The Trial

As Edward and Connie are waiting at the intersection , Edward decides that it's time he turns himself in so this nightmare can finally be over….. he turns to give his wife his final kiss …. Connie has a different idea

Connie: No… You can't… I won't let you….. we aren't just throwing everything away because of my stupidity… We are going to fight it…. Let's go back to the house and call your lawyer and find out our legal options… people have gotten away with killing someone….. Look at OJ Simpson…. We have to try

Edward: We will loose everything, …..Lawyers will take everything

Connie: I've lost everything … If I loose you….. why didn't I understand that months ago ?

Edward: Are you sure…. This will be in the headlines…. Crazy husband kills wife's lover … Everything we've done will be in the papers for all to place their judgement on.

Connie: If there is the slightest chance of saving you from my mess…. I absolutely want to take it…. If we are left penniless we still can go to that shack on the beach in Mexico and live out our lives together….. You're the only one that is important now.

The following morning Edward calls his lawyer Dominic Salvi and explains the situation and asks what their options are and what they could be meeting takes place in Dominic's office

Dominic: Edward, I'm not a criminal lawyer… for what you just told me we need to get one of the best criminal attorney that is out there….. I've made a call to one that has gotten her client off ….. but she ain't cheap ….. but she is good and she has connections to picking jury members that will be sympathetic to your circumstances.

Connie: Call her….. make this happen

Edward: What are my chances?

Dominic: This is not my field of expertise…but Diana Lindsay will have a better idea and how you are to proceed…. For right now go about your business as usual and under no circumstances do you say anything to anyone. Both of you are you ready to tell Diana everything that happened…. You can't blind side her with certain facts that will embarrass you …. I think you are past that point of no return.

The following week Diana Lindsay fly's up to New York City from Huston and meets with Edward and Connie Summers and this is their conversation

Diana: Dominic briefed me on the circumstances , but I need to hear from you and please don't leave out any details because, I can assure that once you turn yourself in everything will come out and your lives will never be the same . Connie lets start with you , since you allowed this Paul Martel into your lives.

Connie: Where do I begin?

Diana: How did you meet Paul Martel?

Connie: I found myself in the Soho area trying to find a shop, that I can't even remember now , but it was very windy and I stumbled and fell and bruised my knee. Paul saw me and asked if he could help. I was reluctant to go and I wish I hadn't but I let him help me up and he offered to clean my cut and then made me a cup of coffee to warm me up. I noticed all of his books and we started talking and the conversation took a life of its own.

Diana: Did he seduce you that day or how did you two start this affair?

Connie: No….. I just didn't jump into bed with him … that passage in his book stuck with me about "seeking the moment" that after talking to some of my friends they suggested I give him a thank you gift for being so helpful.

Diana: Why did you have the need to tell your friends about him?….. where you fantasizing about him … Did they give you permission to pursue him?

Diana: Edward, when did you know what your wife was doing?

Edward: I knew something changed in her from that first day… she was in a different world…. She was forgetting things and finding ways to be in the city more often… she was no longer into me ….. I became secondary… I know my wife.

Diana: I understand you had your wife followed by a PI, what made you do that?

Edward: I had an employee/ friend that I had to fire because of his lack of loyalty , he threw into my face that I should look at my own family when it came to loyalty….. that was the proof that I needed to confirm my suspicions that something was going on. I hired Frank Wilson to follow Connie to see what she was up too and when I saw the pictures of her with him I was boiling mad that she could do this.

Diana: Who was your anger direct towards Connie or Martel?

Edward: I was mad as hell at Connie, how could she do this, especially the way I have treated her…. I gave her everything… I put her on a pedestal that no other woman could match as far as I was concern … here she is fucking this useless kid.

Diana: Connie did you ever sense that Edward knew what you where doing?

Connie: No… I was so wrapped up in my fantasy that I was oblivious to everyone around me… even my son …. I wasn't the wife Edward needed at that time… I took him for granted not once seeing the hurt and damage that I was creating…. If anyone that needs to be locked up it's me … I created this mess …. You have to save my husband… you just have to.

