The following Tuesday morning was going to be a rough morning. Sue's trial was at ten o'clock. Superintendent Harris was still filling in the principal position and had agreed to let everyone go to the trial to support Rachel, Noelle, and Josh as they testified. However, Monday afternoon, as the New Directions were practicing in the auditorium, they were going to learn news that would ultimately change their lives.

"Let's take it from the top you guys," said Will as he and Mike, along with Puck and Quinn and the kids, watched the group practice.

Puck, Quinn, Beth, Will and Mike clapped but saw Kurt, Blaine, Rachel, Noelle, and Josh standing in the corner looking glum.

"Guys?" asked Will. "Is everything okay?" Noelle shook her head.

"No," said Noelle as the other New Directions came down to them. "You guys, Dalton Academy caught fire last night and burned to the ground."

"Oh my god!" gasped Marley, a hand flying to her mouth in horror. "Is everyone okay?"

"Yeah, everyone managed to get out safely but the school is gone," said Kurt.

"I'm so sorry you guys," said Quinn. "But what does this mean for the Warblers?"

"Actually, we wanted to ask you guys if you would consider letting the Warblers merge with the New Directions," said Blaine.

"Absolutely not!" said Jane. "They didn't want me because I'm a girl, so why would I want chauvinistic guys to be in the same choir as me?"

"She has a point, they have been assholes," said Kitty.

"The ones that were rude to you Jane are no longer in the Warblers," said Blaine. "When I suggested merging with the New Directions, only a handful agreed to the merger. The rest transferred to other private schools."

"Well, there's your answer then," said Kitty to Jane. "Come on, let's give them a chance. That's what glee club is about, helping out other schools when they are in need."

"Okay, fine," said Jane.

"But what about sectionals? Who are we going to compete against now?" asked Madison.

"That's the other bad news," said Rachel. "Somehow Carmel managed to convince the show choir board to let Vocal Adrenaline get reinstated."

"You're joking!" exclaimed Will. "How?"

"Bribery more than likely," said Josh.

"I guess we're going to have to work hard then if we want to win, right?" asked Kitty.

"Right!" chorused the group.

"Alright then, let's get to work! It's booty camp time!" said Will.


The next morning, Noelle, Josh, Kurt, Blaine, and Rachel were getting ready to head to the courthouse for Coach Sylvester's trial. Carole and Burt were going to attend as well.

"Carole, have you seen my black tie?" Burt asked hurriedly as he dug through his closet.

"You're wearing it Dad," said Kurt as he helped Blaine with his tie.

"Come on guys, we're gonna be late!" said Noelle. "If we don't get there by ten, we can't go in!"

A few minutes later, the group including the Finchel Four climbed into Carole's van. Well, it used to be Finn's that he would drive Noelle to school in when she was still in her chair. They stopped at Jesse's and picked up him, Ethan and Ella, and then they arrived at the Fabray residence and dropped off the kids for the morning with Judy, who would watch them and Beth and Alex while Quinn and Puck came to the courthouse.

"Bye kids, be good for Great Aunt Judy," said Rachel, kissing William, Reagan, Christopher and Christina.

"Bye Mommy," said Reagan.

"Good luck guys, I hope it goes well," said Judy as she bid the group goodbye.

"Thanks Judy," said Carole, hugging her. "We'll give you a call when we're done."

Twenty minutes later, the group arrived at the courthouse and the group noticed that it was a media frenzy.

"Shit," muttered Noelle. "Now what?"

"Hang on, let me call the prosecutor," said Burt, pulling out his cell phone. He dialed the number and the prosecutor answered.

"Hey, Dave, it's Burt Hummel," said Burt. "We're outside the courthouse and it's a media frenzy. Is there a way for us to get in undetected by the media since my daughters are famous?"

There was a pause.

"Okay, great, see you in a few!" said Burt. He hung up the phone.

"Back entrance around the corner, a sheriff deputy will meet us in case there's a problem," said Burt. "Let's go."

The group scrambled out of the van and headed to the back entrance of the courthouse where they saw a deputy standing there waiting for them.

"Congressman Hummel, Mrs. Hummel, I'm Deputy Miller, please follow me," said the deputy. He led the group in, allowing them to bypass security and led them into the courtroom. He sat them down in the first row behind the prosecutor, Dave, who shook hands with Burt. Will and Emma were already there.

