The State Verses Derek Morgan-Ch 3
Derek had just been photographed, every scratch, every bruise, everything had been documented , he had scratches on his neck, one on his face, some on his chest and on his back, he also had some places on his chest that would more than likely bruise, that looked like they were made with a fist.
Derek was sitting with his head in his cuffed hands when the door opened and two people walked into the room, he looked up and saw that one of them was Hotch but he had no idea who the woman was that was with him. Hotch said, "Derek, this is my friend Mia, she's one of the best lawyers out there and I've talked to her and she's agreed to take your case", Derek held out his hands and shook hands with Mia and said, "thank you both for coming".
Derek looked at Hotch and said, "I didn't do this, I swear to you I didn't do this, I could never hurt her man, she was my world, she's my everything", Hotch said, "Morgan", Derek balled his hands into fists and said, "calm down, how the hell can I calm down, I am being accused of killing the only woman I've ever loved and you want me to calm down", Mia said, "Derek, take a few deep breaths and try to calm down, I don't want them to have to send somebody here to sedate you".
Mia looked at Derek after he blew out a few deep breaths to try to calm down she then said, "okay, can you tell me what happened?", "Derek said, "I can't remember much, I remember that we were all out drinking and dancing after coming back from a case, we needed to wind down". Mia nodded her head and said, "that's understandable in your line of work, I totally understand that", Derek said, "I remember us all being put into cabs and since baby girl and I live in the same direction we shared the same cab".
Hotch said, "so you remember Penelope being in the cab with you?", he nodded his head and said, "I do but after that the next thing I remember is waking up to police officers standing in front of me with their guns drawn, the rest is a complete blank". Mia said, "what have they done to you since they found you?", Derek said, "well at the scene they read me my rights and then brought me here where they took pictures of all the scratches and bruises".
Hotch said, "and where are the scratches?", Derek said, "I have some on my arms, my chest, my neck, one here on my face and all over my back and I have no idea how I got them Hotch, I swear to you". Hotch said, "I believe you Morgan, he looked at Mia who said, "did they do any blood work?", Derek said, "yeah, they took several tubes, I swear I believe they are part vampire or something", Mia said, "they are going to run tests to see if you were drugged along with the alcohol that you consumed".
The police are looking at me like I killed her, like I would actually hurt my baby girl", he looked at Hotch and repeated, "I didn't do it, I didn't kill her, I would never, I could never", Hotch said, "I know Morgan , I know that you would never hurt her but with them you are guilty until proven innocent not the other way around", Derek nodded his head and said, "it just seems like everybody is against me", he then looked down as tears covered the table in front of him.
Mia looked at Derek and then after a couple of minutes repeated. "when they were in here and drew your blood, they will be able to tell us about your blood alcohol level and what drugs are in your system", he looked at her for a second and the hurt covered his face, he then blew out a deep breath and hit the table in front of him to get Mia and Hotch's attention as he readied to speak.
Derek said, "I don't do drugs, never have, never will and there is no way that I would ever hurt baby girl, I loved, I love her, she is the love of my life, I would never hurt her, much less kill her like they are trying to say I did". Hotch said, "have you been treated okay while you've been here?", he nodded his head and said, "yeah, but that one, I forgot his name, he was the first one in here, he told me that if I called my lawyer that I could kiss any deals as good as gone".
Mia said, "he was using that as a scare tactic Derek, don't pay any attention to him", Derek looked at Hotch and Mia and said, "we need to find out what happened to baby girl", he looked at Hotch and said, "please Hotch, please have somebody go see what happened her her", Hotch nodded his head and sent a message to Reid and JJ and asked them to go to the ME's office and see if they could get a preliminary cause of death".
Derek nodded his head and said, "I know that where we work together the team won't be able to work the case but is there anything that you guys can do to help me prove that I didn't do this?", Hotch said,"we'll do everything that we can to prove your innocence Morgan, I promise we won't stop until we find out what happened to Garcia".
A few minutes later at the ME's office JJ and Reid walked over and the examiner said, "I'm so sorry to hear about Penelope, she was an amazing person", JJ wiped away a tear that slid down her cheek and said, "yes, yes she was". Reid looked at the medical examiner and said, "Tasha I know that you can't tell us a lot but please is there anything that you can tell us?", she said, "I'll do whatever I can to help find the person that did this to her".
She looked at JJ and Reid and said, "I don't believe that Derek hurt her, he was in love with the woman for Pete's sake, he would never hurt her, not in this life time or the next' causing JJ and Reid to smile and nod their heads yes. Tasha then reached for the file in front of her and said, "well she had several blows to the head and face, resulting in bruising all over her face".
JJ and Reid stood there listening as she said, "she fought back, there was skin under her nails and yes it did match Derek's but we all know that evidence can be faked now don't we?", JJ said, "yes we do". Reid said, "what about sexual contact, was there any?", Tasha said, "she definitely had sex tonight and it was rough sex, there is evidence of tearing and bruising in her vaginal area", JJ said, "what about semen?", Tasha nodded her head and said, "yes there was semen inside her vagina and also some in her rectum".
Reid said, "do you have a cause of death?", Tasha said, "well it was a mixture of the blows to the head and a broken neck", JJ said, "her neck was broken?", the ME nodded her head and said, "yes". JJ said, "are we sure that it's actually Garcia?", Tasha said, "I have and it is", she stood there for a couple of seconds and said, "would you like to see her?", JJ shook her head and said, "no, no I can't", Reid said, "yes please", he hugged JJ and said, "I'll be right back", JJ looked down at the ground and nodded her head yes as Reid walked off with Tasha.
