A/N guys I'm so sorry. I did have exams but there is no real excuse for my dreadful neglect of this story except my laziness. I am going away this week but I'll try and write a couple chapters and then type them up when I get back. I'm really sorry :(

Harry

He had received a note at breakfast this morning from the headmaster and he was now standing outside Dumbledore's office. He hadn't told anyone about the note- after the events of the last couple of days he didn't want to draw any more attention to himself. He took a deep breath, prepared to meet professor Dumbledore's possible suspicions and opened the door.

'Office' hardly did justice to the room. It was circular and huge. The room was as quirky as the headmaster, with strange equipment emitting odd noises and occasional puffs of smoke. Hundreds of portraits covered the walls, but most were sleeping. There was a huge desk and beyond it Harry could see the sorting hat.

Behind the door was a golden perch on which a swan sized bird with crimson feathers and a long golden tail rested. Harry couldn't see Dumbledore anywhere so he stepped towards the bird. Despite its beautiful colours it looked old and sick.

"He's a phoenix. His name's Fawkes." Harry turned around in surprise, as the voice didn't belong to Dumbledore.

"Hermione? What are you doing here?"

She stepped out of the shadows. 'Professor Dumbledore has been talking to all the muggleborns at the school. He just left to talk to someone."

He noticed she looked upset. "Are you okay?"

"Yeah I was just thinking about stuff. I should probably go now anyway. Professor Dumbledore didn't expect me to stay and I'm sure he'll be back to talk to you soon so bye Harry."

She left and Harry was left alone. Dumbledore arrived soon after and apologised for being late.

"Now Harry, I understand there are some rumours going around."

Harry began to panic. "Professor I didn't- I wouldn't- Colin Creevey-"

"Harry I don't believe you are responsible."

"You- you don't?"

"Of course not. I know you're the victim here. I understand that some of the other students believe that you are the heir of Salazar Slytherin. However I just want to talk to you."

A while later Harry left the office feeling better knowing that the headmaster didn't believe he had hurt the Gryffindor boy. He was heading back to the common room to do his homework before dinner when he walked into Hagrid, who was carrying an armful of dead roosters. Harry continued onto the common room a little freaked out.

Draco and Blaise were playing a card game with some of the others while Pansy and her clique were lounging on the elegant green sofas doing each others make-up. Harry got out his books and sat down next to Draco.

Hermione

The Gryffindor common room was always ridiculously noisy. Fred and George Weasley were playing magical table tennis while Lee Jordan had just stuffed a spider down Neville's back. She would have gone to the library but it wasn't long until dinner anyway.

The Patil twins were braiding each others hair and Hermione wanted to go over and join them but she had a huge extra credit essay due for charms tomorrow.

With a sigh she packed up her things and headed down to the Great Hall. When she finally got there, having taken the long way round to avoid Peeves, Hermione realised she had left her book in her room. Awkwardly she looked around for someone to sit with. She sat down next to Lavender and steeled herself for a dull dinner.

She escaped from dinner as soon as she could and made her way to the library. She was only a staircase away when she noticed Nearly Headless Nick floating in the corridor. She saw a boy in Hufflepuff robes lying on the floor and ran over. Justin Finch-Fletchley, a second year Hufflepuff was lying frozen on the floor. Hermione heard footsteps behind her and then a hand was clamped over her mouth from behind.

Draco

Two more petrified and still no fatalities- his father would be getting impatient. What was more worrying was that he had been caught by her at the scene of the attack and she was already suspicious of him.

She flipped round to stare at him.
"Malfoy" she spat out. "You hurt them?"

She looked scared and hurt. He hated that she was scared of him but he knew what he had to do.

Hermione

He stepped closer but she didn't flinch. "Hermione" he said softly. "I'm sorry."

She only had time to wonder what he was sorry for before he drew his wand and then she fell, drifting into oblivion.

The ground was hard. She was lying on the ground and her head hurt and she could hear voices shouting. She blinked and bright light filteed into her eyes.

She got up sleepily and in a daze followed professor McGonagall through a crowd of people. She didn't know where she was going, just put one foot in front of the other.

Lying in a hospital bed she heard more voices. These ones whispered and she could hardly make them out.

"The headmaster says... possession... check her wand..."

Harry

He had sitting waiting for her to wake up for a while by the time she finally stirred. He didn't know if she wanted him there but none of her Gryffindor friends had come to visit her. Draco wouldn't come with Harry so he'd left his friend to a rather violent Quidditch practice.

She yawned and sat up slowly. "Where am I?"

"The hospital wing."

"Harry?!"

"Hi Hermione. How are you?"

"I'm okay I guess."

"Oh good." He smiled. "I wad worried you might miss the Christmas feast."

She laughed a little then remembered where she was.

"What happened? I remember talking to you in professor Dumbledore's and then... all the people..."

"Justin Finch-Fletchley and the Gryffindor ghost were petrified. You were found lying next to them. You really don't remember what happened?"

She shook her head. "Poor Justin."

They talked for a while and the Madame Pomfrey kicked Harry out saying that Hermione needed her rest.
