Penelope stared at Derek. His eyes were intense and she knew she couldn't talk to him at that moment. If he knew what Spence and she had decided on in regards to their relationship. He would take that as an open invitation to pursue her and she didn't need that right now.
"Look Derek, there is nothing going on. He had some things to do and he couldn't come."
"Something has changed and you won't tell me but I will find out."
"Whatever Derek. I came here for D and for Fran. Don't ruin it for them by letting your imagination get to you."
She walked off and went to catch up with Fran. Derek slowly walked behind them carrying their bags. They spent another hour in the mall before it was decided that they had enough. Derek loaded the packages for D in Pen's car and got him settled when he turned to Pen.
"You still coming for dinner?"
"I told your mom I would."
"Is Spence coming with you?"
"I haven't had a chance to ask him yet but I will as soon as I get home."
"I'm going to take momma back to the hotel and I'll see you later."
Penelope was rocking D to sleep when Spence came looking for her. He watched her for a few minutes. He walked in and sat on the floor across from her.
"How was the shopping trip?"
"Fran went overboard as usual." She said. "I was sitting in the food court feeding D when Savannah came up to us. She said the same nasty things as always."
"Where was Derek?"
"With Fran getting some food." She said. "He came toward the end of the conversation. She said she was going to make his life hell and wasn't going to give him a divorce."
"He can divorce her without her consent. He can file everything and then she'll just have to sign when the time comes."
"That's probably what he'll do then. We have a slight problem. Derek didn't believe me when I said you had some work. He asked what was going on between us. He could tell something was wrong."
"Well what do you want to do? He's not going to give up."
"I know. Fran wants all of us to go out to dinner and I told her we would both go. I'm sorry I agreed without asking you."
"It's ok. I'll go. We'll just have to make it look like nothing has changed between us."
"I know. Do you think we can pull it off?"
"I'm sure we can." He said standing up. "You know that just because aren't together doesn't mean I'm just going to abandon you. I'm still going to be here to help you in any way I can."
"I know but I don't deserve for you to do that for me."
"You deserve that and much more. It isn't your fault that I was the one wish on a dream."
"Oh Spence."
"It's alright. You put that little guy to sleep and I'm going to make some phone calls. What time are we meeting for dinner?"
"Seven."
"That gives me enough time to get some work done."
Penelope looked down at D and whispered to him. He just answered her with a smile of his own.
Derek and Fran were already seated when Spence and Penelope walked in. They were running a little late since D was a little cranky when they dropped him off at JJ's. Penelope didn't want to leave him and it took some convincing from Spence that he would be ok. They sat down.
"How was D when you dropped him off?" Derek asked.
"He was cranky and I didn't want to leave him but Spence said he needed to get used to other people watching him and he would be fine." She looked at Spence and smiled.
"He'll be fine." Fran said. "How are you doing Spence? We missed you when we were shopping."
"I had some work to do but I'm otherwise I'm fine." he said. "Penelope told me the good news that you are moving here."
"I am. I'm so excited. I'll be closer to D."
"I'm sure he will love having his grandma closer. He's growing so fast."
"He is."
The conversation turned to her move and then to work. Derek kept a close on Spence and Penelope and he could tell something was different. He didn't know what it was but he would soon find out. After they went their separate ways and turned in for the night. The next day brought Fran and Derek to their house for a little time with D before Fran left to go back home and start packing. Derek had told then that he too was looking for a place since Savannah had the house.
Monday brought reports and consultations which Derek found irritating. He wanted to talk to Spence to see if he could find out anything. He was just about to go to Hotch's office when Savannah breezed in.
"What do you want Savannah?"
"I have some good new to share with you."
"What? That you're not going to cause problems with the divorce."
"No Derek. As much as you want to divorce me, you might actually change your mind."
"Why would I change my mind?"
"Because I'm pregnant."
Derek's face held shock and savannah's held triumph. "You're lying."
"I am most certainly not. I have the positive test results right here."
She handed Derek a piece of paper and he sank down in his chair as he looked it over. He looked at her and threw the paper on his desk.
"You had that paper made up."
"I didn't do any such thing. I'm almost three months."
"We haven't slept together in a long time."
"The last time we slept together was the night before your son was born."
Derek thought back to that time and realized she was right. That was the last time they had slept together. He panicked. What if she really is pregnant? What am I going to do?
"Why are you just now telling me this?"
"With everything going on, I didn't realize that I hadn't had my period. I was feeling really tired and just had no energy so I went to the doctor and he told me I was pregnant. See Derek, this changes everything. We can finally have our own family: you, me and our baby."
"This changes nothing. I want confirmation from a doctor I choose and then we'll go from there. But make no mistake, the divorce will go on."
"How can you even say that Derek? This is your baby and you are just going to abandon us."
"No Savannah. If you are really pregnant, I will never abandon my child but I will not get back together with you. I will be in my child's life just like I am in my son's."
"Don't you get it Derek? I will never let that happen. It's either both of us or none of us."
"Are you threatening me?"
"No. I'm giving you a choice. I let you make the rules but now I'll be making them."
"I want confirmation first."
"Fine. Choose the doctor you want and make that appointment."
