against me or me against you right?" She asked him.

"Uh Liv aren't we going a little backwards here?"

"When have we ever done thing the right way?" She asked him with all seriousness. "We've always been assbackwards in this relationship. Before we'd even kissed you promised me a kidney El. "This, us" she started to say. "Is something I can't run from anymore. I told you before I ran away from you twice and it didn't do either of us any good. I love you and given what you did earlier I know you feel the same and we both know how a defense attorney or prosecutor will look at this. Doing it now won't give them a whole lot of ammunition against us."

"Liv when are you the reasonable one?"

"I was serious before El, I not losing you again."

"Okay. We will find a Chaplain." He said.

"I need your cell to make a call to get a license." She told him and he handed it over. "Oh you're in the lobby? Okay. Room number is 3110 tell the nurses I said you could come in. See you in a minute." She said and hung up the phone.

"Who was that?"

"Rafael Barba. Our ADA. I trust him." She said and there was a knock on the door.

"How much pain medication are you on?" He asked taking in the sight before him.

"Not funny. In all seriousness I was calling you to ask a favor. A big one. One that needs to be handled with discretion."

"Please tell me what your partner and Rollins told me was the truth Liv?" He asked placing his hands on his hips and taking a deep breath.

"Plausible deniability Rafa. I need a marriage license."

"You're kidding me right?" He asked her.

"Nope. Not kidding. I need it ASAP and if you could be a little foggy on the date that'd be even better."

"How foggy?"

"A week."

"I'm a little lost here Liv. Well more than a little. I have no idea who this person is in your bed and you're asking me for a marriage license. Start talking, now." He said sternly.

"Okay. But it doesn't leave this room." She said and began their story.

"Dear god in heaven. Do Rollins and Amaro know?" He asked them.

"No. I told them it was me that I did it." She said to him.

"Strauss is going to have a field day with this. You know they're going to call him in on this to determine if you brutalized Lewis given his injuries. The man has a hard on for you and SVU Liv ever since Cassidy's rape trial debacle and what happened with Cragen. You also know that Tucker is going to find any hole he can for this. Lucky for you I know a good defense attorney. Lewis is in a coma with swelling in the brain. If he dies this is going to be really bad Liv."

"I can handle it. Rafa I lost him once. I won't go through it again. I won't survive it. He came because I called. He's not going down for this?"

"Liv this is different. Much more than you losing Avery Jones at the doctors office and her leaving on a private jet. I get it especially with your parentage but if I help you with this it's not going to be easy. God I don't even know why I'm even talking to you about this."

"Because you know I'm right. That what happened is justified and that Lewis wasn't going to stop until he was forced to."

"God help me. I'm going to get the damn license. Do you need anything from your place?" He asked her.

"Clothes. Umm just take it to the office. I have to give my statement before I go home with El." She told him. "Thank you Rafa."

"Don't thank me until you're in the clear." He said to her. "I'm glad you're okay Liv." He said and she smiled. "You owe me for this."

"I know."

"I'll call if there's any problems." Barba said before leaving the room.

"I never thought I'd be in this position." She mused.

"What position?"

"Perjury."

"Liv I'm a big boy. I can handle the consequences. I knew what would happen when you called me."

"No. You're not taking the fall for this." She said with a determined voice.

"I know better than to argue with you."

"Good." She said just as the nurse came in.

"She checked Olivia's vitals. "How's your pain?"

"Not bad." She lied.

"Well I'm going to go ahead and give you some pain medication detective. I know you don't like to admit weakness but you've got three fractured ribs and a broken wrist. You're allowed to be in a moderate level of pain Ms. Benson." She said and Elliot smirked.

"Don't you dare. I seem you remember you coming back to work after being shot, twice." She chided.

"Stubborn pain in my ass." He hissed at her and she giggled.

"Yeah but I'm your pain in the ass." She reminded him.

