Derek was asleep in his bed at the hotel and the constant ringing of his phone all night had left little room for sleep. Without even looking at the phone, he knew it was Savannah and wasn't in the mood to talk to her. So he put the phone on vibrate but not even that helped. He couldn't turn off the phone because of his son.

He laid there with his eyes closed and wondered if Pen had told Spence what they talked about. He didn't think so because Spence would have been looking for him. Hell everyone was looking for him. He got up took a shower and went to see his son. He knocked and Spence opened the door.

"Hey Derek, come on in." He said. "D is in his playpen."

Derek went straight to the living room and found D on his stomach trying to reach for a toy. He smiled when he thought about how smart his boy was.

"Hey buddy, you trying to get that toy. You want daddy to help you?" As soon D heard Derek he quit trying to reach for the toy instead he started to whimper. "Ok. I'll get you."

He stood up and picked D up from the playpen. He gave him a kiss and D looked at him and started squirming. Derek laughed and then turned to Spencer.

"He's active this morning for being sick yesterday."

"He woke up this morning like there was nothing wrong with him."

"Where's Pen?"

"She went to get diapers and some other things he needed." He said. "Derek, Savannah showed up last night mad and yelling. She wanted to know where you were at and if Pen had anything to with your ring in her hand. What's going on?"

"I'm going to divorce Savannah?"

"Why are you doing that?"

"I want my family Spence."

"You said you didn't feel the same way about Penelope as she felt for you. Now you do?"

"I'm sorry Spencer. I know you love her and who could blame you but I want the three of us to be what we should have been from the start; a family. I know I hurt her and for that you will never know how sorry I am. I don't want to hurt you either but I won't give them up without a fight."

"You talked about this with her didn't you? When?"

"After we brought D home from the hospital yesterday."

"Everything makes since now." He said. "She was quite all through dinner and would just stare of into space when she wasn't with the baby. She barely talked to me. I thought she was just tired so I left her alone. What was her reaction when you guys talked?"

"Honestly, she doesn't want anything to do with me other than being friends and raising our son. I don't want our son being shuffled from house to house every other weekend. She said it's too late to fix anything. She said she said she loves you."

"You've put her in a very difficult position again. You are making her pick between the two of us and she shouldn't have to. Why can't you just work on your own marriage and leave her alone. Be there for your son and I will be there for her. It's what's best for everybody."

"It's best for everybody or what's best for you."

"Look Derek, I don't want to have to do this to Penelope. She has been through enough already but I will tell you one thing: I love her too and I won't give her up that easily either. You had your chance and you blew it. What do you want from her? I'm going to get ready for work. He just had a bottle about thirty minutes ago."

Derek went to D's room to change him. He rocked him back to sleep and let him sleep on his chest. He heard Pen come in twenty minutes later. He laid D down in his crib and went in search of Pen. He found her in the kitchen putting away groceries.

"Hey."

"Hey. Where's D?"

"Sleeping in his crib. He was pretty active when I got here for being sick yesterday."

"I know he woke up this morning with a smile on his face." She said. "Your mom called me on the way home. She said she was coming this weekend and wanted to talk to us. She included Spencer in this talk. Do you know anything about that?"

"No. last time I talked to her she said she was coming next weekend."

"Well I guess we'll see. She said she's coming in Friday." She said looking at Derek. "Savannah paid a visit last night. I'm only going to say this once. I don't care or want to know what is going on between you and Savannah that is your business. What I won't have is her coming to my house and causing a scene. I will call the police the next time she shows up."

"Do whatever you have to do? Call the police, file a restraining order? It doesn't bother me."

"It should, she's your wife."

"Not for much longer." He said, "How much money do you need for D?"

"I don't know. He's growing so fast him going to need new clothes soon and I want to get him some shoes to wear so he can get used to them."

"How about we go shopping for him together and get what he needs?"

"Derek you know that's …"

"Come on Pen. We are just going shopping for our son. You can bring Spencer with you and I'll bring my mom. We can go Saturday morning."

"I'll mention it to Spence."

"Ok. I'm going to the office give D a kiss for me when he wakes up."

"I will."

She watched Derek walk out and then she went in search of Spence. He was putting his shoes on when she walked into their bedroom."

"Are you ready to go?"

"Yeah. What are you and D going to do today?"

"Stay home. I wanted to take him to the park but he's just feeling better so we'll stay here."