Diana: Edward…. Do you still love your wife?

Edward: Of course I do… What's that got to do with it?

Diana: When you saw those pictures of Connie with another man, you were boiling mad…. Where you mad enough to want to kill her

Edward: Though I said it to her that I wanted to kill her…. I couldn't ever do it…. I love her to much

Diana: Your rage did kill Paul Martel…. Tell me what happened how you did it

Edward: Once I saw those pictures, I had to see for myself , who this person was that my wife was throwing our lives away for. When I went to his door and introduced myself, he was taken back. He offered me a drink of vodka and as I was walking around the room, I kept asking him questions as to which place in the room he fucked my wife. I asked him if they went out or did they do their fucking in other places. His answers were somewhat arrogant in that she did whatever he commanded her to do. Then I saw the anniversary gift that I gave Connie, A glass globe with a note that it be not opened until our 25th wedding anniversary and asked him where he got it. He said it was a gift from Connie , that he thought she wanted him to have it. The way he said it, a sharp pain went into my temple and the next thing I remember is he is on the floor in a pool of blood , dead.

Diana: You, can't remember hitting him?…. Have you ever had black outs before?

Edward: No , I can't… I've had migraine headaches all my life , but never have I blacked out.

Connie: Edward , I'm so sorry I've put you threw this

Diana: Connie, is this the first time you've heard this

Connie: Yes….. He told me that he brought home the globe because he found it in Martel's apartment, everything he has just told you , he hasn't mentioned .

Diana: Edward… what did you do afterwards with the body and the apartment

Edward: Once I realized Martel was dead because of me… I removed all traces of Connie being there, removed her messages on the answering machine, the one saying that it was over and that she couldn't keep lying to her family. I cleaned the place up of all possible finger prints and the big blood stain and then rolled him into a carpet and brought him out on a dolly and put him into the trunk of my car and went to meet my wife at my son's school play. I thought everything would come to light when the trunk of my car was hit and was about to open. Once I dropped off Connie and Charlie at home I went to the Trash Dump and dropped off Martel .

Diana: How remorseful are you both about your actions?

Edward: no one needed to die for what took place… I wish non of this would have happened, I wished that Martel never would have taken advantage of my wife… I wish my wife would have never felt that she needed whatever she thought she needed … I never set out to kill him and I don't know why my anger got so out of control.

Connie: He is right if it wasn't for this fictional need to be who I wasn't none of this would have happened, his love for me is so great the he needed to protect me from myself.

Diana: I've heard what I needed to hear . Edward ….. you're not a cold blooded killer …. But your rage did kill someone…. Question is how do I separate you from your anger. There is a new theory out there about Berserka/ Blind Range Syndrome which your story shows all the requirements for it. Can I get you acquitted it's less than 50% but if we get fortunate enough to get a jury that can put themselves into your shoes then our odds go up substantially.

I've got a friend of mine here in New York that's the best at picking juries. So do you want to proceed with turning your self in which works in your favor or do you want to take your chances until they find real proof and you will more than likely spend at least 20 years in prison.

Edward: Either way I'm constantly looking over my shoulder… I was going to turn myself in before Connie stopped me . ….. Do you think I will have to stay in jail or will you be able to get me out on bail .

Diana: It depends on what they charge you with… If they charge you with first degree murder , I doubt they will give you bail, if it's a lesser charge , yes bail will be appropriate. Let me make a phone call this evening and have my friend listen to what I have recorded and get his take as to how we should plea the case.

Diana leaves the Sumner home Edward and Connie look at each other and have the following words

Edward: There is no turning back now… to some degree I'm relieved but also scared out of my mind

Connie: Diana appears to be a very capable lawyer, she goes right to what she sees the problem is , Dominic gave us a good recommendation…. I have a very good feeling about her… What do you think?

Edward: Yes , she appears to be … but it's going to be a toss up in what the jury will think

Connie: Let's get some dinner, spend some time with Charlie and then once we put him to bed , let me take your mind off all of this if only for a little while.