"14 years and counting." He said proudly. "Just like I'm your stubborn son of a bitch." He said and she giggled.

"Always." She said and he kissed her forehead.

"Ms. Benson promise me that you won't let your husband keep you from resting." The nurse said and Olivia couldn't help but smile.

"Not a problem." They said at the same time.

"Good. Get some rest detective." She said before leaving the room. "I know you said you didn't want to leave me but I could really go for something to eat."

"There's a place around the corner. You sure you'll be okay?"

"I'll be fine El. I promise. You heard Barba, Lewis is in a coma."

"I'll be back in less than a half hour." He said leaving down to kiss her forehead and she angled her head up meeting his lips. "I could do that for the rest of my life." He told her when they parted.

"Hurry back and we'll work on it." She told him and he sent her a wink before leaving the room. Olivia smiled when she saw that he'd left his phone. She decided to call Cragen to let him know the damage but she was distracted by the door opening. "Jesus El just go. I'll be fine." She said looking up from the phone and what little color she had drained.

"Stabler?" Brian asked shutting the door. "I was told you didn't want visitors but Stabler was here?"

"Yeah. Look I was going to call you. We uh, we need to talk."

"Obviously. I knew when I saw him in the squad room he'd weasel his way back into your life. Liv he left you without a word two years ago." Brian said angrily.

"You think I don't know that?" She shot back. "Look things are complicated right now. I need some space." She said to him.

"You need space?"

"Yes, I need space because three days ago I had to listen to that voicemail you left for me. The one cancelling plans because you had to work. Then I had vodka poured down my throat. Then I was burned with a wire hangar and with my own keys. Then I was pistol whipped with my own gun. So yeah I need space because if you had kept our plans you would've been there to save me." She said with tears falling down her face.

"Liv, I'm sorry. I really am. What can I do?" He pleaded with her.

"You can leave. I can't do this anymore. Lewis told me that before when I was unconscious I called out for Elliot. Lewis asked me who he was because he knew your name. When he almost raped me he told me I'd cry out for the person I wanted to see most. It was Elliot. I love you but I'm not in love with you."

"So you're running? This is just like you. You always run. You ran from me 13 years ago Liv. Now you're running from me again. When are you going to stop running?"

"I have stopped. I ran from my feelings for so long because I didn't believe I deserved to be loved. My mother sure as hell didn't love me. It took me being tortured for four days to realize I've been lying to myself for such a long time. I'm in love with Elliot and I have been god since forever. I can't stop. I'm not running anymore Brian. I can't. Not after this. Everything is telling me to run but El is my safe place to land and I need him. Please don't make this any harder than it all ready is." She begged him.

"You told me after I got shot you weren't the same person you were 13 years ago."

"I know. I thought that I had gotten over him but I haven't. It's not fair to me and especially not to you." She said wiping away the tears. "You'll find someone someday who will love you like you deserve. But that's not me." She finished. She closed her eyes wiping away the tears, willing herself to stop crying.

"Liv please think about this. You just went through a traumatic experience."

"I know. You want me to pretend that nothing changed. Well guess what? Everything changed and I can't pretend that it didn't. When I was undercover in Sealview five years ago I was almost raped. It was a close call. I pretended that I was fine. I shoved it all down and it took me months to admit that I wasn't fine. I'm not doing that again. I can't just sweep this under the rug. Brian please leave." She begged him.

"Fine. You win." He said angrily opening the door. He came face to face with Elliot who stopped to take in the situation. "Give me a reason Stabler."

"Nope." Elliot answered breezing past him. He didn't say another word as he handed Olivia her food. She smiled when she saw the bacon cheeseburger with lettuce, tomato, extra pickles, and no onions and fries. "You have your own fries. You're not stealing mine." He chided and she let out a small smile. It really was the little things she missed more than the big ones. She got so absorbed in him she didn't even notice Brian leave shutting the door behind him.

"I thought you'd go hulk on him."

