Chapter 39.

„But you were around long enough to impregnate Captain Benson." Rafael directed his attention towards Carisi and exchanged a significant glance with him.

The tension in the room was palpable as Rafael's words hung in the air. Carisi's face turned crimson as he fought back the urge to respond.

"Excuse me?" Dominick asked, his voice full of shock.

"Oh, should I just congratulate you on getting her pregnant?" Rafael taunted.

"Objection!" David exclaimed as he stood up.

"Proceed with caution, Mr. Barba. I will not warn you again," The judge spoke. Rafael nodded slowly.

"I apologize, your honor."

Rafael walked back to his table and whispered something to Dani, before moving back to Carisi.

"I believe that I'm done," Rafael spoke. He hadn't been prepared for the judge to scold him for what he said, so he didn't have any questions right now.

"Mr. Carisi, you can get down."

A recess was called, and afterwards, Elliot was called to the stand. Rafael asked him a few select questions before David took over. David wasn't worried about questioning the others right after Rafael did, since he wasn't worried about stressing them out. He was only worried about Olivia.

"How did you get involved in this?" David asked as he sat on the edge of his desk and looked over at Elliot. Elliot sighed as he sat back in his chair.

"Olivia came to me. She looked miserable and exhausted. When she got to my apartment, she asked if I was the one that had slept with her."

"Why did she ask you that?" David questioned.

"At the time, Olivia and I were experimenting with our relationship. We were still friends, but wanted to be more. We wanted to see if maybe we would end up as more than friends," Elliot spoke.

"So she asked if you were the one to sleep with her and then left her behind?"

"Yes, she did. I was angry at first, but then I remembered that she was just grasping at straws to try to put the pieces together. While we were talking, she got a phone call. It was the results of the tests she had done at the hospital." Elliot let out a sigh.

"Did she tell you what the results were?" David questioned.

"No, not right away. Eventually I found out."

David asked a few more questions before looking in Dani's direction. He looked back at Elliot and gave him a small nod. Elliot knew what was coming.

"You were the arresting officer, correct?"

"Yes, I arrested Dani Beck."

"What happened to lead up to her arrest?"

"Dani approached me. She showed up at my apartment and asked to go somewhere and talked. We went and got something to drink, and she told me how she was doing. After awhile she asked about Olivia."

"What about Olivia?"

"She asked how she was. They never met as far as I know, so I don't know why she brought her up. But I went along with it."

"Then what happened next?" David questioned.

"I told her about Olivia being Captain and that she had a son. Dani told me that she saw Noah and asked if he was mine. Once I told her that he wasn't, she cut me off and told me about Olivia's attack."

"What did she say?"

"She said that she heard Olivia had been drugged and she blacked out and had sex with someone. So I started to question her. She gave me a lot of information that I didn't even know. When I questioned her on it, she backtracked and tried to say that I told her that all. Eventually she confessed, and I arrested her."

Dani moved from behind the table and to the stand. At this point, it was later in the day and no one knew how long her testimony would be. David moved to stand in front of her after Rafael sat down. Rafael seemed overly confident, as if he thought that this task would be extremely easy and without any challenges.

"The video that was played earlier was taken by you, correct?"

"Yes," Dani replied softly.

"Why did you tape them having sex?"

"I needed to prove to Elliot that Olivia was cheating on him," Dani replied.

"I wonder how you knew that they would end up in Olivia's SUV." David pondered.

"Because I assisted them in reaching their destination," she said with a smile. But as she realised the weight of her words, her smile quickly faded.

"Did you drug Captain Benson and Mr. Carisi?"

"Possibly."

"People's evidence, your honor. When your apartment was searched, a vile of liquid GHB was found. Your fingerprints were on the container, along with an eye dropper."

"So?"

"So, this is the same drug that was found on Captain Benson's and Mr. Carisi's blood panels. Did you administer this drug to them without their knowledge?" David asked, getting a little sterner with his questioning.

"Yes, I did! She doesn't deserve Elliot, so I wasn't going to let her get away with being with him. He loves me, and he always has!" Dani exclaimed in frustration.

"Objection!" Rafael exclaimed. He was starting to panic, and David could see it clearly. The judge didn't speak. He just motioned for David to continue.

"As a cop, do you know what crimes you committed?"

"I didn't-"

"You're being charged with two counts of assault, one for assaulting a police officer, and two counts of drugging the victims. Do you understand that these actions are criminal offenses?" David questioned loudly.

Dani swallowed hard. She leaned forward in her chair.

"I'm deeply in love with him, and I've gone to great lengths to be by his side. Love has a way of overcoming obstacles that others may perceive as unlawful, but my perspective is different. " Dani said, annoyed.

"You are an officer of the law. You are supposed to follow those laws just like everyone else." David turned to Dani.

"No, I'm not." Dani snapped.
"Enough! Remove the jury and we are in recess until tomorrow morning!" The judge said, banging his gavel several times.
