Idea By Zoe-eoZ (Fanfiction): Maybe Kyle getting a new trial and getting out earlier.

I've altered this so it will start with the end of the trial and then we will see how Kyle adjusts to be out of prison. (Also, I don't know how the criminal justice system works so if it's wrong I apologise)

Chapter 40: Regaining Freedom – Part 1

(11:21am)

Summer Bay – Yabbie Creek – Court House – Room 3

"In light of new evidence which shows that Mr Braxton, you were not the person responsibe but in fact you were the person trying to stop the crime taking place. You are now a free man and the time you have spent in prison will be wiped from your criminal records." Judge Appleby finished saying to everyone in the room.

Kyle who had been standing with his lawyer was still in shock that he was eventually getting out of jail. Turning round, he looked at his brother who was sat with a smile across his face.

Heath had moved back to the bay a few months prior with Bianca and the kids when there had been some issues with the restaurant and gym, then Bianca was offered her old job back which sealed the move back to Summer Bay. Then the news about new evidence was released and Health was over the moon and Brax would be too when he tells him.

(11:49am) 28 minutes later…

Summer Bay – Diner

Bianca was currently sat with Irene in the Diner when she got a text from Heath.

"So?" Irene asked when she saw Bianca start to smile.

Looking up from her phone, Bianca replied: "Well, in light of new evidence, Kyle is coming home."

"That's excellent news!"

"I know! The kids are going to love having their Uncle Kyle around the place."

"They'll love that but as long as you all remember, it'll take some time for Kyle to adjust to being out of jail."

"Well, that's the thing, Kyle has already asked Heath if he can have his old job back at the restaurant."

"Crikey, you'd think he would take some time to get over everything that's happened."

"Well, you know what Kyle is like." Bianca laughed then informed Irene what Heath had said "Anyway they going to head to the hospital first to get him checked over as Heath doesn't trust the prison Doctor saying that Kyle was ok after the last beating, he got. So, he just wants to make sure his kidney is all good."

"Honestly, you can't blame Heath for airing on the side of caution. However, knowing Kyle I'm sure he is all good." Irene pointed out "I do have one question though?"

"What is it?" Bianca said curiously.

"Who's going to tell Phoebe?" Irene asked.

(1:04pm) 1 hour and 15 minutes later…

Summer Bay – Braxton House – Main House – Living Room

"Welcome home!" Bianca said as she hugged Kyle.

"Thank you, it's good to be home." Kyle smiled as he pulled away and then put it his suit jacket on the sofa "Where's the kids?"

"At Irene's, she promised them they could make cupcakes." Bianca told him "But they can't wait to see you."

Kyle continued to smile as he didn't know what else to do as he felt the situation was awkward.

Heath sat down on the sofa and asked his brother: "So do you want to grab some lunch from the Diner or restaurant."

"Honestly, I just want a shower and to sleep in my own bed for a few hours. If that's ok?" Kyle checked with them as he didn't know if they had anything planned for later.

"Of course, that's fine. Why wouldn't it be?"

"I don't know just wanted to check." Kyle answered then turned to head to his old bedroom but was stopped.

"Oh Kyle, I think Heath probably forgot to tell you, but we moved all your stuff into the flat as we thought you would like to have your own space but if that's not ok, then we can move everyone around." Bianca told him.

All Kyle said in reply was "Ok."

With that he turned on his heal and headed to the flat.

"Well, that was weird." Heath said to his wife.

"He just needs time to adjust to being out. I wouldn't worry about it." Bianca said before going into the kitchen to fix them some lunch.

Meanwhile…

Summer Bay – Braxton House – The Flat

After entering the flat, Kyle had quickly locked the door and then slowly made his way over to the bed. Sitting down he looked around all of his stuff that he had missed was there: his guitar, photos and the teddy bear which was the last thing he ever received from his mum.

I should be happy! Why aren't I happy? No more beatings every morning or night, no more screams from the next cell over and no more prison food. I had been looking forward to getting out and having my own room back but instead I'm in the flat which doesn't feel right. I know Bianca said they could move everyone around, but I don't want to cause any hassle. Maybe I just need to get back to what I know which is the restaurant. Screw sleep, I'm going to take a shower and then head to Angelo's.

(1:39pm) 35 minutes later…

Summer Bay – Braxton House – Kitchen

"I'm starting to think, that maybe we shouldn't have moved Kyle into the flat." Heath said as he put his plate beside the sink.

Getting up to do the same, Bianca questioned her husband's comment: "Why? He said himself it was, ok?"

"Yeah, but this is Kyle. You know he doesn't always say the truth as he's too much of a people pleaser as Ricky used to say. Besides after coming out of jail maybe all, he wanted was some normality." Heath said.

"Maybe so but at the moment, he seemed happy enough so until he says otherwise, he is staying in the flat." Bianca replied.

Summer Bay – Braxton House – Living Room

As he walked into the main house, Kyle pushed his sleeves up: "Hey, I don't suppose either of you know where my keys?"

Popping out of the kitchen the couple looked at him in shock.

"What?" Kyle asked not understanding why they were looking at him like that.

"You said you were going to get some sleep, not change into the uniform for Angelo's." Heath pointed out.

"Oh, yeah I changed my mind." Kyle smiled "I'm going to head to the restaurant and get caught up on everything I've missed."

Heath starts laughing until he realises Kyle was being serious: "Mate, you just got out of jail and you wanna go to work."

"Yes Heath."

"I think what Heath is saying Kyle, is that we thought you'd might want to wait a couple of days before you go back." Bianca said to him "That way you can have a break and enjoy some family time."

"If it's all the same, I'd rather just get back to normal. Therefore, to do that I need to go to work." Kyle informed them "So as I asked earlier, have you seen my keys."

Sighing, Heath stood up and walked over to the shelf: "We put your keys in here for safe keeping."

Pulling the keys out of the box, Heath handed them to his brother and watched as Kyle left the house.

"Are we sure that it's a good idea to let him go like that?" Bianca asked her husband.

"If he thinks he'll be ok then why not?" Heath replied not understanding what she was trying to say.

"Phoebe." Was all Bianca said.