"I've been in therapy working on my anger and rage issues along with everything else. I'm not saying I won't get mad but I won't fly off the handle like I did before. Well that was before I told Cragen I was coming back. We're going to see how well the therapy works when I get around perps again." He said shoving a couple of fries in his mouth.

"You're coming back?"

"Yeah. I shouldn't have left to begin with but me coming back Liv I'm not just coming back as your partner. I'm coming back as captain. Cragen is ready to retire and he was going to ask you to take the sergeants exam but then this happened. He's passing the reigns temporarily to Munch until you're okay being on your own."

"But what about us?"

"He gently reminded the DA's office and the Commissioner just how much he'd done for the department and that they'd be losing their best detective."

"But we weren't together until today." She said puzzled, with a mouth full of burger.

"Liv, Cragen knew. He knew before either one of us would admit it to ourselves. He knew what would happen the minute we were partnered together."

"So if I come back to work I'll be married to my boss." She mused.

"If?" Elliot asked sitting next to her.

"It's more of when. But it's gonna take time." She admitted.

"I have no doubt. This unit is in your blood just as much as it's in mine. When you come back I want you to take the sergeants exam and be my number two." He told her.

"You're serious?" She asked finishing off her burger.

"There's no one else I trust more to have my back or watch my ass."

"Oh I'll definitely be watching your ass." She smirked raising an eyebrow.

"Hey that's supposed to be my line." He said feigning injury. "Liv I'm not going to push you into anything. What we have now I'm okay with." He told her throwing their empty containers in the trash.

"Elliot we have 14 years of sexual tension built up. As soon as I'm able to we are getting rid of it."

"Oh really?" He asked her with a smirk.

"Oh yes." She told him. "I love you." She told him. "I um, I have something to show you." She said. "So without going into a whole lot of detail I made a promise with Amanda if she made it through March madness without making a bet that I'd go with her to get a tattoo. She held up her end so I held up mine. I got it in white ink so it would just be for me. Amanda doesn't know the whole truth."

"Okay." He said slowly. She lowered her gown and there it was the white ink beautiful on her olive skin. Semper Fi with an anchor next to it. "It's beautiful." He said and without thinking he leaned down and placed a kiss on the marked skin. "I always wondered what you'd look like with a tattoo." He smirked.

"I got another one by myself a few months ago." She admitted. She held out her index finger and there in black ink contrasting against her skin was his badge number. You'd be able to see it when she had her finger on the trigger.

"I think I might just have to steal that one." He told her and she giggled.

"I'm going to hold you to that." She said to him.

"I'm counting on it." He said smiling as she pulled him down for a kiss.

Elliot stood hand in hand with Olivia outside the 1-6. He took a deep breath, grasped her hand and they walked inside. "You ready?" She asked him.

"As I'll ever be." He said pulling her close and wrapping an arm around her waist. "If you want to keep this under wraps we can."

"No. We both had our heads up our asses for too long. No more hiding." She declared. They stepped off the elevator and walked towards the bullpen. Standing at the end of the hallway facing the cage Elliot stopped. He took a deep breath and shook the memories away. He could not now. This was about Olivia. He couldn't freak every time he walked back in this place. Not if he was taking over the unit. "You good?"

"I'm supposed to ask you that after this week." He reminded her.

"There's always when I'm done with my statement." She told him. She saw Barba sitting there with Ed Tucker. Then she saw David Haden.

"Liv I know you worked with David here a couple of times. He's just been appointed as Bureau Chief for SVU. He's my new boss." Barba said and she took a deep breath.

"Stabler you can't be in the room. You're not officially reinstated yet." Tucker said. She squeezed his hand letting him know it was okay. "To ensure privacy only Cragen is going to be in the room and we are doing it in his office."

"Let's get this over with." Olivia said walking into the office with Tucker behind her and shutting the door. Elliot flinched when the blinds were shut. He took a deep breath and reminded himself she'd be okay. She handled Cassidy yesterday. She could handle Tucker.

