Sorry it took so long to upload but I had writers block and then I had to write most of the chapter over again.
I thankfully am not familiar with divorce cases or things of this nature so I tried to make it realistic but if it's not then I apologize. So I hope everyone enjoys and sorry about the long wait and the wonky update earlier. :D
JJ woke up first the next morning. She was still exhausted and her back was sore from sleeping on the couch. She stayed still to listen for movement upstairs but when she heard none she concluded that Jason and Emily were still asleep.
She got up slowly and went to the kitchen to make herself some coffee. She felt pretty groggy so she wasn't in the mood for a real breakfast. Once Emily and Jason woke up and came into the kitchen she would go and get a shower or something to get out of their way.
Meanwhile Jason and Emily were starting to stir. Emily sighed and cuddled into Jason as her lightly traced circles on her back.
He leaned down and kissed her forehead. She smiled but still had her eyes closed. "You woke me up too early again Will." She said sleepily.
Jason caught her slip but didn't draw attention to it. "I'm sorry Em." He said softly. "I have to help my brother move today so I have to go. It was a great night."
Emily opened her eyes and squinted at the light. "Bye Jason thanks for everything."
He kissed her gently before leaving the room. He was thankful that his clothes had somehow found their way to the top of the stairs. He went to the bathroom to change and then quietly walked down the stairs before leaving the apartment.
JJ saw him leave and luckily he hadn't seen her. She smiled to herself when she remembered Emily's words, 'use them and lose them'.
After JJ finished her coffee she walked up the stairs and got in the shower. She washed off the grunginess and felt a little more energized when she got out. She redressed and left the bathroom only to see that Emily still hadn't got up. She was about to go in and check on her when she heard her cellphone ring.
Quickly she went back downstairs and into the kitchen to answer it.
"Hello?"
"Good morning JJ this is Michael."
"Oh hi, how is everything?" JJ asked.
"Everything is good. We sent out Will's paper's shortly after you left so they should be arriving to him within a few days. So if everything goes as planned we should get them back by Friday."
"That's great. Hopefully he signs them."
"Time will tell." Michael replied. "There is one more thing I want to talk to you about. I got in contact with the three women that Will allegedly had affairs with and two have said they would appear in court if need be and one moved to another state. Is there anyone else that you know of who Will may have had an affair with? The more names the better case we have against him if you wanted custody of your son."
JJ bit her lip. She thought about not pulling Emily into the situation but what if she needed another statement or another women in order to convince the judge? "The women I was with yesterday, Emily Prentiss."
"Ok. I will contact her as soon as possible and get back to you." Michael concluded.
"That would be great. Thank you Michael." JJ said before they hung up.
A few minutes later JJ heard Emily come down the stairs. "Morning sleepy head." She said sipping her second cup of coffee.
"Morning Jay." Emily said stifling a yawn.
JJ got up to get Emily some coffee. "What time did Jason leave?" Emily asked when she sat down to the island.
"A little before ten I guess." JJ replied handing the mug to Emily. "You were right about the breakfast thing."
Emily smirked over the ring of her mug. "I told you."
"So was he good?" JJ asked.
Emily didn't want to tell her they didn't have sex but she also didn't want to lie so she just shrugged her shoulders.
"Fine don't tell me. I don't need to hear it from you I'm sure drunk Emily will tell me all the details I desire."
Emily shook her head but laughed because she knew it was true.
They ate their breakfast in silence until JJ remembered the conversation she had with her lawyer. "Michael will probably call you today and ask you if you want to appear in court."
Emily sighed. "Honestly I'd rather not but I will if you need me to."
"Well you can probably just meet with Michael and provide a statement or something like that." JJ assured already feeling bad for bringing her into the mess.
"Maybe." Emily replied. "I'll just talk it over with him when he calls."
JJ changed the subject by asking. "What are we doing today?"
"We could go shopping." Emily offered.
"Is that a polite way to get me to stop wearing your clothes?"
Emily laughed. "No it was just an offer since you might be staying here for a while."
"Sounds great." JJ said finishing up her coffee.
"We can go now if you want and eat out somewhere for lunch." When JJ nodded she continued. "I'll just go up and change and then we can go."
Emily did as she said and 20 minutes later the two were out the door. They drove to the mall and shopped for a little over two hours. They quickly decided on where to eat lunch in the food court and the two sat down with their food.
They talked about maybe going to a bar and maybe calling Garcia as well next weekend.
Emily wanted to ask how long JJ would be staying at her house but she didn't want to sound rude. Honestly she didn't mind JJ staying with her but she knew that it wouldn't be a practical long-term solution for JJ.
In the middle of their lunch Emily's cell phone rang. She apologized and answered it while JJ waved her apology off.
"Hello?" She answered.
"Hello Emily, this is Michael. We meet a few days ago." Michael replied.
"Yes hi Michael." Emily said while making eye contact with JJ.