Diana calls Jason Bull to see if they are still on speaking terms and if he is willing to help her on this case.

Diana: Jason , first of all congratulations on your baby girl… I never thought you as a dad… I'm pissed as hell at you for not telling me what was happening with you. We've been through to much together that you couldn't talk to me….. I'm a big girl , I could handle you being with someone else.

Bull: Diana…. What can I say… Things happened and once I was told I was going to be a father everything changed… You know you always have a special place in my heart … But I'm a dad and I can't screw this up … What can I do for you?

Diana: I've taken a case up here that my client is about to turn himself in for killing his wife's lover. He is a great guy, loves his wife deeply, but was enraged when he found out she was having an affair and when he confronted the lover, their conversation turned a little snarky and his rage took over, blacked out and the lover was dead. I'm thinking with your teams help you should be able to find a jury that could put themselves into this guys shoes… Will you help…. I need you Bull .

Bull: Bring the tapes of their testimony to the office tomorrow and I'll evaluate if we can do anything for them and you…just for the record I've missed you and I still think about you.

Diana: Let's get this straight and up front… I'm not sleeping with you… even though I want to… but your a father and I'm not going to be the reason for you screwing this up … Are we clear on that subject.

Bull: Loud and clear… see you tomorrow!

The next day Diana has informed the DA that she is bringing her client in to turn himself in on an unsolved case that they still have open. He will remain in custody until which time he can be before a Judge who will read the charges against him and proceed if Bail is an option.

Diana and Connie proceed to Bull's office whereby the taped testimony is listened by Bull and he makes the following evaluation.

Bull: Diana , your correct with your assessment of the Berserka/ Blind Rage Syndrome but New York goes by the Model Penal Code where a criminal defendant is not guilty by reason of insanity if he is diagnosed with a relevant mental defect for example, severe mental retardation or schizophrenia disorder whereby at the time of the incident he was unable to either:

Appreciate the criminality of his conduct Conform his conduct to the requirements of the law Therefore , using the MPC test , a legally insane individual must have been diagnosed with a mental defect( typically by a court- appointed mental health professional) and either did not know right from wrong or lacked the ability to control an impulse that led to the incident.

Diana: We can still tie the two together since the Berserka? Blind Rage Syndrome since it's requirements are:
Violent overreaction to physical, verbal or visual insult

Amnesia during the actual period of violence

Abnormally great strength Specifically target- oriented violence

His testimony has all of this tied together… Martel insulted him by claiming that Connie was just some lonely housewife living out her bad girl fantasy and that he could fuck her anyplace and anytime and the straw that broke the camel's back was him having the Anniversary Present that Edward gave to Connie …. He had a sharp pain to his temple and blacked out and then Martel was dead.

Bull: On paper it should work, but getting a jury to buy it may be a little tuff.

Diana: You're Jason Bull , you've gotten juries to believe way more than this….. remember that creep in Houston that shot his wife in the back and made the jury believe she was a trespasser. You found the way to get that asshole. What do you think … Can we save Edward and his family?

Bull: Connie are you prepared to what's going to happen to you… You're going to end up the bad guy ….. your judgement or lapsed there of is the cause of all this.

Connie: Mr Bull ….. I should be on trial….my stupidity and lack of accountability and loyalty to him put us here… If it saves my husband they can say whatever they want about me as long as I get him back.

Bull : We are in … Connie my team will prep you for when you have to testify… what you have just shown me we are going to magnify it a few notches up and make your husband as much of a victim as Martel was.

Connie: Thank you, Mr Bull , My husband didn't deserve this.

Bull : No Mr Bull… Bull will be fine.

Connie leaves to take care of Charlie and to try to explain what is happening to Edward and why he won't be home for a while. Diana and Bull continue there personal conversation.

Diana: Dam you Bull,…. why didn't you tell me you wanted kids so bad, I might of given you one… that's how much I loved you

Bull : That's how much you loved me… you never said you loved me … you always made it look like the roll in the sack was all you wanted from me

Diana: As brilliant as you are you are as stupid as they come when it comes to women….. and you still don't know who is the right woman for you….. do you? Are you gonna marry your ex wife or is that not what she wants .

