S2 E20 AU Red Cell

AU stories for NCIS episodes. Each is independent from all the others since this is based on the possibility of parallel universes and multiple timelines…. many, many of them. Later on some may seem to follow something that happened in an earlier AU episode story but it's probably coincidence unless I say otherwise in the beginning. Again, these are AU scenes/stories which means a character may die in one story and be alive in the next one. Or it might be a missing scene.

This is a short alternate universe story/scene for season 2, episode 20, Red Cell

Gunnery Sergeant Leeka was on the floor where Gibbs left him.

"Cuff him," Gibbs told Tony and Kate.
"Sure thing, boss," Tony replied.
"Somehow I don't remember college being quite like this."
"It reminds me of this time at Ohio State. We had this frat guy…"

"The next person who mentions a spring break or a frat party or college, is fired. Are we clear?"

"Yes."
"Yes."
"That's good."

Gibbs made a bee line for Captain Lemay's office and if the man wasn't there he was going to go find him at home. Students along the way gave him concerned or maybe terrified looks and a wide berth. The fight had been brutal and he'd almost lost. Telling his opponent it was only going to get worse had been wishful thinking and he was damn lucky to be conscious and walking around right then. Oh man was he going to be sore tomorrow and the next day and it will be even worse the day after that.

A security guard met him when he went around a corner. Someone, worried about students' safety, had reported him stalking the hall. It could be almost funny if the guard didn't look so serious and wasn't quite so tall and big.

"Gibbs, NCIS," he told him and started to produce his credentials.

"Hold it right there," the guard told him.

"I have credentials." He leaned over slightly, his hands on his thighs. A few seconds later he stood up and faced the guard. "We just arrested Gunnery Sergeant Leeka for two murders and I'm going to see Captain Lemay."

"Is he the one who beat you up?"

"Yeah, he resisted arrest," Gibbs sighed.

The guard was convinced because he said, "Come on then, before you fall down." He waited for Gibbs to start toward him and then walked forward to the captain's office. "I saw him not too long ago. I think he's still here." Gibbs noticed the guard was being cautious by keeping a little distance between them. Maybe he wasn't convinced.

Gibbs' phone rang and he stopped to answer it. "Yeah, Gibbs."

It was Tony wanting to know where he was so Gibbs answered the question, listened to Tony chatter a little, and then told him, "Two cars DiNozzo. Do not put them in the same car." Gibbs listened and then said, "No, not even one in the front and one in the back." Tony realized his mistake because Gibbs heard, "Right, boss. She's a rape victim."

The security guard knocked on Lemay's door and went in before Gibbs who was stumbling a little. He didn't care and found them a minute later in a bit of a discussion.

"Is there a problem, Captain?"

"Oh my god, Agent Gibbs. The Gunnery Sergeant did that?"

"If you mean beat me up, then yea, and he looks just as bad or worse."

An armchair beckoned him and he plopped down. He was feeling the injuries more now and knew he needed to get this over with.

"I need a few minutes of your time, Captain Lemay."

"Sure Agent Gibbs." and the security guard left, closing the door behind him.

The Captain sat down too and Gibbs got started.

"We arrested Gunnery Sergeant Leeka on multiple charges. Two counts of murder, assault, resisting arrest, rape and sexual harassment, to start."

Lemay looked stunned. "Rape? Sexual harassment?"

"Captain, you have midshipmen playing paintball on campus. You have midshipmen interfering in our investigation. You have a Gunny disciplining females in private after hours. You have a Gunny who is forcing midshipmen to sleep with him. That's what this has all been about. Your two Marines were trying to help Ashley Simmons and Leeka killed them. Not one of the three came to you. Why is that? Or maybe they did and you covered it up and let Leeka do what he wanted."

"I didn't know," Lemay half shouted. "I swear I didn't know."

Gibbs studied him for a moment or two.

"You have midshipmen who are scared to come to you. Tell me right now why I shouldn't open an investigation into you, Captain Lemay."

Before the man could answer there was a knock and Kate opened the door. She didn't look apologetic at all and Gibbs admitted to himself that he was happy to see her.

"Sorry to interrupt, Gibbs. The EMTs have finished checking Gunnery Sergeant Leeka. He's conscious and they want to transport him to the hospital. He might have a concussion. Other injuries." She looked around Lemay's office and Gibbs saw the security guard was standing outside the door.

"Tony's with him?"

"Yes. Leeka is handcuffed to the gurney, both of his wrists, and we had them put on double the straps, just in case."

Gibbs nodded his okay and Kate quickly called DiNozzo on his cell phone. "Gibbs says go ahead. We'll meet you there."

When she hung up he asked, "Simmons?"

"Waiting for me, for us, downstairs."

"Who's with her?"

"McGee. Two cars," she smiled.

"Okay, we'll send McGee to the office and we'll go to the hospital."

Kate looked slightly panicked but Gibbs spoke before she could react.

"I'm all right. I might need an x-ray and Ducky's home with his mom." Gibbs left the chair slowly and stood up, looking like he was pretty stiff. "In case I forget, tell McGee to transport with her in the backseat and doors locked. She didn't want to come the first time from Leeka's office so she might not now."

"She was scared. Probably scared now too. I'll tell him."

During the conversation and phone calls, Lemay had been quietly observing until Gibbs addressed him again.

"Captain, you think about what I told you and I want you at our office at 10 in the morning to give your statement."

"I'll be there. Agent Gibbs, Agent Todd, thank you for finding the murderer."

The ER wasn't quick but it wasn't fatal. Leeka was going to be fine. They needed to keep him overnight for observation but not Gibbs. His head hurt like crazy but he hadn't lost consciousness and a precautionary CT showed nothing wrong. He had painful cuts and scrapes. His forehead, cheek, eye, arms, chest, back and shoulder were already showing deep bruising and he swallowed the 400 milligrams of ibuprofen and 1000 milligrams of acetaminophen that the ER nurse brought to him and gladly put the ice pack on his face.

Kate went with Leeka to his room and Tony was with Gibbs when he went outside the ER doors and called Director Morrow. They needed security at the hospital. Leeka was big, strong, a marine and facing life in prison so that made him desperate. "Yes, sir. Inside and outside the room until doctors release him for transport, probably tomorrow."

McGee, DiNozzo and Todd were on time the next morning. Gibbs showed up more than an hour later and Captain Lemay was 15 minutes early. They took his statement in an interrogation room, asked him a lot of additional questions and then left his fate to his commanding officer. The fates of the paintballers and Simon Frankel were left to the CO too until Lemay was replaced or came back. Nobody wanted to kick them out of serving their country but there would have to be a lot of changes. Ashley Simmons was on the hot seat too for not reporting the rape, sexual harassment and abuse.
