The State Verses Derek Morgan-Ch 44
Hotch and Mia were the last two to arrive at Dave and Fran's so as they walked inside everybody was anxious to know what was going on and what Reid had found out that was so important. Hotch said, "okay, Reid, you and Shane fill the others in on what's going on", Reid smiled and said, "earlier today Shane and I were talking about Penelope, I asked him to tell me something about her that we wouldn't know".
JJ said, "andddd?", Shane said, "I told him about a fight she got in with another woman over me", Emily said, "over you?", he said, "yes", Fran said, "what happened in this fight?", Shane said, "Penelope won of course and when she thought the fight was over she started walking away", Sarah said, "something tells me that it didn't end as easily as Penelope wanted it too", Shane said, "you would be right Sarah".
He then said, "the woman shattered a beer bottle and cut Penelope from here to here" as he showed them behind his left ear", JJ said, "was it bad?", Shane said, "bad enough for 5 to 6 stitches and it left a scar behind her ear". Emily looked at JJ and said, "maybe that's why she rarely wore her hair up?", Emily said, "that's understandable, I mean if you've got a scar your more than likely gonna try to hid it".
Fran said, "so what's this got to do with Derek's case?", Reid said, "I was looking through Penelope's autopsy results and nowhere listed is a scar behind her left ear", everybody listened as he said, "so I called Tasha and asked her, she then looked into her records and said that she didn't remember seeing any scar".
Fran smiled and said, "are you saying what I hope you're saying?", Reid said, "we all know that Garcia's blood type is" and before he could answer they all said, "A" in unison", he nodded his head and said, "right butttttt"?, Sarah said, "we need to get that body exhumed, we need some answers", Desi said, "can we do that, can we get the body exhumed?", Reid said, "no need".
JJ said, "no need, you just told us that the body we buried didn't have a scar behind her left ear, letting us know that the body that we mourned wasn't Garcie, so why isn't there an need to exhume the body?", Shane said, "because Hotch already talked to the director who pulled some strings and exhumed the body already".
Emily said, "and, so what are you saying?", Reid said, "after Tasha examined the body she disclosed to us that the body didn't have a scar behind her left ear", Emily smiled and said, "so that's not PG, that body isn't hers". Shane said, "Reid also got Tasha to call the funeral home and get them to type the blood from one of the samples they had left from where they embalmed it earlier".
They all sat waiting patiently for him to continue so Shane said, "the blood wasn't type A so without a doubt that body isn't Penelope", Fran said, "we need to tell Derek that he didn't kill her that he", Dave said, "wait Bella, we can't do that". She looked at her husband and said, "we can't tell him but why?", Mia said, "the only thing we know for sure is that the body that we buried wasn't her, we don't know for sure that she is alive and well somewhere so telling Derek anything now will only make matters worse".
Desi said, "that does make sense but how do we keep it from Derek, if he sees us he's gonna know that something is different", Dave said,"what we'll have to do is limit our contact to seeing him from the back of the courtroom until this is solved, until we either find kitten alive and well or find her body", JJ wiped away the tears that were streaming down her cheeks and said, "I'm not giving up hope, not now that we know that the body we buried wasn't her".
Reid hugged her and said, "why are you crying Jayje?", she said, "these are happy tears Spence, happy tears", it was only a matter of a few seconds before all of the women were crying, they weren't crying because of mourning somebody this time, they were crying because the woman they had mourned wasn't dead, this was the best news they'd heard in like forever and it's a shame that they couldn't share it with Derek.
Fran said, "if we don't tell Derek, won't he be mad at us?", Hotch said, "right now, that's a chance I'm willing to take, he's got to stay focused on the trial, if we tell him that the woman that we buried wasn't Garcia, what if after he gets his hopes up, what if we find her body again and this time it's really her?", Fran said, "he's been through so much over the past several weeks, I agree that keeping it from him is what's best, at least for now".
The family all nodded their heads yes in agreement and Hotch said, "okay, so for the foreseeable future we are all keeping this from Derek and the only way we will tell him the truth is if we find Garcia alive and well", they all looked at each other and then at him and nodded their heads yes in agreement, he sighed and said, "when this is all over with and if we can find Garcia Derek will forgive us so until then we keep him in the dark", again everybody nodded their heads in agreement.
Dave said, "we'll find kitten first and then and only then can we tell Derek", Reid said, "we won't stop until we find her and we will find her one way or another".