"Okay, what's going to happen first are opening arguments and rules from the judge as he talks to the jury and then we will start with our witnesses today," said Dave. "There is a chance that after you all testify, that the defense might try to cross-examine you."

Coach Sylvester was led out in handcuffs and an orange prison tracksuit shortly thereafter, to everyone's surprise.

"Coach Sylvester looks good in orange," muttered Noelle to Josh as Sue sent them a nasty look.

"You okay?" Jesse asked Rachel as the group sat down.

"Yeah, I think so," said Rachel. He placed his hand on hers and squeezed it comfortingly as the bailiff brought the court to order.

"This court is now in session," said the bailiff. "All rise for the honorable Judge Willow R. Haskell."

"You may be seated," said Judge Haskell as everyone sat down. "This is Case 90-542-8712, The State of Ohio vs. Susan Rodham Sylvester. Are both sides ready?"

"The prosecution is ready, Your Honor," said Dave.

"Good morning Your Honor, the defense is ready to prove our client is not guilty," said the defense attorney.

"Will the clerk please swear in the jury?" asked Judge Haskell.

"Will the jury please stand and raise your right hand?" asked the clerk. The jury stood. "Do each of you swear that you will fairly try the case before this court, and that you will return a true verdict according to the evidence and the instructions of the court, so help you, God? Please say I do."

"I do,"chorused the jury.

"You may be seated," said the clerk. The jury sat and the judge spoke.

"We will begin with the opening statements from the Prosecution, followed by the opening statements from the Defense. After that, the Prosecution will call their witnesses with a possible chance of cross-examination, and the same with the Defense. Mr. Williams, your opening statement please."

Dave stood up and nodded.

"Your Honor and ladies and gentlemen of the jury," started Dave, "the defendant has been charged with the crimes of murder in the first degree, felonious assault in the second degree, and conspiracy. On May 11th, 2013, the defendant hired a third party person over the phone to kill Finnegan Christopher Hudson, Rachel Berry-Hudson, Noelle Hudson-Koontz, and Joshua Koontz. The third party then became drunk and drove his vehicle down a New York City street. He hit Mr. Hudson, resulting in his death. Ms. Hudson-Koontz was injured as a result of her late brother's heroic efforts to push her out of the way of the speeding vehicle, and Mrs. Berry-Hudson and Mr. Koontz were not injured physically but were traumatized from the evening's events. The evidence I present will prove to you that the defendant is guilty as charged."

Dave sat down and the defense attorney stood up.

"Your Honor and ladies and gentlemen of the jury, under the law my client is presumed innocent until proven guilty. During this trial, you will hear no real evidence against my client. You will come to know the truth. The defendant did not commit these felonious acts of crime. The third party is completely and solely responsible for murdering an innocent man and injuring his sister. The third party had not agreed to carry out the acts at the time of Mr. Hudson's death. This was just a tragic series of events where the victims were in the wrong place at the wrong time. It is a coincidence. Therefore, my client is not guilty."

"Thank you, and now, Mr. Williams, your first witness please," said Judge Haskell. Dave stood.

"The prosecution calls Noelle Hudson-Koontz to the stand," said Dave. Noelle took a deep breath as there were murmurs throughout the court. A celebrity was testifying on behalf of her late brother. Noelle stood and walked up to the witness stand. The bailiff swore her in.

"Raise your right hand. Do you swear to tell the truth, the whole truth, and nothing but the truth, so help you God?" asked the bailiff.

"I do," said Noelle.

"Please state your first and last name," said the bailiff.

"Noelle Hudson-Koontz," replied Noelle.

"You may be seated," said the bailiff. The court reporter spoke next.

"Please spell your name for the record," said the court reporter.

"N-O-E-L-L-E, H-U-D-S-O-N, hyphen, K-O-O-N-T-Z," replied Noelle.

"Thank you Mrs. Koontz," said the court reporter.

"Mrs. Koontz," said Dave as he stood up, "can you please tell us what happened on May 11th, 2013?"