Bull : she's not to thrilled about marriage… the fact that I got her pregnant at her fathers funeral still makes it a toss up if we remain together

Diana: Good thing you're great at your job… if only you could understand what you missed out on…. Back to the case … What are chances to pulled this off , Edward loves his wife and Connie loves her husband this couple needs to get back to what they do best which is each other…. At the initial Court Hearing the Prosecutor has decided to file first Degree Murder Charge and set bail at $500,000. Diana counters that her client voluntary turned himself in , doesn't pose as a flight risk, and the Prosecutor doesn't have a case in light that their wasn't any evidence to even charge her client.

This is a gross over reach by a zealot Prosecutor trying to make a name for himself at the expense of Edward Sumner, a very good man, without any criminal history that got caught in a circumstance out of his control that finds him in court. His plea is not guilty by Temporary Insanity. Judge agrees and reduces bail to $100,000 of which Connie post's a $25,000 bond to have him released and back in their home awaiting trial. That night Edward talks to Charlie to try to let him understand what is happening and to reassure him that everything will be fine. Mommy and Daddy love him very much and that what ever happens that will never change. After they put Charlie to bed Connie and Edward continue their conversation.

Connie: Dr Jason Bull that Diana got to help with the jury selection , knows his stuff, they came up with a defense that should work ….. they are going to prep me so as they are going to make you as much as the victim as Martel was. I told him that I was Ok with being made into the bad guy that made poor decisions .

Edward: You made a mistake, god knows I have ….. we are all victims , but we will get through it. I'm so thankful that I can have you in my arms again… Jail is one scary place .

Connie: I promise you ,your arms will be the only arms that will ever hold me again, your love is the only love I will ever want or need …. Let me show you how much …. Bull : Even though our strategy is that your anger got out of control, Edward, you can't show any anger, especially when it comes to Connie and the questions that aren't going make her look very good. You have to be who you really are, mild mannered , loving husband and father.

Diana: Connie, there will be times, I will be tuff on you, but you have shown me that you can handle it. What you told me when I first talked to you , has to stay consistent, no deviation.

Bull: Are you both comfortable as to how Chunk prepped you? Said to say but the Courtroom is more of "Show and Tell" and the impression we can create to garner sympathy. Chunk told me that he is pleased with both of you , Now it's up to Diana and Benny to lead the jury to our desired outcome.

The trial officially begins with a opening statement from Prosecutor Guy Benson…..

Prosecutor Benson: Your honor….. members of the jury … The state of New York will prove that Mr Edward Sumner deliberately and with premeditation planned to kill Paul Martel for having an affair with Connie Sumner , who was a willing participant in this adulterous affair. Mr Sumner hired a Private InvestigatorFrank Wilson to follow his wife to see how often and where this affair was taking place. He then went to the victims home, killed him and then dropped off the body at the local trash dump to be decomposed. Mr Sumner deserves to be convicted of First Degree Murder and be incarcerated for the rest of his life, for he is a danger to society.

Diana: Your Honor… members of the jury…. Mr Benson uses some very strong words in his opening statement, yet he can't prove a single charge….. if he could my client would have been charged with the crime before he voluntarily turned himself in, because he is a very good man, that loves his wife and family and was hounded by his remorse that his Blind Rage caused someone his life.

The State doesn't possess a single bit of evidence that can clearly prove that my client was even in the apartment that Mr Martel was using, to lure unsuspecting women into his sex den. Did Mr Martel deserve to die for his actions, of course not, but does my client deserve to be in jail for the rest of his life for loving his wife and letting a single moment of Blind Rage Anger take away his freedom, his family , his life as it is.

Temporary Insanity is a term that gets thrown about as an excuse, but the Psychiatric community has many syndromes attached to it that shows that Temporary Insanity is very real and beyond someone's control. I will prove to you beyond a shadow of a doubt that my client did in fact become a victim of Berserka / Blind Rage Syndrome that was responsible for the death of Mr Martel.

