The State Verses Derek Morgan-Ch 48
The final witness on their first day of presenting the defenses case was that of Tabitha Sexton, the toxicologist who was the first person to draw Derek's blood after he'd reached the police station. Her testimony lasted for well over 90 minutes with her showing graph after graph showing how the drugs Derek was injected with went through his system.
As Tabitha Sexton took the stand she told about how Derek's blood alcohol was almost double the legal limit and how his system was filled with LSD and Mescaline. When Mia asked what Mescaline and LSD could do to a persons body Tabitha went into great detail and talked about how it is a psychedelic hallucinogenic which in most cases would make everything very vivid and cause hallucinations, she also told of the side effects of both medications.
Upon cross examination Scott had asked how many times the defendant had been injected with the drugs to which Tabitha said, "four, two in the bend of his arm and two to his neck", Mia also redirected and asked about the vivid hallucinations that could occur to which Tabitha went into great detail explaining that the hallucinations were just that hallucinations and were not real but with the amount of drugs in Derek's system he wouldn't have been able to tell the difference.
At this time Cindy looked at her watch and said, "we'll stop here for today since it's almost 5:00 and we will start at 9:00", everybody nodded their heads yes and the bailiff said, "all rise". Everybody stood up and watched as Cindy stepped down from the bench and made her way back to her chambers and closed the door, after that everybody but the team/family started clearing the court room.
Derek looked at his attorneys and said, "so now what?", Mia said, "I think we are in great standing right now, Tabitha really sent the information home to the jury, I have no doubt that they understood everything she was saying". Hotch nodded his head and said, "I agree", he then closed the files in front of him and put them in his briefcase before looking at Derek and saying, "it's been a long day, Anderson will escort you and Mia back to the jail, I'll be there shortly and we'll get prepped for tomorrow".
The guards came over and cuffed Derek and then led him and Mia from the courtroom, once they were in the hall Anderson looked at Mia and said, "are you riding with Derek or are you going to ride back with me?", Mia said, "if it's okay, I'll just ride back with you?", Anderson said, "sure, no problem at all Mia" as the two of them headed down the hall to the nearest exit.
After making sure that Derek was loaded onto the police van safely Mia and Anderson pulled out following said van, they wanted to be close just in case somebody tried something to try to kill Derek. Anderson had other agents hidden in various places throughout the van's travel route just in case, Mia sighed and said, "well Anderson, what did you think about our first day of presenting?", he glanced at her and said, "I thought you and agent Hotchner did an amazing job".
She smiled and said, "we have 3 witnesses for tomorrow in those 3 are Derek's 2 character witnesses", Anderson said, "so you're thinking that you might be able to rest the defenses side tomorrow?",Mia said, "it's highly likely Anderson, highly". About 20 minutes later the van carrying Derek pulled up to the back exit of the jail, the officers helped Derek out of the van and slowly led him inside with Mia and Anderson following behind.
Once Derek was back in isolation Anderson said, "I'll be right over here Mia if you need anything", she said, "thanks Anderson", he nodded his head and said, "no problem at all", she then walked over to Derek and said, "alright, when Hotch gets here we'll go through what's going to happen tomorrow and practice our closing arguments".
Derek said, "so you're thinking that you might be able to rest the case tomorrow then?", she nodded her head and said, "I think so, we have 3 witnesses to present tomorrow, 2 of where are you character witnesses". Derek smiled and said, "so if you're able to rest tomorrow and give closing arguments how long do you think it's going to take for the jury to reach a verdict?", she said, "if they've understood all of the evidence we will have presented then it shouldn't take long, we might even find out the verdict tomorrow".
Derek looked at her and said, "and if they haven't understood the evidence?", she said, "well in that case it could take a couple of days or more for them to reach a decision", he nodded his head and said, "okay, thank you". Meanwhile back at the BAU Shane was deep in thought and then he hit the table and said, "how did I not figure this out, how was I that stupid".
Reid looked at him and said, "what are you talking about?", Shane let his fingers fly across the keyboard and said, "do you remember how I said that there was something bothering me but I couldn't put my finger on it?", Reid said, "yes". Shane said, "welllllll, I forgot to check for cameras on the property", Reid listened as Shane said, "if Robert and Robin are on the premises, which I think they are, they are hidden?", Reid nodded his head and said, "yes, go on".
Shane said, "well then, how would they know when to hide?", Reid said, "but looking at the surveliance cameras and watching?", Shane said, "that's right but I was so caught up in finding out that the body in the casket wasn't Penelope that it never even occurred to me to check for cameras", Reid grinned and said, "if they do have cameras how long will it take for you to get inside and be able to see what they see?", Shane said, "well it depends on how sophisticated they are, I might be able to get inside after a few minutes".
Reid said, "and if they are sophisticated?", Shane said, "it might take me all night and most of the morning, so it all depends on what I find once I get in there", Reid said, "well what are you waiting on, get in there". Shane grinned and said, "on it" as he let his fingers continue to fly across the keyboard.
Reid pulled his cell from his belt and sent Hotch a message asking him to call him ASAP, it was only a matter of a few minutes before Reid's cell started ringing, Reid grinned and hit talk and speaker so that Shane could hear and be involved in the conversation.
When Reid said, "hello", Hotch said, "what's so important?", Reid looked at Shane and smiled as Shane said, "we might have found them Hotch, we might have found them all", Hotch sat smiling for a few seconds before he said, "who, you might have found who Shane?", Shane said, "Robert, Robin and Penelope".