"Come to the office for lunch, I'm sure everyone would like to see him."

"I don't know. JJ is still mad at me."

"Give her time she'll come around."

"I'll think about it."

"That's all I ask." He said giving her a kiss. "Got to go bye."

She laid on the bed and wondered why she couldn't feel that spark with Spence the way she felt it with Derek. She loved Spencer, she really did but not in the way she had loved Derek. She didn't know what to do. She didn't want to hurt Spencer but she had a feeling she would. She didn't want a relationship with Derek. She was afraid he would hurt her again and this time she wouldn't recover. She knew that if Derek was going to fight for her she didn't want Spencer caught in the middle. Did she make a mistake a moving in here with him? She knew he had to be uncomfortable with Derek coming here every day. Seeing him every day was not helping her either. All this stress was causing her to have headaches every day.

Derek was sitting in his office doing paperwork when Savannah strolled in. He took one look at her and threw down the pen.

"I'm not having this discussion with you here."

Savannah closed the door behind her. "Well when do you suppose we have this discussion. You moved out and I assume you don't plan on coming back."

"No I don't plan on going back. We can to talk about things tomorrow. I'll come by when I'm done here providing we don't get a case."

"Let's just start some of that talk now." She said sitting in a chair across from him. "I won't give you a divorce, not so you can go running to that bitch that ruined everything."

"Watch it Savannah."

"Ah yes. We mustn't insult the mother of your precious son. She is what she is. What kind of woman sleeps with another woman's man?"

"What kind of woman makes a man that doesn't love her marry her?" he said. "That was a mistake a plan to correct. I've already filed the papers for the divorce."

"It's not going to be that easy for you. I will fight you every step of the way."

"Why would you want to do that? Why can't' we just get a divorce and go our separate ways."

"Why? So you can go running to her."

"You want to know the reason I filed for a divorce. I can't spend the time I want with my son because of my wife. You have called him names and insulted his mother. She won't ever trust you and I can't say that I blame her. I'm sorry Savannah but my son comes first."

"I'll do whatever you want me to do. Do you want me to apologize to Penelope? I will. I can gain her trust if that's what it takes. I can be a mother to him."

"You don't get it Savannah. He has a mother. You are not going to replace her. I'm not trying to replace her. It's too late. The damage has been done. Now you need to leave."

"Fine. You'll regret this Derek and so will she."

Savannah stood and went to the door. She turned back around and gave him a look.

"You think she can make you happy, give you what you want."

"She already has, she gave me a son."

Savannah flinched and then walked out the door, slamming it behind her. She went fuming to the elevator and stopped short when she saw why had just gotten off.

"Well well. I see it didn't take you long to take right up with Derek and show everyone the bitch you are."

"I see the bitter wife has come crawling to her husband asking for another chance. Did he turn you down?"

"You think you have won and things are only going to get better. Well let me tell you this: Derek belongs with me. He always has and always will. I will make your life a living hell."

"Threaten all you want but I'm not the reason for your divorce. Look in the mirror and you'll see the reason staring back at you. If you weren't such a bitch none of this would be happening. If you hadn't pressured Derek into marrying you, would you be in this situation."

"Derek married me and makes love to me, not you."

"Yes that's all true but I gave Derek something you haven't. I gave him a son."

"Pen is everything ok?" JJ asked.

"I'm fine. We came to have lunch with Spencer."

JJ looked down at the stroller where D was playing with a toy.

"Wow Pen. He looks more and more like Derek doesn't he?" she said. "I'm sorry Savannah I forget you were there."

The elevator opened at the moment and Savannah moved inside. The door closed and Pen let out a breath.

"I hate being mean but that woman brings it out of me."

"Oh you're just acting like a mother protecting her child that's all." she said. "Pen listen. I wanted to say how sorry I was for over reacting. The more I thought about it the more I couldn't stay mad at you. It still hurts that you didn't come to me when you need someone but I'm glad you had Spence."

"It's fine JJ. I would have gotten mad too."

"Maybe in the near future we can go to lunch and dinner and we can talk. I miss our talks but I'm glad you're back. I wasn't lying when I said he looks so much like Derek."

"I know. He's a carbon copy of Derek."

"Can I hold him?"

"Sure."

JJ reached down and picked D up. "Oh my that baby smell. I miss that."

"You can always have another one."

"Ha-ha. No. I have enough with Henry."

"Let's go find Spence."
