The State Verses Derek Morgan Ch 38
The next two days flew by and then it was finally the big day, today was the day that his trial would begin, he was nervous but knew that Hotch, Mia and the rest of his team/family had done everything that they could, now, now his fate would depend on the outcome of this trial, he blew out a deep breath as his cell door opened, allowing him to step out and join Mia, Hotch and Anderson.
Hotch said, "everybody will be in the courtroom today, well everybody but Reid and Shane, they are still doing their best to find something, anything that might help us prove your innocence". Derek nodded his head and said, "I don't think I will ever be able to repay all of you for everything that you've done to help me", Mia said, "let's get you found innocent first and then you can thank us, that's all we need", Derek nodded his head yes and smiled.
As he was being led up the corridor by the guards it was regulation that he had to be cuffed the entire time he was being escorted to and from the courthouse, he was okay with that because he wanted to prove his innocence and when that was done he'd be able to leave that jail a free man and never ever have to worry about wearing those stupid cuffs ever again.
They arrived at the courthouse in about 15 minutes and he was led to an interrogation room where he would stay for about half an hour before he would be led into the courtroom and then a couple of minutes after that the trial to decide his fate would begin. While they were waiting Mia and Hotch went over their questions one more time, they wanted Derek to be prepared and ready for anything that the prosecution might throw at him.
Mia looked at Derek and said, "now the judge Cindy Appleton, she's a fair judge, I've been in court with her several times, now she won't let Scott Deskins who's the prosecutor get away with anything so on that point I'm glad".
Derek said, "do you know this Scott Deskins, what kind of lawyer is he?", Mia said, "he'll try to trick you and trap you into saying something that you shouldn't that's why both Hotch and myself have told you not to give any more information than you have too", Derek nodded his head and said, "understood".
Their attention turned to the door as they heard somebody knock, the door opened to reveal the bailiff who said, "the trial will be starting in a few minutes, the guards are here to bring your client into the courtroom". Mia and Hotch stood up and nodded their heads yes, Derek then stood up and allowed himself to be cuffed again, Mia said, "the cuffs will come off once they get you into the courtroom", Derek sighed and said, "got it".
As Mia and Hotch watched Derek being led out of the interrogation room they looked at each other, Hotch said, "it's go time Mia, are you ready for this?", she nodded her head and said, "I'm ready, let's go prove he's innocent and get him out of here". The two lawyers then fell in line behind their client and walked up the hall that led to the courtroom, the guards stopped and watched as Mia and Hotch walked into the room first.
They gave them a couple of minutes to get to their table and get things set up before leading span class="il"Derek/span into the room, once Derek was standing behind the table they uncuffed him turned around and walked to the front of the courtroom to stand for the duration of today's hearing, as Derek stood there he glanced around the room and saw 2 guards in the back of the room and one at each exit, he blew out a deep breath and closed his eyes as he thought to himself, "I love you goddess, I miss you and ohhhhh how I wish you were here with me".
He was then pulled from his thoughts when the bailiff said, "all rise, the honorable Judge Cindy Appleton presiding", when Cindy walked into the room, she walked up and sat down behind the bench in her seat. She looked out at the people in the seats, not many people were allowed, just the BAU, Derek's mom and sisters and the people that would be testifying today.
Cindy said, "you may be seated", after everybody was seated she looked at the prosecution and the defense tables and said, "alright, let's have the clerk call this case please", everybody watched as a small woman stood up and got ready to speak. She said, "your honor this is the case of the state verses Derek Morgan, the defendant is being charged with murder in the first degree with special circumstances".
The judge thanked the clerk and then looked at the prosecution and defense and said, "are both parties ready to continue?", Mia said, the defense is ready your honor", next Scott stood up and said, "the prosecution is ready your honor". Cindy nodded her head and said, "alright Mr. Deskins call your first witness", Scott stood up and said, "I would like to call Office Todd Matthews to the stand", the bailiff said, "Todd Matthews", everybody in the courtroom then watched as the officer stood up and made his way to the front of the room to be sworn in.
