The State Verses Derek Morgan Ch 39
During Officer Matthew's testimony he'd told everything that he'd seen and done from the time he'd gotten on the scene, he was then asked about what Derek was doing when they arrived on the scene. Officer Matthew's testimony continued as he told the court that Derek was laying naked beside the deceased body of Penelope Garcia, he also described how the crime scene was all in shambles with clothes thrown all over
Next sthe prosecution called Officer Martin Shrine, he was the second officer to arrive on the scene, he for the most part backed up everything that the officer before him had said, no more, no less. Hotch cross examined this witness where he didn't the first one, on his cross examination he said, "when you arrived on the scene did agent Morgan do anything to try to harm you?", "the officer said, "no sir, he was to intoxicated and high on drugs to do much of anything", to which Hotch thanked him and sat back down.
It was now almost noon so Cindy said, "we're going to stop it here for this morning, we'll break for lunch, this hearing will reconvene at 1:30", the bailiff said, "all rise", everybody stood up and watched as the judge stepped down from the bench and walked back to her chambers.
Dave looked at Fran and said, "all in all I think that went pretty good", JJ said, "me too, whenever the prosecution tried to prove one thing either Mia or Hotch would prove the opposite", Emily said, "it looks like Morgan is handling things okay so far", Fran said, "my poor baby, he shouldn't even be here, he should be at work catching sickos instead of being here on trial for a murder he didn't commit".
Sarah said, "come on momma, let's go get some lunch", Fran looked up to see them leading Derek from the courtroom, since they had an hour and a half for lunch that meant that Derek, Hotch and Mia would have lunch together and continue talking strategy for the rest of the days trial.
When Derek was led back to the room he was in earlier, Hotch said, "alright Morgan, let's order some lunch and go over everything that was said today", Derek nodded his head yes and said, "sounds like a plan". After deciding what they would have for lunch, Mia sent one of her aides to pick up their lunch and bring it to the courthouse for her, while they were waiting on the food to arrive they discussed the testimony from both officers.
Derek said, "it's like I've said before I can't remember much of what happened after I got into the cab with baby girl but I do remember waking up naked but I didn't know that Penelope was the woman in the bed beside me until after I found out she was dead and put into the body bag".
Mia said, "so what happened that led up to you finding out that it was Penelope in the body bag?", Derek said, "I got really nauseated and had to run to the door to vomit and when they practically carried me back to the bed that's when I saw the gurney and body bag on the gurney".
He continued by saying, " asked who was in the body bag and that's when I was told it was baby girl, I didn't believe it so I stood up and made my way to her, I unzipped the bag and there she was, there was my baby girl, her face, ohhhh her face was beaten black and blue and I saw, I saw", Hotch said, "take it easy Morgan take it easy", Derek nodded his head and blew out several deep breaths as he readied to continue.
Derek then said, "I saw bruises around her neck like she had been strangled", Mia said, "did they do anything like check your hands or measure anything to see if your hands matched the prints around her neck?", Derek shook his head and said, "no, they didn't do anything like that, the next thing they did was read me my rights and cuff me".
Hotch smiled and said, "that's good for us, that means that they were lax in their job, they didn't do comparisons of your hands and the marks around her neck", Derek said, "no, no they didn't", Mia looked at Hotch and said, "it looks like we've been given our first big break, we need to remember this in case it's brought up again", Hotch nodded his head yes in agreement.
A few minutes later their lunch arrived so they stopped discussing the case and ate lunch, they would need nourishment for the rest of the day because this case was going to get harder as the day went on but right now, now is the time to rest and regroup so that when court reconvened they would be ready for whatever the prosecution threw at them.