Marrisa talks into Bull's ear piece telling him how their secondary jury panel has reacted to both of the two opening statements …. Diana's opening statement was very effective in that they have 7 green in favor and 5 not moved.

Bull : This throws the First Degree charge out the window… It's a good start… Diana did good

Prosecutor Benson: The state would like to call Detective Gary Dean to the stand….. Detective Dean… How were you called to this investigation?

Detective Dean: I and Detective Mirojnick were asked to investigate a missing persons report by Mr Martels wife ….. which we did and we came up with a phone number for Mrs Connie Sumner which we followed up on and interviewed her at her home. She appeared evasive and nervous which made us believe that she was more involved with Mr Martel than she let us to believe.

Prosecutor Benson: What else did your investigation discover about Mrs Sumner

Detective Dean: We found that she had a parking ticket right in front of Mr Martel's apartment, which she had no memory of , but continued to be evasive to the questioning.

Prosecutor Benson: When and where was Mr Martel's body found

Detective Dean: When they were moving trash around in the city dump, Mr Martel's body was discovered rolled in a rug. He was identified by his wife and the Autopsy showed that he died from a blunt trauma to his head. Prosecutor Benson: How were the Sumners involved in this ?

Detective Dean: When we went back to the Sumner home, Mr Sumner was also home …. We notified them that Mr Martel's body had been discovered and that he was killed. Mr Sumner cut the interview short by asking what Martel's death had to do with his wife and his family. This raised the alarm flag that he may be involved. Crimes of passion usually involve family members.

Diana then cross examines Detective Dean

Diana: Detective Dean…Have you any viable evidence tying my client to the crime scene?

Detective Dean: No… But

Diana: You have no evidence , is that correct Detective Dean

Detective Dean: Yes….. But

Diana: I have no further questions for this witness

Prosecutor Benson: I would like to call Detective Ivan Mirojnick….. Detective Mirojnick what can you tell us of your investigation as to Connie Sumner's involvement with Paul Martel.

Detective Mirojnick: We received a tip from one of Mr Martels lady friends that Mrs Sumner was accusing Mr Martel cheating on him because he was just talking to another women… that was the confirmation that Mrs Sumner was having an affair with Mr Martel.

Prosecutor Benson: What else did you find out in your investigation

Detective Mirojnick: Now that we knew Mrs Sumner was having an affair with Mr Martel we began interviewing her friends to see if we could get more evidence of the affair and Mrs Salley Jenkins provided us with the knowledge that Mrs Sumner and Mr Martel were having sexual relation's in the Restaurant's bath room

Prosecutor Benson: Looks like Mrs Sumner didn't care who knew

Diane: Objection….that speculation on the prosecutors part

Judge: Sustain….. Mr Benson… be careful with your choice of words

Diana: Detective Mirojnick… as I asked Detective Dean….. Where is your evidence tying my client to the crime scene…. Have either of you come up with a single shred of evidence putting my client with Mr Martel?

Detective Mirojnick: He confessed

Diana: What did he confess to? From the written transcript he stated that he was there and during back and forth sparing with words , my client had a blackout and can't remembering anything that happened other than Mr Martel was dead. Without this testimony , you can't prove at all that my client was even there, you have no evidence and you and your partner can't prove what happened without my clients testimony… so who are we to believe my client or your lack of evidence?

Marrisa gives Bull another update as to how the jury is viewing the testimony it's now 9 green and 3 red…. The jury is shifting towards Edwards favor

Prosecutor Benson: The state would like to call Salley Jenkins …. Mrs Jenkins what can you tells of that day in the restaurant when you told Detective Mirojnick that Mrs Sumner was having sex in the bathroom

Diana would normally object but this question opens the door to show who Salley Jenkins truly is

Salley: Tracy , Connie and I were having lunch when Mr Martel walked by and it appeared that he smiled and gave a signal as he was going to the bath room…. Connie excuses herself and say she has to go make a phone call to Edward… that must have been some phone call because when she came back her blouse wasn't completely buttoned, her hair was messed up and she looked liked she just had the best orgasm ever.

