here's the second fic. This one is a darvey fic :)

It's Gordon's first anniversary and Donna tries to be there for Harvey.

"Harvey" he hears Donna saying his name and she sounds desperately.

"Donna" he says as he looks up at her and immerdiatly stands up to walk towards her "what is it? are you okay?" he asks afraid.

"I- I don't know how to say it"

"Donna, what's wrong with you?" He gets more anxiously with every second. He's never seen her like this before.

"it's not me, I'm fine" and he feels a big relief leaving his body.

"It's your father… he- he had a heart attack" tears roll down her cheeks while they look at each other. He looks at her questioningly and desperately hopes that he doesn't hear what he thinks is coming although deep down he already knows the answer. His whole world stops when he sees Donna shaking her head.

"Oh my god" he whispers.

"I'm so sorry, Harvey" she says crying as she starts walking towards him to pull him in a hug but he quickly turns to the side and walks a few steps forward. "It's okay" he says "I'm fine"

"Oh my god" he says again while his eyes are closed and he tries to hold back his tears.

"Harvey please" she tries.

He takes a deep breath gathering himself. He then opens his eyes, turns to Donna and says in a soft but firm voice:

"I said I'm fine Donna. Now please leave my office, I have a hell of a lot to do" and goes back to his desk focusing on his files again… well he at least pretends to do so.

One year later

It was a pretty hard year for Harvey. The loss of his father was pretty hard for him. They had such a close relationship and Harvey could always count on him but gordon also on Harvey of course. He thought so many times about calling him just to real-time in the same second that he's not there anymore. And every time it happend he couldn't hold back his tears.

He didn't talk to anyone, not even Donna. She tired but he always blocked her. He either changed the topic the second he saw what's coming or he left the room or did one of the 146 other possibilities he had.

Harvey is sitting on his armchair and is drinking scotch when hears a knock on his door. He puts the glass on the table in front of him and gets up towards the door.

"Donna" he says when he opens it.

"Hey" she says in a soft voice. "Can I come in?"

Harvey first wants to tell her to leave but decides against it and moves a little to let her in. "D'you want a drink, too?" he asks pointing at his glass of scotch.

"Yeah" she replies.

After he poors her a glas he sits on the armchair in front of her and looks on the floor not knowing what to say.

"Are you okay?" she asks worried.

"I'm fine" he answers and tries to do so as honest as possible.

"You weren't at the firm today"

"I wasn't feeling good today morning, so I decided to stay at home and rest. Turns out to be the right decision 'cause like I said I'm fine now again" And he knows that it's such a bullshit and he'd never believe himself, so There's no way Donna ever would either.

"You never called a sick day before"

"There's always a first time for everything Donna"

They stay in silcence for a few seconds.

"You visited his grave, right?" Harvey bits his under lip and nods. He then takes a deep shaky breath and starts to speak.

"I miss him" he says quietly and gulps, almost unable to hold back the tears.

"Harvey…" Donna gets up and sits on the Armrest on his right side. She puts her left arm behind his back on his left shoulder.

"Hey, it's okay to be sad Harvey. You don't need to hide it and especially not from me"

she says in a soft tone.

"I know, it's just… it's easier not to talk about it and just wait for the day to pass"

"Probably it's easier… but it doesn't do anything good to you. You can't just wait for the day to pass and go on with the next one like nothing's wrong… you need to let the sorrow out Harvey, I'm not saying you have to talk about it but you need to find a way to deal with it. It's his anniversary, it must be pretty hard for you. Like the whole last year"

"It is" he admits while a tear rolls down his cheek and he presses his lips together.

"It's just not fair…" he sobs, "he didn't deserve to die that early" Donna rubs his back but she doesn't speak. "He was such a kind man, everybody loved him, he never did something bad to anyone… it's just not fair"

"I know" Donna whispers

"I never got to tell him I became junior partner… he waited so long for it and I… I just couldn't call him for a few minutes, just to let him know. I'm such a goddamn idiot" he says in a more angry tone.

"Harvey hey, don't do that to yourself. I told you once, I am convinced that he knew."

"You don't know that for sure, Donna"

"Yes I do. You called him every Wednesday evening, and you told him if there's a reasons you'd miss calling him it'll be because you become junior partner and didn't have time."

"I should've called him" he says and can't hold back his tears anymore. Donna pulls him in a half hug. He leans his head on her cheast while she puts her chin on his head. "He'd be so proud of you" she whispers and puts a kiss on his hair.

"I miss him so much" he whispers, barely bearable

"I know, I know that"

They stay so for several minutes until Harvey breaks the hug again and leaves towards the kitchen.

"I need your cell phone for a minute" says Donna and takes it from the table.

"Okay" he says and tells her his code as if she wouldn't already know.

Donna goes threw Harvey's voicemails and since barely nobody has his privat number there aren't that much of them. She goes back to the day he became junior partner and finds an unlisted voicemail from Gordon.

Donna lifts her head and looks at him while he returns with two fresh glasses of scotch.

"What it is?" he asks.

"I found here something" she says and hands him the phone.

Harvey gulps when he sees his father's voicemail. He looks back at Donna. "He left me a message" he says shocked. "How could I miss it?"

"Harvey you had a lot to do on that day and than he… you had other things to do than to check your voicemails" she tries to reassure him and he nods.

"You wanna be alone?" She asks softly but he shakes his head "no".

And he puts the finger on the voicemail to hear it.

"Hey, my boy…" He takes a shaky breath when he hears his fathers voice after a year again.

"Sooo. you missed the call… I guess it means you made it, you're a junior partner" he says in a cheer tone and sounds so proud "I am sooo proud of you Harvey, you deserve it more than anyone else. Can't wait to hear how your first day as a junior partner was like. And don't worry you missed the call, it was kinda our deal" Gordon laughs and so does Harvey "I love you Harvey" he says and hangs up. Harvey nods and tears roll down his ckeeks. "He knew" he whispers "You knew it" he says looking at her and she can't hold back her own tears either. "Thank you, Donna" he says and pulls her in a tight hug. "Without you I would've never known"

"You're welcome, Harvey"

"How did you know?" He asks breaking their hug and wipes his tears away.

"I didn't, I just thought or hoped he called you and you just missed it." He nods and looks at her with a sad smile on his face.