"I called JJ earlier today and she said that you may have had a relationship with her husband. This is just an allegation and you don't have to answer anything over the phone. We can set up a meeting this coming week to work something out."
"I have no problem with that. As for the relationship it did happen and although I've never been on this side of the situation I have seen what it can do to friendships and things of that nature. So with that being said I would like if we could work out a deal where I would provide a statement but stay out of court."
"That would be doable. We can set up a meeting Friday afternoon and you can come in a make your statement." Michael replied.
"Sounds great, thank you Michael." Emily said with a smile.
"I will talk to you soon." He said before hanging up.
"So?" JJ asked when Emily laid her phone on the table.
Emily explained what would happen and asked her once again if it was ok that she wasn't going to appear in court.
"Of course that's all right. I mean life has to go on after this and I don't want your name to be forever tainted by this."
"Thank you." Emily said as they finished up their lunch. "His voice is even sexy." Emily laughed.
"I know." JJ agreed. "Can you imagine his voice early in the morning?"
"Oh my god." Emily dragged out. "But you know he kind of reminds me of Hotch."
"Wow way to kill the mood." JJ frowned but then laughed.
"I mean he's always serious and monotone, I don't know he reminds me of Hotch." Emily said trying to dismiss the subject.
"Do you have to hot's for Hotch or something?" JJ said while trying but failing to be serious.
"I can't believe you said that." Emily laughed.
While they were teasing each other JJ's phone rang.
"Hello?" She answered still laughing a little.
"Hi sweetheart." Her mother answered.
"Oh hey mom, what's up?"
"Will just dropped Henry off at my house for the day and I was wondering if you wanted to come see him."
"Is Will still there?" JJ asked while biting her lip.
"No he just left. He said he would come pick him up around 6."
"Ok I guess we'll see you in a bit." JJ replied looking at Emily. When she nodded JJ smiled and said goodbye to her mother.
They left the mall after they ate and got back into Emily's car. The drive to JJ's mother's house was only 15 minutes so they didn't get a chance to talk much.
"We'll leave by five I guess." Emily said and was satisfied when JJ nodded.
When they arrived at the house JJ got out of the car before it came to a full stop. Emily parked and turned off the car as JJ raced ahead. Emily took her time getting out and walking up the walkway. When she got to the open front door she was greeted by JJ's mother who complemented her on her figure and hair as she always did.
JJ had Henry up in her arms and was rocking him slowly. Emily heard her whisper things like I missed you and I love you my baby but she tried not to listen. Instead Emily followed Sandy into the kitchen so that JJ could have some alone time with her son.
Emily and Sandy sat at the table and drank some coffee that had been brewed in anticipation for their visit.
"So how are things?" Sandy asked once they were settled.
Emily let out a breath. "That's a loaded question if I ever heard one." She paused to gather her thoughts. "Things are, well, they're kind of… I don't really know." She said finally. "I can tell JJ is putting on a brave face but I'm worried about her. She's strong but I feel like this is really testing her."
Sandy nodded as Emily spoke. "Yeah I can see it in her eyes. I'm just glad she has someone like you to help her out when she really needs it. But if you ever need a break just call me and I'll let her stay here for a while."
Emily smiled. It was a nice offer but Emily knew she wouldn't take it. The reality of the situation was that she was not some perfect friend that needed to be put on such a high pedestal. It was quite the opposite actually. She was going to do anything and everything JJ asked her to do. Partly because she wanted to help her friend but also because she still felt absolutely terrible about everything she did.
Sandy didn't know that Emily had had an affair with Will but she felt like it was an inappropriate time to bring it up.
"I was actually a little happy when JJ told me about the divorce." She said pulling Emily away from her thoughts. "Not about the circumstance of course but I never did like Will much."
"Are you just saying that because he broke JJ's heart into a million pieces?" Emily asked with a smile.
"Of course." She replied causing them both to laugh.
Everyone liked Will. You almost couldn't help liking him. It was almost like an epidemic. Some people liked him a little too much, obviously that's what got them into their current situation and obviously Emily was one of those people but, once you got to know Will you liked him. End of story.
"Are you two staying for supper?"
"Oh, I don't know we haven't talked about it." Emily replied.
"Then it's settled. You're staying." Sandy said firmly before getting up from the table and going out to the living room with JJ and Henry.
Emily got up as well and put their mugs in the dishwasher before joining everyone in the living room.
JJ was on the floor with Henry and Sandy was on the couch smiling at her daughter.
Emily decided to sit on the floor as well with her back against the bottom of the couch near JJ but not intruding.
The three adults talked and planned an early supper. When Henry was ready to take a nap at a little after 3:30 JJ went upstairs to put him down and Emily followed as well.
JJ changed his diaper and put him in footie pajamas for his nap. The whole time Henry's eyes were glued to his mother. Like he was in awe of her.