Prosecutor Benson: What else can you tell us?

Judge calls for a recess Lunch break and then Diana will call her witnesses to tell their side of the story. At lunch Bull goes over what Marrisa has been telling him how the jury is reacting. He is pleased and has never scene a prosecutor so out of his element as Benson is. After Lunch Bull pulls Diana aside

Judge instructs the jury to once again only listen to the facts and those facts that are pertinent to the case.

Judge: Miss Lindsay please call your first witness

Diana: The Defense calls Dr Robert Jacobson an expert witness in Berserka / Blind Rage Syndrome… Dr Jacobson can you explain to the court how Berserka / Blind Rage Syndrome came to be and how it comes into play in Temporary Insanity Pleas in criminal cases.

Dr Jacobson: Let me begin with the acknowledgment that everyone in some point in their lives gets angry, some more so than other and some more violent than others. With this in mind Society is responsible to determine when an individual is responsible for their anger and when they are not.

Anger by itself doesn't make one loose control, but extreme anger generates so much blood infusion into the brain that the mind looses consciousness and the body is left with and an adrenaline rush that needs to escape thus causing violent acts that the person isn't aware of committing. Thus we have the Berserka / Blind Rage Syndrome.

To put it in simple terms that anyone can visual what happens … in the movie The Incredible Hulk because of his gamma ray inducement …. The mild mannered Dr Robert Bruce Banner when angered his brain becomes consumed with the intermittent Explosive Disorder that forces him to destroy everything in his path. So the question is Dr Robert Bruce Banner responsible for all the destruction that the Hulk does, when he has no idea that he is the Hulk.

Modern medicine has come up with diagnosis of such behavior so such anger can be properly diagnosed and treated accordingly.

Diana: Dr Jacobson you've read Edward Sumner's sworn testimony and you've also looked at his past medical records , what can you tell the court that Mr Sumner has experienced and what is he responsible for.

Dr Jacobson: At first I was very skeptical because , there are many people that use anger an excuse for bad behavior that they enjoy. Mr Sumner doesn't fall into that category….. when stated that before his blackout he experienced a very severe sharp piercing pain to his temple , he was experiencing and abnormal Adrenaline rush flooding his brain making him loose all consciousness but he needed to release his mental rage by some physical act.

He couldn't possibly remember what he did or why he did it?

Diana: Dr Jacobson are you telling the court that Edward Sumner had no idea what he was doing during that black out.

Dr Jacobson: Whatever stimulant that triggered his rage, he had no idea what he was doing….. Edward Sumner the individual isn't responsible for the actions of his Extreme Anger.

Prosecutor Benson: Are you expecting the court to believe that Edward Sumner turned into the Incredible Hulk and killed Paul Martel…. Now I've heard everything

Diana: Objection…. Prosecutor is trying to badger the witness

Judge: Sustained….. Mr Benson keep your opinions to yourself ….. Dr Jacobson has provided his expertise in brain functions.

Marrisa tells Bull the count is now 11 green, 1 red Dr Jacobson hit it out of the park.

Diana: The Defense calls Connie Sumner to the stand….. Connie you're one of two people that know what happened and why it happened…. Can you tell it the best way you know how.

Connie: Let me say up front , I love my husband more than life itself, but I allowed my self to get caught up in a teen age girl fantasy that I was missing out on a life experience that I never thought I would ever let myself , but I did.

I let my guard down and when I did he began touching me in places no other man than Edward ever has in our 11 years of marriage. I found myself trapped in an immature emotional toxic high that for a brief while didn't want it to end. When I started seeing what I was neglecting in my son , my husband I came to my senses and I ended it. I did those horrible things my so called friends stated… I put my family into this nightmare for no reason other than I thought I needed a foolish experience that has given me more pain and anguish than that cheap 5 minute thrill.

If society requires that someone needs to pay for that death, it should be me…. I created the problem….. not my beloved husband, not my adorable son…. Only me… my stupidity , my selfishness is responsible.