"I've heard you're taking Cragen's spot." Haden said and Elliot nodded.

"It was a shock when he asked me. I needed the time away to remind myself why I stayed as long as I did." He told the man. He knew Haden and Liv had been an item. He couldn't get jealous. He'd been the one to leave. He'd walked away. He took a calming breath.

"I can understand that." Haden replied.

"Oh, Stabler. I was able to get that document for you. I also made sure the date was correct. Two weeks ago was the time frame you needed right?" Barba asked hanging him the Manila folder. He opened it and there it was in black and white with Elizabeth Donnelly's signature.

"Thank you for this. It really means a lot." Elliot said closing the folder and shaking his hand. "I'm surprised Liz didn't ask why you needed."

"I assured her that it was just an oversight. That things had been crazy with the kidnapping of Detective Benson. She does want to see you at some point."

"Tell her she's more than welcome to come by the house. But until I step into my role here I'll be home with Olivia until her ribs and wrist heal." He said.

"What were the final injuries?" Haden asked.

"Three broken ribs, broken wrist, concussion and numerous lacerations and burn marks consistent with torture."

"I know Lewis's MO. I read the files." Haden said silently asking the question he couldn't bear to say out loud.

"Negative." Was all Elliot had to say and both Haden and Barba let out a sign of relief. His head snapped up when Cragen's office door opened. Elliot watched as Ed Tucker stood to the side as Cragen called the rooms attention. Elliot noticed Rollins and Amaro at their desks as well as Fin and John. It was now or never.

"I had planned on something different but the last week has changed my perspective. I've decided to retire. My original plan was to speak with Detective Benson and have her take over the unit but in light of recent developments I spoke with someone else. A lot of new faces have graced us this year. This squad has gone through a lot of changes. Sometimes we move on to bigger and better things and sometimes we come back home. In light of recent events I have asked Elliot Stabler to take over my role as Captain of this unit. He is distinguished and has a passion for this job, for this unit that I've so rarely come across. Until he steps into this role Sergeant Munch will be leading the squad." Cragen said.

"I guess now is as good a time as any. The original plan was for Detective Benson to lead this squad. In a way she will once she takes the sergeants exam. I've asked her once she's ready to take the exam and be my number 2." Elliot said to the group hoping this would earn him some brownie points.

"All right everyone. You have your assignments. Let's get back to work." Munch said and everyone went back to their business. "I really thought Cragen had been drinking again when he told me last night."

"I thought I'd been drugged when I agreed." Elliot replied. "But it feels right." He said.

"Welcome home." Fin said shaking his hand. He brought Olivia in for a hug and released her. He noticed her hand hadn't left Elliot's the entire time. "I'm not going to ask right now but eventually you both owe me an explanation." Fin said and Olivia smirked.

"Soon." She told him.

"Looking forward to it baby girl." Fin said before going back to his desk. "Stabler want to get a drink later?"

"Come to my place for a beer. I won't be going out much until I start back." He said hoping Fin would get the hint.

"Text me later on. If Rollins and Amaro wanted to come to hear some war stories would that be okay?" Fin asked.

"That's uh not up to me." He said looking down at Liv.

"Go for it. I need family around me." She said with a smirk.

"See you later man." Fin said departing with a handshake.

So when are we disclosing?" She asked him as they turned to leave the squad room.

"Whenever you feel ready." He said with a deep breath.

"Fine we are heading to 1PP now." She quipped and turned to go ahead of her and she pulled him back. "Chicken?" She asked him and he shook his head. "Stabler." She warned and he cocked his eyebrow at her. She saw that Tucker was still standing there and she shook her head before pulling Elliot to her. She met him in a passionate kiss that would be around the entire NYPD in less than an hour.

"What the hell has gotten into you?" He asked when they parted.
