AN: So I was watching HP: Order of the Phoenix and it got me thinking.
Anyways here's my idea, its kind of like a behind the scenes event that I think possibly happened – leave a review and tell me what you think.
Draco sped from Professor Umbridge's office a second after the Weasleys, Neville and Luna had left, not bothering to help his friends recover from the Puking Pasties.
He ran along the corridors and up to the owlery, past many bewildered students and teachers and the call of Professor McGonagall's "2O Points from Slytherin."
Reaching the owlery he took a letter from his pocket and attached it to his owl Midnight.
"Take this to my father," he whispered to the owl.
Draco watched the owl fly out of sight before exiting the Owlery.
Lucius sat in his office in Malfoy Manor; he was awaiting a letter from his son Draco. The letter was important and would decide what he would do next.
TAP, TAP.
He looked up to the window to see his son's owl Midnight.
Lucius walked over to the window and received the letter from the owl.
He opened it,
Father,
Potters left, he's got company – the Mudblood, a couple of Weasels, Longbottom (Bella can have some fun) and the Lovegood girl.
Draco
Lucius looked up to the other occupants in the room.
"They've left," Lucius stated to his eleven companions.

It's basically how I think Lucius was aware that Harry was at the Ministry of Magic.