"Yes sir, my brother Finn, my sister-in-law Rachel, and my then-fiance, now husband Josh, were heading home to our brownstone in New York City's Greenwich Village around 6:30 in the evening. We were making a stop at the daycare down the street from our brownstone to pick up my niece and nephew. As we were about to cross the intersection at Eleventh and Bleeker St., my brother yelled out to me. I was pushed and I landed on the pavement. I heard a loud thud and the breaking of glass and I turned slowly to see Finn laying on the pavement, bleeding from his head. I was disoriented from hitting my head on the pavement but I saw that a Chevy Cobalt had crashed into a light pole. Rachel was crying hysterically, screaming for Finn to hang on. Josh pulled Finn from Rachel's arms and began to administer CPR. The police, fire department and EMS arrived shortly after. Finn was taken away first, Rachel going with him. Josh had gone into the daycare to retrieve the twins while I was being tended to by the EMS personnel. Josh returned moments later with the twins as the driver of the Cobalt was given a sobriety test and arrested. We arrived later at the hospital where I was treated for a broken wrist, a mild concussion, and some scrapes. Finn died on the operating table several hours later."

"Do you know the defendant, Mrs. Koontz?" asked Dave, motioning to Coach Sylvester.

"Yes sir, the defendant was the former cheerleading coach and principal at my high school," said Noelle.

"Did she ever show any dislike or hatred towards you?" asked Dave.

"Objection, relavancy," said the defense attorney.

"Overruled, answer the question Mrs. Hudson," said Judge Haskell.

"Yes, she always had since the day I rolled into the halls of McKinley," said Noelle. "I have MS, and when I was in my wheelchair she would call me names such as Gimpy, Wheelchair Girl, the list goes on and on. She had an even more hatred for me once I had joined the McKinley High Glee Club. Coach Sylvester's life goal was to bring down the New Directions. She tried for years to destroy the glee club. She finally succeeded when my brother died."

"Objection, witness is stating her opinion and not facts and stating my client is guilty when she is yet to be found guilty or not guilty."

"Overruled, witness is simply testifying her about her relationship with the defendant," said the judge.

"Mrs. Koontz, has the defendant ever threatened you physically or verbally?" asked Dave.

"Yes, Coach Sylvester's threatened me verbally and physically numerous times," said Noelle. There were gasps from the crowd as Judge Haskell banged her gavel.

"Order, order," said Judge Haskell.

"No further questions, your Honor," said Dave.

"Cross-examine from the defense?" asked Judge Haskell.

"No, your Honor," said the defense.


Rachel testified after Noelle, talking about losing her husband and how he left behind four small children, and reiterated the events from the night of Finn's death. Josh did the same, talking about administering CPR and such. Then Kurt, Carole, Burt, Will, Quinn, Puck and Emma all testified about the aftermath of Finn's death and how Coach Sylvester tormented the glee club for years. The man who hit Finn was brought in by the prosecution to testify against Coach Sylvester, as per their agreement. The defense cross-examined him, Will, Rachel, and the Hummels to what Noelle determined as unsuccessfully and then it was the defense's turn to bring in witnesses. The first witness was someone who claimed to be Coach Sylvester's alibi, stating that she was on a date with him when the call to the hitman was supposedly made.

And then came the moment everyone was anticipating: whether or not Coach Sylvester would be called to the stand.

"The defense calls the defendant Susan Rodham Sylvester to the stand," said the defense attorney.

"Oh boy," muttered Blaine as Coach Sylvester took the stand. "Here we go."

"Raise your right hand. Do you swear to tell the truth, the whole truth, and nothing but the truth, so help you God?" asked the bailiff.

"I do," said Coach Sylvester.

"Please state your first and last name," said the bailiff.

"Susan Rodham Sylvester," replied Coach Sylvester.

"You may be seated," said the bailiff.

"Coach Sylvester, please tell us of your whereabouts on May 11th, 2013," said the defense attorney.

"I was sitting at Breadstix with my date, enjoying a nice spaghetti dinner, my daughter Robin sitting in her stroller," replied Coach Sylvester.

"Do you know the man who claims that you hired him to murder Finn Hudson, Rachel Berry-Hudson, Noelle Hudson-Koontz and Joshua Koontz?"

"No, I have never met the man before in my life," said Coach Sylvester.

"Did you ever dial this phone number, 419-555-0984 on May 11th, 2013?"

"I did not, no," said Coach Sylvester.

"No further questions, your honor," said the defense. The courtroom filled with murmurs as Judge Haskell banged her gavel.

"Order!" she cried. "DA Williams, do you wish to cross-examine the defendant?"

"Yes, your honor," said Dave. He stood up and approached Coach Sylvester.

