The State Verses Derek Morgan Ch 43
As they were pulling away from the medical examiners office Reid pulled his cell out of his pocket and dialed Hotch's number, he needed to let him know what was going on, that the woman in the coffin wasn't the heart and soul of their team, it wasn't Penelope". After a couple of rings Hotch said, "what were you able to find out Spencer?", Reid said, "are you alone?", Hotch said, "yes".
Reid put the phone on speaker and said, "there was no scar behind the left ear on the body in the coffin", Hotch said, "you mean that it wasn't Garcia?", Reid said, "hang on a second and I'll explain everything that we know". Hotch stood listening as Reid and Shane filled him in on the different blood types and Hotch said, "so that isn't her, that isn't Garcia, she's not dead, Garcia isn't dead".
Shane said, "we don't know for sure that she's not dead, all we know is that isn't her body in the coffin", Reid said, "Shane's right, we don't know for sure if she's alive or not, just that it isn't her, it isn't her in the coffin". Hotch said, "I won't tell Derek anything, we can't afford to let him get his hopes up only to have them dashed", Reid and Shane nodded their heads yes in agreement.
Meanwhile Mia and Derek were talking about the first day of his trial and Mia said, "it went good I think, they weren't able to prove anything, they couldn't prove that you did anything, the only thing that they proved without a shadow of a doubt was that you had been in the room, well and the semen found inside the body was yours but that hasn't been brought up yet but I have no doubt that it will be brought up during this trial, if they can't get you for murder they'll try to get you for rape instead".
Derek said, "I didn't do it, I never raped Penelope, I love her, I would never ever hurt her", Mia said,"I know that Derek, I know that but if they can't make one charge stick, they'll try for another one, that's just the way it works". He looked down at his hands and said, "how many more days do you think this case is going to be?", Mia said, "they still have a few witnesses and then the prosecution will rest and then it's our turn and we have at least 2 days of witnesses soooooo, maybe 3 or 4 more days".
He nodded his head and said, "what's taking Hotch so long?", Mia said, "he's talking to Reid about something, don't worry, he'll be back when he's done", Derek sighed and said, "it's been a long day, I'm exhausted". Mia said, "did you have any nightmares lastnight?", he shook his head and said, "nope, not a one, all of my dreams were good, they were about me and baby girl", Mia said, "good Derek that's good".
Hotch walked back into the room and Derek said, "what did pretty boy want?", Hotch said,"he wanted to let us know that they are looking at another angle", Derek said, "another angle, what angle?", Hotch said, "Shane found out that the cousin Charles is married to a woman named Olivia, she wasn't mentioned in any of the other records so Shane is trying to find everything that he can". Derek said, "everybody is working so hard to try to prove that I'm innocent".
Mia said, "that's because you are innocent Derek and helping you is something that we can all get behind", Derek sighed and said, "so what other questions do you think they will ask tomorrow?", Hotch said, "I'm looking for them to call a few people that will try to testify to the fact that you raped Penelope", Derek said, "but I didn't rape her", Hotch said, "I didn't say you did, all I'm saying is that it will be brought up in court so when it is you need to stay quiet, don't let it bother you in the slightest because you are innocent".
Derek looked at them and Mia said, "don't let them see that it's bothering you, let them see that you aren't bothered in the least, that will throw them off guard and maybe they'll slip up". Derek said, "I loved it when you cross examined that one witness, the one that said they didn't compare my hands to span class="il"the/span marks around Penelope's neck".
Hotch said, "that should have been one of the first things they did when they saw "the bruises on her neck, they really dropped the ball on that part", Mia said, "that they did, now how about we take the ball and ram it down their throats", the trio laughed and nodded their heads yes in agreement.
Hotch and Mia stayed till a few minutes after 7 they wanted to make sure that shift change between Anderson and Luke went smoothly and when it did they said their goodbyes and told Derek that they would see him in the morning at the courthouse". Derek yawned and said, "good night you two and thanks again", Hotch and Mia smiled and waved at him, Mia said, "try and get some sleep", Derek said, "I'll try, I'll try".
When Mia and Hotch were alone in the hall she said, "okay spill it, what did Reid really say?", Hotch said. "we're having a meeting at Dave and Fran's and you need to be there, this news changes everything". Now Mia was intrigued, she said, "alright then, let's go, what are we waiting on" as they headed up the corridor and out the side door that led to their cars.