Savannah sat in the chair across from Derek's desk while he looked for the number of the doctor Penelope used. He was lucky and got an appointment in thirty minutes. He called Hotch and told him an appointment he forgot to mention and needed at least an hour. Hotch gave him the hour and asked he if was ok. Derek told the truth and said no but didn't go in to detail.
He drove with Savannah to the office and they signed in. Savannah filled out the papers and they waited to be called. Derek thought of a lot of things but he could believe he was so stupid. He knew how things were with his wife and her being pregnant is not what he needed right now. He wanted to be free of her once and for all. Thirty minutes later Savannah name was called and they were shown to a room in the back.
Penelope sat nervously in the Director's office while she waited for her appointment. She looked up when she heard footsteps and saw Strauss walking into the office.
"Go right in Chief Strauss, the director is waiting for you." Karla, the director's assistant said.
Penelope noticed she didn't even bother to acknowledge her. That did not bode well for what she was there for. Ten minutes later the door opened and the director himself came out.
"Ms. Garcia, you can come in now."
Penelope stood up and followed him into his office. Strauss was standing near the director's desk with her arms crossed against her chest. Penelope swallowed the lump in her throat.
"Have a seat Ms. Garcia." He said. "Am I correct in guessing that you are here for your old job back as a technical analysis?"
"I am Sir."
"There isn't an opening on your old team right now."
"I do not want on my old team Sir. I want to work in a department where I will work normal business hours. I have a baby at home and I want to spend my evenings with him. I don't want to work in the BAU."
"Is that the reason? Or maybe it has to do with Dr. Reid and Agent Morgan? I believe you have a son with Agent Morgan but you live with Dr. Reid."
"With no disrespect ma'am, who I have a child with and who I live with have nothing to do with my skills to do my job. I want to work again but I want to spend time with my son as well. The hours with the BAU are long and I don't want to neglect my son. He is still very small and he needs me."
"I understand completely understand but with your skills I could really use you in the BAU but with Team B. I could work it out that you leave no later than 5:30 and if you must, you can work from home."
"You would do that for me."
"Yes personal life if your own and although I don't like my employees to fraternize, well frankly that shipped has sailed. I just don't want any problem between you and Agent Hotchner's team. There will occasions where you will have to work with Team A. Is that going to be a problem?"
"No Sir. I can be professional."
"We haven't see any of that yet. As far as I can see you've been nothing but unprofessional."
"Erin that is uncalled for." The director said. "Do you accept that offer?"
"I do and thank you so much. When would I start?"
"Next Monday would be fine. That'll give you a chance to set up arrangements for your son. We do have a day care here on the second floor for our employees. It's run by one of the agent's wife and every employee is married to an agent or the daughter of one. It's also free."
"Oh. I didn't know. May I go and check it out."
"Sure." He said. "The lady you need to ask for is Diane."
"Thank you Director for everything. Ma'am."
"I'm going to be keeping an eye on you Ms. Garcia."
"Yes. Ma'am."
"Karla has all the papers you need to fill out."
"Thank you again Sir."
Penelope filled out the papers and went to talk to Hotch. She found him in his office. He smiled at her and motioned her in.
"Have a seat Penelope. What are you doing here?"
"I was here for a job."
"You are. Why didn't you tell me? I would have talked to the director."
"I want to come back to work but not for you Hotch. I don't think I can work with Derek again. Then there is Spence to think of."
"I see. So what did the director tell you?"
"I wanted to work in another department but he said my skills were needed in the BAU but with Team B. So I accepted and start on Monday."
"Well as much as I would like you to come back to us I understand. Do either Derek or Spence know?"
"No this was something I wanted to do on my own."
"Everything ok Penelope. You know you can talk to me anytime."
"Has Derek told you that he is divorcing Savannah and that he wants his family back? A family he never had in the first place."
"No. What was your response?"
"Aaron, at this point I don't care. I know I have to get over what he did, the things he said and I will. But really I don't want to be the reason he divorces Savannah. I don't want to be caught in the middle. I don't want my son in the middle."
"What does Spence think of all this?"
Penelope started crying. Hotch went around and kneeled in front of her. "What's wrong?"
"Aaron, I'm a bad person. I hurt Spence and I didn't intend to. I wanted to feel for him what he felt for me but I don't. I don't think I ever will. He knows and we decided to call off the engagement and just be friends. I know I hurt him but he still wants to help me."
"Does Derek know?"
"No and I don't want him to."
"I won't tell him."
"Thank you but there was another reason I came here to talk to you." she said. "Did Jack ever attend the daycare here?"
"No cause Haley was a stay at home mom. But I have heard that it's run by wives or daughters of agents that work here. Everyone loves it. Even the kids love it. Are you thinking about putting D in there?"
"Yes but I have to talk to Derek first. I would prefer him closer to me."
"Well Spence is out on a consult with Emily so why don't we go check it out."
"That would be nice."
They left his office and walked toward the elevator. As they approached the doors opened and out stepped Derek with Savannah. Derek had a stunned look on his face and savannah was grinning.
"Agent Hotchner, Penelope, you'll be the first to know and congratulate us." She smiled directly at Penelope. "We're pregnant and our baby is due November 6th, weeks before our first anniversary. Isn't that wonderful?"