"Coach Sylvester, please take a look at Exhibit A, is this your cell phone?" asked Dave.

"It is, yes," said Coach Sylvester.

"I have here, phone records from the phone number 419-555-1356, is that your phone number?" asked Dave.

"It is," said Coach Sylvester.

"According to your phone records, several calls were made to the phone number 419-555-0984 between the dates of April 30th, 2013 and May 11th, 2013," said Dave. "Yet you told the court that you had never placed a call to the said number."

"I didn't," said Coach Sylvester.

"Then who did? It's your phone so it had to have been you," said Dave.

"My secretary did," said Coach Sylvester. There were gasps from Noelle, Josh, Blaine, Kurt, Rachel, the Hummels, Puck and Quinn and several other people who knew whom Coach Sylvester was referring to.

"Your honor, the prosecution would like to bring in a surprise witness, who asked not to be called until Coach Sylvester testified," said Dave. "I have no further questions for the defendant."

"Granted," said Judge Haskell. "Coach Sylvester, you may step down." As Coach Sylvester stepped down, Dave spoke again.

"The prosecution calls Miss Becky Jackson to the stand," said Dave. There were murmurs from the court as Judge Haskell banged her gavel and Becky was escorted in from outside. Becky glanced over at Coach Sylvester and the look on Coach Sylvester's face was priceless as Becky was sworn in.

"Miss Jackson, do you swear to tell the truth, the whole truth, and nothing but the truth, so help you God?" asked the bailiff.

"I do," said Becky.

"Please state your name for the record," said the court reporter.

"My name is Becky Jackson," said Becky.

"That is spelled, B-E-C-K-Y J-A-C-K-S-O-N," Dave said to the court reporter. "Because of Miss Jackson's disabillity, if there is any clarification needed, I will repeat what she says so everyone might understand, is that okay with you Becky?"

"Yes Sir," said Becky.

"Very well then," said Dave. "Miss Jackson, can you please tell us in your own words what took place between April 30th and May 11th, 2013?"

"Coach asked me to dial a phone number for her and then asked me to hand her the phone," said Becky.

"Then what happened?" asked Dave.

"Then she would go into her office and close the door and be in there for hours on the phone," said Becky.

"Did you do anything about it?" asked Dave.

"I tapped her phones," said Becky. The courtroom gasped again and the look on Sue Sylvester's face was that of astonishment.

"Order, order!" said Judge Haskell. "Please continue."

"Becky, can you please tell the court what Exhibit B is?" asked Dave.

"It's a cassette tape," said Becky.

"And what is on the cassette tape?" asked Dave.

"The conversations she had with the man who hit Finn with the car," said Becky.

"The prosecution now requests to play Exhibit B to the court," said Dave.

"Granted," said the judge.

Dave put the cassette tape in a cassette player and pushed play.

"Hello?"

"Hello Frank, this is Sue Sylvester, how are you?"

"Oh, yes, you."

"Have you decided on whether or not you want to take up my offer to kill those Glee Club kids?"

"NO, I WON'T! STOP CALLING ME! I WILL CALL THE POLICE!"

"If you don't do it, I will destroy you!"

"FINE FINE I'LL DO IT! Just give me back my wife and daughter unharmed!"

"Meet me in New York City at 1 PM at the Gershwin Theatre on May 11th."

The sound of the phone hanging up followed and then another call recording followed.

"Okay, I'm here, where are my wife and daughter? Where are you?"

"Your wife and daughter are safe and sound back here in Ohio. Now, I need you to go through with the plan. Should you succeed, you will be well paid for your efforts. If you don't succeed, I will kill you. Now they should be crossing 11th and Bleeker about 3:30 PM. Kill them, kill them all or you will suffer miserably."

Another click and the courtroom murmured in horror. Noelle, Rachel, Quinn, and Carole were white as ghosts as the guys grew angry.

"Order, order!" exclaimed Judge Haskell.

"No further questions your honor," said Dave as he stopped the tape.

"Cross-examine from the defense?" Judge Haskell asked the defense attorney.

"No your honor, defense rests," said the attorney to the gasps of everyone.

"Thank you Miss Jackson, you may step down," said Judge Haskell. As Becky stepped down from the stands, Coach Sylvester finally spoke to her.

"Why Becky, why?" asked Coach Sylvester.

