"Good morning sweetheart! How was your appointment at Dr. Montgomery yesterday? How's my godchild doing?" Rachel asks with a big smile when she joins Donna at the firms kitchen.
"Morning darling! Our little troublemaker is about 26cm tall and everything looks like it should. Dr. Montgomery reassured me that everything is fine as long as I take it easy and take care of my blood pressure. In about 4 months it will be ready. Wanna have a look?" She knows she doesn't even need to ask her best friend that question. With a smile she hands her the ultrasound picture.
"Oh Donna, that's amazing! Do you finally know the gender?"
"No. He or she kept this a secret. Actually, I don't think it's a bad thing not to know yet."
"But I wanna know! Did you get another picture?"
"Actually yes, I did. But…" Donna's sudden hesitation alarms Rachel.
"What's wrong?"
"Nothing! It's just… I gave the other picture to Harvey." When she sees Rachel's surprised expression, she feels how she's turning red, turns her face quickly and continues talking: "I thought it might be fair if he had his own picture of our kid, too. I mean, I can see it at every examination and I kept the pictures from the first ultrasound to myself. Besides, I can feel the baby, and he can't… Well, anyway, what are your plans for the weekend?"
"No, no, no! Miss Paulsen, I won't take your cheap red herring. When did you see Harvey? I thought you two weren't talking at the moment?" Donna sighs. Actually, she doesn't want to open that can of worms at all, after all she's been thinking about it almost continuously and maybe it was a good idea to share her thoughts with somebody.
"We are not. But he came over last night. He learned from Gretchen that I had an appointment and he wanted to make sure we were alright. Actually, I wasn't planning on letting him into my life again until we both finally have figured out what we really want. He has built this wall around himself that makes it impossible for him to admit his own feelings, let alone share them with anybody. But until this wall is torn down, I have no place for him in my life. He knows that, too. Anyway, he came over yesterday, and because he was really worried and seemed kind of. . . hurt… Well, I let him in"
"And did you guys talk?" Rachel asks carefully.
"About the baby. About what happened with Thomas. I told him I handled this and the thanked me for that. I gave him the picture. Then he left." She knows it's only half the truth, but she's not willing to talk about this intimate moment that had happened between them, not even to Rachel. She hasn't figure out yet for herself what that meant.
He is lost in his thoughts so he doesn't realise how Jessica is watching him from outside his office. It was at least nine or ten in the evening and they had send Gretchen and all the others employees home hours ago. There was no need for them to stay up all night to. It was for him an Jessica alone to find a way out of this mess.
After Gallo had threated Mike in prison it was more urgent then ever before that they have to get him out of there. Now there was this new chance, the opportunity that appeared with the deal that Cahill had offered. But Harvey knows it is not that simple. He knows Mike. He knows how loyal he is. He himself wouldn't be in this office now if his best friend wouldn't be that loyal. So he knows it will take a lot from him to convince Mike to betray Kevin…
He's been staring at the glass of scotch in his hand for about 15 minutes and is chasing his thoughts. Jessica isn't willing to watch this for a long time anymore. She knows it's not just the Mike thing that's haunting his mind – there is something else and after all that happened in the last weeks, she thinks she has finally figured out what it might be. She knows he is not in a good mood but she has to talk to him. Carefully she knocks at his door.
"Oh Jessica! I didn't realise you are still here. I thought I was the last man standing." He jokes but the smile does not reach his eyes.
"Of course I am still at the firm. I am as responsible for Mike as you are."
"No, you are not. That's all my fault." He gives up pretending to be in a good mood. He knows Jessica knows better. Instead he finally drinks the Scotch in one go.
"You know that's not true." She takes a seat at the sofa. "So, what's the plan?"
He sighs, takes the seat next to her and then explains what Cahill has offered and what he has planned to do. When he has finished she just nods.
"I see. It's a risk but I don't think we have another chance… Have you already talked to Mike?"
"Mike doesn't know yet and I don't think he will agree at first but it's the only chance we get. I haven't told anybody but you."
"Not even Donna?" She knows it's risky to open that can of worms but she needs to try.
"Donna? No. Of course not."
"Harvey, I don't remember a single time you let me in on anything before Donna knew."
He sighs again. "It's different now."
"Because she is pregnant?" He isn't even surprised, that Jessica knows. Sooner or later Donna had to tell her boss.
"Yeah, I guess. She needs rest." She waits to give him the chance to continue but he doesn't.
"Is there anything else you wanna tell me?"
"Actually yes. I don't know what she has told you but she doesn't have an easy pregnancy. The doctors told her to take it easy but we both know Donna and slowing down is not really her strong suite. So I was wondering if you, as her boss… if you maybe… Is there a chance that you… Could you send her to maternity leave a little sooner then usual?" She can't remember if she ever saw him lost for words like this. And she takes her chance.
"You know that this decision is on her. Why do you care so much?"
"It's just… I worry something could happen to her. Or the baby." It didn't occur to her that he turned his gaze away from her when he said this last words.
„Harvey, is there something you wanna tell me?" She asks again, this time with even more insistence.
"About what?" He spills out.
"About the fact, that Donna just passed her 6th month of pregnancy and I think that's more or less exactly the time, since you started acting like a fish out of the water. About why you care so much for her pregnancy? About the fact that she told me that her last boyfriend is not the father and that she will be a single mom?"
"Jessica! I don't think that this is any of your business! And I won't discuss that with you."
"You don't have to. Not with me at least. I think there is someone else you should talk to."
He sighs. Again. She thinks she's never seen him in such a desperate state. "I know, Jessica. I tried."
"Haven't I taught you anything in all those years? Get your sad ass up and fight."
"She made it clear to me that she doesn't want me to fight. She wants me to give her space and I'm trying to do so. I hate it but I have to, if I don't want to lose her for good."
"What is the one thing that makes the difference between losing a case and winning one? The evidence. The proof."
"What are you talking about? Donna is not a case. She is not a thing to win."
"Harvey, it was a metaphor. What I was trying to say: you need to proof to her that you are worth it." With this she leaves him alone.
