The State Verses Derek Morgan-Ch 5
The team arrived at the courthouse and made their way into a courtroom and had a seat, it was only a few minutes later when they saw their friend being led into the room and over to the table to join Hotch and Mia.
Derek looked up at his family for a brief second before sitting down and from that glance the team could tell that he was completely shattered, his heart, like there's was shattered into a million pieces at the loss of Penelope.
Dave looked at Emily and said, "I still haven't had a chance to tell Fran anything", Emily said, "Derek was arrested last night and you still haven't told her?", he shook his head and said, "I don't know how too". JJ took a deep breath and said, "how about after this, we go with you, maybe between all of us we can tell her".
The older agent smiled and said, "thank you because when she finds out she's gonna be as devastated as the rest of us about Penelope but hearing that her only son is being accused of the crime might be too much for her to take". Their attention then turned to the front of the room as the bailiff stood up and walked to the center of the room and said, "all rise, Judge Cindy Appleton presiding"
Cindy walked into the room the team watched as she sat down in her seat, she then looked up and said, "you may be seated", everybody took their seats and watched as the judge readied to continue the proceedings. Cindy looked up and said, "we're here this evening for preliminary hearing for Derek Morgan, are both parties ready to continue?", Mia stood up and said, "Mia Sanders and Aaron Hotchner for the defendant your honor".
Across the aisle a man said, "Scott Deskins for the prosecution your honor, we're ready to continue", Mia said, "so are we mam", Cindy said, "alright, I understand that Mr. Morgan is an FBI agent, is that correct?", Mia said, "yes your honor he is". As she looked at the file in front of her she said, "agent Morgan is being charged with murder in the first degree with special circumstances and with Virginia not being a death penalty state that means that if he's found guilty he will spend the rest of his life in prison without the possibility of parole".
Morgan Derek looked up at her and said, "yes mam", next he heard, "on the charges of murder in the first degree with special circumstances how do you plead?", he said, "not guilty your honor". Mia said, "agent Morgan has been an FBI agent for over 10 years and is in good standing in the community your honor so we are asking for bail".
Scott said, "we object your honor, Mr. Morgan is being accused of murder in the first degree, not for a parking violation, we're afraid that he will flee and we ask that he be held in jail until his trial". Mia said, "he has family in town your honor, his mother, sisters and step- father, not to mention his team that are also considered his family, he won't flee", Mia said, "I don't think that he will flee but the crime he's being charged with is a major crime so I side with the prosecution and deny bail".
Mia said, "but your honor", Cindy held up her hand and said, "I have made my decision Ms. Sanders", Mia nodded her head and said, "yes mam" as she stood stock still beside Derek. Cindy looked at her calendar and said, "I have an opening on May 19th, that's in three weeks, does that date sound good for both parties?", Mia and Scott looked at each other and nodded their heads yes before looking at the judge and saying in unison, "yes, your honor".
Cindy said, "agent Morgan will be remanded back to jail, where he will stay until the continuation of his trial and if he's found guilty he will be spending the rest of his life behind bars to pay for his crimes". Mia nodded her head and said, "yes mam". The bailiff said, "all rise", everybody stood up and watched as the judge walked back to her chambers, Derek then turned and looked at his team for a second before Hotch said, "we will be to see you later", Derek nodded his head and said, "okay" before he was led away but 2 officers.
Mia looked at Hotch and said, "we need to meet with your team, there are some things that we need to discuss", Hotch said, "I agree" and they turned to walk to the back of the courtroom to join the rest of the team. Dave said, "that didn't go as good as I was hoping", Mia said, "no, no it didn't but we're not done for just yet", Dave said, "we need to head back to my place, I still haven't told Fran that Derek was arrested".
Mia said, "Fran issss?", Dave said, "his mother, she still doesn't know what's going on", Mia looked at Hotch and said, "may I join this conversation, there are some things that we all need to discuss and I have to warn you that some of the things won't be too pretty, not pretty at all", Dave nodded his head and said, "Fran, well she needs to know and the sooner we tell her the better, I just hope that she can handle this".
Hotch looked at the team and then back at Dave and says, "me too Dave, me too".
