The State Verses Derek Morgan-Ch 6
Fran had just taken a batch of muffins out of the oven and turned around to see Dave walking into the kitchen, she smiled and said, "where did you run off to so early this morning, when I woke up you were gone?", Dave took her by the hand and said, "I need to talk to you and the girls, can you get them and join us in the living room please?", she said, "us?", he said, "we'll explain it all to the three of you once you come to the living room".
She said, "oh okay, I'll just go get the girls", Dave weakly smiled before turning around and walking out of the kitchen to head toward the living room to rejoin the team and Mia while they waited on Fran and the girls. Hotch looked at his long time friend and said, "this is going to be one of the hardest things we've ever had to do", Dave said, "it is, I'm just afraid that this will break her, she'll be crushed Aaron, how can I do this to her?", Mia said, "you're only doing what's right, she has the right to know, they all do".
Fran cleared her throat when her and the girls walked into the room, Fran said, "hello everybody", she then saw that Derek and Penelope were absent from this little talk, she instantly looked at her husband. She said, "Dave where are Derek and Penelope?", Dave said, "sit down Bella, that's what we need to talk about", she looked at him and said, "please tell me that he's alright?", Dave said, "physically other than some scratches and a few bruises he's okay".
Sarah and Desi looked at each other and then their mom as Fran said, "you said physically he's okay, what's wrong with him otherwise and why isn't he here"?, Dave looked at Mia, she nodded her head and said, "Mrs. Rossi, my name is Mia and myself along with Aaron are your sons lawyers", Fran said, "lawyers, why would my son need a lawyer, wait, has he, has he been arrested?", Mia nodded her head and said, "yes, yes he has".
Desi said, "on what charges?", Mia said, "murder in the first degree with special circumstances", Sarah said, "murder, who did he supposedly kill?", Mia blew out a deep breath and said, "Penelope Grace Garcia". Fran dropped to her knees on the floor in front of everybody, Sarah, Desi and Dave got down beside her, she said, "my son would never hurt her, he's head over heels in love with her, he has been for a long time".
Sarah said, "momma's right, my baby brother would never hurt his baby girl, she is the light of his world, she's the one that keeps the monsters away for him, you have to be wrong, you just have to be". Mia said, "we don't think he did this but he's been accused of it so between Aaron, myself and the team we're going to do everything we can to prove that Derek is innocent of the charges that are against him".
Desi said,"wait, you said special circumstances, Virginia isn't a death penalty state", Mia said, "correct, so instead of being put to death, he would be spending the rest of his life in prison without the possibility of parole". Tears streamed down Fran and the girls faces, Dave held his wife close and said, "we'll prove that he's innocent Bella, I promise, I promise", the team all looked at each other and then at the trio of Morgan women who's hearts they had just shattered into a million pieces.
Mia and Hotch were talking when her cell started ringing, she pulled if out of her purse and said, "I need to take this, it's about Derek", Hotch nodded his head and the family then watched as she got up and walked across the room. Reid said, "I still can't believe that this is happening, we've got to prove that Derek is innocent and make the bastard that killed Garcia pay", JJ put her hand on his and said, "we will Spence, we will", he reached up and wiped away the tears that were streaming down his face.
When Mia walked back a couple of minutes later she looked at Hotch and said, "they got the blood work results back on Derek", Hotch said, "and, what did they find?", Mia said, "his blood alcohol level was almost twice the legal limit and they found drugs in his system, it's looking bad Aaron, it's looking really bad for Derek".
Fran said,"my son doesn't do drugs, he never has and he never will", Mia said,"I didn't mean that he took them willingly Mrs. Rossi, what I meant is somebody is going to great lengths to make it look really bad on Derek". Emily said, "what drugs were in his system?", she said, "one was LSD", Hotch said, "and the other one?" Mia said, "Mescaline", it was then that the team looked to Reid for clarification as to what the drug was for.
Reid said, Mescaline is a hallucinagenic drug, it alters the state of consciousness, with altered and changes in time and perception with emotions like happy, enjoyable those types of emotions, he would be easily susceptible while taking this drug and added to that LSD and alcohol anybody could have gotten him to do anything at anytime", Fran said, "my son wouldn't do this Spencer, please tell me that you believe that".
Reid got down on the floor in front of her and said, "I do believe that Fran, your son loves Penelope, there is no way, drugged or not drugged that he would hurt her and we will prove it and we will get revenge for Garcia". Fran threw her arms around Reid as once again she broke down, the scene in front of them was breaking the teams hearts and now, now they needed to start trying to figure out who do this to Derek, they needed to see who hated Derek enough to do this to not only him but the woman he loved with all of his heart.
Hotch said, "we need to head back to the BAU and start making lists", JJ said, "lists of what?", Hotch said, "lists of people that would have it out for Derek and would want to make him pay and pay by whatever means", the team all nodded their heads yes in agreement as they stood up and got ready to go.
Hotch looked at Mia and said, "we need to get back to Derek", she said, "I agree, we need to tell him about his blood work results and see if he has any ideas of who would go to this extent to frame him". Fran said, "c c can I see my son?", Dave said,"are you sure that you're ready Bella?", she said, "ready or not I need to see my son and he needs to see me, right now he needs his mother's love and support and that's exactly what he's going to get".
Mia smiled and said, "you can come with us Mrs. Rossi", Dave said, "do you want me to come with you?", Fran said, "yes please", Sarah looked at her mother and said,"please tell him that we love him and we know that he didn't do this". Fran hugged her daughters and said,"I'll tell him, I promise", so as Dave, Fran, Mia and Hotch headed back to the jail Reid, JJ and Emily headed back to the BAU to start making lists of people that would do anything to destroy Derek's world.
