"Who authorised this interview?" Derek asked.
"DI Arnott's DNA is a match to the semen found on DI Fleming," James told his boss, trying to defend his actions.
"So I gather," Derek retorted. "I had about twenty messages on my answer phone after my dentist appointment from DS Howard and Sally from forensics. You better hope there's more evidence than that,".
"Are you trying to say I taped me and Kate having sex?" Steve asked, piecing together what James had last insinuated. Both VCU officers turned to look at him as he spoke, having forgotten he was still present.
"I'd advise you not to say anything, DI Arnott," Steve's legal representative advised. "This interview is no longer being taped," he reminded his client.
"I don't care," Steve retorted. "I didn't do this to Kate and I certainly wasn't taping us having sex,".
"Sir," interjected James. "If you let the interview continue, we found some interesting things during our search of DI Arnott's flat,".
"Like what?" Steve asked.
"DI Arnott!" Steve's solicitor warned, exasperated at his clients failure to follow his advice.
"No!" Steve replied to his solicitor. "I want to hear what they've found. Let's continue this interview," he suggested, very determined now.
James looked at Derek who looked at the two DI's as he thought about Steve's request. Both seemed intent on wanting to continue the interrogation. Derek shrugged his shoulders in resignation. "Ok," he said as he took the empty chair next to James. He pressed the button on the tape recorder. "Interview resumed at," Derek looked at his watch, "13:45," he continued. "Same people still present,".
"Before last weekend, when did you last see Kate Fleming?" James asked.
Steve thought back. "Her leaving party," he finally answered.
"So absolutely no contact with DI Fleming, since she left AC-12 and you ran in to her at the pub?".
"No. I haven't seen her,".
"Bit strange," Booth said. "We've talked to your colleagues at AC-12. They say you were very close when you worked together,".
"We had planned to keep in contact but, I don't know, real life got in the way,".
"You haven't sent her any gifts in the mean time?".
"Gifts?".
"No flowers. No chocolates or soft toys?" Asked James, mentioning the presents that Kate had received from her stalker.
"No," Steve echoed.
"Ever write her a letter?" James asked.
Steve worked out where the VCU officer was going with this particular line of questioning. "You think I was her stalker?" He challenged before shaking his head in disbelief. "This is crazy,".
"Is it?" James asked. "You ever been in Kate's flat uninvited?".
"No," Steve replied vehemently.
James slid an evidence bag on to the table between the four men that contained a set of keys that Steve recognised. "There was no sign of a break in when Kate found someone had been in her bedroom, was there?" James asked Steve.
"No," Steve admitted.
"You didn't use this set of keys?" James asked. "We tested them. They are the keys to DI Fleming's flat. Why are they in your possession?".
Derek appeared interested to hear Steve's response.
"When we were partners, we gave each other keys to our flat and car. For safety. In case we ever were in trouble and needed a place to hide or escape," Steve explained. "I've got Kate's. She has a set to my place,".
"And you forgot to return them when she left AC-12?".
"Obviously," Steve replied. "What about this video tape stuff you mentioned earlier?" He asked, getting back to the topic he was keen to find out more about.
Derek looked at James. He wanted to know as well. "Can you explain why we found four discreetly hidden video cameras during a search of your flat, including one in the bedroom?".
"No! They aren't mine," Steve said. "You've got to believe me,".
"So who put them there?" Derek asked.
"And whilst you're at it, can you tell us where the recording device is that these cameras send their images to?".
"I don't know," Steve said wondering what the hell was going on as he tried to make sense of this latest finding. "Unless... Oh my god! Kate was right that one time and he had been in my flat," he mused out loud.
"Convenient," James said, clearly not believing Steve. "Let's change topic then. You ever get angry at Kate?".
"No,".
"In all the time you worked together?" Booth asked incredulous. He had had a few disagreements with his partners in his time.
"Just a few fallings out. Nothing major," Steve replied.
"Do you have a temper?".
"I've never hit a woman before, angry or not if that is what you are getting at," Steve pressed his point. "You're going to ask next if I was the one that beat Kate aren't you?" he continued. He knew interview technique and exactly where James was heading. "I'm not going to answer that question until you provide me with the evidence you have to prove you are allowed to ask it,".
Wheeler and Booth were silent. It was the one very frustrating part of the case. They didn't have any proof of who did the attack. Forensics had still come up blank on the white scrap of material. None of the suits worn at the scene by FI's were a match or had any holes.
"You've been arrested before haven't you? For the murder of another police woman?" James countered. "That would indicate some anger issues,".
"Released without charge thanks to Kate," Steve clarified. "I was being set up,".
"But there is a pattern emerging of violence to female police officers who just happen to be associated with you,".
"There is no pattern!" Steve retorted angrily. "Except maybe for being framed for things I haven't done!" He amended. "I didn't kill Lindsey and I certainly didn't hurt Kate. I love her!" He declared, realising too late he had just worn his heart on his sleeve. It wasn't a surprise to Derek who had already come to that conclusion anyway. "Why on earth would I want to hurt her?".
"So let me get this straight," James attempted to sum up the interview as it was drawing to a close. "Your story is that you and Kate are at the start of a fledgling romance. You leave her in bed and play football. She is then attacked by someone else in her flat the next day,".
"Yes," replied Steve. "You have my word that that is what happened,".
"Putting the mysterious video cameras to one side for the minute, there's something else I don't quite believe about that story,".
"What's that?".
"You have an impotence problem following your broken back don't you? Not sure you could manage three times! Maybe you hit Kate because you blamed her for your body failing to perform?".
Steve glared at the two policemen opposite him. They were perfectly entitled to look at his medical notes but it still felt a gross invasion of privacy. It had been a miserable period of his life and very emasculating. Thankfully it had only been temporary.
"Had," Steve corrected them. "It's resolved itself," he told them. "I can prove it if you want," he added sarcastically. He would get an erection in front of them if it helped clear his name.
"That won't be necessary DI Arnott," Wheeler said. "Please disregard that line of questioning," he apologised, realising James had crossed a line. "I think we'll call it a day there. Interview terminated at 12:30," he said before pressing the stop button once again.
Steve slouched back against the back of his chair, glad that was over.
Derek motioned to a guard and Steve was soon on his feet and being led back to his cell when he stopped in his stride. Something suddenly made sense.
"Were there any video cameras found at Kate's?" he asked the VCU team out of interest. "She said she felt as if she was being watched in her home. Maybe she was right?" he postulated.
"Not in the kitchen where she was found," Derek replied, "but I have to admit I don't think the rest of the flat was searched for them," he admitted embarrassed. It was definitely something to follow up on.
"Any tracker like devices in Kate's belongings?" Steve added.
"Why do you ask?".
"For what it's worth, I think Kate's stalker knew where she was," Steve said. "He broke in to mine and planted the cameras. He saw me and Kate spend the night together which must have upset him and made sure Kate paid the price for our actions," he continued before he was led off.
Derek spent a few moments thinking over what Steve had just said. His theory had a lot of merit to it and was worth investigating. Getting out his phone he dialled DS Howard's number and directed her to go to Kate's flat with some FI's and search the whole flat for any cameras. He then called Sally and requested a search for trackers on Kate's belongings that had been found at the crime scene.
"You and I need to have a little chat," Derek said to James once he had hung up. The look on his face told James that he had severely screwed up and it wasn't going to be a very pleasant conversation for him.
A knock at the interview door spared him from the telling off.
"Enter!" Barked Derek and a shy little DC popped her head in to the room. "What is it?".
"Umm, the hospital just phoned," she said meekly. "They thought you would like to know that Kate Fleming has woken up,".