Edward has always been there for me , even now he has forgiven me , because his love for me has never wavered. When I think that I caused the type of anger he had to experience, I don't deserve his love and loyalty.

So if you need to convict someone convict me, I'm the cause, only me.

Prosecutor Benson: When did you find out that your husband knew about the affair

Connie: When the two detectives came back to the house to tell us that Martel was dead and I saw the pain that was in Edwards eyes , I then knew he knew. I then realize the damage that I caused to him, to us…. He wanted to turn himself in immediately, but I couldn't let him sacrifice himself….. Couldn't let this very good man, throw his life away because of me.

Prosecutor Benson: When did he admit to killing Paul Martel?

Connie: He never admitted to killing Martel… his anger was directed towards me for betraying, him ,our family, our life together , yet he has forgiven me… No he didn't kill Martel. Martel got in the way of his blind rage towards me in that brief moment.

Prosecutor Benson: Are you saying you would be fearful for your safety being with him with such anger he has displayed.

Connie: Absolutely not, I'm safer in his arms than anywhere, he shows me more love than I deserve…. I created the anger in him… I never intended to do that to him ever again, I will be his loving devoted wife as long as life will allow.

Marrisa tells Bull it's 12 green , O reds , Connie changed everyone's mind

Diana: The defense calls Edward Sumner…. Edward explain to the court what transpired the day you confronted Paul Martel in his apartment.

Edward: When he opened the door and I told him , I was Connie's husband , he was somewhat taken back… wondering what I was going to do… My only intentions were to see him eye to eye and see the place that my wife fond so captivating that she kept returning. As I walked around the room I asked him questions as to were they were having sex, did they mostly stay in or did they go out…. I knew most of that from Frank Wilson's report and photos…

Connie's eyes are filled with tears as she is hearing him relive this nightmare….

I started to get my migraine headache once I saw the anniversary gift that I gave Connie and there it was ,here… I asked him were he got it and he sarcastically responded that she gave it to him like she gives him everything he wants. The pain was so great that I went to the bathroom to put some water in my face because I was on the verge of passing out….. once I got my composure he started to be even more sarcastic, telling me that she keeps coming back, how could he pass up a great lay like her…..

that's all I remember and when I came to my senses he was dead in a pool of blooded I immediately knew that I had to remove anything that had Connie there and me. I wiped the place clean removed any trace of blood and I rolled him in the bloodied rug and stuck him in my trunk and then went to my son's school play. I thought every thing would come to a halt when my trunk was hit in the school parking lot , but that was avoided and I dropped Connie and Charlie home and I proceeded to the Dump where I dropped Martel's body where it could be mixed with all the trash out there.

Connie is crying uncontrollably listening her husband and what he was doing to protect her.

Diana: The defense rests

Prosecutor Benson: So you knew you deliberately kill Paul Martel and you had to dump him with all the other trash… Was his life trash to you?

Edward: I had no intentions of doing anything to Martel but to make him see whose husband he was screwing with. Yes, he was a piece of trash, he used my wife took advantage of her and wanted to flaunt that he was some kind of stud. Did he deserve to die, no, but people die every day for unexplained reasons….. this is one of them.

Judge: You in the jury , do not talk to anyone about the case, tomorrow we will have closing arguments ….. This court is adjourned for the day.

Bull can't get Diana's words out of his mind

Bull: Why do you do that to me… put something in my head and then yank it away.

Diana: Dr Bull,…. You're the doctor, you're the expert on human behavior… what did I do , but put a little visual and now you want it.

Bull : You're mean and vindictive … you want me to suffer

Diana: Why suffer on something you can no longer have… anyway sweet dreams….. it's wetter than before….. Good Night Jason.

At the Sumner home it's just Connie and Edward alone thinking what tomorrow will bring. Charlie is at grandma so he doesn't have to see his parents in such turmoil.

Edward: You didn't have to put yourself out there the way you did…. Thank you, I love you so much

Connie: I was crushed listening to you relive that …. I'm so sorry …. Anyway the only great lay that I will be is yours… with Charlie not here we can do what ever your heart imagines and not worry about him walking in. Have your way with me you deserve it.