"I'm sorry Coach, I had to, and I wish I had said something much sooner," said Becky. "You made that man kill Finn. Finn was my friend and he was nice to me even though I wasn't very nice to him. You hurt my friends, and you hurt me." Becky walked over to the Hummels and hugged Noelle.

"I'm so sorry I didn't say anything sooner," cried Becky. "I'm so sorry."

"It's okay, Becky, you didn't know he would go through with it," said Noelle. The courtroom by now was in loud murmurs and Judge Haskell was banging her gavel repeatedly to bring the court to order.

"I am ordering a fifteen minute recess before closing arguments and then the jury will begin deliberations."


After the closing arguments, the judge gave directions to the jury before sending them off to deliberate. The group stayed close by in case the jury took a short time to reach a verdict. Several members of the media tried to interview the group but Burt stepped in as the representative and declined to comment and asked them to leave. An hour after the jury was sent to deliberate, word came back that they had reached a verdict.

Becky stayed seated with Noelle and Josh and the others as the jury was brought back in the courtroom.

"Who is the foreman or forewoman?" asked Judge Haskell.

"I am, Your Honor," said one of the jurors as she stood up.

"Very well, make note that Juror Number Five is the forewoman," said Judge Haskell to the court reporter. She turned back to the jury.

"Has the jury reached a verdict?" asked Judge Haskell.

"We have, your honor," said Juror Number Five as she handed the papers to the bailiff. The bailiff then passed the papers over to Judge Haskell, who read them over and nodded.

"Very well," said Judge Haskell, handing the papers back to the bailiff who returned them to Juror Five. "When the verdict is read, there will be no demonstrations, or any emotional outbursts of any type. I'll ask the jury at this time to stand and face the defendant. The defendant will face the jury."

The jury stood as did Coach Sylvester and the judge nodded to Juror Five.

"The jury forewoman will now read the verdict," said Judge Haskell.

"We, the jury, find the defendant, Susan Rodham Sylvester, guilty on all charges," said the forewoman.


"It's over, the nightmare is finally over!" shouted Noelle as the group celebrated later at the Fabray residence. "Finn can finally rest in peace!" She looked over to Blaine and Kurt, and noticed Blaine looked upset.

"Blaine, aren't you happy?" asked Noelle as Rachel poured her some champagne. "That evil woman is finally going to prison for all the shit she's done!"

"I am, yeah, but I'm still kind of bummed about Dalton," said Blaine. "It was arson and we don't know who did it."

"You know what? I have an idea, I'm in the mood for a song!" said Noelle. "Kurt! Let's do our old Meet Me In St. Louis routine!"

"Ooh, great idea!" said Kurt, clapping his hands.

"Puck, you can play piano, come on, here's the music," said Noelle, thrusting the sheet music in his hands.

"No way, I'm good on that," said Puck, shoving the sheet music back at Noelle.

"I'll play!" said Judy. "I love this song! I was named for Judy Garland you know."

As Judy started playing the song everyone watched as Kurt and Noelle tried to cheer up Blaine.

Noelle:

He was quite the handsomest of men

Before everyone knew it, Noelle and Kurt were in the choir room reprising their performance later that evening for the New Directions at rehearsal.

Noelle:

Chug, chug, chug went the motor

Kurt:

Bump, bump, bump went the brake

Kurt and Noelle:

Thump, thump, thump went my heart strings

When he smiled I could feel the car shake

Kurt:

He tipped his hat and took a seat

Kurt and Noelle:

He said he hoped he hadn't stepped upon my feet

Noelle:

He asked my name, I held my breath

Kurt and Noelle:

I couldn't speak because he scared me half to death

Kurt:

Buzz, buzz, buzz went the buzzer

Plop, plop, plop went the wheels

Kurt with Noelle:

Stop, stop, stop went my heart strings

As he started to go then I started to know how it feels

The day was bright, the air was sweet

As he started to leave I took hold of his sleeve with my hand

And as if it were planned

He stayed on with me and it was grand just to stand

With his hand holding mine to the end of the line

Kurt and Noelle:

The group clapped and cheered as Noelle and Kurt took a bow.

"That was great you guys!" said Marley excitedly.

"Thank you, thank you, thank you," said Noelle as she curtsied.

"Hey, so I've been thinking about how we should go about sectionals," said Blaine as he stood up. "I know the Warblers don't want to give up their blazers, so Noelle and I came up with an idea to get everyone in uniform."
