Potomac General Hospital –
Fran and Dave rushed through the emergency room doors followed by the rest of the family and team. Penelope was beside herself; she'd imagined the worst possible scenario while on the ride from the Rossi's to the hospital. All they knew was that an unconscious Derek and a screaming baby boy were found in a car outside a downtown alley. Now both were being examined by doctors and all she could do was wait.
Hotch saw the uniformed officers and a woman dressed in a dark suit with county credentials hanging from a lanyard around her neck standing near the nurse's desk; he recognized the detective who was there. He rushed over to get more information. Hotch displayed his badge and introduced himself; the others did the same.
"Agent Hotchner," the detective began extending his hand toward Hotch. "These are officers Perez and Stanislaus; they were the first on the scene."
Hotch nodded at both men.
"This is Amanda Peralta with Child Protective Services."
"Ma'am," Hotch looked at the familiar face in the group. "Fill me in."
"We received a call about a man asleep in a car with a kid screaming his head off in the back seat."
"Asleep, that doesn't make sense."
"One of our local working girls called it in. She was holding the baby when we arrived," added ofc. Perez. "Your guy was out cold! That baby was damn lucky that some crazy wasn't the one who pulled him out of the car! What kind of father takes his child to score drugs?"
"Drugs?" Fran gasped from behind them.
The group turned to see the horrified look on the woman's face.
"Fran..." Hotch began.
"No Hotch, my son doesn't take drugs! He'd never take drugs not with his son with him! There must be a mistake!"
"I'm sorry, ma'am I know this is hard to hear but the truck was littered with drug paraphernalia," added ofc. Stanislaus.
"No, no, no, something's wrong here," she insisted. "Where's my son, where's my grandson?"
"The doctors are in with them both right now," Hotch started. "It looks like Hank wasn't harmed, just a little confused and scared."
"Thank God! I need to see them; both of them!"
"And you will, the doctors will be out soon," said Amanda.
"I'm sorry, who are you?" Fran asked the woman.
"My name is Amanda Peralta with Child Protective Services."
"Child..."
"Excuse me," said a newcomer.
Everyone turned to face the young woman in the white lab coat. The rest of the team and family had arrived now and were waiting along with Hotch and Fran.
"My name is Dr. Jean Fryer and I'm taking care of both Derek and Hank Morgan."
"How are they?" Penelope asked.
"Baby boy Hank is just fine," the woman smiled before continuing. "He's just tired and hungry and wants his daddy."
"And my son, how is he?"
"Mr. Morgan received a near-fatal dose of heroin. If he'd gotten here five minutes later, we wouldn't have been able to save him. I'm running labs because I don't think heroin is the only thing in his system; he's awake but he doesn't seem to remember what happened."
"That's convenient," Perez whispered under his breath.
"Save your judgement until we have all the facts, officer!" ordered Det. Baines.
"Yes sir!"
"Can we see him?" JJ asked.
"I need to see my grandson," Fran added, "then if he's fine, we'll take him home with us."
Amanda and the detective exchanged guilty looks.
"What are those looks about?"
"Hank is going home with us!"
The group turned and came face-to-face with Charles and Lydia Hayes and their attorney Artemis Maker.
"Like hell he is!" Dave barked.
"You didn't tell them?" Artemis shot a look at the social worker.
"I haven't had a chance to."
"Tell us what? Fran asked. "Tell us what?"
"The family court judge has granted the Hayes custody of Hank in response to their emergency request," Amanda answered.
"How convenient," Reid chimed in. "It hasn't even been two hours since this all happened."
"It's a good thing that the Hayes were still in town. I'm sure the judge regrets her decision a few days ago to award Derek custody."
"A good thing? Is that what you're calling this...this set up?"
"Reid! Let's keep cool heads here," Hotch then turns to Marker, "You and I both know that something smells here, and rest assured we will get to the bottom of this and if I find out that you've crossed the line, Counselor, I'll call in every favor, and move every mountain to get you dis-barred and thrown in jail!"
"I'm trembling, Agent...shaking in my boots!" Then turning toward Amanda, "what do Mr. and Mrs. Hayes have to do to take their grandson home?
2 hours later –
Derek watched his mother, and the others enter his room. He was still confused as to how he'd ended up here. He and his son were supposed to join everyone at the Rossi's for a family gathering. How did he get here? Everything was a blank.
"Hank?"
Fran fought the tears as she gathered his hand in hers. Penelope did the same from the other side of the bed.
"I'm sorry, I'm sorry Ma," he whispered.
"Oh, baby boy..." Fran cried, "you have nothing to be sorry for."
"But we were late for dinner and it's my fault."
Everyone looked at each other not knowing what to say next.
"Where's Hank, Ma? I need to see Hank."
"Hank is just fine. The doctors..."
"Doctors, what happened? Where's my son?"
Derek began to struggle against the haze in his mind and the restraints that had to be put in place earlier. He looked down at his wrists and then at the faces in the group who obviously knew something he didn't.
"Calm down, Handsome, please."
Derek saw the tears streaming down Penelope's face. Why was she crying and where was his son?
The Clarion –
"We're going to need some things," Lydia began.
The older woman rocked her fussy grandson as she walked around the large room. She and her husband had rented the Presidential Suite in the upscale boutique hotel and now the reality of what they had accomplished was setting in. They'd won temporary custody of Hank thanks to a sudden mishap that nearly ended in the death of their former son-in-law.
"Not to worry, honey the nanny will be here shortly and Chelsea is making sure we get what we need to take care of Hank while we're in town."
"I hate that we have to stay here until the police finish their investigation on what happened."
"Well, we have to remember that Derek has some smart and powerful people on his team too. We just have to hope that Artemis and his people are smarter."
"I can't believe he would put our grandson in danger like that!" Lydia whispered.
"Well, he did, and it was a good thing that someone came by when they did."
Hank had finally fallen asleep in his grandmother's arms. Lydia planted a soft kiss on his cheek.
"What were you thinking, Derek! What on earth were you thinking?"
