REQUEST FOR THE PSYCHIATRIC RECORDS OF MR. MICHEAL SOLOMON AFTON

Dear St. George Police Department Staff,

I am writing to you today as I have been made aware that you have confidential material regarding independent psychiatric evaluations of Mr. Michael Solomon Afton, who is presently undergoing criminal prosecution in the murder of his late brother. Whilst looking through the evidence and documentation provided to us regarding the case, it has come to my attention that information of the psychological evaluations conducted on each of the apprehended persons have been submitted to us, except for Mr. Afton. This is despite the legal guardians of Mr. Afton requesting the documents be submitted to us to potentially allow their son's legal team to argue for a plea of insanity.

We are aware that certain information about health and mental well-being can be restricted behind legally binding privacy clauses and statues. However, these investigations were conducted in the pursuit of criminal justice with the consent of the legal guardians of the individual involved. Therefore, we request that the information we requested be provided to us as soon as possible or an explanation should be provided as to why we are not allowed to access or use this information to not further hinder the process of Discovery.

Any documentation regarding the case should be sent to the Washington County Justice Court Building at 87 North 200 East, 3rd Floor St. George, Utah 84770, Phone: (435) 634-5728. The court case these documents should be submitted for is 'State of Utah vs. Afton'. Hope this message reaches you well and have a pleasant day.

Sincerely,

Brian J. Wacker