Emily watched the two interact and was surprised when she didn't get jealous. She had expected to get jealous of JJ having someone who loved her unconditionally and someone who depended on her some much but it didn't happen. Emily never wanted children of her own and this further confirmed that. But that didn't mean she couldn't be happy for JJ.
"You are so good with him. He's quiet and he hasn't stopped staring at you." Emily said smiling at little Henry.
JJ just smiled and waved Emily's compliments off. She picked up Henry who was starting to doze off and put him in a crib that her mother had insisted she have.
She laid a blanket over him and turned on the mobile that was hung above the crib. When she stood up again she no longer had a smile on her face.
In the dim light Emily could see that she had tears in her eyes. "Everyone thinks I'm this amazing mother and I just don't think it's true."
"Oh honey of course you are." Emily said as she wrapped her arms around JJ.
"I'm splitting up our family Em, I don't think that's on the top of any best mom to do lists." JJ said quietly into Emily's shoulder as she sniffled.
"Jay you are not the bad parent in this situation. Think about what happened and what brought you to make such a difficult decision and you will she you are doing everything right. Henry loves you more than anyone else and there is a reason for that. You are a good mother and you're not allowed to think you aren't." Emily said still holding JJ in her arms.
"My life is a mess." JJ said finally pulling away from Emily and wiping her eyes.
Emily offered a sad smile. "I know and it may take a while to clean it all up but I know you can and I'll help you every step. I promise." Emily said once again.
JJ quickly hugged Emily again and turned around to kiss Henry before the two left the room.
When they walked back downstairs and into the kitchen they saw that Sandy was busy making supper.
She told JJ and Emily to sit down and take it easy and wouldn't let them help at all. She also brought them a bottle of wine, which made sitting around doing nothing a lot more enjoyable.
Sandy told the two stories about JJ's dad who had died a long time ago while she cooked and Emily saw JJ's face light up whenever Sandy said her father's name.
Emily had never met the man but from some of the stories she was hearing he seemed to be an easy to get along with, mellow, fun loving man.
As if on the same timer as soon as supper was ready Henry started to cry. JJ rushed up to get him while Emily and Sandy stayed downstairs and set the table and put food on all the plates.
When JJ came down the stairs Emily was putting the plates of food on the table. JJ looked at Emily as she watched the two come into the dining room.
"Do you want to hold him?" JJ asked.
"No." Emily said quickly.
"Why? Afraid you'll want one?" JJ teased.
"More like afraid I'll drop him." Emily joked.
JJ smiled and let the topic drop as Sandy came in the room to join them.
They all sat at the table and ate together like a family. A twisted and fucked up family but a family none the less.
While Emily wasn't jealous of JJ having Henry she was jealous of having grown up in the same house and eating meals together at the same time. She never had that growing up and she didn't have it now. Emily's mother would often be locked in her office for hours on end and after her parents had divorced her father was never around.
Every time Emily thought about her childhood she got more depressed and more astonished that she had ever quit using drugs.
When they finished eating it was getting close to five-thirty and even though they offered to help clean up Sandy shooed them away.
After an extended goodbye to Henry they thanked Sandy and left.
JJ was upset on the drive home because she hadn't wanted to leave Henry but she knew she had too.
When they where back at Emily's house they changed into comfier clothes and watched movies and ate junk food until bed.
After Emily had gotten quick shower she joined JJ in her bed. Just as she was about to turn off the lights JJ spoke. "So you're really not going to tell me what happened last night with Jason?"
"What do you want to know?" Emily asked.
"I want to know if he was good." JJ said for what felt like the hundredth time.
Emily sighed. "I wouldn't know." She said finally.
"What?" JJ said dumbfounded. "You mean you didn't sleep with him?"
"No." Emily replied.
"So he just stayed the night and you didn't have sex?" Emily shook her head. "At all?"
"Well we were going to and we got really close to having sex but it didn't feel right so we stopped." Emily said with a matter of fact tone.
"Ok we need to go to a mental hospital because clearly you are insane." JJ replied, still a little shaken. "Didn't feel right? For Christ's sake I'll sleep with him."
"Oh would you? That would take so much pressure off me." Emily said sarcastically. "It'll happen JJ, don't worry about it."
JJ laughed. "I'm overreacting I know. I'm just surprised because it's not like you to put it off for so long especially when it's with someone you really like."
Emily kicked herself on the inside. She should have just lied to JJ and said that she had had amazing sex with Jason because she couldn't tell her that the real reason she didn't have sex last night was because the memories of Will raping her were still fresh in her mind.
So she just shrugged and said. "I guess something's different this time around."
When JJ smiled at her she turned over to turn off the light. "Good night Em."
"Good night Jay."
The two fell asleep next to each other as they did a few nights ago and as they would continue to do for at least the near future.
Emily woke up first as always and turned off the alarm quickly. She went downstairs and made them breakfast and as soon as it was done JJ appeared as if she was waiting on the other side of the door.
