A/N: Set during S01E02, with some dialogue from that episode.
Martha puffs on her cigarette outside the courthouse, ignoring the voice in her head telling her she shouldn't be smoking after the test result she got this morning. It doesn't matter, she thinks defiantly. She's booking a termination anyway. It's bad enough having to defend an accused rapist without having to juggle organising an abortion at the same time.
To make matters worse the father of her child comes over and starts needling her about the trial, all Poor Annie and Armed robbery's not very nice either, are you all complicated about armed robbery? reminding her of their 'celebration' in Nottingham. Clive finally succeeds in winding her up, leaving her more determined than ever to win this case and achieve QC status. She does her job, cross-examining the alleged victim (or complainant as Nick said) until Annie is reduced to tears and even Clive looks uncomfortable. She gets her Not Guilty verdict and watches Annie leave before shaking hands with her attacker (alleged attacker).
It's only at home, while swaying to an old sad song her mum always liked, that she lets Annie's words on the stand permeate. Would you keep a baby if the father raped you? She's in a better position than Annie, she knows, because the father of her child didn't rape her, even if he is selfish and a womaniser and totally unreliable. She ends up laying on the bed with her hand across her stomach, wanting a cigarette but not reaching for one for some reason.
She doesn't sleep.