As hard as they both want to tonight is for anticipation

After a night filled with anguish and anticipation for both Edward and Connie, Diana put enough tease into Bulls head that he didn't get much sleep.

Judge address the court and once again instructs the jurors to only be concerned about the facts to the case. Instructs Prosecutor Benson to give his closing arguments

Prosecutor Benson: Yesterday you heard Edward Sumner admit that he was the reason for Paul Martels vicious murder. He had him followed, he taunted him and then he crushed his scull to end his life. He cover his crime by eliminating all evidence and then threw him into the Dump to be with all the trash.

Mr Sumner viewed Paul Martel has trash, not a human life , but garbage to be discarded. He didn't see him as a husband or a son but trash to be thrown away. Mr Sumner is heartless, he waited until they could come up with this absurd Incredible Hulk defense , that has to be as laughable as the show itself… there is nothing real about that defense….. what is real he killed the person that was screwing his wife and he was enraged because she kept returning for more. What does that say about him that his wife needed to go somewhere else to get satisfied. You have to fined Edward Sumner Guilty.

Diana: Mr Benson… I have no idea at which trial you have been prosecuting but your closing arguments are absurd as your defense. Both your detectives said they couldn't come up with a single shred of evidence. That fact alone should have this case be thrown out on merit that nothing could be proven. Then putting a real lonely housewife that craves her friends husband as proof to an act that they assumed happen. In a court of law if you assume something it usually shows that you exposed yourself to your failings. Mr Benson, you want this jury to find this very good man guilty of a crime that you couldn't prove or even come close to proving. Our expert witness with years of research did provide the explanation as to what Mr Sumner experienced and had to live through when his blind rage took someone's life.

As both the Sumner's stated, Edward Sumner had such remorse that he wanted to turn himself in without knowing why he was doing it. He had no memory of the killing, He stated that he never had any intention of hurting Mr Martel, but circumstance beyond his control took over and we all find ourselves at this point in time. Edward Sumner never had to say a word of any of this happening, the police couldn't charge him with any crime because they couldn't. They still don't know what killed Mr Martel. It's very hard to prove First degree Murder without knowing the instrument used.

This is reality that Mr Benson tried to allude to , they over charged on the case with First Degree Murder…. There was no premeditated conditions shown… Temporary Insanity defenses have been around since the Civil War, Peoples Rage is on the rise and Extreme Rage can be seen everyday driving on the freeway. Mr Martel sarcastic tone to real questions that Mr Sumner was trying to find out triggered a very violent Blind Rage that ended in death. They call it Blind Rage because The accused has no idea they he is committing such a violet act. Mr Edward Sumner is not guilty, of First Degree Murder, He is not guilty of Mr Martel death , the only thing he is guilty of is loving his wife the way every husband should.

You must acquit this very good and honorable man and let him return to his loving wife and family, he doesn't deserve to be here .

Judge : Members of the Jury you have been shown the facts of this case….. please proceed to the jury room and deliberate and return your verdict to the actual Charge and not something that he has not been charged with.

Marrisa tells Bull it still remains solid green Diana destroyed Benson

Within an hour the Jury returns with their verdict of Not Guilty. Connie immediately hugs her husband and then proceed to hug Diana for giving her husband back Edward thanks everyone for their efforts and proceeds to take his wife home where they can resume what they couldn't do last night. Diana and Bull still have a conversation to continue

Bull: Benson was like play dough in your hands…. You manipulated and twisted and turned him where he didn't know if he was coming or going

Diana: Are you talking about Benson or yourself…. You look terrible today….. didn't you get any sleep last night… I know I did , I had the best wet dream I've had in a very long time….. you know you were in it….. but I still wouldn't give it to you.

Bull: Seriously where does that leave us… you still want me and I want you

Diana: I want what Connie has… If you could be like Edward and give me the love that he gives Connie , I'll take you in a heart beat… but if you can't….. stay away from me …. It's all or nothing this time around Jason… I'm never going to be played with ever again.
